2.
(a)Congress
makes the following findings:
(1)A
child who grows up in a permanent family in an atmosphere of happiness, love,
and understanding has the best opportunity for the full and harmonious
development of his or her potential.
(2)The right of a
child to grow up in a safe, loving and permanent loving relationship with a
responsible adult is a basic human right.
(3)The safety and
well being of children should be the paramount concern of child welfare
policies and programs.
(4)As stated in the
United Nations Programme for the International Year of the Family (1994),
the family provides the natural framework for the emotional, financial,
and material support essential to the growth and development of its members,
particularly infants and children.

(5)Cost benefit
analysis data shows that effective, high quality interventions to improve
parenting skills and reduce child maltreatment save between $2 and $8 dollars
for every dollar spent.
(6)Despite the good
efforts of countless governments and nongovernmental organizations, millions of
children remain outside of the protection, permanency, safety, and love of a
family. Without the care of a family, these children are forced to live on the
streets, in child-headed households, or in institutions.
(7)According to
UNICEF, there are more than 132,000,000 orphans worldwide. Unless immediate
action is taken, the number of orphans is expected to increase over
time.
(8)According to Dr.
Dana Johnson at the University of Minnesota, lack of stimulation and consistent
caregivers, suboptimal nutrition and physical/sexual abuse all conspire to
delay and sometimes preclude normal development, speech acquisition and
attainment of necessary social skills. Children lose one month of linear growth
for every three months in an orphanage.
(9)Research indicates
that infants who do not receive touching, holding, and stimulation fail to
thrive and may suffer life-affecting physical and emotional stressors, if not
death.
(10)Although
governments throughout the world are seeking models for preventing
institutionalization and finding permanent families for orphaned children, many
lack the resources or infrastructure to adequately address this need.
(11)As a result of
its efforts to protect its children from abuse and neglect, the United States
has amassed a vast body of research, policy, and the professional capacity to
promote safety, permanency and well-being for children and youth so they can
become healthy and successful adults.
(12)Despite the fact
that the United States invests $300,000,000,000 annually in international aid
programs that are improving the health, safety and well-being of children
throughout the world, it is unclear how much of this funding is used to support
the preservation and reunification of families or the provision of permanent
parental care.
(13)Greater
coordination is needed between Federal bureaus and agencies with an interest in
orphan care policy. Such efforts would be assisted greatly by the development
of a comprehensive global strategy for providing permanent parental care for
orphans.
(14)Despite the
United States’ interest in developing a comprehensive global strategy for
providing permanent parental care for orphans, the United States lacks a clear,
dedicated diplomatic authority to represent these interests.
(b)The
purposes of this Act are to—
(1)provide the
infrastructure and resources necessary for the United States to develop and
implement a comprehensive, global strategy for the preservation and
reunification of families and the provision of permanent parental care for
orphans;
(2)streamline and
coordinate United States policies and programs related to the preservation and
reunification of families and the provision of permanent parental care for
orphans;
(3)encourage and
assist foreign governments in the development and implementation of effective
child welfare policies, systems, and programs that preserve and reunify
families and provide permanent parental care for orphans;
(4)ensure that all
aid efforts receiving funding from the United States recognize and support the
need for the preservation and reunification of families and the provision of
permanent parental care for orphans; and
(5)build global
awareness of the need for the preservation and reunification of families and
the provision of permanent parental care for orphans.
3.In this Act:
(1)The
term deinstitutionalization
means the process of safely moving
youth from institutions to—
(A)permanent parental
care; or
(B)temporary
alternatives designed to lead to permanent parental care.
(2)Family at risk
of dissolutionThe term family at risk of
dissolution
means a family under circumstances which—
(A)compromise the
health, safety and well-being of minor, dependent children to an extent that
the parental caregivers may be compelled to voluntarily or involuntarily
forfeit care parental rights or custody of such children; or
(B)are likely to
cause the parents to abandon or relinquish rights to minor, dependent
children.
(3)The term family preservation
means
services for children and families designed to promote the safety and
well-being of children and families and to help families (at risk or in crisis,
including community-based family support, social, therapeutic, and financial
programs and services designed to—
(A)enable families to
provide safe, permanent, and nurturing care to their children; and
(B)strengthen and
support birth families who are at risk of dissolution, separation, or domestic
violence.
(4)The
term reunification
means time-limited services and activities
provided to an orphan in order to facilitate the safe and timely reunification
of the child and parent.
(5)The
term institution
means—
(A)an
orphanage;
(B)a children’s
home;
(C)a boarding school
for orphans;
(D)a shelter;
(E)a residential
facility;
(F)a hospital;
(G)a
dormitory;
(H)long-term foster
care; and
(I)any other setting
in which permanent parental care is not being provided to the child.
(6)The term institutionalized child
is a child
who is—
(A)younger than 21
years of age; and
(B)living in an
institution.
(7)The
term orphan
means any child—
(A)who lacks
permanent parental care because of the death, the disappearance of, or the
legal, permanent relinquishment of such child by both biological
parents;
(B)who is living in
the care and custody of an institution;
(C)whose biological
parents’ rights have been legally terminated; or
(D)whose country of
origin has determined lacks permanent parental care.
(8)The term permanent parental
care
—
(A)means a legally
recognized relationship between a adult and a child who is younger than 21
years of age, which is life-long and provides a caring, safe, stable physical
environment;
(B)includes—
(i)domestic and
international adoption;
(ii)legal
guardianship; and
(iii)legal kinship
care; and
(C)does not include
temporary or long-term foster care, institutionalization, or mentoring.
(9)The term legal guardianship
means a
legally recognized relationship between child and caretaker which is intended
to be permanent and is evidenced by the transfer to the caretaker of the
following parental rights with respect to the child: protection, education,
custody, and decisionmaking.
(10)The term legal kinship
means a legally
recognized relationship between child and caretaker which is intended to be
permanent and is evidenced by the transfer to the caretaker of the following
parental rights with respect to the child: protection, education, custody, and
decisionmaking.
(11)Adoption
support servicesThe term adoption support
services
means services and activities designed to encourage when
adoption is found to be in the best interests of children, including but not
limited to pre- and post-adoptive services; activities designed to expedite the
adoption process and support adoptive families.
<enum>I</enum><header>GLOBAL ORPHANS
STRATEGY </header>
<section id="HED13DCB74DF1413F90785282CC1E126B"><enum>101.</enum><header>Office for
orphan policy diplomacy and development</header>
<subsection id="H064985D7FA60453B976EDDAE46455280"><enum>(a)</enum><header>Establishment</header><text>There
is established within the Department of State the Office for Orphan Policy
Diplomacy and Development (referred to in this section as the
<quote>Office</quote>), which shall promote and support—</text>
<paragraph id="H5FFD53C2B8B24155BC8B5CB500AC64DE"><enum>(1)</enum><text>the preservation
and reunification of families; and</text>
</paragraph><paragraph id="H2BE4E8D2FB6F495E99EDB951E49D9CB1"><enum>(2)</enum><text>the provision of
permanent parental care for orphans.</text>
</paragraph></subsection><subsection id="HA039FE1D745F4069A08BA58747A46F89"><enum>(b)</enum><header>Coordinator</header>
<paragraph id="H249BEDCD5DB94C2EABBCB6D887593307"><enum>(1)</enum><header>Appointment</header><text>The
Office shall be headed by the Coordinator for Orphan Policy Diplomacy and
Development (referred to in this section as the <quote>Coordinator</quote>),
who shall be designated by the President.</text>
</paragraph><paragraph id="H06188A2EF6274F07AEB5E147FC26587"><enum>(2)</enum><header>Qualifications</header><text>To
the extent possible, the Coordinator shall be an individual with background and
experience in the development of permanency related policies and
systems.</text>
</paragraph><paragraph id="H319FDC19505947259F49BC0DF8BE03D"><enum>(3)</enum><header>Duties</header><text>The
Coordinator shall—</text>
<subparagraph id="H717DA76B1DC34A16006B93A600A500A9"><enum>(A)</enum><text>oversee and
coordinate—</text>
<clause id="H3E34452701CE41EE939184EC8C927220"><enum>(i)</enum><text>all
programs and duties described in this Act; and</text>
</clause><clause id="HBCE3496DFCE44677A95398786E9C9522"><enum>(ii)</enum><text>all
other activities that the United States Government conducts in furtherance of
the purposes of this Act; and</text>
</clause></subparagraph><subparagraph id="HA16709C45E09411F9017A6DBF0CC8D99"><enum>(B)</enum><text>carry out the
functions described in subsection (c).</text>
</subparagraph></paragraph><paragraph id="H9C5523EB604A4023BBAD3859E7FB5F41"><enum>(4)</enum><header>Authority</header><text>The
Coordinator will report directly to the Secretary of State.</text>
</paragraph></subsection><subsection id="HC691DC062EB44B908B006D6E00F716AF"><enum>(c)</enum><header>Functions</header>
<paragraph id="H469D0B91A03B4063BB44F0DED817D71"><enum>(1)</enum><header>Advisory</header><text>Unless
otherwise specified in law, the Coordinator shall serve as the primary advisor
to the Secretary of State and the President in all matters related to—</text>
<subparagraph id="HB602E81DB4764A15B74892F398BA5D1"><enum>(A)</enum><text>global family
preservation and reunification; and</text>
</subparagraph><subparagraph id="HE0AF4989D9D34D68B3D88DAAC64FCE63"><enum>(B)</enum><text>the provision of
permanent parental care for orphans.</text>
</subparagraph></paragraph><paragraph id="H96CE76F4218F4B1F85E71674F5D3AE33"><enum>(2)</enum><header>Diplomatic
representation</header>
<subparagraph id="H930A67F822E34FFB9E67A6DFA6CC6299"><enum>(A)</enum><header>In
general</header><text>Subject to the direction of the President and the
Secretary of State, the Coordinator shall represent the United States in
matters and cases relevant to family preservation and reunification and
permanent parental care in—</text>
<clause id="H4BE5F419ACED48B89B3BE0DCCEE3CEE8"><enum>(i)</enum><text>contacts with
foreign governments, nongovernmental organizations, intergovernmental agencies,
and specialized agencies of the United Nations and other international
organizations of which the United States is a member;</text>
</clause><clause id="HD63E45633E724748A5A7368F59162131"><enum>(ii)</enum><text>multilateral
conferences and meetings relevant to family preservation, reunification, and
permanent parental care for orphaned children; and</text>
</clause><clause id="H76AFEE53DC844BA1AA998E05DF688DB8"><enum>(iii)</enum><text>fulfillment of
the diplomatic responsibilities designated to the central authority under title
I of the Intercountry Adoption Act of 2000 (42 U.S.C. 14911 et seq.).</text>
</clause></subparagraph><subparagraph id="H43ADC63E5161461DBE584DD7A9E8400"><enum>(B)</enum><header>Waiver</header><text>The
Secretary of State may waive the requirements of subparagraph (A) if—</text>
<clause id="H77BA3B591791489182D48FC791DEFB05"><enum>(i)</enum><text>representation by
the Coordinator would interfere with the Secretary’s constitutional duty to
represent the United States; or</text>
</clause><clause id="H8AA0FAA71B554BE79DB157509F5D2B60"><enum>(ii)</enum><text>representation by
another high level official would be more appropriate or beneficial.</text>
</clause></subparagraph></paragraph><paragraph id="H2813C5C99C7C4B2CAA795D87E8CEF5FC"><enum>(3)</enum><header>Policy
development</header>
<subparagraph id="H2ACE1A0120DD400F9C9553AF479BA59"><enum>(A)</enum><header>In
general</header><text>The Coordinator shall—</text>
<clause id="H8D2A2555A37144E49185B6D025EBE822"><enum>(i)</enum><text>advise and support
the Secretary of State in the development of a comprehensive, global strategy
to promote the preservation and reunification of families and the provision of
permanent parental care for orphans; and</text>
</clause><clause id="HEDCD17E8960E44A9B0489134078D4884"><enum>(ii)</enum><text>advise and
support foreign governments with the development of sound policy
regarding—</text>
<subclause id="H9E1C6DD2750C4B179D11964D01A610E6"><enum>(I)</enum><text>preservation and
reunification of families; and</text>
</subclause><subclause id="HDBFAA9FCA508412A93CB62E4573527C1"><enum>(II)</enum><text>the provision of
permanent parental care for orphans.</text>
</subclause></clause></subparagraph><subparagraph id="HC88C3674B1ED44CDA6BC905E7787061C"><enum>(B)</enum><header>Best
practices</header><text>In developing policies under this Act, the Coordinator
should identify and engage evidence-based programs and best practices in family
preservation, reunification and permanent parental care derived from a wide
variety of both domestic and global policy and practice leaders.</text>
</subparagraph><subparagraph id="H5FD9C87274154A0DAC5CF9D1CD97C92"><enum>(C)</enum><header>Cultural
sensitivity</header><text>In developing policies under this Act, the
Coordinator should take into account cultural norms for each country to the
extent consistent with the overall purposes of this Act.</text>
</subparagraph><subparagraph id="HBBF8C33496DC4ECF004D2163D2CD771B"><enum>(D)</enum><header>Principle of
subsidiarity</header><text>In developing policies and programs under this Act,
the Coordinator should—</text>
<clause id="H6C85815DCC8A4DEAB961887E72604595"><enum>(i)</enum><text>attempt to reunify
children with their family before pursuing adoption, legal kinship or legal
guardianship and domestic adoption; and</text>
</clause><clause id="HD0FC3EF489B146D3BE3D006500F5BBF7"><enum>(ii)</enum><text>ensure that
reasonable efforts have been made to provide permanent parental care
domestically before international.</text>
</clause></subparagraph><subparagraph id="H332E01BF833F4711805BC4668B13EC36"><enum>(E)</enum><header>Technical
assistance</header><text>The Coordinator shall provide technical assistance to
foreign countries to help build their capacities to strengthen family
preservation, reunification, and permanent parental care policies, services,
and practices, including—</text>
<clause id="HA3262202FDEC46CB92AAD84B00578162"><enum>(i)</enum><text>assistance with
the drafting, disseminating, and implementing of legislation for family
preservation and reunification and the provision of permanent parental
care;</text>
</clause><clause id="HDE06ACD4CAFB466ABC724F111E73D72F"><enum>(ii)</enum><text>assistance with
the development of systems designed to support family preservation,
reunification and permanent parental care for institutionalized orphans;</text>
</clause><clause id="H82599FCEF62D4A70B8F4C6E86800FA21"><enum>(iii)</enum><text>assistance with
the establishment of public, private, and faith- and community-based
partnerships designed to support the preservation and reunification of families
and permanent parental care for orphans;</text>
</clause><clause id="H90A2E96BDD1947C2AF92A467AB7C363F"><enum>(iv)</enum><text>assistance with
the development of workforce training for governmental and nongovernmental
staff working to support the preservation and reunification of families and
permanent parental care for orphans; and</text>
</clause><clause id="H9512BED6F5B34E48B21FDB77C6D6B04E"><enum>(v)</enum><text>assistance with
infrastructure development and data collection techniques necessary to—</text>
<subclause id="H2EE754CBDF90459B87ACC3D79F1937DE"><enum>(I)</enum><text>support the
biennial census required under paragraph (6)(A);</text>
</subclause><subclause id="H96FE099D985642C4BFE6136C7055C1C5"><enum>(II)</enum><text>collect
permanency indicators described in paragraph (6)(B);</text>
</subclause><subclause id="HDB0833AEC9F344BC969E5BE14B005F91"><enum>(III)</enum><text>collect the data
necessary to determine to what extent countries meet the minimum standards
described in section 103; and</text>
</subclause><subclause id="HF83E382BA6204375ABD8507815D6886C"><enum>(IV)</enum><text>organizing
exchanges for child welfare, adoption, and other social service professionals
working to support the preservation and reunification of families and permanent
parental care for orphans.</text>
</subclause></clause></subparagraph><subparagraph id="H45396034198E43169DB00040094DA1A5"><enum>(F)</enum><header>Preservation of
the family and permanent parental care conference</header><text>In fiscal year
2011, and every 2 years thereafter, the Secretary of State—</text>
<clause id="H4D0756CBF57F4D34BD27B642DBDAAA62"><enum>(i)</enum><text>shall conduct a
conference on best practices and successful strategies for the preservation and
reunification of families and the provision of permanent parental care for
orphans;</text>
</clause><clause id="H9AFE71B16E244BC8BBBEBAA9B6D85C2B"><enum>(ii)</enum><text>share and address
key issues relative to—</text>
<subclause id="H63870010A58E4E2A9486A3CB11EDFE00"><enum>(I)</enum><text>the most current
biennial census data collected under paragraph (6)(A);</text>
</subclause><subclause id="H90C506A1A9FC4DF19FF6D4B56C23863"><enum>(II)</enum><text>the permanency
indicator data collected under paragraph (6)(B); and</text>
</subclause><subclause id="HC523390122D944D497C4001EA5D92268"><enum>(III)</enum><text>the data
collected from the Global Best Practices Pilot Program under section
104(c);</text>
</subclause></clause><clause id="H7AAAE3166EB74775B27E8D09C7E786F7"><enum>(iii)</enum><text>disseminate
information regarding best practices for building country and regional capacity
to decrease the number of orphans;</text>
</clause><clause id="H9C683E4ECCD040CD89D497663354EB13"><enum>(iv)</enum><text>disseminate
information regarding strategies for financially sustaining activities to
support family preservation and reunification and permanent parental
care;</text>
</clause><clause id="H2DB5CE77270B483490D009FC0ADB055"><enum>(v)</enum><text>disseminate
information regarding best practices in international adoption and in
preventing corruption; and</text>
</clause><clause id="HB0509EE9C8D9430DA20607A9153C8005"><enum>(vi)</enum><text>disseminate best
methods and practices for assessing progress and quality for moving children
into permanent parental care in a safe and timely way.</text>
</clause></subparagraph></paragraph><paragraph id="H9A39B10566F74EEE96A60F5A076092E"><enum>(4)</enum><header>Coordination</header>
<subparagraph id="H47ECD21068A34505AB2CE953D3C84B3D"><enum>(A)</enum><header>In
general</header><text>The Office shall coordinate the foreign policy and
assistance of the United States in support of—</text>
<clause id="H61295024186A48DF965BAF18FC1FE006"><enum>(i)</enum><text>families at risk
of dissolution; and</text>
</clause><clause id="H7E49CEA061724780AC3EF294FCB92CDC"><enum>(ii)</enum><text>orphans in need
of permanent parental care.</text>
</clause></subparagraph><subparagraph id="HF79CA02C502A46E49FCBA4E32D92C51D"><enum>(B)</enum><header>Coordination
between domestic and international policy</header><text>To the extent possible,
the Coordinator shall work with the Secretary of Health and Human Services to
maintain consistency between United States foreign and domestic policy on
family preservation and reunification and permanent parental care.</text>
</subparagraph></paragraph><paragraph id="H9D856F38E48E42A982BFE35236D9A0AC"><enum>(5)</enum><header>Communication</header>
<subparagraph id="H5F76D22640F04D31AB3999626B6D1342"><enum>(A)</enum><header>In
general</header><text>The Office shall build global awareness of its purpose
and activities.</text>
</subparagraph><subparagraph id="H2AF34C71C2B845D7A9DAD246ED7FFD5"><enum>(B)</enum><header>Website</header><text>To
carry out subparagraph (A), the Office shall maintain a Website that
includes—</text>
<clause id="HFB9A75F22C5E461A926CE71D16DA7726"><enum>(i)</enum><text>a
description of the global problems related to orphans and children in
institutional and temporary non-family care;</text>
</clause><clause id="HC2CABBAA84554E1181BFD65FDE34248E"><enum>(ii)</enum><text>the
status of activities being carried out by the Office;</text>
</clause><clause id="HEF54D35157694AACA2D7321D529DCB02"><enum>(iii)</enum><text>the progress
made by the Office to achieve its goals;</text>
</clause><clause id="HE7F148B36C764265A5EDFA6FC06D4CFE"><enum>(iv)</enum><text>current research,
reports, policy, training opportunities, evaluation, and methodology describing
best practices;</text>
</clause><clause id="H545039F47995416381B420FF0031A1B2"><enum>(v)</enum><text>information
collected by the biennial census under paragraph (6)(A);</text>
</clause><clause id="H69BCFEE0AD9A4FFA808C29C53169A19C"><enum>(vi)</enum><text>permanency
indicators collected under paragraph (6)(B);</text>
</clause><clause id="HC8CD95D65B6440D88BD2C79934FDABAC"><enum>(vii)</enum><text>the annual
report submitted to Congress under paragraph (6)(C);</text>
</clause><clause id="H348F840D8C584A0E9297DA48B2870400"><enum>(viii)</enum><text>the status of
site results for the study of global best practices conducted under section
104(c)(1);</text>
</clause><clause id="HA3EEEC1CF0FE4371A8AA4CEF2735CBF"><enum>(ix)</enum><text>requests for
proposals, grant or contract awards, amounts, purposes, and lessons learned
during implementation; and</text>
</clause><clause id="H8B7604A9976740FDB9CDCDA83F23841E"><enum>(x)</enum><text>a
summary of the scope and progress of country projects funded by the
Office.</text>
</clause></subparagraph></paragraph><paragraph id="H7645046EC4BA470FB9F2927C58C6A747"><enum>(6)</enum><header>Reports,
research, and assessments</header>
<subparagraph id="HF2105222C70D434F81A0B2A46BAABB10"><enum>(A)</enum><header>Biennial census
of children without permanent parental care</header>
<clause id="H4EB2D91F50AC4E799C42F1025EFEEC15"><enum>(i)</enum><header>In
general</header><text>Not later than December 31, 2010, and every 2 years
thereafter, the Office shall develop, oversee, support, and publish the results
of a census of all children who live outside permanent parental care. The
census shall enumerate the number of children, categorized by sex and age, who
reside—</text>
<subclause id="H7B4E391E88CA4C32B4FFCE3D0066E6E8"><enum>(I)</enum><text>in a public or
private orphanage;</text>
</subclause><subclause id="H7F064FF77C224B56B5DB83FAF3DCE98F"><enum>(II)</enum><text>in a hospital or
other medical institution or treatment facility;</text>
</subclause><subclause id="H89232A3B78E5451ABCFD3E7985518021"><enum>(III)</enum><text>in temporary or
long-term family-based foster care;</text>
</subclause><subclause id="H0E83A2E99E744E8C8432C5B4DC718E9F"><enum>(IV)</enum><text>in a group
home;</text>
</subclause><subclause id="H4D1567B43D954A57892B2E93E3464E1C"><enum>(V)</enum><text>in a residential
or congregational facility, regardless of the availability of treatment
services;</text>
</subclause><subclause id="HD651A6BB332F42D0A4BCDC4BC1AA8342"><enum>(VI)</enum><text>in kinship care
without legal status or the presence of adult family members; or</text>
</subclause><subclause id="HDE3CF1C316A54D1FB1BB81E4F6F9E0B5"><enum>(VII)</enum><text>in a dormitory
or other permanent or temporary living situation in which a government or
nongovernmental organization places children who do not have parental
care.</text>
</subclause></clause><clause id="H5914382F952042B7A1C1D64EE5E635EB"><enum>(ii)</enum><header>Census
countries</header><text>The data collected under clause (i) shall include all
member countries of the United Nations.</text>
</clause><clause id="H0F6A7C48909242BC911B8CEAA731500"><enum>(iii)</enum><header>Delegate</header><text>The
Coordinator may delegate the responsibility for conducting the census to a
third party if—</text>
<subclause id="H48BB274D3CB54F47A1CC355DB64077A5"><enum>(I)</enum><text>such party has
expertise in human or social services and international quantitative data
collection and analysis; and</text>
</subclause><subclause id="HA791B88685AD4C9500A7DEE7AE21DE94"><enum>(II)</enum><text>such a delegation
is consistent with the overall goals of this Act.</text>
</subclause></clause></subparagraph><subparagraph id="H5AB4B05752D04F358E4256FA4CC14027"><enum>(B)</enum><header>Permanency
indicators for children without permanent parental care</header>
<clause id="HC939825FD02447B3B58ED277FFDD00DF"><enum>(i)</enum><header>In
general</header><text>The Office shall collect available data related to a
series of policy and practice indicators on the capacity of foreign governments
to offer permanency as an option for orphaned children.</text>
</clause><clause id="HE6A9AC4C391B48039D615C64D1EB8F1"><enum>(ii)</enum><header>Data</header><text>Data
collected under clause (i) shall include—</text>
<subclause id="HA0D7C7BBAB32493685B8C4A2F3462D78"><enum>(I)</enum><text>the number of
families provided preservation services and the number of such families that
remained intact after receiving such services;</text>
</subclause><subclause id="H53881C00EB4743EF98829669AA56B95C"><enum>(II)</enum><text>the number of
children in institutions who were reunified with their respective
families;</text>
</subclause><subclause id="HA4E3C56A046B4C178861ADF5672C9925"><enum>(III)</enum><text>the number of
children placed in a permanent family through domestic adoption and the living
situation of such children before such permanent placement;</text>
</subclause><subclause id="HDF597EBDC66F49E79F7B2F311C4FB08F"><enum>(IV)</enum><text>the number of
children who were placed in a permanent family through legal guardianship and
their living situation before such permanent placement;</text>
</subclause><subclause id="HA82AFF4D192441D8A2E4F396B390AF4"><enum>(V)</enum><text>the number of
children who were placed in a permanent family through international adoption
and the living situation of such children before such permanent
placement;</text>
</subclause><subclause id="HC517EADCE2BD4194A21BEF4B33B02FE9"><enum>(VI)</enum><text>the number of
children who were placed in legal or informal kinship care and their placement
pre-kinship care;</text>
</subclause><subclause id="H1740FAFF9C5B488ABA8E247072F5019B"><enum>(VII)</enum><text>the number of
children who moved from temporary foster care to long-term foster care;</text>
</subclause><subclause id="H74749DA6D7EE4EC4BD7E3200F0AD5FEF"><enum>(VIII)</enum><text>the number of
children who re-entered institutional care after moving into permanent parental
care; and</text>
</subclause><subclause id="HAE6FC880B6CD4D2C9DCACA87BA732FF5"><enum>(IX)</enum><text>the length of
time children are spending in institutional or foster care.</text>
</subclause></clause><clause id="H170E2A4326654818905D59F45325727E"><enum>(iii)</enum><header>Delegate</header><text>The
Coordinator may delegate the responsibility for collecting data on permanency
indicators under this paragraph to a third party if—</text>
<subclause id="H075390F3332C41E889B8A87FE1CF6EFF"><enum>(I)</enum><text>the third party
has expertise in human or social services and international quantitative data
collection; and</text>
</subclause><subclause id="H0F33E1A0D5EF419400BD1338A658964D"><enum>(II)</enum><text>such a delegation
is consistent with the overall goals of this Act.</text>
</subclause></clause><clause id="HFD4641E9C951414A9C5792201E5CD59F"><enum>(iv)</enum><header>Consultation</header><text>The
Coordinator may consult with the Millennium Challenge Corporation, the
Department of Homeland Security, the United States Agency for International
Development, the United Nations, the United States Department of Health and
Human Services, UNICEF, the World Health Organization, and other aid- or child
welfare-related networks and organizations to—</text>
<subclause id="H0BFD33CF24E541A8854D009BE5313697"><enum>(I)</enum><text>identify and
expand existing reporting networks; and</text>
</subclause><subclause id="H8C2C1BBC20AD40C48C62DA2FC4DB6FB5"><enum>(II)</enum><text>refine common
definitions of indicators.</text>
</subclause></clause><clause id="H45AA0D32BCA140D7BCCAD5C4CD6E9FE3"><enum>(v)</enum><header>United States
indicators</header><text>The Secretary of Health and Human Services shall
provide the Coordinator with the information required to be collected under
this paragraph relating to individuals and families residing in the United
States.</text>
</clause><clause id="HB65A362E8AB64B71B54D3E149E48C419"><enum>(vi)</enum><header>Report</header><text>Not
later than December 31, 2011, and every 2 years thereafter, the Office shall
publish a report that includes the data described in clause (ii).</text>
</clause></subparagraph><subparagraph id="H53DE700AFBE34DEBB0D6D3F31C55398B"><enum>(C)</enum><header>Annual report to
congress</header><text>Not later than September 1 of each year, the Secretary
of State shall submit to Congress an annual report that includes—</text>
<clause id="H875A9C94DEAF49BEAF557FDF70B63613"><enum>(i)</enum><text>a
description of the global status of orphans;</text>
</clause><clause id="HC910DFAAE81F443982719F4DFEB2BE3F"><enum>(ii)</enum><text>a
description of the activities of the Office in support of family preservation
and reunification and permanent parental care for orphans;</text>
</clause><clause id="HC44E57ACEACB43F4B2602C16EEB0DC53"><enum>(iii)</enum><text>estimates from
the most recent biennial census of the number of children living without
permanent parental care;</text>
</clause><clause id="H3F5A3F95EC044F7C83FD28892DBF8362"><enum>(iv)</enum><text>a
description of the status of family preservation, reunification, and permanent
parental care initiatives underway in each foreign country receiving financial
assistance under this Act;</text>
</clause><clause id="H7BEF05D016B54920BFE7C7EB37B17549"><enum>(v)</enum><text>a
description of—</text>
<subclause id="H8A4B41EC7BEE4246A9CB9BF3351ED82C"><enum>(I)</enum><text>the major
challenges faced by governments that are resulting in an increase in the
numbers of orphans; and</text>
</subclause><subclause id="H08C98106A06A46079EEE1D963D670430"><enum>(II)</enum><text>barriers which
are preventing governments from achieving permanent parental care for
orphans;</text>
</subclause></clause><clause id="H76E20EB449244737A0C1640230B081F9"><enum>(vi)</enum><text>trends in
increasing or decreasing risks for orphans and families at risk of
dissolution;</text>
</clause><clause id="H7104A1C238194E4785E0045045D5C6F8"><enum>(vii)</enum><text>a
listing of the governments that do not meet minimum standards described in
section 103(a);</text>
</clause><clause id="H1A5F7217DF05407BA0B6FC144FDDD2BA"><enum>(viii)</enum><text>trends toward
improvement in family preservation and reunification;</text>
</clause><clause id="H9D2C1A11766A41EFA73CF6683F10C263"><enum>(ix)</enum><text>trends in
domestic and international adoption, foster care, and institutional
care;</text>
</clause><clause id="H9C8DDC6EE46F42E795A7BDCF639C549"><enum>(x)</enum><text>the
most current permanency indicators described in subparagraph (B); and</text>
</clause><clause id="H272A7760C40F4DA38D2F73F0A5A34CBA"><enum>(xi)</enum><text>movement toward
implementation of permanency related laws and conventions.</text>
</clause></subparagraph></paragraph><paragraph id="H83B2678645194C54B3356340BAE473A0"><enum>(7)</enum><header>Grants</header><text>The
Office shall oversee the provision of technical and financial assistance,
including grants, pilot programs, and demonstrations, to governments and
nongovernmental organizations to promote family preservation, reunification,
and permanent parental care for orphans.</text>
</paragraph></subsection></section><section id="HBB06A2CF6A8C4366AEFC14B411003C7B"><enum>102.</enum><header>Policy
coordinating committee in support of orphan policy, diplomacy, and
development</header>
<subsection id="H2385FC2A1BEB47B1A87C5433DACED700"><enum>(a)</enum><header>Establishment</header><text>The
President shall establish an interagency policy coordinating committee
(referred to in this section as the <quote>Policy Coordinating
Committee</quote>), which shall monitor and support international efforts in
family preservation, family reunification, and permanent parental care for
orphans.</text>
</subsection><subsection id="HE6646530D6BE49FDA711A5902053938B"><enum>(b)</enum><header>Appointment</header><text>The
President shall appoint the members of the Policy Coordinating Committee, which
shall include—</text>
<paragraph id="H92B357C0A502497488029C1102A6285B"><enum>(1)</enum><text>the Secretary of
State, who shall serve as Chair;</text>
</paragraph><paragraph id="H79C60FCA32B846239664815F16B4EEFE"><enum>(2)</enum><text>the Administrator
of the United States Agency for International Development;</text>
</paragraph><paragraph id="HC692FF3B38704B92A5A3DA4F35D6A375"><enum>(3)</enum><text>the Attorney
General;</text>
</paragraph><paragraph id="H5218298F49D84FEEA16835BADD64EF82"><enum>(4)</enum><text>the Secretary of
Health and Human Services;</text>
</paragraph><paragraph id="HF7316E1E9D6541CD81C5581DF4832499"><enum>(5)</enum><text>the Secretary of
Homeland Security; and</text>
</paragraph><paragraph id="H84ED6438E08B45B5B48743007ED0C7C"><enum>(6)</enum><text>any other
Government official appointed by the President.</text>
</paragraph></subsection><subsection id="HC16D2A302F59409E803BB042CF94418"><enum>(c)</enum><header>Activities of
committee</header><text>The Policy Coordinating Committee shall provide advice
to the Office for Orphan Policy Diplomacy and Development regarding—</text>
<paragraph id="H88B162899461409100AEB700DA64FF00"><enum>(1)</enum><text>the development of
a comprehensive global strategy in accordance with the minimum standards of
this Act;</text>
</paragraph><paragraph id="HC10610AD03054AF8A79F755F38617459"><enum>(2)</enum><text>financial support
of programs that assist countries in developing child welfare systems
that—</text>
<subparagraph id="H304D7B8F2AC545D6AFDB382BFE76FE08"><enum>(A)</enum><text>preserve and
reunify families; and</text>
</subparagraph><subparagraph id="H3542E45620AF4F7A970600228557EA1C"><enum>(B)</enum><text>provide permanent
parental care for orphans.</text>
</subparagraph></paragraph><paragraph id="H2EFEC4677C474B858539F3C199F8DA73"><enum>(3)</enum><text>advocacy efforts
with governments, nongovernmental organizations, and other entities to advance
the purposes of this Act; and</text>
</paragraph><paragraph id="HA398065666734F0681A24EEF85AA59C3"><enum>(4)</enum><text>the collection of
data through significant research on family preservation, reunification, and
permanent parental care methods for orphans.</text>
</paragraph></subsection><subsection id="H2B9485A6EF2E4B3DB57DEA3F125B1260"><enum>(d)</enum><header>Working
groups</header><text>Members of the Policy Coordinating Committee may create
small working groups within their respective agencies to support and advise
their work on behalf of the Policy Coordinating Committee.</text>
</subsection></section><section id="H8ACFFECDD9F0420FA1B74980CA6A530"><enum>103.</enum><header>Minimum
standards for the provision of permanent parental care</header>
<subsection id="HF7497A72BCC8424AB4DB28E42866DA75"><enum>(a)</enum><header>Minimum
standards</header><text>A country meets the minimum standards for the provision
of permanent parental care by a partner country if—</text>
<paragraph id="HA6140A30069F45369BE243702EBD67D9"><enum>(1)</enum><text>the government of
the country has laws, practices and judicial standards that—</text>
<subparagraph id="HE6FC8E2F63594A8E85C811EC7E79FFCD"><enum>(A)</enum><text>protect children
from abuse and neglect;</text>
</subparagraph><subparagraph id="H3CE05DD6F98346AF84084E1C359E5E26"><enum>(B)</enum><text>are aimed at
reducing the number of abandoned children;</text>
</subparagraph><subparagraph id="H7EFFCDEBDF664DB4A3291978A49926A0"><enum>(C)</enum><text>are aimed at
preserving families at risk of dissolution;</text>
</subparagraph><subparagraph id="H1718F2087FE5408DB7131DABDD3195B6"><enum>(D)</enum><text>are aimed at
safely and appropriately reunifying orphans and institutionalized children with
their families;</text>
</subparagraph><subparagraph id="HC0D95899D0F2406CA573BF776C257200"><enum>(E)</enum><text>promote legal
guardianship and kinship care;</text>
</subparagraph><subparagraph id="H5243AAD9BD5B4E098D8820A7F2CC6000"><enum>(F)</enum><text>promote domestic
adoption;</text>
</subparagraph><subparagraph id="HA5FA77BCD87D4A8EA773D3E778F744EB"><enum>(G)</enum><text>allow for
international adoption; and</text>
</subparagraph><subparagraph id="H937FA7F9A6B7437F86D5E987B270D83C"><enum>(H)</enum><text>promote the
physical and emotional well-being and protection of children while they are
waiting for reunification or placement with a permanent family;</text>
</subparagraph></paragraph><paragraph id="H01BD8AA3248D4BDD8F980271D3E675C3"><enum>(2)</enum><text>the government of
the country is—</text>
<subparagraph id="H002A0FF418174C3A9F3134A9006B57B2"><enum>(A)</enum><text>keeping a
significant percentage of families at risk of dissolution intact;</text>
</subparagraph><subparagraph id="H30D6090C32A440739FB649ED4CD2928E"><enum>(B)</enum><text>reuniting a
significant percentage of orphans and institutionalized children with safe
families and relatives; and</text>
</subparagraph><subparagraph id="H28236AD2C9DF43A1941DE14F183CE231"><enum>(C)</enum><text>moving a
significant percentage of orphans into permanent parental care when it is
determined that they cannot be reunified; and</text>
</subparagraph></paragraph><paragraph id="H136ED6E86DC74A09850592B9C96428A2"><enum>(3)</enum><text>the numbers of
children aging out of institutions or foster care in such country is decreasing
by a significant percentage each year.</text>
</paragraph></subsection><subsection id="H73FA0ACAC1BE458B845F3545EDC818E3"><enum>(b)</enum><header>Criteria</header><text>A
country is eligible for assistance from the Office for Orphan Policy Diplomacy
and Development under this Act if the government of the country—</text>
<paragraph id="HB905F4D6F9B64C558B8DFD255100D92D"><enum>(1)</enum><text>publicly
acknowledges the need for family preservation, reunification and permanent
parental care for orphans; and</text>
</paragraph><paragraph id="HFC3F5B70DAE44DA29213075DE7F0F6AB"><enum>(2)</enum><text>demonstrates a
commitment to develop improved laws, policies, infrastructures, and training
programs to preserve and reunify with safe families and provide permanent
parental care for orphans by—</text>
<subparagraph id="HBE0CE47874024DC69EFA16A1EDEA208C"><enum>(A)</enum><text>developing formal
strategic plans to develop laws and infrastructure to address shortcomings
related to meeting the minimum standards described in subsection (a);</text>
</subparagraph><subparagraph id="H5141E1CD5978460DA93F199FF084F279"><enum>(B)</enum><text>allocating
resources to study the issues described in subparagraph (A); or</text>
</subparagraph><subparagraph id="H528D8FDB3A724347A6AEE0DA3003671"><enum>(C)</enum><text>expending or
setting aside sufficient funds, to help build child welfare and judicial
infrastructure and enact laws to address shortcomings related to meeting such
minimum standards.</text>
</subparagraph></paragraph></subsection></section><section id="HCCE2BF65AE394684AEF4A0C408D32930"><enum>104.</enum><header>Grant, pilot,
and development programs</header>
<subsection id="H3008C66E764C4002818B23A127ED006C"><enum>(a)</enum><header>Assistance to
foreign governments</header><text>Chapter 1 of part I of the Foreign Assistance
Act of 1961 (22 U.S.C. 2151 et seq.) is amended—</text>
<paragraph commented="no" id="HA10574E6CB3D4C2D8B94949C25C4FEE4"><enum>(1)</enum><text>by redesignating
section 135, as added by section 5(a) of Public Law 109–121, as section 137;
and</text>
</paragraph><paragraph commented="no" id="H72C26CF0FC4D4DE2A825DE48E849DD23"><enum>(2)</enum><text>by inserting after
section 135, as added by section 3 of Public Law 109–95, the following:</text>

meet minimum standards</header><text display-inline="yes-display-inline">The
President is authorized to provide assistance to foreign countries directly, or
through nongovernmental and multilateral organizations, for programs, projects,
and activities designed to assist the country to meet the minimum standards
described in section 103(a) of the Families for Orphans Act of 2009.</text>
</subsection><subsection commented="no" id="H5FADF1D87063461DA8337B27F2B43BE7"><enum>(b)</enum><header>Assistance to
foreign governments that meet minimum standards</header>
<paragraph commented="no" id="H83F2936EAC2545BBAFE410ACA046AFE3"><enum>(1)</enum><header>In
general</header><text>The President is authorized to provide assistance,
including trade and debt relief, to any foreign country that demonstrates
success in meeting the majority of the minimum standards and other goals
described in paragraph (2).</text>
</paragraph><paragraph commented="no" id="HC653018813C741AC853C210424D76608"><enum>(2)</enum><header>Plan</header><text>The
government of a country desiring assistance under this subsection shall
demonstrate a commitment to meeting the minimum standards described in section
103(a) of the Families for Orphans Act of 2009 by independently, or with
assistance from the Office for Orphan Policy Diplomacy and Development,
developing—</text>
<subparagraph commented="no" id="H5CFD1C86F9C449B38607A200447C14CD"><enum>(A)</enum><text>a detailed,
long-term strategic plan for meeting such minimum standards and related
long-range goals; and</text>
</subparagraph><subparagraph commented="no" id="H8A16E9C6CE884476A54195E750FDE992"><enum>(B)</enum><text>a 1-year or 2-year
operational plan that describes the immediate steps that the foreign government
will take toward meeting such minimum
standards.</text>
</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
</paragraph></subsection><subsection id="H88DEE655DE684BCB88B7B1C53077BB3"><enum>(b)</enum><header>Assistance in
support of family preservation, reunification and permanent parental care for
orphans</header>
<paragraph id="H434B38972C244CB09725544D00FDF69"><enum>(1)</enum><header>In
general</header><text>The Secretary of State is authorized to make grants to
nongovernmental agencies working to promote permanent parental care for
orphans, in accordance with the results of the global best practices study
conducted under subsection (c).</text>
</paragraph><paragraph id="H108D8A83D3634488005C6600798BEB42"><enum>(2)</enum><header>Use of
funds</header><text>Grants received under this subsection can be used
to—</text>
<subparagraph id="H6A1BAEA3B87A4569ABA033B6A45BE6EE"><enum>(A)</enum><text>improve public
policy in support of the preservation and reunification of families and
permanent parental care for orphans;</text>
</subparagraph><subparagraph id="H347D8DB4622E45F6B444C8EF6EED3B"><enum>(B)</enum><text>reduce the number of
children abandoned;</text>
</subparagraph><subparagraph id="H7D1896ACB71B41970004CEC1CC9CA82"><enum>(C)</enum><text>reduce the number
of families at risk of dissolution;</text>
</subparagraph><subparagraph id="H43859FABE6F244E68DB39BE93F2B941E"><enum>(D)</enum><text>increase the
number of children reunified with their parents;</text>
</subparagraph><subparagraph id="HD0BC74F3864B4F0CAE0755E78989AF6B"><enum>(E)</enum><text>increase the
number of children obtaining legal guardianship and kinship care;</text>
</subparagraph><subparagraph id="H5117E8C7A8F04A74A1D9B40044275364"><enum>(F)</enum><text>increase the
number of children placed for adoption domestically;</text>
</subparagraph><subparagraph id="H7E62BD1175AD4D01B59686713871562B"><enum>(G)</enum><text>support
international adoption for children who cannot be adopted domestically, or
reunified with their biological parents;</text>
</subparagraph><subparagraph id="HAB9ECAC8DF744CB585718F00ED8DC003"><enum>(H)</enum><text>draft laws and
develop systems designed to promote ethical, evidence-based practice in
international adoption;</text>
</subparagraph><subparagraph id="H1A1C0CE6641A49FC8C0073BA87634400"><enum>(I)</enum><text>increase the level
of expertise and understanding of foreign governments working to preserve and
reunify families and promote permanent parental care for orphans;</text>
</subparagraph><subparagraph id="HB1808DB7BC7D4AF18FD2E11CD400274F"><enum>(J)</enum><text>create and support
connections with caring, committed adults to older children at risk of or in
the process of aging out of institutional care;</text>
</subparagraph><subparagraph id="HB44F8540EA13455997E2F65CAA371F35"><enum>(K)</enum><text>develop mentoring,
visitation and foster adopt programs aimed at recruiting a larger number of
individuals willing to provide permanent parental care for orphans;</text>
</subparagraph><subparagraph id="H209F15BD68FC4B1BA23E3D9C355FF92C"><enum>(L)</enum><text>increase adoption
support services; and</text>
</subparagraph><subparagraph id="H1E175716A88A46C687C736BE04EE3DF6"><enum>(M)</enum><text>create and improve
child welfare and judicial infrastructures, that strengthen and support
permanent family care for orphans.</text>
</subparagraph></paragraph><paragraph id="HF720F7727D114FBEABFA84A00B16E69"><enum>(3)</enum><header>Eligibility
criteria</header><text>To the extent possible, grants shall be awarded under
this subsection to organizations that have demonstrated—</text>
<subparagraph id="H504379FBDED34A4C804BC755D1402868"><enum>(A)</enum><text>experience in the
area of child welfare and judicial policy, family preservation, reunification,
permanent parental care for orphans;</text>
</subparagraph><subparagraph id="HEF6E0A6211D3444CB530E726F4316B33"><enum>(B)</enum><text>success in working
with the in-country governmental agencies responsible for care of children;
and</text>
</subparagraph><subparagraph id="HEBFCDA61B4024798AFF6D7E825FE00F1"><enum>(C)</enum><text>adherence to the
child welfare laws of the foreign government in which such organizations are
located.</text>
</subparagraph></paragraph></subsection><subsection id="H4D9EFA0BD78145B19202416C748075D3"><enum>(c)</enum><header>Global best
practices</header>
<paragraph id="H5B45DD7941FD47AE98626FBC007B87A2"><enum>(1)</enum><header>Study on global
best practices</header>
<subparagraph id="HABA2E222A65E4A89AA0100F69D005CAB"><enum>(A)</enum><header>In
general</header><text>Not later than 90 days after the date of the enactment of
this Act, the Secretary of State shall initiate a study to identify global best
practices for—</text>
<clause id="H96DC8D3455154509A5E310E8F620B575"><enum>(i)</enum><text>preserving and
reunifying families; and</text>
</clause><clause id="H0AEFC932372A4C6CAFBD00274C379853"><enum>(ii)</enum><text>providing
permanent parental care for orphans.</text>
</clause></subparagraph><subparagraph id="H3AFF3E7981044A67961F43FB122E68AA"><enum>(B)</enum><header>Identification
of factors</header><text>In conducting the study under subparagraph (A), the
Secretary shall identify—</text>
<clause id="H74ECDC65B6C94EC2926300FAE13C6821"><enum>(i)</enum><text>evidence-based
programs that are demonstrated to provide permanent parental care in a timely
manner;</text>
</clause><clause id="H1C80221E19B041168899C37B783B88FC"><enum>(ii)</enum><text>policy and
practices that result in increased deinstitutionalization of children;</text>
</clause><clause id="H74A6489ACC2B4C92BB67734947BA3951"><enum>(iii)</enum><text>legislation
globally that requires and supports permanent parental care;</text>
</clause><clause id="H677AC49FDECC4B25B2297985C87704B4"><enum>(iv)</enum><text>factors that
decrease the dissolution of families; and</text>
</clause><clause id="HC82F116642334E6D94C437D177A71DB"><enum>(v)</enum><text>best
practices for promoting ethical international adoption practices.</text>
</clause></subparagraph><subparagraph id="H5A784ECE49CD498C885E4445583D5D56"><enum>(C)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after initiating the
study under this paragraph, the Secretary shall publish a report on the best
practices identified in the study.</text>
</subparagraph><subparagraph id="H045091397F2649F28CD9DA3266CBA60"><enum>(D)</enum><header>Use of study
results</header><text>The Secretary shall use the results of the study
conducted under this paragraph to guide and inform—</text>
<clause id="HA7D44983134B4FA2A55CA823F074795E"><enum>(i)</enum><text>the
award of all grants under this Act; and</text>
</clause><clause id="H52B5350FBF16495AA29E21C402CB577D"><enum>(ii)</enum><text>all
activities in the global best practices pilot program carried out under
paragraph (2).</text>
</clause></subparagraph></paragraph><paragraph id="HD8F8FC2EADF140B2A1CBCC49ECD803F7"><enum>(2)</enum><header>Global best
practices pilot program</header>
<subparagraph id="HDB9865F211444C28B92EEAB5FB22B869"><enum>(A)</enum><header>In
general</header><text>Upon completing the study described in paragraph (1), the
Secretary of State shall establish and carry out a global best practices pilot
program.</text>
</subparagraph><subparagraph id="H95E7F5907CEA43E1864741C43C476833"><enum>(B)</enum><header>Purposes</header><text>The
purposes of the program established pursuant to subparagraph (A) shall be
to—</text>
<clause id="H01B9F3CF89B849408B498FA34354F2A9"><enum>(i)</enum><text>demonstrate how
research-based policies and programs to provide orphans with permanent parental
care can be successfully implemented;</text>
</clause><clause id="HF71D5A4EBE304C3889031C1713F8C3DE"><enum>(ii)</enum><text>establish model
programs that, once tested for effectiveness, will be available, replicable,
and adaptable on a global basis;</text>
</clause><clause id="HA36D35BF07C6430896BCBB00A36DAB9F"><enum>(iii)</enum><text>identify a
comprehensive series of interventions, which result in family preservation,
reunification, and permanent parental care for orphans; and</text>
</clause><clause id="HB8B11FABA30948A68ED7C452326F31A4"><enum>(iv)</enum><text>determine which
in-country factors enhance or negate efforts to achieve family preservation,
reunification and permanent parental care for orphans.</text>
</clause></subparagraph><subparagraph id="H5D7D300AC0B2457AAAE239B509568367"><enum>(C)</enum><header>Selection of
sites</header>
<clause id="H6D78B2340C7C47C299AB6EB0C4921213"><enum>(i)</enum><header>Number of
sites</header><text>In carrying out the pilot program established under this
paragraph, the Secretary of State shall select and establish not fewer than 5
sites, each of which shall be located in a different region of the
world.</text>
</clause><clause id="H6E56C70EB7EC44099213A8F56ED03799"><enum>(ii)</enum><header>Priorities</header><text>In
selecting sites under clause (i), the Secretary shall consider—</text>
<subclause id="H612F358AF96D4426A5909F003B4F67CD"><enum>(I)</enum><text>cultural,
geographic, and economic diversity of countries included in the region;</text>
</subclause><subclause id="H6082864E9BDB445C8E004559945C3B48"><enum>(II)</enum><text>whether
governments within the region have sufficient infrastructure and capacity to
support the pilot program; and</text>
</subclause><subclause id="H2D190DFC1E884E92AB65441E24D7DABA"><enum>(III)</enum><text>the incidence of
abandoned children and children in institutional care in the region and
culture.</text>
</subclause></clause><clause id="HEDF55D4E724B4558A987607264AE35B"><enum>(iii)</enum><header>Delegation</header><text>The
Coordinator for Orphan Policy Diplomacy and Development may delegate
implementation of the pilot program under this paragraph to 1 or more
organizations that have experience in the use of evidence-based programs to
promote family preservation, reunification or permanent parental care for
orphans.</text>
</clause><clause id="HCEA255D25134407782C9FC23441BF674"><enum>(iv)</enum><header>Annual
report</header><text>Not later than 1 year after the date on which the first
pilot program is established under this paragraph, and each subsequent year,
the Coordinator shall publish a report on the status of, and lessons learned
in, the pilot program.</text>
</clause></subparagraph></paragraph></subsection></section><section id="H7217A6A7A77A48E1B3CA87CB127CFFBD"><enum>105.</enum><header>Authorization
of appropriations</header>
<paragraph id="HCCC38F104C8D438E8FD680041709902E"><enum>(1)</enum><header>Operations</header><text>There
are authorized to be appropriated for the administrative costs associated with
carrying out the duties of the Office for Orphan Policy Diplomacy and
Development—</text>
<subparagraph id="HF8409200B59C4B21A3001B73548DFC4D"><enum>(A)</enum><text>$3,000,000 for
fiscal year 2010; and</text>
</subparagraph><subparagraph id="H27CE5C0D6B9B4CA2A35F732812225BB5"><enum>(B)</enum><text>such sums as may
be necessary for each subsequent fiscal year.</text>
</subparagraph></paragraph><paragraph id="H72775341A49D4E27A959636684B6B7AF"><enum>(2)</enum><header>Assistance to
foreign governments</header><text>There are authorized to be appropriated for
assistance to foreign governments under section 136 of the Foreign Assistance
Act of 1961—</text>
<subparagraph id="HE3DA6347399143750096FBE0865EE2C5"><enum>(A)</enum><text>$5,000,000 for
fiscal year 2010; and</text>
</subparagraph><subparagraph id="HB9CFFD57ABDD4902A130701624B43BB0"><enum>(B)</enum><text>such sums as may
be necessary for each subsequent fiscal year.</text>
</subparagraph></paragraph><paragraph id="H97822E6A05874BBAA965BB88BB30395C"><enum>(3)</enum><header>Grants to
support permanent parental care</header><text>There is authorized to be
appropriated for grants under section 104(b)—</text>
<subparagraph id="HA6AFC271816A4BD69F7526F5B8C7C7DE"><enum>(A)</enum><text>$5,000,000 for
fiscal year 2010; and</text>
</subparagraph><subparagraph id="H155E015EA3AB411382A806749116F47F"><enum>(B)</enum><text>such sums as may
be necessary for each subsequent fiscal year.</text>
</subparagraph></paragraph><paragraph id="HE4C96AEDB616400EB586BB378BDC662E"><enum>(4)</enum><header>Global best
practices pilot program</header><text>There are authorized to be appropriated
to the Secretary of State to carry out section 104—</text>
<subparagraph id="H5857DAF10B284DAE8FE99789857D354C"><enum>(A)</enum><text>$3,000,000 for
fiscal year 2010; and</text>
</subparagraph><subparagraph id="HB1B08A430FC4403B91B3FCD072C686F6"><enum>(B)</enum><text>such sums as may
be necessary for each subsequent fiscal year.</text>
