		<official-title>To strengthen the Occupational Safety and Health Act of
		  1970 by revising regulations to increase worker safety on construction sites
		  and, consequently, to protect child trespassers from unforeseen
		  dangers.</official-title>

		<section id="H7C5D519C3A054DDDB7BD586CD0922559" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Alexander L. Booker Child Protection
			 Construction Site Safety Act</short-title></quote>.</text>
		</section><section id="HEA2141ACB95440838537DF9024DADAEC"><enum>2.</enum><header>Revision of
			 regulations required</header><text display-inline="no-display-inline">Not later
			 than 1 year after the date of the enactment of this Act, the Secretary of Labor
			 shall revise regulations promulgated under the Occupational Safety and Health
			 Act of 1970 (29 U.S.C. 651 et seq.) and contained in section 1926 of title 29,
			 Code of Federal Regulations as follows:</text>
			<paragraph id="H5EE95F5C36ED4F739236D94C684FC1B0"><enum>(1)</enum><text display-inline="yes-display-inline">Revise section 1926.200—</text>
				<subparagraph id="H2AEB119928BD442297FB9F481BF654C5"><enum>(A)</enum><text>in subsection (a),
			 to require that signs and symbols be on prominent display when a hazard exists,
			 even during hours when work is not being performed;</text>
				</subparagraph><subparagraph id="H2360839DB0D4471A93465E1374FCBB00"><enum>(B)
			 </enum><text>in subsection (b)(1), to require danger signs to display clear
			 warnings to children, as well as adults, of the danger present in a
			 construction site, including signs indicating the danger of equipment present
			 on such site, and shall warn such individuals to not enter the site or touch or
			 tamper with such equipment; and</text>
				</subparagraph><subparagraph id="HF957C0DBD55943AB98E94487160CE23"><enum>(C)</enum><text>in subsection
			 (b)(2), to require danger signs to be large in size and contain graphic
			 figures, such as a person falling with a no trespass sign overlaying the
			 figure, to indicate the present danger of falling or other bodily harm present
			 on the construction site.</text>
				</subparagraph></paragraph><paragraph id="H6522B3AD2B774ACEB36400000058A6F2"><enum>(2)</enum><text>Revise section
			 1926.600(a)—</text>
				<subparagraph id="HE36C696CE7B248959FDA2FB7E94733B3"><enum>(A)</enum><text>in paragraph (1),
			 to require that all equipment left unattended at night, adjacent to a highway
			 in normal use, construction areas where work is in progress, or schools or
			 other areas where children are known to congregate (such as bike trails and
			 parks), have adequate and sufficient barricades—</text>
					<clause id="H9254A77ABF3E40DAACE01955B9B2BEB"><enum>(i)</enum><text>preventing access
			 to the equipment by any person;</text>
					</clause><clause id="HC12EF12D43F34CC8B5B95C2757A808D8"><enum>(ii)</enum><text>equipped with
			 appropriate lights, reflectors, and signage warning trespassers to keep out and
			 indicating that construction equipment is enclosed; and</text>
					</clause><clause id="H4BC381F98E534BABA6AF83C940712705"><enum>(iii)</enum><text>surrounding
			 areas of imminent danger such as areas near transformers or sink holes;
			 and</text>
					</clause></subparagraph><subparagraph id="H1065F173F4714F27BF73C6C574A6CBB8"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (3)(ii), to require that, when
			 not in use, all equipment must set the parking brakes and have devices
			 attached, which—</text>
					<clause id="HBCFC9151DDA745F18774BDF86F1C9900"><enum>(i)</enum><text>cannot be
			 triggered by the insertion of coins or other objects; and</text>
					</clause><clause id="H720D430C65A14F4AA212D966E779FFF2"><enum>(ii)</enum><text>set
			 off an audible alarm when tampered with or broken.</text>
					</clause></subparagraph></paragraph><paragraph id="HE165510FED1742D3AAF84C2CF8D285C3"><enum>(3)</enum><text>Revise section
			 1926.601(b)—</text>
				<subparagraph id="H31A77D47B8E840D6BE66EBCAAA5D643"><enum>(A)</enum><text>in paragraph (1),
			 to require that all motorized vehicles be equipped with safety lock systems
			 which—</text>
					<clause id="HD9C3CE8D7F02487EA4DEFBFCCC2557A5"><enum>(i)</enum><text>shall render the
			 vehicle inoperable when the vehicle is not in use;</text>
					</clause><clause id="H2E09C94D0082420AB702D1B8001D565C"><enum>(ii)</enum><text>cannot be
			 triggered by the insertion of coins or other objects;</text>
					</clause><clause id="H3BC0D15A77364CFFA7ED59687BC25198"><enum>(iii)</enum><text display-inline="yes-display-inline">which trigger an audible alarm when broken
			 or tampered with; and</text>
					</clause><clause id="H35799C5521B3414387C3DB6D27C19D5C"><enum>(iv)</enum><text>are
			 inspected regularly for functionality; and</text>
					</clause></subparagraph><subparagraph id="H85ED9BCBB33945C59907A9E4640062A9"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (11), to require that
			 operating levers controlling hoisting or dumping devices on haulage bodies or
			 start or stop devices on motorized construction equipment, including
			 all-terrain vehicles, shall be equipped with safety latches or other devices
			 which—</text>
					<clause id="H6953D72B02034C74001BDDF2C3A7BFEA"><enum>(i)</enum><text display-inline="yes-display-inline">will prevent accidental starting or
			 tripping of the operating levers controlling hoisting or dumping devices on
			 haulage bodies or start or stop devices on motorized construction equipment;</text>
					</clause><clause id="H4BBE1252D3314050971209E2B2139C82"><enum>(ii)</enum><text display-inline="yes-display-inline">ensure that, once the safety latches or
			 other devices are engaged and the motorized equipment is turned off, the
			 motorized equipment cannot be started;</text>
					</clause><clause id="H46A5249524174235A0A5FF1803D44361"><enum>(iii)</enum><text>cannot be
			 triggered by the insertion of coins or other objects; and</text>
					</clause><clause id="H52EAAF3C31DF492082E90150BD70B857"><enum>(iv)</enum><text>will trigger an
			 audible alarm when such safety latches or other devices are tampered with,
			 removed, or destroyed.</text>
