<official-title>To amend titles XVIII of the Social Security Act to ensure that low-income beneficiaries have improved access to prescription drugs under the Medicare and Medicaid programs.</official-title>

<section id="HB0A11615C8E048AEBC2D12612E57F300" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Helping Seniors Choose their Medicare Drug Plan Act</short-title></quote>.</text></section> 
<section id="H99313FC2955E47ABBF195EC7D7C6926"><enum>2.</enum><header>Beneficiary-centered assignment under Medicare part D prescription drug plans</header> 
<subsection id="H7B95F3BD17224A22B65E5D98AF824E7"><enum>(a)</enum><header>In general</header><text>Section 1860D–1(b)(1) of the Social Security Act (42 U.S.C. 1395w–101(b)(1)) is amended—</text> 
<paragraph id="HB5776811AA83419F86E1095143DC7FA0"><enum>(1)</enum><text>in the second sentence of subparagraph (C), by striking <quote>on a random basis among all such plans</quote> and inserting <quote>, subject to subparagraph (D), in the most appropriate plan for such individual</quote>; and</text></paragraph> 
<paragraph id="H97C88AD1970B436CAEEFFFE5FDB155D1"><enum>(2)</enum><text>by adding at the end the following new subparagraph:</text>

<subparagraph id="H69C5806D55414F04841BA1E7E2C4B0E1"><enum>(D)</enum><header>Beneficiary centered assignment</header><text>In the case of any default enrollment under subparagraph (C), a part D eligible individual described in such subparagraph shall be enrolled in a prescription drug plan based on guidelines established by the Secretary that account for the individual’s previous prescription drug utilization.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HCD09A4DA39D545938644DB8C0323DF63"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall apply to enrollments effected on or after November 15, 2010.</text></subsection></section>
