		<legis-type>A BILL</legis-type>
		<official-title>To provide that certain photographic records relating to
		  the treatment of any individual engaged, captured, or detained after September
		  11, 2001, by the Armed Forces of the United States in operations outside the
		  United States shall not be subject to disclosure under section 552 of title 5,
		  United States Code (commonly referred to as the Freedom of Information Act), to
		  amend section 552(b)(3) of title 5, United States Code (commonly referred to as
		  the Freedom of Information Act) to provide that statutory exemptions to the
		  disclosure requirements of that Act shall specifically cite to the provision of
		  that Act authorizing such exemptions, to ensure an open and deliberative
		  process in Congress by providing for related legislative proposals to
		  explicitly state such required citations, and for other
		  purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="H4FB60BE8C7D0417AA336C3C41C9D30DF" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Detainee Photographic Records
			 Protection</header>
			<subsection commented="no" display-inline="no-display-inline" id="H4033320925E34206917D9AE2ADB0A333"><enum>(a)</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="yes-display-inline">This section may be cited as the
			 <quote><short-title>Detainee Photographic Records
			 Protection Act of 2009</short-title></quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H0613F8A949D747DE8C5321E318B7F71D"><enum>(b)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HA1F01F4333744A8B84C6A7FE53C104CC"><enum>(1)</enum><header display-inline="yes-display-inline">Covered
			 record</header><text display-inline="yes-display-inline">The term <term>covered
			 record</term> means any record—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H76E83670B5A84E478CE6EF21DEBE75A3"><enum>(A)</enum><text display-inline="yes-display-inline">that is a photograph that—</text>
						<clause commented="no" display-inline="no-display-inline" id="HB103E4866EA546FAB1BBD8538D3A46B9"><enum>(i)</enum><text display-inline="yes-display-inline">was taken during the period beginning on
			 September 11, 2001, through January 22, 2009; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H7DD8FAD68F3D498C8F146969CE1B6889"><enum>(ii)</enum><text display-inline="yes-display-inline">relates to the treatment of individuals
			 engaged, captured, or detained after September 11, 2001, by the Armed Forces of
			 the United States in operations outside of the United States; and</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4335C486F4CA48D6B243DDA23400DD15"><enum>(B)</enum><text display-inline="yes-display-inline">for which a certification by the Secretary
			 of Defense under subsection (c) is in effect.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H71FEC805C74440A784F85076FC456AFE"><enum>(2)</enum><header display-inline="yes-display-inline">Photograph</header><text display-inline="yes-display-inline">The term <term>photograph</term>
			 encompasses all photographic images, whether originals or copies, including
			 still photographs, negatives, digital images, films, video tapes, and motion
			 pictures.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H1A6063A89A9E4B2093F96B7F181FD914"><enum>(c)</enum><header display-inline="yes-display-inline">Certification</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H68749BF98B7544779831E6F75BF9FB98"><enum>(1)</enum><header display-inline="yes-display-inline">In General</header><text display-inline="yes-display-inline">For any photograph described under
			 subsection (b)(1)(A), the Secretary of Defense shall certify, if the Secretary
			 of Defense, in consultation with the Chairman of the Joint Chiefs of Staff,
			 determines that the disclosure of that photograph would endanger—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H4331A694D3FF4244B40D78A756FD681C"><enum>(A)</enum><text display-inline="yes-display-inline">citizens of the United States; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB49BA6D525E64B04808513EE8D034C8B"><enum>(B)</enum><text display-inline="yes-display-inline">members of the Armed Forces or employees of
			 the United States Government deployed outside the United States.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC1514D2F42BC4472A6A08642D31C41D9"><enum>(2)</enum><header display-inline="yes-display-inline">Certification expiration</header><text display-inline="yes-display-inline">A certification submitted under paragraph
			 (1) and a renewal of a certification submitted under paragraph (3) shall expire
			 3 years after the date on which the certification or renewal, as the case may
			 be, is submitted to the President.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBD80455217E34A89B1A94DF4EBBA1CBE"><enum>(3)</enum><header display-inline="yes-display-inline">Certification renewal</header><text display-inline="yes-display-inline">The Secretary of Defense may submit to the
			 President—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HFBFB3609F59A4833ABB21BC2435F9707"><enum>(A)</enum><text display-inline="yes-display-inline">a renewal of a certification in accordance
			 with paragraph (1) at any time; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1D1EC5BBFC064ACA92032EB51B5CC710"><enum>(B)</enum><text display-inline="yes-display-inline">more than 1 renewal of a
			 certification.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA90D13E74DFB40799CDEE003237E52A3"><enum>(4)</enum><header display-inline="yes-display-inline">Notice to Congress</header><text display-inline="yes-display-inline">A timely notice of the Secretary's
			 certification shall be submitted to Congress.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H009FC263710F499E83A987884D98B45F"><enum>(d)</enum><header display-inline="yes-display-inline">Nondisclosure of Detainee
			 records</header><text display-inline="yes-display-inline">A covered record
			 shall not be subject to—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HCD05E411BC8E4E9CB39534F4345AF789"><enum>(1)</enum><text display-inline="yes-display-inline">disclosure under section 552 of title 5,
			 United States Code (commonly referred to as the Freedom of Information Act);
			 or</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9A50B948CA3D4AE9BE3525B309432F11"><enum>(2)</enum><text display-inline="yes-display-inline">disclosure under any proceeding under that
			 section.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H631442AD2B0641AC8D43965E4312DF88"><enum>(e)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed
			 to preclude the voluntary disclosure of a covered record.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HA7395CDC549B4A8D86F7069D6F3DC9F8"><enum>(f)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">This section shall take
			 effect on the date of enactment of this Act and apply to any photograph created
			 before, on, or after that date that is a covered record.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H79FBB61DECBA4A45B9204714BF6FEDFE" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Open Freedom of Information Act</header>
			<subsection commented="no" display-inline="no-display-inline" id="HDB7539871E8447448D16372E1866C0C6"><enum>(a)</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="yes-display-inline">This section may be cited as the
			 <quote><short-title>OPEN FOIA Act of
			 2009</short-title></quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H041DBEA4429E44A2BF21FE4AF2387EA7"><enum>(b)</enum><header display-inline="yes-display-inline">Specific citations in statutory
			 exemptions</header><text display-inline="yes-display-inline">Section 552(b) of
			 title 5, United States Code, is amended by striking paragraph (3) and inserting
			 the following:</text>
				<quoted-block display-inline="no-display-inline" id="H087F49FE31354E26A64A34F6C61AA8D0" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="HEBF4662E726145B28E1B8D5820D804DB"><enum>(3)</enum><text display-inline="yes-display-inline">specifically exempted from disclosure by
				statute (other than section 552b of this title), if that statute—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H2A01D7ECF39843B8B469D0204C72098E"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H37B0673E31754BD9AD8015F708064970"><enum>(i)</enum><text display-inline="yes-display-inline">requires that the matters be withheld from
				the public in such a manner as to leave no discretion on the issue; or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="HEC7AE00170144084A9414BD503E49F88" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">establishes particular criteria for
				withholding or refers to particular types of matters to be withheld; and</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H13EDC012931048119E141B240D33589C"><enum>(B)</enum><text display-inline="yes-display-inline">if enacted after the date of enactment of
				the OPEN FOIA Act of 2009, specifically cites to this
				paragraph.</text>
