		<official-title>To amend the Robert T. Stafford Disaster Relief and
		  Emergency Assistance Act to establish a grant program to assist innovative
		  natural disaster first responder programs, and for other
		  purposes.</official-title>

		<section id="H659F306FE05A41E795B5D18E9C1872D7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>First Responder Innovation and Support Act of
			 2009</short-title></quote>.</text>
		</section><section id="HBDB89D86DEC54759AE3D1C4F49549999"><enum>2.</enum><header>Grant
			 program</header><text display-inline="no-display-inline">Title II of the Robert
			 T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5131 et
			 seq.) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H9EC1C56341254F3DAE3CC0A7ED1128F0" style="OLC">
				<section id="H0048B3CD986C44FDBBFBCCECBF9657FD"><enum>205.</enum><header>First responder
				innovation and support grant program</header>
					<subsection id="H1A70E25FF1104D46AE0A8DC992AAA940"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The President may
				make grants to eligible entities to assist innovative natural disaster first
				responder programs in accordance with this section.</text>
					</subsection><subsection id="H3CBEABFEFC434030AD3370F06C2279DD"><enum>(b)</enum><header>Application</header><text>To
				be eligible for a grant under this section, an eligible entity shall submit an
				application to the President. Such application shall include, at a minimum, a
				description of each of the following:</text>
						<paragraph id="H9D50C4386B1F4401B219847C0EBEBF17"><enum>(1)</enum><text>The purpose for
				which the grant is sought and the reason Federal assistance is needed for such
				purpose.</text>
						</paragraph><paragraph id="H2D33E8812FAA4F3EB58E2C4DDCE64C6E"><enum>(2)</enum><text>The innovation
				with respect to natural disaster first responders to be achieved with the
				grant.</text>
						</paragraph><paragraph id="HCB81F54B2614485BBD8669EB881EEB28"><enum>(3)</enum><text display-inline="yes-display-inline">The plans, if any, of the eligible entity
				to allocate amounts from the grant to local governments and federally
				recognized Indian tribes.</text>
						</paragraph><paragraph id="HDE1FE080E3834E4F835FFE77347B6A35"><enum>(4)</enum><text>A budget for the
				expected expenditure of the grant amounts.</text>
						</paragraph></subsection><subsection id="HB283C629D1A4459FAF4EA64154EA07D1"><enum>(c)</enum><header>Selection
				criteria</header><text>The President shall issue regulations establishing
				selection criteria for making grants under this section. Such criteria shall
				include consideration of the following:</text>
						<paragraph id="HBF438B9B84854433BA639FCC36D0970E"><enum>(1)</enum><text>The severity and
				frequency of natural disasters that affect the eligible entity applying for the
				grant.</text>
						</paragraph><paragraph id="HB3BED128798E4E9E90B58D569D2399C3"><enum>(2)</enum><text>Whether existing
				natural disaster first responder systems would be improved by the grant.</text>
						</paragraph><paragraph id="H7B50CDFE402D4776B0A78059FB951FF4"><enum>(3)</enum><text display-inline="yes-display-inline">Whether the grant would provide natural
				disaster first responder support for special populations, including children,
				pregnant women, the elderly, and the disabled.</text>
						</paragraph><paragraph id="HCBEEC5B29C69476F84BF9FA9FB29AC28"><enum>(4)</enum><text>Whether the
				activity assisted by the grant is sustainable with non-Federal amounts after
				such grant is made.</text>
						</paragraph></subsection><subsection id="H6A18E88EB4B8487284474120F3BE0F0A"><enum>(d)</enum><header>Timing and
				number of grants</header><text>The President shall make grants under this
				section annually and an eligible entity may apply for multiple grants under
				this section each year. An eligible entity is not limited in the number of
				grants such entity may receive under this section.</text>
					</subsection><subsection id="HD86C3375886840C3B89FA84AE918C64B"><enum>(e)</enum><header>Competitive
				basis</header><text>The President shall make grants under this section on a
				competitive basis subject to the requirements of this section.</text>
					</subsection><subsection id="HBDACDBD1F4414C40BC3C4796E792B784"><enum>(f)</enum><header>Regulations</header><text>Not
				later than one year after the date of enactment of this section, the President
				shall issue regulations necessary to carry out this section.</text>
					</subsection><subsection id="HB209A3EE223E492DB5507958DAA737CB"><enum>(g)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section, the following definitions
				apply:</text>
						<paragraph id="H6D0779D5201E4B04A2681B2E49060ED5"><enum>(1)</enum><header>Eligible
				entity</header><text display-inline="yes-display-inline">The term
				<term>eligible entity</term> means any of the 50 States, the District of
				Columbia, any federally recognized Indian tribe, and any territory or
				possession of the United States that has an approved mitigation plan under
				section 322.</text>
						</paragraph><paragraph id="H7C46B7BC307D42A1964C1BB4FA8661CC"><enum>(2)</enum><header>First
				responder</header><text>The term <term>first responder</term> means an
				individual who in the early stages of an incident is responsible for the
				protection and preservation of life, property, evidence, and the environment,
				including emergency response providers (as such term is defined under section 2
				of the Homeland Security Act of 2002 (6 U.S.C. 101)) and emergency management,
				public health, clinical care, public works, and other skilled support
				personnel, including equipment operators, that provide immediate support
				services during prevention, response, and recovery operations.</text>
						</paragraph><paragraph id="HC7C948C4A7DC4AC0BA400AA2665119FA"><enum>(3)</enum><header>Natural
				Disaster</header><text>The term <term>natural disaster</term> has the meaning
				given such term under section 602.</text>
						</paragraph><paragraph id="H7D37FA10E1A840E49BD4B05B615C8F09"><enum>(4)</enum><header>President</header><text>The
				term <term>President</term> means the President, acting through the
				Administrator of the Federal Emergency Management Agency.</text>
						</paragraph></subsection><subsection id="H1BC4E3A3B91B48E791372ED103C71ACC"><enum>(h)</enum><header>Authorization of
				appropriations</header><text>There is authorized to be appropriated to the
				President to carry out this section $100,000,000 for each of fiscal years 2010
				through 2015. Such sums shall remain available until
				expended.</text>
