		<official-title>To increase the number of Federal judgeships in certain
		  judicial districts with heavy caseloads of criminal immigration
		  cases.</official-title>

		<section id="HA997FAA754D547B39FB7EDBDF0E7E031" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Federal Criminal Immigration Courts
			 Act of 2009</short-title></quote>.</text>
		</section><section id="id3F17E780AA0A485A8B3B66A8B0738A5C" section-type="subsequent-section"><enum>2.</enum><header>Findings and
			 purpose</header>
			<subsection id="id3A4CBC29092945B4BE34C0681E8A8038"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Based on the recommendations made by the
			 2007 Judicial Conference and the statistical data provided by the 2006 Federal
			 Court Management Statistics (issued by the Administrative Office of the United
			 States Courts), the Congress finds the following:</text>
				<paragraph id="id6CD42369AC0C4F368C674F44E3A2034F"><enum>(1)</enum><text>Federal courts
			 along the southwest border of the United States have a greater percentage of
			 their criminal caseload affected by immigration cases than other Federal
			 courts.</text>
				</paragraph><paragraph id="id37C83EB126754B3293D2A56C416817F7"><enum>(2)</enum><text>The percentage of
			 criminal immigration cases in most southwest border district courts totals more
			 than 49 percent of the total criminal caseloads of those districts.</text>
				</paragraph><paragraph id="id041923AB2380490A8E8573767B2EE844"><enum>(3)</enum><text>The current
			 number of judges authorized for those courts is inadequate to handle the
			 current caseload.</text>
				</paragraph><paragraph id="idA412A8E81D304E4BA60C06272A7CCB43"><enum>(4)</enum><text>Such an increase
			 in the caseload of criminal immigration filings requires a corresponding
			 increase in the number of Federal judgeships.</text>
				</paragraph><paragraph id="idBF2A99AEBD3A448EB96A059D1D588DDA"><enum>(5)</enum><text>The 2007 Judicial
			 Conference recommended the addition of judgeships to meet this growing
			 burden.</text>
				</paragraph><paragraph id="id3E8D0E35B7254B938AAF8C36AB8EB6D6"><enum>(6)</enum><text>The Congress
			 should authorize the additional district court judges necessary to carry out
			 the 2007 recommendations of the Judicial Conference for district courts in
			 which the criminal immigration filings represented more than 49 percent of all
			 criminal filings for the 12-month period ending September 30, 2006.</text>
				</paragraph></subsection><subsection id="id5588298AC8674E98AFF0239FC3E4935D"><enum>(b)</enum><header>Purpose</header><text>The
			 purpose of this Act is to increase the number of Federal judgeships, in
			 accordance with the recommendations of the 2007 Judicial Conference, in
			 district courts that have an extraordinarily high criminal immigration
			 caseload.</text>
			</subsection></section><section id="idBB61DABE9AF34BD2A2EE7854CB2E100B"><enum>3.</enum><header>Additional
			 District Court Judgeships</header>
			<subsection id="idA95972B6824D4515A56F0B569C06263C"><enum>(a)</enum><text display-inline="yes-display-inline">Permanent Judgeships—</text>
				<paragraph id="id870168EE541C44D484A1E8374F677372"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The President shall
			 appoint, by and with the advice and consent of the Senate—</text>
					<subparagraph id="id3C4977D6423C497B8D0864C6B7873656"><enum>(A)</enum><text display-inline="yes-display-inline">4 additional district judges for the
			 district of Arizona;</text>
					</subparagraph><subparagraph id="id5FF6D60B0DFE4339A77651AA5568269F"><enum>(B)</enum><text display-inline="yes-display-inline">1 additional district judge for the
			 district of New Mexico;</text>
					</subparagraph><subparagraph id="id7B838A7F50F74E2098A6C1F5B8923FCF"><enum>(C)</enum><text display-inline="yes-display-inline">2 additional district judges for the
			 southern district of Texas; and</text>
					</subparagraph><subparagraph id="id974C33C9D67444AA8573C27F56E71C57"><enum>(D)</enum><text display-inline="yes-display-inline">1 additional district judge for the western
			 district of Texas.</text>
					</subparagraph></paragraph><paragraph id="idEF96EFC347EB4A608E4153B8B12C724A"><enum>(2)</enum><header>Conforming
			 Amendments</header><text display-inline="yes-display-inline">In order that the
			 table contained in section 133(a) of title 28, United States Code, reflect the
			 number of additional judges authorized under paragraph (1), such table is
			 amended—</text>
					<subparagraph id="id20C0E2B127B9424185F81416EC450849"><enum>(A)</enum><text display-inline="yes-display-inline">in the item relating to Arizona, by
			 striking <quote>12</quote> and inserting <quote>16</quote>;</text>
					</subparagraph><subparagraph id="id99B51AC2A0D540EF9945C930F8F4A2E2"><enum>(B)</enum><text>in the item
			 relating to New Mexico, by striking <quote>6</quote> and inserting
			 <quote>7</quote>;</text>
					</subparagraph><subparagraph id="id9BCBF3A0EC2A4833B1D6724039993345"><enum>(C)</enum><text display-inline="yes-display-inline">in the item relating to Texas—</text>
						<clause id="id9E574C6A56D3444581C911F2FDBF07AF"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>19</quote> and inserting
			 <quote>21</quote> and;</text>
						</clause><clause id="idE470EF61A3794561A95BBF68E1169132"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>13</quote> and inserting
			 <quote>14</quote>.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="id1770F51B52FB4EBB9543C2B636D40DF1"><enum>(b)</enum><header>Temporary
			 Judgeships</header>
				<paragraph id="id42A59B53F8284E9B9A077E1D0322FFDB"><enum>(1)</enum><header>In
			 general</header><text>The President shall appoint, by and with the advice and
			 consent of the Senate—</text>
					<subparagraph id="id6FADA37E5E694E05A52B688D5C9FA28C"><enum>(A)</enum><text>1 additional
			 district judge for the district of Arizona; and</text>
					</subparagraph><subparagraph id="id454796F9EC6144808F3CEF75FB1A4FC9"><enum>(B)</enum><text>1 additional
			 district judge for the district of New Mexico.</text>
					</subparagraph></paragraph><paragraph id="idADD30E5F6A5C40FA8AA3282A8CECD68B"><enum>(2)</enum><header>Vacancy not
			 filled</header><text>For each of the judicial districts named in this
			 subsection, the first vacancy arising on the district court 10 years or more
			 after a judge is first confirmed to fill the temporary district judgeship
			 created in that district by this subsection shall not be filled.</text>
				</paragraph></subsection></section></legis-body>
