		(H.R. 3082) entitled <quote>An Act making appropriations for military
		construction, the Department of Veterans Affairs, and related agencies for the
		fiscal year ending September 30, 2010, and for other purposes.</quote>, do pass
		with the following</text>

		Appropriations Amendments</header>
					<section id="id18B630AEDAA74D1D8390D421D0631970" section-type="section-one"><enum>1.</enum><subsection commented="no" display-inline="yes-display-inline" id="idDD50503DCB9C428DB72B1E7AEB15731B"><enum>(a)</enum><text display-inline="yes-display-inline">The Continuing Appropriations Act, 2011
		(Public Law 111–242) is further amended by—</text>
							<paragraph id="id453D616A85704614976A3569F34DF00E"><enum>(1)</enum><text display-inline="yes-display-inline">striking the date specified in section
		106(3) and inserting <quote>March 4, 2011</quote>; and</text>
							</paragraph><paragraph id="id874FBB28EE0741C7868CEC2BB5077B75"><enum>(2)</enum><text display-inline="yes-display-inline">adding the following:</text>
								<quoted-block display-inline="no-display-inline" id="id354A4FF30E084689B7F5304021A75D40" style="appropriations">
									<section id="id8E10DAB06C1545B6BC5FC6E9985CD485"><enum>147.</enum><subsection commented="no" display-inline="yes-display-inline" id="idC373EC65BF7E4436AF8D4C0B0D4C9DAB"><enum>(a)</enum><text display-inline="yes-display-inline">For the purposes of this section—</text>
											<paragraph id="H26735F350D2E4B749E52A991D249C2CC"><enum>(1)</enum><text display-inline="yes-display-inline">the term <quote>employee</quote>—</text>
												<subparagraph id="H18B13CADC80447FDA82D4A14EE11D30A"><enum>(A)</enum><text>means an employee
		  as defined in section 2105 of title 5, United States Code; and</text>
												</subparagraph><subparagraph id="H27036C45CA424B5394F4F7056C46DDC4"><enum>(B)</enum><text>includes an
		  individual to whom subsection (b), (c), or (f) of such section 2105 pertains
		  (whether or not such individual satisfies subparagraph (A));</text>
												</subparagraph></paragraph><paragraph id="HD45E84146A32492C9B4E671CB86F90D6"><enum>(2)</enum><text display-inline="yes-display-inline">the term <quote>senior executive</quote>
		  means—</text>
												<subparagraph id="H63B9472F5E3E407996BB74A6006F8AAF"><enum>(A)</enum><text>a member of the
		  Senior Executive Service under subchapter VIII of chapter 53 of title 5, United
		  States Code;</text>
												</subparagraph><subparagraph id="H3CCE0A1C1AAA41BFBB94FF9BD230784F"><enum>(B)</enum><text>a member of the
		  FBI–DEA Senior Executive Service under subchapter III of chapter 31 of title 5,
		  United States Code;</text>
												</subparagraph><subparagraph id="H0AA2A0F8987E448CA4B1F21A40DBB0AF"><enum>(C)</enum><text>a member of the
		  Senior Foreign Service under chapter 4 of title I of the Foreign Service Act of
		  1980 (22 U.S.C. 3961 and following); and</text>
												</subparagraph><subparagraph id="HB100895BE30B4F45BD38FEB33D6C62F4"><enum>(D)</enum><text>a member of any
		  similar senior executive service in an Executive agency;</text>
												</subparagraph></paragraph><paragraph id="H19B28CB6F7464259B5EAAC37A1096177"><enum>(3)</enum><text display-inline="yes-display-inline">the term <quote>senior-level
		  employee</quote> means an employee who holds a position in an Executive agency
		  and who is covered by section 5376 of title 5, United States Code, or any
		  similar authority; and</text>
											</paragraph><paragraph id="HB563372914BC496794A05986AA0C8919"><enum>(4)</enum><text>the
		  term <quote>Executive agency</quote> has the meaning given such term by section
		  105 of title 5, United States Code.</text>
											</paragraph></subsection><subsection id="H6049650432B746BA8A0CB24DAE52BC45"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H831650F7B337466192AED3B5F14EC655"><enum>(1)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
		  except as provided in subsection (e), no statutory pay adjustment which (but
		  for this subsection) would otherwise take effect during the period beginning on
		  January 1, 2011, and ending on December 31, 2012, shall be made.</text>
											</paragraph><paragraph id="H9CF2AD6B536243CA9042B466B69290F4" indent="up1"><enum>(2)</enum><text>For purposes of this subsection, the
		  term <quote>statutory pay adjustment</quote> means—</text>
												<subparagraph id="HB228D6B447DC44D5A8F7CB1BDF21729C"><enum>(A)</enum><text display-inline="yes-display-inline">an
		  adjustment required under section 5303, 5304, 5304a, 5318, or 5343(a) of title
		  5, United States Code; and</text>
												</subparagraph><subparagraph id="HF356EDE5544D4466B9CA51BEC9581D0E"><enum>(B)</enum><text display-inline="yes-display-inline">any similar adjustment, required by
		  statute, with respect to employees in an Executive agency.</text>
												</subparagraph></paragraph></subsection><subsection id="H35D9847094444100A3A65D017B15741F"><enum>(c)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
		  except as provided in subsection (e), during the period beginning on January 1,
		  2011, and ending on December 31, 2012, no senior executive or senior-level
		  employee may receive an increase in his or her rate of basic pay absent a
		  change of position that results in a substantial increase in responsibility, or
		  a promotion.</text>
										</subsection><subsection id="H20E83EA09EF64A1192EC31F0726E0D9D"><enum>(d)</enum><text display-inline="yes-display-inline">The President may issue guidance that
		  Executive agencies shall apply in the implementation of this section.</text>
										</subsection><subsection id="HD40C8F8886264DC4BD3DC06F2E5AA42E"><enum>(e)</enum><text display-inline="yes-display-inline">The Non-Foreign Area Retirement Equity
		  Assurance Act of 2009 (5 U.S.C. 5304 note) shall be applied using the
		  appropriate locality-based comparability payments established by the President
		  as the applicable comparability payments in section 1914(2) and (3) of such
		  Act.</text>
										</subsection></section><section id="idFC68378C7A634FA38FD4EA74732FDA9B"><enum>148.</enum><text display-inline="yes-display-inline">Notwithstanding section 101, the level for
		  <quote>Department of Commerce, National Telecommunications and Information
		  Administration, Salaries and Expenses</quote> shall be $40,649,000.</text>
									</section><section id="id019F778F2BC44377ABA9DB6EF6FFB43F"><enum>149.</enum><text display-inline="yes-display-inline">The following authorities shall continue in
		  effect through the earlier of the date specified in section 106(3) of this Act
		  or the date of enactment of the National Defense Authorization Act for Fiscal
		  Year 2011:</text>
										<paragraph id="idA37C4854725A4EA28741E1D5C9287A7C"><enum>(1)</enum><text display-inline="yes-display-inline">Section 1021 of the Ronald W. Reagan
		  National Defense Authorization Act for Fiscal Year 2005 (Public Law 108–375;
		  118 Stat. 2042), as amended by section 1011 of the National Defense
		  Authorization Act for Fiscal Year 2010 (Public Law 111–84; 123 Stat.
		  2441);</text>
										</paragraph><paragraph id="idDD20E1B1998C45968835D6CADA037FDC"><enum>(2)</enum><text display-inline="yes-display-inline">Section 1022 of the National Defense
		  Authorization Act for Fiscal Year 2004 (Public Law 108–136; 10 U.S.C. 371
		  note), as amended by section 1012 of the National Defense Authorization Act for
		  Fiscal Year 2010 (Public Law 111–84; 123 Stat. 2441);</text>

										</paragraph></section><section id="idCB02B009C4994CA0887D3FF3627999D6"><enum>150.</enum><text display-inline="yes-display-inline">Subject to the availability of
		  appropriations, the Secretary of the Navy may award a contract or contracts for
		  up to 20 Littoral Combat Ships (LCS).</text>
									</section><section id="idC47741ACD3A844CD9440DE65DD10012A"><enum>151.</enum><text display-inline="yes-display-inline">Section 8905a(d)(4)(B) of title 5, United
		  States Code, is amended—</text>
										<paragraph id="idB5514D339C48456AB42958D768A252D2"><enum>(1)</enum><text display-inline="yes-display-inline">in clause (i), by striking <quote>October
		  1, 2010</quote> and inserting <quote>December 31, 2011</quote>; and</text>
										</paragraph><paragraph id="idEC5F5E2C01FF43A490D82B73D9316A12"><enum>(2)</enum><text display-inline="yes-display-inline">in clause (ii)—</text>
											<subparagraph id="id308F055C5DDA48D2A174DCD3E749D9CE"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>February 1, 2011</quote>
		  and inserting <quote>February 1, 2012</quote>; and</text>
											</subparagraph><subparagraph id="idC633E870D451469091416788F308980A"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>October 1, 2010</quote>
		  and inserting <quote>December 31, 2011</quote>.</text>
											</subparagraph></paragraph></section><section id="id44E9CCFC64564BB7B1BC5CFE3166344F"><enum>152.</enum><text display-inline="yes-display-inline">Notwithstanding section 101, the level for
		  <quote>Special Inspector General for the Troubled Asset Relief Program,
		  Salaries and Expenses</quote> shall be $36,300,000.</text>
									</section><section id="idCF80AC1D09D84450B77805F462124DBE"><enum>153.</enum><text display-inline="yes-display-inline">Public Law 111–240 is amended in section
		  1114 and section 1704 by striking <quote>December 31, 2010</quote> and
		  inserting <quote>March 4, 2011</quote> each time it appears and in section 1704
		  by adding at the end the following:</text>
										<subsection id="id55B0E9B8EF544631BC0E5619B4CAA2C4"><enum>‘(c)</enum><text display-inline="yes-display-inline">For purposes of the loans made under this
		  section, the maximum guaranteed amount outstanding to the borrower may not
		  exceed $4,500,000.’</text>
										</subsection></section><section id="id0AC65992388848E6A29FFBC2DC887A31"><enum>154.</enum><text display-inline="yes-display-inline">The appropriation to the Securities and
		  Exchange Commission pursuant to this Act shall be deemed a regular
		  appropriation for purposes of section 6(b) of the Securities Act of 1933 (15
		  U.S.C. 77f(b)) and sections 13(e), 14(g), and 31 of the Securities Exchange Act
		  of 1934 (15 U.S.C. 78m(e), 78n(g), and 78ee).</text>
									</section><section id="id557277B82D4A42FABAB35601CC653114"><enum>155.</enum><text display-inline="yes-display-inline">Section 302 of the Universal Service
		  Antideficiency Temporary Suspension Act is amended by striking <quote>December
		  31, 2010</quote> each place it appears and inserting <quote>December 31,
		  2011</quote>.</text>
									</section><section id="id5D80D4AC1B204BA3947E74D0208DB909"><enum>156.</enum><text display-inline="yes-display-inline">Notwithstanding section 503 of Public Law
		  111–83, amounts made available in this Act for the Transportation Security
		  Administration shall be available for transfer between and within
		  Transportation Security Administration appropriations to the extent necessary
		  to avoid furloughs or reduction in force, or to provide funding necessary for
		  programs and activities required by law: 
		  <proviso><italic>Provided</italic>,</proviso> That such transfers may
		  not result in the termination of programs, projects or activities: 
		  <proviso><italic>Provided further</italic>,</proviso> That the House
		  and Senate Appropriations Committees shall be notified within 15 days of such
		  transfers.</text>
									</section><section id="idF0A51BE446964E7C9D81F32BCD886040"><enum>157.</enum><text display-inline="yes-display-inline">Up to $21,880,000 from <quote>Coast Guard,
		  Acquisition, Construction, and Improvements</quote> and <quote>Coast Guard,
		  Alteration of Bridges</quote> may be transferred to <quote>Coast Guard,
		  Operating Expenses</quote>: 
		  <proviso><italic>Provided</italic>,</proviso> That the Coast Guard may
		  decommission one Medium Endurance Cutter, two High Endurance Cutters, four
		  HU–25 aircraft, the Maritime Intelligence Fusion Center, and one Maritime
		  Safety and Security Team, and make staffing changes at the Coast Guard
		  Investigative Service, as outlined in its budget justification documents for
		  fiscal year 2011 as submitted to the Committees on Appropriations of the Senate
		  and House of Representatives.</text>
									</section><section id="id0676E57DFAF04892AB820467C952329D"><enum>158.</enum><text display-inline="yes-display-inline">Notwithstanding section 101, the final
		  proviso under the heading <quote>Science and Technology, Research, Development,
		  Acquisition, and Operations</quote> in Public Law 111–83 (related to the
		  National Bio- and Agro-defense Facility) shall have no effect with respect to
		  all amounts available under this heading.</text>
									</section><section id="id4DD645CDCDD94E70ABC0F4B9B507E33F"><enum>159.</enum><text display-inline="yes-display-inline">Notwithstanding sections 101 and 128,
		  amounts are provided for <quote>Department of the Interior—Minerals Management
		  Service—Royalty and Offshore Minerals Management</quote> in the manner
		  authorized in Public Law 111–88 for fiscal year 2010, except that for fiscal
		  year 2011 the amounts specified in division A of Public Law 111–88 shall be
		  modified by substituting—</text>
										<paragraph id="idF2A722A79F7A4E44A4717140F4CDDCB1"><enum>(1)</enum><text display-inline="yes-display-inline"><quote>$200,110,000</quote> for
		  <quote>$175,217,000</quote>;</text>
										</paragraph><paragraph id="idABCF3B8E3CAA4E7398DC9F08FF4CF92F"><enum>(2)</enum><text display-inline="yes-display-inline"><quote>$102,231,000</quote> for
		  <quote>$89,374,000</quote>;</text>
										</paragraph><paragraph id="id8555AF796F7B48B196FF74743C4367FF"><enum>(3)</enum><text display-inline="yes-display-inline"><quote>$154,890,000</quote> for
		  <quote>$156,730,000</quote> each place it appears; and</text>
										</paragraph><paragraph id="idC583E1B159624B8DBCA2F1AE4464C4F6"><enum>(4)</enum><text display-inline="yes-display-inline"><quote>fiscal year 2011</quote> shall be
		  substituted for <quote>fiscal year 2010</quote> each place it appears.</text>
										</paragraph></section><section id="idA729EF65A5274980B03DF6B763A84CEA"><enum>160.</enum><text display-inline="yes-display-inline">The Secretary of the Interior, in order to
		  implement a reorganization of the Bureau of Ocean Energy Management,
		  Regulation, and Enforcement, may establish accounts, transfer funds among and
		  between the offices and bureaus affected by the reorganization, and take any
		  other administrative actions necessary in conformance with the Appropriations
		  Committee reprogramming procedures described in the joint explanatory statement
		  of the managers accompanying Public Law 111–88 (House of Representatives Report
		  111–316).</text>
									</section><section id="idCFC788C47EFF4FF092ABE361A6A87667"><enum>161.</enum><text display-inline="yes-display-inline">Notwithstanding section 101, section 423 of
		  Public Law 111–88 (123 Stat. 2961), concerning the distribution of geothermal
		  energy receipts, shall have no force or effect and the provisions of section
		  3003(a) of Public Law 111–212 (124 Stat. 2338) shall apply for fiscal year
		  2011.</text>
									</section><section id="idB17119AB69804F02B886855F416BB252"><enum>162.</enum><text display-inline="yes-display-inline">Notwithstanding section 109, of the funds
		  made available by section 101 for payments under subsections (b) and (d) of
		  section 2602 of the Low Income Home Energy Assistance Act of 1981, the
		  Department of Health and Human Services shall obligate the same amount during
		  the period covered by this continuing resolution as was obligated for such
		  purpose during the comparable period during fiscal year 2010.</text>
									</section><section id="id70A10865423249EEA5D9C00BCF799138"><enum>163.</enum><subsection commented="no" display-inline="yes-display-inline" id="idD55B8822E5974FDA803A58DC448BFBF4"><enum>(a)</enum><text display-inline="yes-display-inline">A <quote>highly qualified teacher</quote>
		  includes a teacher who meets the requirements in 34 C.F.R. 200.56(a)(2)(ii), as
		  published in the Federal Register on December 2, 2002.</text>
										</subsection><subsection id="idF17AFE70F98B405ABB45A494804C2632"><enum>(b)</enum><text display-inline="yes-display-inline">This provision is effective on the date of
		  enactment of this provision through the end of the 2012–2013 academic
		  year.</text>
										</subsection></section><section id="id39918B1B81C8452B92CEF09AE2399093"><enum>164.</enum><subsection commented="no" display-inline="yes-display-inline" id="id0FAD26EFF37A4306A87883EBCAD9B9C4"><enum>(a)</enum><text display-inline="yes-display-inline">Notwithstanding section 101, the level for
		  <quote>Department of Education, Student Financial Assistance</quote> to carry
		  out subpart 1 of part A of title IV of the Higher Education Act of 1965 shall
		  be $23,162,000,000.</text>
										</subsection><subsection id="id94BE550F954D4C0F8EEE98CF41CD7628"><enum>(b)</enum><text display-inline="yes-display-inline">The maximum Pell Grant for which a student
		  shall be eligible during award year 2011–2012 shall be $4,860.</text>
										</subsection></section><section id="HB716AB3BDA0D44B8B367ABE3EFE5E3D5"><enum>165.</enum><subsection commented="no" display-inline="yes-display-inline" id="H077FF5CB04E248788E6A7037D0FFD032"><enum>(a)</enum><text display-inline="yes-display-inline">Notwithstanding section 1018(d) of the
		  Legislative Branch Appropriations Act, 2003 (2 U.S.C. 1907(d)), the use of any
		  funds appropriated to the United States Capitol Police during fiscal year 2003
		  for transfer relating to the Truck Interdiction Monitoring Program to the
		  working capital fund established under section 328 of title 49, United States
		  Code, is ratified.</text>
										</subsection><subsection id="H1ACC86867FF7423D86EA9C853B938E97"><enum>(b)</enum><text>Nothing in
		  subsection (a) may be construed to waive sections 1341, 1342, 1349, 1350, or
		  1351 of title 31, United States Code, or subchapter II of chapter 15 of such
		  title (commonly known as the <quote>Anti-Deficiency Act</quote>).</text>
										</subsection><subsection id="idFC7B9C76E2F54EA6A58300A6E0653F98"><enum>(c)</enum><text>Notwithstanding
		  section 106 of this Act, the use of the funds described under subsection (a) of
		  this section shall apply without fiscal year limitation.</text>
										</subsection></section><section id="id6077A15647FB4FFE9DB6B42C6A1426A0"><enum>166.</enum><text>Notwithstanding
		  section 101, amounts are provided for <quote>Department of Veterans Affairs,
		  Departmental Administration, General Operating Expenses</quote> at a rate for
		  operations of $2,546,276,000, of which not less than $2,148,776,000 shall be
		  for the Veterans Benefits
		  Administration.</text>
									</section><after-quoted-block>.</after-quoted-block></quoted-block>
							</paragraph></subsection><subsection id="id56811DE1739C46B6A490BEC0F0AC56D6"><enum>(b)</enum><text display-inline="yes-display-inline">This section may be cited as the
		<quote><short-title>Continuing Appropriations Amendments,
		2011</short-title></quote>.</text>
						</subsection></section></title><title id="H69CA3586572F4DA7843554C33541EEB0" style="OLC"><enum>II</enum><header display-inline="yes-display-inline">Extension of Current Surface Transportation
		Programs</header>
					<section id="H61FE1B0F82A245A5AF83FE9B97091F45"><enum>2001.</enum>
						<header>Short title; reconciliation of
  funds</header>
						<subsection id="id0403AFF9E66F493E8B8496018E07A8A2"><enum>(a)</enum><text display-inline="yes-display-inline">This title may be cited as the
		<quote>Surface Transportation Extension Act of 2010, Part II</quote>.</text>
						</subsection><subsection id="HF91B0CD8407E43C9945A63AFE9E26E8D"><enum>(b)</enum><header>Reconciliation
		of funds</header><text>The Secretary of Transportation shall reduce the amount
		apportioned or allocated for a program, project, or activity under this title
		in fiscal year 2011 by amounts apportioned or allocated pursuant to the Surface
		Transportation Extension Act of 2010 for the period beginning on October 1,
		2010, and ending on December 31, 2010.</text>
						</subsection></section><subtitle id="H3F6ABC8AC42141C7A0022979C4045372"><enum>A</enum><header>Federal-Aid
		Highways</header>
						<section id="H696E6D68DD9E48178E80870DA520D481"><enum>2101.</enum><text display-inline="yes-display-inline">EXTENSION OF FEDERAL-AID HIGHWAY
		PROGRAMS.</text>
							<subsection id="id4A100ABD2B634468AF1AA930E79AEB32"><enum>(a)</enum><header>In
		general</header><text display-inline="yes-display-inline">Section 411 of the
		Surface Transportation Extension Act of 2010 (Public Law 111–147; 124 Stat. 78)
		is amended—</text>
								<paragraph id="H610B673FACF64A6AB075199C6FFCE4C1"><enum>(1)</enum><text>by
		striking <quote>the period beginning on October 1, 2010, and ending on December
		31, 2010</quote> each place it appears (except in subsection (c)(2)) and
		inserting <quote>the period beginning on October 1, 2010, and ending on March
		4, 2011</quote>;</text>
								</paragraph><paragraph id="HA8CBEC3A68324EE6809E93E607CDB61B"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (a) by striking

		striking <quote>Surface Transportation Extension Act of 2010</quote> each place
		it appears in subsection (b)(2) and inserting <quote>Surface Transportation
		Extension Act of 2010, Part II</quote>; and</text>
								</paragraph><paragraph id="H856DFB86CD164666877DAF29E545786C"><enum>(2)</enum><text>by
		striking <quote>January 1, 2011</quote> in subsection (d)(2) and inserting
		<quote>March 5, 2011</quote>.</text>
