<official-title>To provide American consumers information about the broadcast television transition from an analog to a digital format, and to provide additional funds for the converter box coupon program under the Digital Television Transition and Public Safety Act of 2005.</official-title>

<section display-inline="no-display-inline" id="H628B408999D849CC9360D1F145000017" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Digital Television Consumer Education Act</short-title></quote>.</text></section> 
<section id="HC6A4A15634754EC4AA2B26F3A7BC6BF"><enum>2.</enum><header>Labeling and consumer education</header><text display-inline="no-display-inline">Section 330 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/330">47 U.S.C. 330</external-xref>) is amended—</text> 
<paragraph id="HC6CBFB51A7E24D95B9BFE635D83FC6BD"><enum>(1)</enum><text>by redesignating subsection (d) as subsection (e); and</text></paragraph> 
<paragraph id="H28607F85D10C458F8B41CC099E7223A3"><enum>(2)</enum><text>by inserting after subsection (c) the following new subsection:</text>

<subsection id="HB3538F3212F0478BAEB639833BF1FD9C"><enum>(d)</enum><header>Labeling and consumer education</header> 
<paragraph id="H0150802CB949453094DB385C118E0701"><enum>(1)</enum><header>Requirements for retail distributors and other vendors</header> 
<subparagraph id="H39B8C296A52A4A22A0546F93D6ADCD6"><enum>(A)</enum><header>Retail distributors</header><text display-inline="yes-display-inline">Any retail distributor of any television receiving equipment described in section 303(s) that does not include a digital tuner shall—</text> 
<clause id="H0E1EA810ADBB498F848179C668195917"><enum>(i)</enum><text display-inline="yes-display-inline">effective 30 days after the date of enactment of the <short-title>National Digital Television Consumer Education Act</short-title>, place adjacent to each unit of such equipment that such distributor displays for sale or rent a consumer alert as provided by the manufacturer pursuant to <internal-xref idref="HE9514B08737F4B2D977E4FDE004E4717" legis-path="(d)(2)">paragraph (2)</internal-xref>, except that such distributor shall not be required to affix such label to the television screen on such equipment, as long as the label is—</text> 
<subclause id="H705E97A6A0794F43B3F9E13B2F132E84"><enum>(I)</enum><text>in the close vicinity of, and associated with, the unit on display; and</text></subclause> 
<subclause id="H5F14E285543F45A4AC503990FBE763E3"><enum>(II)</enum><text>clearly visible to consumers; and</text></subclause></clause> 
<clause id="H38ABB037B1B94FA49634DE26C3C34FB4"><enum>(ii)</enum><text display-inline="yes-display-inline">effective 30 days after the enactment of the <short-title>National Digital Television Consumer Education Act</short-title>, provide information to consumers, on signs and in pamphlet form, in the display area for product categories that include any television receiving equipment described in section 303(s) that does not include a digital tuner television, sufficient to convey the information carried in the consumer advisory label. Such signs and pamphlets shall also include information on recycling old televisions, computer monitors, computer central processing units, fax machines, and scanners and other consumer electronics.</text></clause></subparagraph> 
<subparagraph id="H1132B1E0BDBD4695BC368E2C01BA6048"><enum>(B)</enum><header>Other vendors</header><text display-inline="yes-display-inline">Effective 30 days after the date of enactment of the <short-title>National Digital Television Consumer Education Act</short-title>, any seller via direct mail, catalog, or electronic means, such as the Internet, of any television receiving equipment described in section 303(s) that does not include a digital tuner, shall include in clear and conspicuous print the consumer alert required by <internal-xref idref="HE9514B08737F4B2D977E4FDE004E4717" legis-path="(d)(2)">paragraph (2)</internal-xref> at the point of display for the apparatus, or, if there is no display, at the point of sale. Such information shall also include information on recycling old televisions and other consumer electronics.</text></subparagraph></paragraph> 
<paragraph id="HE9514B08737F4B2D977E4FDE004E4717"><enum>(2)</enum><header>Consumer alert</header><text display-inline="yes-display-inline">The consumer alert required by this paragraph shall display in clear and conspicuous print, the following consumer alert:</text> 
<subparagraph id="H3EC1BC481B4040C2B7BFACB2F3DF5B"><enum></enum><text>Consumer Alert</text></subparagraph> 
<subparagraph id="H10F3E71E01F54457B0DDE284C9E8ADC3"><enum></enum><text>This TV has only an analog broadcast tuner and will require a converter box after February 17, 2009, to receive over-the-air broadcasts with an antenna because of the Nation’s transition to digital broadcasting. The TV should continue to work as before with cable and satellite TV services, gaming consoles, VCRs, DVD players, and similar products. For more information, call the Federal Communications Commission at 1–888–225–5322 (TTY: 1–888–835–5322) or visit the Commission’s digital television website at: www.dtv.gov.</text></subparagraph> 
<subparagraph id="H93C1BC183D07474184B91FDB284EFE3F"><enum></enum><text>Nuncio Consumidor</text></subparagraph> 
<subparagraph id="HE9C513E6974A4B33871B51492FBAE6C"><enum></enum><text display-inline="yes-display-inline">Esta TV tiene sólo un sintonizador de emisión análogo y por lo tanto requerirá una caja de conversión después del 17 de febrero de 2009 para recibir emisiones de TV terrestre con una antena, debido a la transición nacional a la emisión de TV digital. Esta continuará funcionando igualmente con TV por cable, sistema de TV satélite, consolas de juegos, videograbadoras, reproductores de DVD y productos similares. <paragraph id="H4EA3EC9CC2C648A0933B051C4B183E46"><enum>(3)</enum><header>Other devices</header><text>For devices other than television sets that are included in section 303(s) and that contain an analog tuner, but not a digital tuner, the Commission shall require the clear and conspicuous placement of a comparable consumer advisory label on such devices, as well as on the outside of the retail packaging of such devices.</text></paragraph> 
<paragraph id="HE244C8FB699C4858B6665743CA69D778"><enum>(4)</enum><header>Additional Disclosures</header> 
<subparagraph id="H0115F05A136148459FE300B67DAC1711"><enum>(A)</enum><header>Announcements and notices required</header><text>From the date of enactment of this Act through March 31, 2009—</text> 
<clause id="HF689AC2C5D874CCDA0A72B61202C61D4"><enum>(i)</enum><text>each television broadcaster shall air, at a minimum, 120 seconds per day of public service announcements between the hours of 6 a.m. and 11:35 p.m., at variable time slots throughout the week, with at least half aired between the hours of 5 p.m. and 11:35 p.m.; and</text></clause> 
<clause id="H18379488D1CD449A0094717B862624AE"><enum>(ii)</enum><text>any multichannel video program distributor shall include a notice in or with each periodic bill.</text></clause></subparagraph> 
<subparagraph id="HA4056F6C1E7F40148307FDF4DC003094"><enum>(B)</enum><header>Content of announcements and notices</header><text>The announcements and notices required by this paragraph shall educate consumers about the deadline for termination of analog television broadcasting and the equipment options consumers have after such termination. Announcements aired and notices distributed after January 1, 2009, shall also educate consumers about the need for and availability of the converter box voucher program and the steps to redeem the voucher.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H71612D0422644D6E99987FE4EB52FB46"><enum>3.</enum><header>Digital television consumer education grant program</header><text display-inline="no-display-inline">Part C of the National Telecommunications and Information Administration Organization Act is amended by inserting after section 158 (<external-xref legal-doc="usc" parsable-cite="usc/47/942">47 U.S.C. 942</external-xref>) the following new section:</text>

<section id="H69CE9E5B17724BBFB233146673C354D"><enum>159.</enum><header>Digital television consumer education grant program</header> 
<subsection id="H362B733738334B338DDAF5A92FAE2DD9"><enum>(a)</enum><header>Program authorized</header><text>The Assistant Secretary of Commerce for Communications and Information is authorized to establish a temporary grant program for the purpose of coordinating and leading a nationwide consumer education and outreach campaign regarding America’s conversion to digital television.</text></subsection> 
<subsection id="HDEFE1D0A3F84430AAA369744F024AF3"><enum>(b)</enum><header>Single grant</header><text display-inline="yes-display-inline">No later than January 31, 2009, and ending no earlier than March 31, 2009, the Assistant Secretary shall award a single grant from the program authorized by this section to one qualified entity.</text></subsection> 
<subsection id="HCF2FAB7014984E9BB3A34C8CE5098299"><enum>(c)</enum><header>Qualified entity</header><text>For purposes of this section, the term <term>qualified entity</term> shall be a corporation, organized under <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986, that represents the interests of local noncommercial television stations at the national level, and consults with commercial broadcasters, consumer equipment manufacturers, electronics retailers, cable and satellite operators, consumer groups, older Americans, Hispanic Americans, Americans whose primary language is not English, Americans with disabilities, and Americans living in rural communities.</text></subsection> 
<subsection id="HD8BD113E5B7A40DBB70418A6B600E4F4"><enum>(d)</enum><header>Authorization of Appropriations</header><text>There are authorized to be appropriated to carry out this section $20,000,000 for fiscal year 2009. Such sums are authorized to remain available subject to subsection (e).</text></subsection> 
<subsection id="HFD9CBA57BC914B1EA9661C35208B3FE1"><enum>(e)</enum><header>Termination</header><text>Expenditures for the grant program under this section shall terminate on April 30, 2009.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H62A1F3E239B049A799BC27C31E693018" commented="no"><enum>4.</enum><header>Additional funds for the converter box coupon program</header> 
<subsection id="HE540F509F17A497A8E12AF69ED5B2CAF" commented="no"><enum>(a)</enum><header>Amendment</header><text display-inline="yes-display-inline">Section 3005 of the Digital Television Transition and Public Safety Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/171">Public Law 109–171</external-xref>; 120 Stat. 23) is amended—</text> 
<paragraph id="HCB9108AC0A504E558599B44427B659BD" commented="no"><enum>(1)</enum><text>in subsection (b), by striking <quote>$1,500,000,000</quote> and inserting <quote>$1,700,000,000</quote>; and</text></paragraph> 
<paragraph id="HCC2E0E7BC5E44A18A026BF9D86708C8F" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (c)(3), by striking <quote>by substituting <quote>$1,500,000,000</quote></quote> each place it appears in subparagraphs (A)(ii) and (B) and inserting <quote>by substituting <quote>$1,700,000,000</quote></quote>.</text></paragraph></subsection> 
<subsection id="H0DDBF70C9BFF45A7A489C02E944BA414" commented="no"><enum>(b)</enum><header>Conforming Amendment</header><text display-inline="yes-display-inline">Section 309(j)(8)(E)(iii) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(j)(8)(E)(iii)</external-xref>) is amended by striking <quote>$7,363,000,000</quote> and inserting <quote>$7,163,000,000</quote>. </text></subsection></section>
