		<section id="H4BEDEC082E7E49DDAD3592742185A0B5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Healthcare Innovation Zone Program Act
			 of 2009</short-title></quote>.</text>
		</section><section id="H0F4859F54D4944C8B8ABC2A61C6D7800"><enum>2.</enum><header>Healthcare
			 Innovation Zone demonstration program</header>
			<subsection id="HCE201B6DF5B840DD8518F38D10788F91"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 6 months after the date of
			 enactment of this Act, the Secretary of Health and Human Services shall
			 establish a Healthcare Innovation Zone pilot program to increase healthcare
			 provider integration and align healthcare provider incentives to improve health
			 and to reduce healthcare costs.</text>
			</subsection><subsection id="H2C5AFACBB8254DC8BC64A31A0CD742A5"><enum>(b)</enum><header>Features of
			 program</header><text>The HIZ pilot program established under subsection (a)
			 shall consist of the following:</text>
				<paragraph id="H06B568CCE41543938660D66304C019EA"><enum>(1)</enum><text>An HIZ planning
			 grant program, as described in section 3.</text>
				</paragraph><paragraph id="H0A93B13F2B5D40F19AAB65CD921F3630"><enum>(2)</enum><text>An HIZ
			 demonstration project, as described in section 4.</text>
				</paragraph></subsection><subsection id="H183D21403E854D6289FED51B46515FD4"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this Act:</text>
				<paragraph display-inline="no-display-inline" id="H77346B8808974E3385F3588D3EF78F09"><enum>(1)</enum><header>Grant
			 program</header><text>The term <quote>grant program</quote> means the HIZ
			 planning grant program as described in section 3.</text>
				</paragraph><paragraph id="H094738F726654EF981B240C211473A33"><enum>(2)</enum><header>HIZ</header><text display-inline="yes-display-inline">The term <quote>HIZ</quote> means a
			 Healthcare Innovation Zone, consisting of an integrated healthcare delivery
			 network that works with local employers, community leaders, and private and
			 governmental payors in a geographic region, that—</text>
					<subparagraph id="H5D426AABEE9F46C5B15D5772AEC09BB4"><enum>(A)</enum><text>provides a full
			 spectrum of care, including inpatient, outpatient, post-acute, and preventive
			 care, to individuals including Medicare beneficiaries;</text>
					</subparagraph><subparagraph id="H98716EA1B51E472CBD67E8DE0E590F3D"><enum>(B)</enum><text>has an academic
			 medical center that provides tertiary and quaternary care, has existing
			 capabilities to conduct health services research, and provides clinical
			 training for health professionals; and</text>
					</subparagraph><subparagraph id="HD69D2BF66D9F43A49A5B89DE8E0A4BE2"><enum>(C)</enum><text>is able to accept
			 alternative payment structures beyond fee-for-service and per diem
			 amounts.</text>
					</subparagraph></paragraph><paragraph id="H68C85F772E01498C940E631E40C0D7A1"><enum>(3)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <quote>Secretary</quote> means the
			 Secretary of Health and Human Services.</text>
				</paragraph></subsection></section><section id="H8ECC80FB39B844B8BFCE3675FA823D16"><enum>3.</enum><header>HIZ planning
			 grant program</header>
			<subsection id="H3618CBC659E44131A9E031F38E80EFE"><enum>(a)</enum><header>Establishment</header><text>The
			 Secretary shall make grants to eligible entities for the purposes of
			 researching and preparing an HIZ model plan, in accordance with subsection
			 (f).</text>
			</subsection><subsection id="HE4F44BF9E28C4A9C9368C62FD5DA207F"><enum>(b)</enum><header>Conditions</header><text display-inline="yes-display-inline">A grant recipient under this section must
			 apply for the HIZ demonstration project described in section 4. If a grant
			 recipient under this section is not selected to participate in such project,
			 then such recipient must return any unused grant funds to the Secretary.</text>
			</subsection><subsection id="H0736754945004D4E9DDC45E4D3D44250"><enum>(c)</enum><header>Eligibility</header><text>The
			 following persons are eligible entities for purposes of this section:</text>
				<paragraph id="HB0229790A7884800A800F4A9E8C31100"><enum>(1)</enum><text>A
			 healthcare institution or provider licensed and accredited in the United
			 States.</text>
				</paragraph><paragraph id="H4C60D20FB90B472F92F27EC6BA8685"><enum>(2)</enum><text>An
			 academic medical center.</text>
				</paragraph><paragraph id="H2342517C50224E19AAED738379C058A6"><enum>(3)</enum><text>A
			 large multispecialty group practice.</text>
				</paragraph><paragraph id="H110461E8385F475B9D32FD7E59611084"><enum>(4)</enum><text>Any other clinical
			 organization.</text>
				</paragraph><paragraph id="H33B4F6477BD6442284F2DC351F00DA"><enum>(5)</enum><text>Any
			 other organization that is able to establish, through a memorandum of
			 understanding or by other means to be defined by the Secretary, an intent to
			 collaborate with a person listed in paragraphs (1) through (4).</text>
				</paragraph></subsection><subsection id="HA600EBDFB651478DAB72065132B8A666"><enum>(d)</enum><header>Application</header><text>An
			 application for a grant under this section shall include the following:</text>
				<paragraph id="HD1AF660649C242759C47A3B187B9BF"><enum>(1)</enum><text>A
			 demonstration that the grant applicant is located in a geographic region that
			 has the necessary breadth of healthcare providers to support the HIZ.</text>
				</paragraph><paragraph id="H42A5C8C437024EA6BBC76E4DBAF5A9A"><enum>(2)</enum><text>The support and
			 endorsement of the HIZ concept by the following persons:</text>
					<subparagraph id="HA65B94C5B0554B3099D728B814793FF1"><enum>(A)</enum><text>At least one
			 leader of a clinical entity that provides the full spectrum of care.</text>
					</subparagraph><subparagraph id="HBCFF8BD6C03C48D2811E417681A17B11"><enum>(B)</enum><text>At least one
			 private payer.</text>
					</subparagraph></paragraph><paragraph id="H7EBCFFBD7CDF4FC3AC4FF60038F8C4D2"><enum>(3)</enum><text>A
			 demonstration that the grant applicant has the resources and expertise to
			 implement the features listed in subsection (f).</text>
				</paragraph><paragraph id="HDB4CE82B247C464EB768C0DF6DCDD635"><enum>(4)</enum><text>A
			 proposed budget setting forth the costs to be incurred in creating the model
			 HIZ plan.</text>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="H4E71B960FD2946F985E5BED4B5DE00B3"><enum>(e)</enum><header>Criteria for
			 awarding grants</header><text>The Secretary shall give preference to a grant
			 application that demonstrates a likelihood that the HIZ model plan will meet
			 the requirements of subsection (f).</text>
			</subsection><subsection display-inline="no-display-inline" id="H8415B40BADBC4879B0A2549030DDC45"><enum>(f)</enum><header>HIZ model plan
			 requirements</header><text>A recipient of a grant under this section must
			 submit to the Secretary, within 6 months of receiving such grant, an HIZ model
			 plan describing the HIZ to be implemented in the demonstration project under
			 section 4. Such HIZ model plan must contain the following:</text>
				<paragraph id="H1D0DFC1DACBB44E3944CC758AEC1BAB1"><enum>(1)</enum><text>A
			 description of innovative models of care that improve quality and decrease
			 costs.</text>
				</paragraph><paragraph id="HF210F9492B5843B3B173ED0120C3983E"><enum>(2)</enum><text>A
			 provider network that will provide the full spectrum of care.</text>
				</paragraph><paragraph id="H73C0F141656C47388D4D5CBB4F1B8E05"><enum>(3)</enum><text>A
			 target population and mechanisms to enroll such population, supported by
			 evidence that such population is willing to participate in an HIZ
			 demonstration.</text>
				</paragraph><paragraph id="H7CA60EC15AA945478B1C8CF5201B6BB"><enum>(4)</enum><text>A
			 mechanism to provide for knowledge and information-sharing across the HIZ
			 participants.</text>
				</paragraph><paragraph id="H2162937A168B455CA7C6BA384E62EB6"><enum>(5)</enum><text>A
			 description of how the HIZ would incorporate the training of the next
			 generation of physicians, nurses, and allied health professionals in a new
			 model of cost-effective quality healthcare.</text>
				</paragraph><paragraph id="H9C0B34F567DB443600CBA71D5521AA54"><enum>(6)</enum><text>A
			 description of the governance of the HIZ, and how it would affect the
			 administration of the model and management of the organizational and cultural
			 changes necessary for a successful HIZ.</text>
				</paragraph><paragraph id="H002A94D39E924A3EB93B692242BF5829"><enum>(7)</enum><text>A
			 description of non-financial barriers to innovation that must be addressed for
			 the creation of a successful HIZ, including physician self-referral laws,
			 anti-trust considerations, State laws, and accreditation or certification
			 requirements.</text>
				</paragraph><paragraph id="H37FDFAEA27454C61B00243AAB00002AD"><enum>(8)</enum><text>A
			 process for data reporting, annual site visits, and developing community health
			 impact assessments.</text>
				</paragraph><paragraph id="HFFE0C128A93A4CC39CC8AF10F09ED032"><enum>(9)</enum><text>A
			 set of indicators to help track performance and success of the HIZ model plan,
			 including measures to address cost containment, access to care, and quality
			 improvement, and how the HIZ model plan would facilitate achievement of these
			 improvements.</text>
				</paragraph><paragraph id="H8FB3DEF06DA042DDBF891449746DC5F9"><enum>(10)</enum><text>A description of
			 mechanisms to achieve involvement by the community and external experts as
			 ongoing monitors of the success of the HIZ model plan.</text>
				</paragraph><paragraph id="HE51DFF0D8ECE46A894C56FD58034B8FF"><enum>(11)</enum><text>Payment
			 methodology options that address both funding mechanisms to the HIZ as well as
			 how the HIZ would distribute funds to the HIZ participants.</text>
				</paragraph></subsection><subsection id="H9B7B76E1F9C84B50A72488191F374B94"><enum>(g)</enum><header>Number and
			 amount of planning grants</header><text>The Secretary shall award at least 10
			 but not more than 25 grants under this section in an amount of at least
			 $250,000 and not more than $1,000,000 per grant.</text>
			</subsection><subsection id="H7C5A3320B7764DAF96D006612BF6112"><enum>(h)</enum><header>Funding</header><text>Amounts
			 made available under the heading <quote>Agency for Healthcare Research and
			 Quality—Healthcare Research and Quality</quote> in title VIII of division I of
			 the American Recovery and Reinvestment Act of 2009 (Public Law 111–5) may be
			 used by the Secretary to make grants under this section.</text>
			</subsection></section><section id="H0BA2EDF1F6934003B300A8B01E1B7345"><enum>4.</enum><header>Healthcare
			 Innovation Zone demonstration project</header>
			<subsection id="HC9F9739127B34014BF096744926029E3"><enum>(a)</enum><header>Establishment</header><text>The
			 Secretary shall establish an HIZ demonstration project in order to test the
			 effectiveness of HIZs in increasing healthcare provider integration, improving
			 healthcare services, and reducing healthcare costs. Such demonstration project
			 shall not be subject to current requirements regarding shared savings under
			 demonstration projects. The Secretary shall select demonstration project
			 participants from the persons that have received grants under section 3.</text>
			</subsection><subsection display-inline="no-display-inline" id="HB3AD618BA9554A21BFC9D100FDCCB0E6"><enum>(b)</enum><header>Duration</header><text display-inline="yes-display-inline">The demonstration project shall operate for
			 a period of at least 3 years, and shall be subject to renewal at the
			 Secretary’s discretion.</text>
			</subsection><subsection id="H411E2555228B43D4B0C9CB7C2FFEEA1E"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">An eligible entity shall submit an
			 application for participation in the HIZ demonstration project to the Secretary
			 at such time and manner, and containing such information as the Secretary may
			 require.</text>
			</subsection><subsection id="H8BD0AA98DA5E42B9AFFA3505E200FE69"><enum>(d)</enum><header>Eligibility</header><text>To
			 be eligible to participate in the demonstration project established under this
			 section, a person must—</text>
				<paragraph id="HBE8F3BC677B14135B1E313FD323B9C61"><enum>(1)</enum><text>have submitted an
			 HIZ model plan in accordance with section 3(f) that is approved by the
			 Secretary;</text>
				</paragraph><paragraph id="H13DE8887057D44AFBA6D0062DD32CCC3"><enum>(2)</enum><text>agree to submit
			 the necessary data so that Secretary can assess the costs, quality of care, and
			 access to care for the population participating in the HIZ demonstration
			 project;</text>
				</paragraph><paragraph id="H4FD167D9A67746FA926CA11083C65DB5"><enum>(3)</enum><text>demonstrate a
			 culture of innovation and commitment to preventive and public health;</text>
				</paragraph><paragraph id="HB83FD990CDA2416FB020292343203592"><enum>(4)</enum><text>possess structural
			 elements to provide the full range of care necessary for a successful
			 HIZ;</text>
				</paragraph><paragraph id="H20B470CDB35840B688F25B08AE3B53F"><enum>(5)</enum><text>provide clinical
			 training for healthcare professionals in a medical environment that emphasizes
			 coordinated, integrated, high-quality care delivered at a controlled
			 cost;</text>
				</paragraph><paragraph id="HCAEBADA3D8C64322935DD857B8989352"><enum>(6)</enum><text>have the ability
			 to allocate resources within the members of the HIZ;</text>
				</paragraph><paragraph id="HFE00EE4B791A47C28D26BE67161600E7"><enum>(7)</enum><text>have a broad
			 research infrastructure that supports data gathering, analytics, and synthesis
			 of unrelated population elements, including quality-related data
			 elements;</text>
				</paragraph><paragraph id="H3BB66D5739654C88008DF5FC9C588CE6"><enum>(8)</enum><text>have significant
			 investment in health information technology that extends across the system to
			 include healthcare providers, physicians, and other clinicians;</text>
				</paragraph><paragraph id="HF99AD525ADCC4EB6B1DBA2063672114E"><enum>(9)</enum><text>possess advance
			 innovations including, but not limited to, creation of medical homes, pay for
			 performance, and other cost-effective delivery platforms;</text>
				</paragraph><paragraph id="H8E4BE7FBF1774E3F93A7DC919EBC098B"><enum>(10)</enum><text>demonstrate
			 long-term economic sustainability;</text>
				</paragraph><paragraph id="HECCB9906782D42DE9C488F9BE7AE75C7"><enum>(11)</enum><text>demonstrate
			 strong hospital and physician leadership and the willingness to undergo a full
			 portfolio assessment and reengineering of core patient care and administrative
			 processes;</text>
				</paragraph><paragraph id="HEB11A53E5A92485EAEA3A661CFA89C44"><enum>(12)</enum><text>possess robust
			 financial infrastructure and administrative support to assure the HIZ’s
			 success; and</text>
				</paragraph><paragraph id="H702A8EE452C946FA99DCD26BC302B8FE"><enum>(13)</enum><text>demonstrate
			 arrangements that maintain oversight and accreditation standards.</text>
				</paragraph></subsection><subsection id="H77DCBDD951AF4C5B931F5950FA4C555C"><enum>(e)</enum><header>HIZ
			 requirements</header><text display-inline="yes-display-inline">An HIZ
			 established under this section shall—</text>
				<paragraph id="H0CBAE138FB224298801094BF89C9A677"><enum>(1)</enum><text>provide healthcare
			 services to individuals who voluntarily enroll to receive such services for
			 multi-year periods from the HIZ; and</text>
				</paragraph><paragraph id="H6BC68EFB66D744679286667981D38DEB"><enum>(2)</enum><text>provide
			 comprehensive healthcare services, as described in subsection (f).</text>
				</paragraph></subsection><subsection id="H984BD6606AD7481D8F1F3D51DF0C42B2"><enum>(f)</enum><header>Comprehensive
			 healthcare services</header><text display-inline="yes-display-inline">The
			 comprehensive healthcare services referred to in subsection (e)(2) shall
			 consist of hospital care, physician services, post-acute care, preventive care,
			 education, tertiary and quaternary care, and palliative care, and shall include
			 the following:</text>
				<paragraph id="H6D2C62B6D2E44395BBA3FF00585FA4E4"><enum>(1)</enum><text>For a primary care
			 practice, contractual agreements with practices that deliver both primary and
			 preventive care.</text>
				</paragraph><paragraph id="H64790B311D5B4A19ACDA00BC9592AEE8"><enum>(2)</enum><text>For a teaching
			 hospital or other hospital, arrangements with teaching and nonteaching
			 hospitals and arrangements with community hospitals.</text>
				</paragraph><paragraph id="HE78355112BE14EABA4DD9FBBD6AB471F"><enum>(3)</enum><text>For a network of
			 outpatient facilities, arrangements with outpatient facilities, including
			 Federally Qualified Health Centers and community health providers.</text>
				</paragraph><paragraph id="H7D442C25858B4739AFBFC4EFF9B1F424"><enum>(4)</enum><text>For a network of
			 post-acute care providers, arrangements with post-acute care providers for
			 rehabilitation services, home health services, hospice services, skilled
			 nursing services, and such other post-acute care services as the Secretary
			 determines to be appropriate.</text>
				</paragraph><paragraph id="H42A79A68E7604400B1009B2572905754"><enum>(5)</enum><text>For a network of
			 community services, arrangements for the provision of ambulance services and
			 community outreach service.</text>
				</paragraph><paragraph id="H92784ACD98E6498FB7700197E1DCF983"><enum>(6)</enum><text>Arrangements for
			 the provision such additional services as the Secretary may require.</text>
				</paragraph></subsection><subsection id="H782C1E963F05460DAD3FAE7C9B2F0000"><enum>(g)</enum><header>Payment</header><text display-inline="yes-display-inline">The Secretary may determine the payments
			 that are required to be made for receipt of healthcare services provided under
			 a model plan implemented with a grant under this section. The Secretary shall
			 determine those amounts based on the methodology options submitted through the
			 grant program established under section 3.</text>
			</subsection><subsection id="H57221B8A493D444DBE66A682A3F40619"><enum>(h)</enum><header>Assumption of
			 financial risk for costs above HIZ payment amounts</header><text>An HIZ
			 established under this section shall assume the full financial risk for the
			 costs of healthcare services delivered to an individual receiving services from
			 the HIZ that are in excess of any payments made to the HIZ and must have
			 sufficient reserves to accommodate any such additional costs.</text>
			</subsection><subsection id="H68FBCF0593FB4E72B0CB06C39F82AFED"><enum>(i)</enum><header>Waiver of rights
			 to payment under private or public programs</header><text>An HIZ established
			 with amounts provided under this section shall waive any right to additional
			 reimbursement under any Federal healthcare entitlement program, including under
			 titles XVIII and XIX of the Social Security Act (42 U.S.C. 1395 et seq.; 42
			 U.S.C. 1396 et seq.), and under any group health plan or from any health
			 insurance issuer offering group or individual health insurance coverage for
			 healthcare services furnished to an individual receiving healthcare services
			 from the HIZ and for which payment is made under this subsection for such
			 services.</text>
			</subsection><subsection display-inline="no-display-inline" id="H56C80A3736604F1DA1E932B85000A889"><enum>(j)</enum><header>Scoring cost
			 savings</header><text display-inline="yes-display-inline">The Secretary shall
			 collaborate with the Government Accountability Office in scoring the healthcare
			 costs and savings associated with implementing HIZs on a nationwide
			 basis.</text>
			</subsection><subsection id="H250196D8B93D49A18C6C6FD658EC22D"><enum>(k)</enum><header>Waiver</header><text display-inline="yes-display-inline">Any requirements under titles XI and XVIII
			 of the Social Security Act (42 U.S.C. 1301 et seq.; 42 U.S.C. 1395 et seq.), or
			 under any other provision of law that would preclude the establishment or
			 operation of an HIZ under this section, shall not apply with respect to such
			 establishment or operation.</text>
			</subsection><subsection id="HF74ADAA0F68244ADA60951A42C50AF00"><enum>(l)</enum><header>Reports</header>
				<paragraph id="H2B45341625AC45FBA3C449C30066C500"><enum>(1)</enum><header>HIZ
			 report</header><text display-inline="yes-display-inline">An entity that
			 establishes an HIZ under this section shall submit to the Secretary a report
			 that describes and evaluates the activities of the HIZ.</text>
				</paragraph><paragraph id="H457242D8A57C4FE1B5228B9B45F9F52D"><enum>(2)</enum><header>Secretary
			 report</header><text display-inline="yes-display-inline">The Secretary shall
			 submit to Congress an evaluation of the current status of the demonstration
			 program within 6 months after the end of the first year of the demonstration
			 program, and every 6 months thereafter until the end of the demonstration
			 program.</text>
				</paragraph></subsection></section></legis-body>
