		  certain current and former service members to receive a refundable credit for

		<section id="H24A48C584B114713B369982950DEFB31" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>American Heroes’ Homeownership
			 Assistance Act of 2009</short-title></quote>.</text>
		</section><section id="H94A42440191F4DD3825548937218A694"><enum>2.</enum><header>Qualified Service
			 Member Homebuyer Credit</header>
			<subsection id="H81CDCD4A7FCD4109A6674EECEDDF8F9"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subpart C of part IV
			 of subchapter A of chapter 1 of the Internal Revenue Code of 1986 is amended by
			 inserting after section 36 the following new section:</text>
				<quoted-block id="H82E16709D03D4C76A9BDAF381526EC6C">
					<section id="HDFCA19E0AB9C43EE8C5B3300AAD92204"><enum>36A.</enum><header>Qualified
				Service Member Homebuyer Credit</header>
						<subsection id="HA828D89856184382A98B26C2A3B4EFCB"><enum>(a)</enum><header>Allowance of
				Credit</header><text display-inline="yes-display-inline">In the case of a
				qualified service member, or such service member’s surviving spouse, who
				purchases a principal residence, there shall be allowed to the taxpayer a
				credit against the tax imposed by this chapter an amount equal to 10 percent of
				the purchase price of such residence.</text>
						</subsection><subsection id="H46D51499FEF04B5B00E917009150EFF7"><enum>(b)</enum><header>Limitations</header>
							<paragraph id="HBAADE05DDC0A4F50ACF2100053A98798"><enum>(1)</enum><header>In
				General</header><text display-inline="yes-display-inline">Except as otherwise
				provided in this paragraph, the credit allowed under subsection (a) shall not
				exceed $7,500.</text>
							</paragraph><paragraph id="HC9640B07D79442D88BE200E3D6B25791"><enum>(2)</enum><header>Married
				Individuals Filing Separately</header><text>In the case of a married individual
				filing a separate return, paragraph (1) shall be applied by substituting
				<quote>$3,750</quote> for <quote>$7,500</quote>.</text>
							</paragraph><paragraph id="H396C43C12F624A4AAD066D2FE77DD500"><enum>(3)</enum><header>Other
				Individuals</header><text>If two or more individuals who are not married
				purchase a principal residence, the amount of the credit allowed under
				subsection (a) shall be allocated among such individuals in such a manner as
				the Secretary may prescribe, except that the total amount of the credits
				allowed to all such individuals shall not exceed $7,500.</text>
							</paragraph><paragraph id="H640D30289F0F4E4F90AE88ED10C5E602"><enum>(4)</enum><header>One-Time
				Only</header><text display-inline="yes-display-inline">If an individual
				receives a credit under subsection (a) for the purchase of a principal
				residence, such individual shall not be allowed a credit under subsection (a)
				with respect to the purchase of any other principal residence. The preceding
				sentence shall not apply to a principal residence with respect to which a
				credit is allowed under subsection (a) and to which subsection (e)(1)
				applies.</text>
							</paragraph></subsection><subsection id="HFD9E79E7F048463FA70101F08232EF0"><enum>(c)</enum><header>Definitions</header>
							<paragraph id="H5460F4BC7B6C4C76A1F9B06EAC51DBE"><enum>(1)</enum><header>Qualified service
				member</header><text display-inline="yes-display-inline">The term
				<term>qualified service member</term> means a current or former service member
				who performs duty in a combat zone between the years 2001 and 2010.</text>
							</paragraph><paragraph id="H83C414094749459CB58D00E98272F482"><enum>(2)</enum><header>Service
				member</header><text display-inline="yes-display-inline">The term <term>service
				member</term> means a member of the uniformed services (as defined in section
				101(a)(5) of title 10, United States Code).</text>
							</paragraph><paragraph id="HEE509305B89B4701AAC73534FD230722"><enum>(3)</enum><header>Combat
				Zone</header><text display-inline="yes-display-inline">The term <term>combat
				zone</term> has the meaning given such term by section 112(c)(2).</text>
							</paragraph><paragraph id="H8D982CEA0B8347BBA2006648B2CEB31F"><enum>(4)</enum><header>Principal
				Residence</header><text display-inline="yes-display-inline">The term
				<term>principal residence</term> has the same meaning as when used in section
				121.</text>
							</paragraph><paragraph id="H66B8FF7156B6402E9C44A865470315D1"><enum>(5)</enum><header>Purchase</header>
								<subparagraph id="H552EA11666C84E179FE57FA536B45A3"><enum>(A)</enum><header>In
				General</header><text display-inline="yes-display-inline">The term
				<term>purchase</term> means any acquisition, but only if—</text>
									<clause id="H1FE13C20318C48F4ADD11E183F6FDA86"><enum>(i)</enum><text>the property is
				not acquired from a person related to the person acquiring it, and</text>
									</clause><clause id="H63F03AD75A9240D8AABE1CF87783A211"><enum>(ii)</enum><text>the basis of the
				property in the hands of the person acquiring it is not determined—</text>
										<subclause id="HDC103385CD45410CA5F70038DD43D619"><enum>(I)</enum><text>in whole or part
				by reference to the adjusted basis of such property in the hands of the person
				from whom acquired it, or</text>
										</subclause><subclause id="H353B078D644B40658EE67BAD462CF663"><enum>(II)</enum><text>under section
				1014(a) (relating to property acquired from a decedent).</text>
										</subclause></clause></subparagraph><subparagraph id="H0C554082C3784F63A6D7886D1592546C"><enum>(B)</enum><header>Construction</header><text display-inline="yes-display-inline">A residence which is constructed by the
				taxpayer shall be treated as purchased by the taxpayer on the date the taxpayer
				first occupies the residence.</text>
								</subparagraph></paragraph><paragraph id="HC7EEFC9DDF814739AFB714AEB0EFEAB"><enum>(6)</enum><header>Purchase
				Price</header><text display-inline="yes-display-inline">The term <term>purchase
				price</term> means the adjusted basis of the principal residence on the date
				such residence is purchased.</text>
							</paragraph><paragraph id="H5AC343CB8E7C4BFCA96400285B2D5C3F"><enum>(7)</enum><header>Related
				Persons</header><text>A person shall be treated as related to another person if
				the relationship between such persons would result in the disallowance of
				losses under section 267 or 707(b) (but in applying section 267(b) and (c) for
				purposes of this section, paragraph (4) of section 267(c) shall be treated as
				providing that the family of an individual shall include only his spouse,
				ancestors, and lineal descendants).</text>
							</paragraph></subsection><subsection id="HE8240B54E3114D9F972859E84F5338F9"><enum>(d)</enum><header>Exceptions</header><text>No
				credit under subsection (a) shall be allowed to any taxpayer for any taxable
				year with respect to the purchase of a residence if—</text>
							<paragraph display-inline="no-display-inline" id="H0502752B92F144DC9E20ECFBBD00315C"><enum>(1)</enum><text>credit under
				section 36 (relating to first-time homebuyer credit) or 1400C (relating to
				first-time homebuyer in the District of Columbia) is allowed to the taxpayer
				(or the taxpayer's spouse) for such taxable year or any prior taxable
				year,</text>
							</paragraph><paragraph id="H3982A8F0B5774B77B0F0BDF386D01F60"><enum>(2)</enum><text>the residence is
				financed by the proceeds of a qualified mortgage issue, the interest on which
				is exempt from tax under section 103,</text>
							</paragraph><paragraph id="HE4E2B2B9BB53403CB1D7356E5E9EC1E0"><enum>(3)</enum><text>the taxpayer is a
				nonresident alien, or</text>
							</paragraph><paragraph id="H5AAA193478AD48A58E78365BE5704264"><enum>(4)</enum><text>the taxpayer
				disposes of such residence (or such residence ceases to be the principal
				residence of the taxpayer (and, if married, the taxpayer’s spouse)) before the
				close of such taxable year.</text>
							</paragraph></subsection><subsection id="H7183C7BC9E6C431BAFD62BB84280004"><enum>(e)</enum><header>Recapture of
				Credit</header>
							<paragraph id="H2403F294C5524422A754A3CE846F2DBB"><enum>(1)</enum><header>In
				General</header><text display-inline="yes-display-inline">Except as otherwise
				provided in this subsection, if a taxpayer disposes of the principal residence
				with respect to which a credit was allowed under subsection (a) (or such
				residence ceases to be the principal residence of the taxpayer) before the end
				of the recapture period, the taxpayer shall take into gross income an amount
				equal to one half the credit allowed under subsection (a) in the first taxable
				year following such disposal or cessation and one half in the second taxable
				year following such disposal or cessation.</text>
							</paragraph><paragraph id="H38DD5CC54CC2482A93D1BBE790B4779C"><enum>(2)</enum><header>Exceptions</header>
								<subparagraph id="H272F6255C5704E2487DB86262C49F8A9"><enum>(A)</enum><header>Death of
				Taxpayer</header><text display-inline="yes-display-inline">Paragraph (1) shall
				not apply to any taxable year ending after the date of the taxpayer’s
				death.</text>
								</subparagraph><subparagraph id="H53950857D1DC4BA6A7CC56FB5DD71FC"><enum>(B)</enum><header>Involuntary
				Conversion</header><text>Paragraph (1) shall not apply in the case of a
				residence which is compulsorily or involuntarily converted (within the meaning
				of section 1033(a)) if the taxpayer acquires a new principal residence during
				the 2-year period beginning on the date of the disposition or cessation
				referred to in paragraph (1). Paragraph (1) shall apply to such new principal
				residence during the recapture period in the same manner as if such new
				principal residence were the converted residence.</text>
								</subparagraph><subparagraph id="HCEB58AAD577241D8A8E6FF5594217758"><enum>(C)</enum><header>Transfers
				Between Spouses or Incident to Divorce</header><text>In the case of a transfer
				of a residence to which section 1041(a) applies—</text>
									<clause id="HD3E9FEFFB71C4EE0BCFCB82B39255A5"><enum>(i)</enum><text>paragraph (1) shall
				not apply to such transfer, and</text>
									</clause><clause id="HB760503051EB409EB9AD42C516D2F9F0"><enum>(ii)</enum><text>in the case of
				taxable years ending after such transfer, paragraph (1) shall apply to the
				transferee in the same manner as if such transferee were the transferor (and
				shall not apply to the transferor).</text>
									</clause></subparagraph><subparagraph id="H8D64906EFB2D44559E97732DBD91E683"><enum>(D)</enum><header>Acquisition of
				New Principal Residence</header><text>Paragraph (1) shall not apply if the
				taxpayer acquires a new principal residence during the 2-year period beginning
				on the date of the disposition. Paragraph (1) shall apply to such new principal
				residence during the recapture period in the same manner as if such new
				principal residence were the disposed residence.</text>
								</subparagraph></paragraph><paragraph id="H01C2725E2B62490BA2DA814100DEDB25"><enum>(3)</enum><header>Recapture
				Period</header><text display-inline="yes-display-inline">For purposes of this
				subsection, the term <term>recapture period</term> means the taxable year
				following the taxable year for which a credit is allowed under subsection
				(a).</text>
							</paragraph><paragraph id="H92A2F3783CF04C8791AAD745AC2D87FD"><enum>(4)</enum><header>Joint
				Returns</header><text>In the case of a credit allowed under subsection (a) with
				respect to a joint return, half of such credit shall be treated as having been
				allowed to each individual filing such return for purposes of this
				subsection.</text>
							</paragraph></subsection><subsection id="H9A492C3B114F4C76B66D87C220C4C056"><enum>(f)</enum><header>Application of
				Section</header><text>This section shall only apply to principal residences
				purchased by the taxpayer before January 1,
				2011.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H2C9D0818CC6241E5969631C7FF8D065B"><enum>(b)</enum><header>Conforming
			 Amendments</header>
				<paragraph id="H8972D329DFDD4780B8A9329613450081"><enum>(1)</enum><text display-inline="yes-display-inline">Section 26(b)(2) of such Code is amended by
			 striking <quote>and</quote> at the end of subparagraph (W), by striking the
			 period and inserting <quote>, and</quote> at the end of paragraph (X), and by
			 inserting after subparagraph (X) the following new subparagraph:</text>
					<quoted-block id="HA58BC48C8E534A4DB52275A8FF2F1D8">
						<subparagraph id="HEC853C5FE1494736B600C72D7CB2375F"><enum>(Y)</enum><text>section 36A(e)
				(relating to recapture of qualified service member homebuyer
				credit).</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H00F82922A82049DD9E873B80C1204EE2"><enum>(2)</enum><text>Section
			 6211(b)(4)(A) of such Code is amended by inserting <quote>36A,</quote> after
			 <quote>36,</quote>.</text>
				</paragraph><paragraph id="H99E779551EE74E5DA9CADD51009275D8"><enum>(3)</enum><text>Section 1324(b)(2)
			 of title 31, United States Code, is amended by inserting <quote>36A,</quote>
			 after <quote>36,</quote>.</text>
				</paragraph><paragraph id="HB9F245E67C844F060059D5B32C10568E"><enum>(4)</enum><text>The table of
			 sections for subpart C of part IV of subchapter A of chapter 1 of the Internal
			 Revenue Code of 1986 is amended by inserting after the item relating to section
			 36 the following new item:</text>

						</toc>
						<after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H902767BE66D5401298B58CC300764717"><enum>(c)</enum><header>Effective
			 Date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply to principal residences purchased by the taxpayer on
			 or after the date of enactment of this Act.</text>
			</subsection></section></legis-body>
