		<section id="HFA705245891347A59F3589FF04FC66FA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Foreign Evidence Request Efficiency
			 Act of 2009</short-title></quote>.</text>
		</section><section id="H734B95438C6B4E8FB16FF31E34B0030C"><enum>2.</enum><header>Improvements to
			 title 18</header><text display-inline="no-display-inline">Title 18 of the
			 United States Code is amended—</text>
			<paragraph id="H27CC807C0407495E807A22F135FE8513"><enum>(1)</enum><text>in section
			 2703—</text>
				<subparagraph id="H35082C1A0ACE4E9F9B6396A81528C513"><enum>(A)</enum><text>in subsection (a),
			 by striking <quote>by a court with jurisdiction over the offense under
			 investigation or an equivalent State warrant</quote> and inserting <quote>(or,
			 in the case of a State court, issued using State warrant procedures) by a court
			 of competent jurisdiction</quote>;</text>
				</subparagraph><subparagraph id="HE828B2D123644AA882D9FAB23CE1D68C"><enum>(B)</enum><text>in subsection
			 (b)(1)(A), by striking <quote>by a court with jurisdiction over the offense
			 under investigation or an equivalent State warrant</quote> and inserting
			 <quote>(or, in the case of a State court, issued using State warrant
			 procedures) by a court of competent jurisdiction</quote>; and</text>
				</subparagraph><subparagraph id="HEB90D63F1B604288ADCD2D8B9CA8DEB8"><enum>(C)</enum><text>in subsection
			 (c)(1)(A), by striking <quote>by a court with jurisdiction over the offense
			 under investigation or an equivalent State warrant</quote> and inserting
			 <quote>(or, in the case of a State court, issued using State warrant
			 procedures) by a court of competent jurisdiction</quote>;</text>
				</subparagraph></paragraph><paragraph id="H9C140517046441A681D4CA9826E25717"><enum>(2)</enum><text>in section
			 2711(3), by striking <quote>has the meaning assigned by section 3127, and
			 includes any Federal court within that definition, without geographic
			 limitation; and</quote> and inserting the following: “includes—</text>
				<quoted-block id="H11B939124C8441C4A3FC3C06156235F8" style="OLC">
					<subparagraph id="H73F58BFA2E064459A5EC66B8153503BA"><enum>(A)</enum><text>any district court
				of the United States (including a magistrate judge of such a court) or any
				United States court of appeals that—</text>
						<clause id="H39FD93F1BDA14710B261B9AE59BA99B8"><enum>(i)</enum><text>has jurisdiction
				over the offense being investigated;</text>
						</clause><clause id="HE1FED2F41CCD48A5870D2A314EC35530"><enum>(ii)</enum><text>is in or for a
				district in which the provider of a wire or electronic communication service is
				located or in which the wire or electronic communications, records, or other
				information are stored; or</text>
						</clause><clause id="H0A50B4D34D0D4742B5C8215610383BD4"><enum>(iii)</enum><text>is acting on a
				request for foreign assistance pursuant to section 3512 of this title;
				or</text>
						</clause></subparagraph><subparagraph id="H954D91B19CCB47CAA6C6A2C039C8E5A1"><enum>(B)</enum><text>a court of general
				criminal jurisdiction of a State authorized by the law of that State to issue
				search warrants;
				and</text>
					</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HD13EDD2CD0A54E81ACDEE970728563BA"><enum>(3)</enum><text>in section
			 3127(2)(A), by striking <quote>having jurisdiction over the offense being
			 investigated;</quote> and inserting the following: “that—</text>
				<quoted-block id="H8C26DF7D8CE241E186FBB7EC93F4E614" style="OLC">
					<clause id="H3C7350090FCE439D8B2A34C423BABF76"><enum>(i)</enum><text>has jurisdiction
				over the offense being investigated;</text>
					</clause><clause id="H8BB93C3D1A8B4FF99AA168C5985AF0EB"><enum>(ii)</enum><text>is in or for a
				district in which the provider of a wire or electronic communication service is
				located;</text>
					</clause><clause id="HF2132F1DA0324A1F9C589BD8EBF63E32"><enum>(iii)</enum><text>is in or for a
				district in which a landlord, custodian, or other person subject to subsections
				(a) or (b) of section 3124 of this title is located; or</text>
					</clause><clause id="H978D86EDB26A4F0D9644976D7A88F37B"><enum>(iv)</enum><text>is acting on a
				request for foreign assistance pursuant to section 3512 of this
				title;</text>
					</clause><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HDE84011675624740AE9EBE85F61ACD88"><enum>(4)</enum><text>in chapter 223, by
			 adding at the end the following:</text>
				<quoted-block id="H1C0981CCD3064DEE9D6C9D7CF1706F96" style="USC">
					<section id="H8D846E01221040EE876DABF4C5AEC012"><enum>3512.</enum><header>Foreign
				requests for assistance in criminal investigations and prosecutions</header>
						<subsection id="HBBA37AC8EE7F4B80858CB874EA2B666F"><enum>(a)</enum><header>Execution of
				Request for Assistance</header>
							<paragraph id="H8436A1C530F14EB398D391D48F82BD22"><enum>(1)</enum><header>In
				general</header><text>Upon application, duly authorized by an appropriate
				official of the Department of Justice, of an attorney for the Government, a
				Federal judge may issue such orders as may be necessary to execute a request
				from a foreign authority for assistance in the investigation or prosecution of
				criminal offenses, or in proceedings related to the prosecution of criminal
				offenses, including proceedings regarding forfeiture, sentencing, and
				restitution.</text>
							</paragraph><paragraph id="H33BD9CE574FA4212A57645ACD5A702F0"><enum>(2)</enum><header>Scope of
				orders</header><text>Any order issued by a Federal judge pursuant to paragraph
				(1) may include the issuance of—</text>
								<subparagraph id="H7850120D8FA24E83BFFC841FAB6ADBA0"><enum>(A)</enum><text>a search warrant,
				as provided under rule 41 of the Federal Rules of Criminal Procedure;</text>
								</subparagraph><subparagraph id="H12AFC75A94404EE9B9FBA0A3C47BE572"><enum>(B)</enum><text>a warrant or order
				for contents of stored wire or electronic communications or for records related
				thereto, as provided under section 2703 of this title;</text>
								</subparagraph><subparagraph id="H703C4E8643154A94972F1D9785933C3A"><enum>(C)</enum><text>an order for a pen
				register or trap and trace device as provided under section 3123 of this title;
				or</text>
								</subparagraph><subparagraph id="HF806770EEFD8435DB9AB0581ECBE1511"><enum>(D)</enum><text>an order requiring
				the appearance of a person for the purpose of providing testimony or a
				statement, or requiring the production of documents or other things, or
				both.</text>
								</subparagraph></paragraph></subsection><subsection id="H0DEB70E2BCB84198AE7D0676912D92C6"><enum>(b)</enum><header>Appointment of
				Persons To Take Testimony or Statements</header>
							<paragraph id="H3278C78E073444018CE10FC429DFE004"><enum>(1)</enum><header>In
				general</header><text>In response to an application for execution of a request
				from a foreign authority as described under subsection (a), a Federal judge may
				also issue an order appointing a person to direct the taking of testimony or
				statements or of the production of documents or other things, or both.</text>
							</paragraph><paragraph id="H9255DF62832B434FAB968B7F8308E505"><enum>(2)</enum><header>Authority of
				appointed person</header><text>Any person appointed under an order issued
				pursuant to paragraph (1) may—</text>
								<subparagraph id="H35AEC2E17F524598961AEDDE8FFE3D4D"><enum>(A)</enum><text>issue orders
				requiring the appearance of a person, or the production of documents or other
				things, or both;</text>
								</subparagraph><subparagraph id="HEAB48DAFB75D49D7AE03B4E0C6695E92"><enum>(B)</enum><text>administer any
				necessary oath; and</text>
								</subparagraph><subparagraph id="H0DF4DD1F7C934011AD78592CD48037BB"><enum>(C)</enum><text>take testimony or
				statements and receive documents or other things.</text>
								</subparagraph></paragraph></subsection><subsection id="HFEA2DC022F4B4F77B2D5E077A61C0DCE"><enum>(c)</enum><header>Filing of
				Requests</header><text>Except as provided under subsection (d), an application
				for execution of a request from a foreign authority under this section may be
				filed—</text>
							<paragraph id="HAD99DB800D61427F95D4DF373C61FB8E"><enum>(1)</enum><text>in the district in
				which a person who may be required to appear resides or is located or in which
				the documents or things to be produced are located;</text>
							</paragraph><paragraph id="H58364AC807904108883D81CA15FF0618"><enum>(2)</enum><text>in cases in which
				the request seeks the appearance of persons or production of documents or
				things that may be located in multiple districts, in any one of the districts
				in which such a person, documents, or things may be located; or</text>
							</paragraph><paragraph id="HE7D582A876AB46EAAC3FF5CD5C045475"><enum>(3)</enum><text>in any case, the
				district in which a related Federal criminal investigation or prosecution is
				being conducted, or in the District of Columbia.</text>
							</paragraph></subsection><subsection id="H10DA93B99F6F492F8A1EF97BE409E7FC"><enum>(d)</enum><header>Search Warrant
				Limitation</header><text>An application for execution of a request for a search
				warrant from a foreign authority under this section, other than an application
				for a warrant issued as provided under section 2703 of this title, shall be
				filed in the district in which the place or person to be searched is
				located.</text>
						</subsection><subsection id="H63D1BE342A444FE2A903623DCE89A212"><enum>(e)</enum><header>Search Warrant
				Standard</header><text>A Federal judge may issue a search warrant under this
				section only if the foreign offense for which the evidence is sought involves
				conduct that, if committed in the United States, would be considered an offense
				punishable by imprisonment for more than one year under Federal or State
				law.</text>
						</subsection><subsection id="HDAD2F972ADCF4B868B5DC65D4DD3768E"><enum>(f)</enum><header>Service of Order
				or Warrant</header><text>Except as provided under subsection (d), an order or
				warrant issued pursuant to this section may be served or executed in any place
				in the United States.</text>
						</subsection><subsection id="H24A871E6BE274A2783E276D268133E99"><enum>(g)</enum><header>Rule of
				Construction</header><text>Nothing in this section shall be construed to
				preclude any foreign authority or an interested person from obtaining
				assistance in a criminal investigation or prosecution pursuant to section 1782
				of title 28, United States Code.</text>
						</subsection><subsection id="HF9727563E6C9436CB60DA1819C7CA75B"><enum>(h)</enum><header>Definitions</header><text>As
				used in this section, the following definitions shall apply:</text>
							<paragraph id="H0F984F964F2547038C2F64281B380D01"><enum>(1)</enum><header>Federal
				judge</header><text>The terms <quote>Federal judge</quote> and <quote>attorney
				for the Government</quote> have the meaning given such terms for the purposes
				of the Federal Rules of Criminal Procedure.</text>
							</paragraph><paragraph id="H8455C31D58D8469D97279E3D9625890E"><enum>(2)</enum><header>Foreign
				authority</header><text>The term <quote>foreign authority</quote> means a
				foreign judicial authority, a foreign authority responsible for the
				investigation or prosecution of criminal offenses or for proceedings related to
				the prosecution of criminal offenses, or an authority designated as a competent
				authority or central authority for the purpose of making requests for
				assistance pursuant to an agreement or treaty with the United States regarding
				assistance in criminal matters.</text>
							</paragraph></subsection></section><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H1D0EFC601CE44F0B8F6FE8CF6BC05C06"><enum>(5)</enum><text>in the table of
			 sections for chapter 223, by adding at the end the following:</text>
