		<official-title>To amend the Federal Reserve Act to authorize Federal
		  Reserve Banks to examine the methodologies of used by nationally recognized
		  statistical rating organizations in analyzing and rating asset backed
		  securities and structured finance products.</official-title>

		<section id="HC321BE2325BB4663945034B57B8C83DE" section-type="section-one"><enum>1.</enum><header>Examination authority with
			 respect to nationally recognized statistical rating organizations</header><text display-inline="no-display-inline">Section 13 of the Federal Reserve Act is
			 amended by adding at the end the following new paragraph:</text>
			<quoted-block display-inline="no-display-inline" id="H7604849B7F8C4EB8962185B6858AB34A" style="OLC">
				<paragraph id="HF1D4CD2913814CC3854332A88D378A2D"><enum>(15)</enum><header>Examination
				authority with respect to nationally recognized statistical rating
				organizations</header>
					<subparagraph id="HF2AA0317A76645D88C53443CEB367561"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Board may
				authorize any Federal reserve bank to examine the methodologies used by
				nationally recognized statistical rating organizations in analyzing and rating
				asset backed securities and structured finance products. Such examinations
				shall be subject to such limitations, restrictions, and regulations as the
				Board may prescribe.</text>
					</subparagraph><subparagraph id="H19ED0834F1354BBB8EC79B02D155342B"><enum>(B)</enum><header>Definitions</header><text>For
				purposes of this paragraph:</text>
						<clause id="H0DC10B29E0A54F3081356AA653250ABB"><enum>(i)</enum><header>Asset backed
				security</header><text display-inline="yes-display-inline">The term <term>asset
				backed security</term> means—</text>
							<subclause id="H355455E0887943888F93772C9CABE2BD"><enum>(I)</enum><text>a security that is
				primarily serviced by the cash flows of a discrete pool of receivables or other
				financial assets (including mortgages), either fixed or revolving, that by
				their terms convert into cash within a finite time period, plus any rights or
				other assets designed to assure the servicing or timely distributions of
				proceeds to the security holders; and</text>
							</subclause><subclause id="HE35D2DB6C8314B1295A502D08F5BC617"><enum>(II)</enum><text>such other
				security as the Board may prescribe.</text>
							</subclause></clause><clause id="H837A979E15E248A0B2B71E4F4631CE3D"><enum>(ii)</enum><header>Nationally
				recognized statistical rating organization</header><text>The term
				<term>nationally recognized statistical rating organization</term> has the same
				meaning as in section 3(a)(62) of the Securities Exchange Act of 1934 (15
				U.S.C. 78c(a)(62)).</text>
						</clause><clause id="H2F6C9FA5F1EA448AB837B0104CE395D3"><enum>(iii)</enum><header>Security</header><text display-inline="yes-display-inline">The term <term>security</term> has the same
				meaning as in section 3(a)(10) of the Securities Exchange Act of 1934 (15
				U.S.C. 78c(a)(10)).</text>
						</clause><clause id="H9A56F8AFD21846918456158C7E4EFC18"><enum>(iv)</enum><header>Structured
				finance product</header><text>The term <term>structured finance product</term>
				means a product that includes—</text>
							<subclause id="H30F6E25C42CA4FE590AFB2629BA4536B"><enum>(I)</enum><text display-inline="yes-display-inline">the pooling of assets (either cash-based or
				synthetically created);</text>
							</subclause><subclause id="H5613FD9D88AF470E914BE9F5992F6741"><enum>(II)</enum><text>the tranching of
				liabilities that are backed by such assets;</text>
							</subclause><subclause id="H6A5E1EBA74BA443C9247A91768FF1F5C"><enum>(III)</enum><text>de-linking of
				the credit risk of such assets from the credit risk of the originator (usually
				through use of a finite-lived, standalone financing vehicle); or</text>
							</subclause><subclause id="HA881C9E5B52B492892077D7AE0CA9FEB"><enum>(IV)</enum><text>such other
				elements as the Board may
				prescribe.</text>
