		<official-title>To use amounts made available under the Troubled Assets
		  Relief Program of the Secretary of the Treasury for relief for homeowners and
		  neighborhoods.</official-title>

		<section id="HFC34A7D1C34947A0B3B1A83B988171CE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>TARP for Main Street Act of
			 2009</short-title></quote>.</text>
		</section><section id="H43E4B27C7C4A48AD996C4E14F21E4266"><enum>2.</enum><header>Housing Trust
			 Fund</header><text display-inline="no-display-inline">From dividends paid by
			 financial institutions that have received financial assistance provided under
			 title I of division A of the Emergency Economic Stabilization Act of 2008 (12
			 U.S.C. 5211 et seq.), the Secretary of the Treasury shall transfer and credit
			 $1,000,000,000 to the Housing Trust Fund established under section 1338 of the
			 Federal Housing Enterprises Financial Safety and Soundness Act of 1992 (12
			 U.S.C. 4567) for use in accordance with such section.</text>
		</section><section id="HC602490FC8E64FCC92C00319C6D6FF5F"><enum>3.</enum><header>Neighborhood
			 Stabilization Program</header><text display-inline="no-display-inline">From
			 dividends paid by financial institutions that have received financial
			 assistance provided under title I of division A of the Emergency Economic
			 Stabilization Act of 2008 (12 U.S.C. 5211 et seq.), the Secretary of the
			 Treasury shall transfer $1,500,000,000 to the Secretary of Housing and Urban
			 Development and such Secretary shall use such amounts for assistance to States
			 and units of general local government for the redevelopment of abandoned and
			 foreclosed homes, in accordance with the same provisions applicable under the
			 second undesignated paragraph under the heading <quote>Community Planning and
			 Development—Community Development Fund</quote> in title XII of division A of
			 the American Recovery and Reinvestment Act of 2009 (Public Law 111–5; 123 Stat.
			 217) to amounts made available under such second undesignated paragraph, except
			 as follows:</text>
			<paragraph id="H650FE42E5CF54328878E960AE76EFBE1"><enum>(1)</enum><text>Notwithstanding
			 the matter of such second undesignated paragraph that precedes the first
			 proviso, amounts made available by this section shall remain available until
			 expended.</text>
			</paragraph><paragraph id="H8F29889C915349829537F27329E977A1"><enum>(2)</enum><text>The 3rd, 4th, 5th,
			 6th, 7th, and 15th provisos of such second undesignated paragraph shall not
			 apply to amounts made available by this section.</text>
			</paragraph><paragraph id="H355FFE185F9B45279244999E87E1E648"><enum>(3)</enum><text display-inline="yes-display-inline">Amounts made available by this section
			 shall be allocated based on a funding formula for such amounts established by
			 the Secretary in accordance with section 2301(b) of the Housing and Economic
			 Recovery Act of 2008 (42 U.S.C. 5301 note), except that—</text>
				<subparagraph id="HFD0F46C22C8B43F891F36A07B9F9CD81"><enum>(A)</enum><text>notwithstanding
			 paragraph (2) of such section 2301(b), the formula shall be established not
			 later than 30 days after the date of the enactment of this Act;</text>
				</subparagraph><subparagraph id="H40CF547A990E4B21BDB35A7F9ABEE719"><enum>(B)</enum><text>the Secretary may
			 not establish any minimum grant amount or size for grants to States; and</text>
				</subparagraph><subparagraph id="HE60F3BE5B7B04421AC97F4334E2A0FFA"><enum>(C)</enum><text display-inline="yes-display-inline">the Secretary may establish a minimum grant
			 amount for direct allocations to units of general local government located
			 within a State, which shall not exceed $1,000,000.</text>
				</subparagraph></paragraph><paragraph id="H1D58662CF9FF48189A3CB50660E76794"><enum>(4)</enum><text display-inline="yes-display-inline">Paragraph (1) of section 2301(c) of the
			 Housing and Economic Recovery Act of 2008 shall not apply to amounts made
			 available by this section.</text>
			</paragraph><paragraph id="H72F7A1A6F79645948F9F189D70A4E6E9"><enum>(5)</enum><text display-inline="yes-display-inline">Section 2302 of the Housing and Economic
			 Recovery Act of 2008 shall not apply to amounts made available by this
			 section.</text>
			</paragraph><paragraph id="H40ADDEA89F6F4DADAE5FB942FEFAD0AB"><enum>(6)</enum><text>The fourth proviso
			 from the end of such second undesignated paragraph shall be applied to amounts
			 made available by this section by substituting <quote>2013</quote> for
			 <quote>2012</quote>.</text>
			</paragraph><paragraph id="H2383A51C319F445EA49300BF374495DE"><enum>(7)</enum><text display-inline="yes-display-inline">Notwithstanding section 2301(a) of the
			 Housing and Economic Recovery Act of 2008, the term <term>State</term> means
			 any State of the United States, the District of Columbia, the Commonwealth of
			 Puerto Rico, the Commonwealth of the Northern Mariana Islands, Guam, the Virgin
			 Islands, American Samoa, and other territory or possession of the United States
			 for purposes of this section and title III of division B of such Act, as
			 applied to amounts made available by this section.</text>
			</paragraph></section><section id="H610C9DDFB67D4D7FA16D22B9EDAF3E43"><enum>4.</enum><header>Emergency
			 mortgage relief</header>
			<subsection id="HA38FF82A2DD04711BAF206445E90D0DC"><enum>(a)</enum><header>Use of TARP
			 funds</header><text display-inline="yes-display-inline">Using the authority
			 available under section 115(a) of division A of the Emergency Economic
			 Stabilization Act of 2008 (12 U.S.C. 5225(a)), the Secretary of the Treasury
			 shall transfer to the Secretary of Housing and Urban Development
			 $2,000,000,000, and the Secretary of Housing and Urban Development shall credit
			 such amount to the Emergency Homeowners’ Relief Fund, which such Secretary
			 shall establish pursuant to section 107 of the Emergency Housing Act of 1975
			 (12 U.S.C. 2706), as such Act is amended by this section, for use for emergency
			 mortgage assistance in accordance with title I of such Act.</text>
			</subsection><subsection id="H146049B89F424CF3A4F23043E8FC4709"><enum>(b)</enum><header>Reauthorization
			 of emergency mortgage relief program</header><text>Title I of the Emergency
			 Housing Act of 1975 is amended—</text>
				<paragraph id="HDB8418FE74D84DF3B840AD16C5D206C5"><enum>(1)</enum><text>in section 103(2)
			 (12 U.S.C. 2702(2)—</text>
					<subparagraph id="HF1659A2A5C5D430D98BBEE6C20381B73"><enum>(A)</enum><text>by striking
			 <quote>have indicated</quote> and all that follows through <quote>regulation of
			 the holder</quote> and insert <quote>have certified</quote>;</text>
					</subparagraph><subparagraph id="HC20F32CDB6954545A5569F2E244024E3"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>(such as the volume of
			 delinquent loans in its portfolio)</quote>; and</text>
					</subparagraph><subparagraph id="H614A3051360941A4AF80AB32072C39CE"><enum>(C)</enum><text>by striking
			 <quote>, except that such statement</quote> and all that follows through
			 <quote>purposes of this title</quote>;</text>
					</subparagraph></paragraph><paragraph id="H4508B703E1374E809A2565728A84EE8A"><enum>(2)</enum><text>in section 104(b)
			 (12 U.S.C. 2703(b)), by striking <quote>the lesser of $250 per
			 month</quote>;</text>
				</paragraph><paragraph id="H4A1F2C3C384946D7A50F57F388C0C792"><enum>(3)</enum><text display-inline="yes-display-inline">in section 105(e) (12 U.S.C. 2704(e)), by
			 striking <quote>$1,500,000,000</quote> and inserting
			 <quote>$2,000,000,000</quote>;</text>
				</paragraph><paragraph id="H1137DC22CCAD49B1A4F23B561FFC1789"><enum>(4)</enum><text>in section 109 (12
			 U.S.C. 2708)—</text>
					<subparagraph id="HAEF3B340DE2D4D05A2F91659A905B844"><enum>(A)</enum><text>in the section
			 heading, by striking <quote><header-in-text level="section" style="traditional">authorization and</header-in-text></quote>;</text>
					</subparagraph><subparagraph id="HCC32BF830F28405B9704D028CE72A24E"><enum>(B)</enum><text>by striking
			 subsection (a);</text>
					</subparagraph><subparagraph id="HC3DE0919A3284311A2FD16EB64757747"><enum>(C)</enum><text>by striking
			 <quote>(b)</quote>; and</text>
					</subparagraph><subparagraph id="H523EC5534E1444BABA604E0D3E840A3B"><enum>(D)</enum><text>by striking
			 <quote>1977</quote> and inserting <quote>2011</quote>; and</text>
					</subparagraph></paragraph><paragraph id="HD675F2D4C24B42D58CF027CFB757B0E0"><enum>(5)</enum><text display-inline="yes-display-inline">by striking sections 110, 111, and 113 (12
			 U.S.C. 2709, 2710, 2712).</text>
				</paragraph></subsection></section><section id="H0579368DC23446139DF4E794ECE1E40A"><enum>5.</enum><header>Multifamily
			 mortgage resolution</header>
			<subsection id="H7765B99CD78040DB99B58FFB40E0373D"><enum>(a)</enum><header>Use of TARP
			 funds</header><text display-inline="yes-display-inline">Using the authority
			 available under section 115(a) of division A of the Emergency Economic
			 Stabilization Act of 2008 (12 U.S.C. 5225(a)), the Secretary of the Treasury
			 shall transfer $2,000,000,000 to the Secretary of Housing and Urban Development
			 for use under the program developed under subsection (b) to stabilize
			 multifamily properties that are in default or foreclosure, or have recently
			 been foreclosed.</text>
			</subsection><subsection id="H86C1571C5114494AA8EA474614CC3AB9"><enum>(b)</enum><header>Multifamily
			 mortgage resolution program</header><text>The Secretary of Housing and Urban
			 Development shall develop a program under this subsection to ensure the
			 protection of current and future tenants of at-risk multifamily properties,
			 where feasible, based on criteria that may include—</text>
				<paragraph id="H69D56B1F91DF4B42851F8E6A683D19CE"><enum>(1)</enum><text>creating
			 sustainable financing of such properties, that may take into consideration such
			 factors as—</text>
					<subparagraph id="HC888211D4D63454484CDB2D05E60B821"><enum>(A)</enum><text>the rental income
			 generated by such properties; and</text>
					</subparagraph><subparagraph id="HC5355B56B1654BB3800195792A54853D"><enum>(B)</enum><text>the preservation
			 of adequate operating reserves;</text>
					</subparagraph></paragraph><paragraph id="HE3E3244EE8C14AC7ACAF28F7798397BB"><enum>(2)</enum><text>maintaining the
			 level of Federal, State, and city subsidies in effect as of the date of
			 enactment of this Act;</text>
				</paragraph><paragraph id="HC163B564D46040E697F45B64D11298AF"><enum>(3)</enum><text>providing funds
			 for rehabilitation; and</text>
				</paragraph><paragraph id="H7AF41EBEA83D452481C95E7E7896E316"><enum>(4)</enum><text display-inline="yes-display-inline">facilitating the transfer of such
			 properties, when appropriate and with the agreement of owners, to responsible
			 new owners and ensuring affordability of such properties.</text>
				</paragraph></subsection><subsection id="HF7AC0F10FE64420EAEEC6BF7FD04B5FE"><enum>(c)</enum><header>Definition</header><text>For
			 purposes of this section, the term <term>multifamily properties</term> means a
			 residential structure that consists of 5 or more dwelling units.</text>
			</subsection></section><section id="HA591249759144B098BAE1F3C5C0E9958"><enum>6.</enum><header>Reducing TARP
			 authorization limit to offset costs</header><text display-inline="no-display-inline">Paragraph (3) of section 115(a) of the
			 Emergency Economic Stabilization Act of 2008 (12 U.S.C. 5225) is amended by
			 inserting after <quote>$1,244,000,000</quote> the following: <quote>, and as
			 such amount is further reduced by such sums as may be necessary for assistance
			 and costs (as such term is defined in section 502 of the Federal Credit Reform
			 Act of 1990 (2 U.S.C. 661a)) of loans, advances, insurance, and appropriations
			 as authorized under the <short-title>TARP for Main Street
			 Act of 2009</short-title></quote> .</text>
