	 appropriated, $13,000,000 is for stabilization and developmental activities to
	 be carried out under the authority provided by title XIV of the Food and

	 of both Houses of Congress on the allocation of these funds by USDA agency:

	 Department by this Act shall be available to the Department for support of

	 and other arrangements with public agencies and private persons pursuant to
	 section 6(a)(9) of the Inspector General Act of 1978, and including not to
	 exceed $125,000 for certain confidential operational expenses, including the
	 payment of informants, to be expended under the direction of the Inspector
	 General pursuant to Public Law 95–452 and section 1337 of Public Law 97–98:
	 <italic>Provided,</italic> That of the amount made available for the Office of
	 Inspector General to conduct investigations such sums as are necessary shall be
	 made available for the inspection of the national organic program established
	 under the Organic Foods Production Act of 1990 (7 U.S.C. 6501 et
	 seq.).</text>

					</appropriations-intermediate><appropriations-intermediate commented="no" id="id6B99B0C2AB8E4A6E9E44690BA9F324B2"><header display-inline="yes-display-inline">Agricultural research
	 service</header>
					</appropriations-intermediate><appropriations-small commented="no" id="id879E5B2CC118417D997DE17ED60F88B2"><header display-inline="yes-display-inline">Salaries and expenses</header><text display-inline="no-display-inline">For necessary expenses of the Agricultural
	 Research Service and for acquisition of lands by donation, exchange, or
	 purchase at a nominal cost not to exceed $100, and for land exchanges where the
	 lands exchanged shall be of equal value or shall be equalized by a payment of
	 money to the grantor which shall not exceed 25 percent of the total value of
	 the land or interests transferred out of Federal ownership, $1,181,632,000, of
	 which $35,512,000 shall be for the purposes, and in the amounts, specified in
	 the table titled <quote>Congressionally Designated Projects</quote> in the
	 report to accompany this Act:<italic> Provided</italic>, That appropriations
	 hereunder shall be available for the operation and maintenance of aircraft and
	 the purchase of not to exceed one for replacement only: <italic>Provided
	 further</italic>, That appropriations hereunder shall be available pursuant to
	 7 U.S.C. 2250 for the construction, alteration, and repair of buildings and
	 improvements, but unless otherwise provided, the cost of constructing any one
	 building shall not exceed $375,000, except for headhouses or greenhouses which
	 shall each be limited to $1,200,000, and except for 10 buildings to be
	 constructed or improved at a cost not to exceed $750,000 each, and the cost of
	 altering any one building during the fiscal year shall not exceed 10 percent of
	 the current replacement value of the building or $375,000, whichever is
	 greater: <italic>Provided further</italic>, That the limitations on alterations
	 contained in this Act shall not apply to modernization or replacement of
	 existing facilities at Beltsville, Maryland: <italic>Provided further</italic>,
	 That appropriations hereunder shall be available for granting easements at the
	 Beltsville Agricultural Research Center: <italic>Provided further</italic>,
	 That the foregoing limitations shall not apply to replacement of buildings
	 needed to carry out the Act of April 24, 1948 (21 U.S.C. 113a):
	 <italic>Provided further</italic>, That funds may be received from any State,
	 other political subdivision, organization, or individual for the purpose of
	 establishing or operating any research facility or research project of the
	 Agricultural Research Service, as authorized by
	 law.</text>
					</appropriations-small><appropriations-small commented="no" id="idEA0B3D4F36CF49FA9824FEC74B976DC5"><header display-inline="yes-display-inline">Buildings and facilities</header><text display-inline="no-display-inline">For acquisition of land, construction,
	 repair, improvement, extension, alteration, and purchase of fixed equipment or
	 facilities as necessary to carry out the agricultural research programs of the
	 Department of Agriculture, where not otherwise provided, $47,027,000, of which
	 $47,027,000 shall be for the purposes, and in the amounts, specified in the
	 table titled <quote>Congressionally Designated Projects</quote> in the report
	 to accompany this Act, to remain available until
	 expended.</text>

	 Agriculture</header>

	 (7 U.S.C. 3322), $3,928,000; for sustainable agriculture research and education
	 (7 U.S.C. 5811), $14,500,000; for a program of capacity building grants (7
	 U.S.C. 3152(b)(4)) to institutions eligible to receive funds under 7 U.S.C.

	 2209b); for payments to the 1994 Institutions pursuant to section 534(a)(1) of
	 Public Law 103–382, $3,342,000; for resident instruction grants for insular
	 areas under section 1491 of the National Agricultural Research, Extension, and
	 Teaching Policy Act of 1977 (7 U.S.C. 3363), $800,000; for a new era rural
	 technology program pursuant to section 1473E of the National Agricultural

	 fund</header><text display-inline="no-display-inline">For the Native American

					</appropriations-small><appropriations-small commented="no" id="idD38CCA006B444BBD891795CA3A5EDB86"><header display-inline="yes-display-inline">Extension activities</header><text display-inline="no-display-inline">For payments to States, the District of
	 Columbia, Puerto Rico, Guam, the Virgin Islands, Micronesia, the Northern
	 Marianas, and American Samoa, $491,292,000, of which $7,898,000 shall be for
	 the purposes, and in the amounts, specified in the table titled
	 <quote>Congressionally Designated Projects</quote> in the report to accompany
	 this Act, as follows: payments for cooperative extension work under the
	 Smith-Lever Act, to be distributed under sections 3(b) and 3(c) of said Act,
	 and under section 208(c) of Public Law 93–471, for retirement and employees'
	 compensation costs for extension agents, $300,000,000; payments for extension
	 work at the 1994 Institutions under the Smith-Lever Act (7 U.S.C. 343(b)(3)),
	 $4,000,000; payments for the nutrition and family education program for
	 low-income areas under section 3(d) of the Act, $68,139,000; payments for the
	 pest management program under section 3(d) of the Act, $10,085,000; payments
	 for the farm safety program under section 3(d) of the Act, $4,863,000; payments
	 for New Technologies for Ag Extension under section 3(d) of the Act,
	 $2,000,000; payments to upgrade research, extension, and teaching facilities at
	 institutions eligible to receive funds under 7 U.S.C. 3221 and 3222,
	 $18,540,000, to remain available until expended; payments for youth-at-risk
	 programs under section 3(d) of the Smith-Lever Act, $8,427,000; for youth farm
	 safety education and certification extension grants, to be awarded
	 competitively under section 3(d) of the Act, $493,000; payments for carrying
	 out the provisions of the Renewable Resources Extension Act of 1978 (16 U.S.C.
	 1671 et seq.), $4,128,000; payments for the federally-recognized Tribes
	 Extension Program under section 3(d) of the Smith-Lever Act, $3,090,000;
	 payments for sustainable agriculture programs under section 3(d) of the Act,
	 $4,705,000; payments for rural health and safety education as authorized by
	 section 502(i) of Public Law 92–419 (7 U.S.C. 2662(i)), $1,738,000; payments
	 for cooperative extension work by eligible institutions (7 U.S.C. 3221),
	 $41,354,000, provided that each institution receives no less than $1,000,000;
	 for grants to youth organizations pursuant to 7 U.S.C. 7630, $1,767,000;
	 payments to carry out the food animal residue avoidance database program as
	 authorized by 7 U.S.C. 7642, $1,000,000; payments to carry out section
	 1672(e)(49) of the Food, Agriculture, Conservation, and Trade Act of 1990 (7

	 provisions of sections 31 and 32 of the Bankhead-Jones Farm Tenant Act (7
	 U.S.C. 1010–1011; 76 Stat. 607); the Act of April 27, 1935 (16 U.S.C.
	 590a–590f); and subtitle H of title XV of the Agriculture and Food Act of 1981
	 (16 U.S.C. 3451–3461), and of which $21,511,000 shall be for the purposes, and
	 in the amounts, specified in the table titled <quote>Congressionally Designated
	 Projects</quote> in the report to accompany this Act:
	 <italic>Provided,</italic> That appropriations hereunder shall be available
	 pursuant to 7 U.S.C. 2250 for construction and improvement of buildings and
	 public improvements at plant materials centers, except that the cost of
	 alterations and improvements to other buildings and other public improvements
	 shall not exceed $250,000: <italic>Provided further,</italic> That the
	 Secretary is authorized to transfer ownership of all land, buildings, and
	 related improvements of the Natural Resources Conservation Service facilities
	 located in Medicine Bow, Wyoming, to the Medicine Bow Conservation District: 
	 <proviso><italic>Provided further</italic></proviso>, That when buildings
	 or other structures are erected on non-Federal land, that the right to use such
	 land is obtained as provided in 7 U.S.C. 2250a.</text>

	 into or renewed pursuant to the authority under section 521(a)(2) or agreements
	 entered into in lieu of debt forgiveness or payments for eligible households as
	 authorized by section 502(c)(5)(D) of the <act-name parsable-cite="HA49">Housing Act of 1949</act-name>, $980,000,000; and, in
	 addition, such sums as may be necessary, as authorized by section 521(c) of the
	 Act, to liquidate debt incurred prior to fiscal year 1992 to carry out the
	 rental assistance program under section 521(a)(2) of the Act:

	 available for debt forgiveness or payments for eligible households as
	 authorized by section 502(c)(5)(D) of the Act, and not to exceed $50,000 per
	 project for advances to nonprofit organizations or public agencies to cover
	 direct costs (other than purchase price) incurred in purchasing projects
	 pursuant to section 502(c)(5)(C) of the Act: <italic>Provided further,</italic>
	 That of this amount not less than $2,030,000 is available for newly constructed
	 units financed by section 515 of the <act-name parsable-cite="HA49">Housing Act
	 of 1949</act-name>, and not less than $3,400,000 is for newly constructed units
	 financed under sections 514 and 516 of the <act-name parsable-cite="HA49">Housing Act of 1949</act-name>: <italic>Provided
	 further,</italic> That rental assistance agreements entered into or renewed
	 during the current fiscal year shall be funded for a one-year period:
	 <italic>Provided further,</italic> That any unexpended balances remaining at
	 the end of such one-year agreements may be transferred and used for the
	 purposes of any debt reduction; maintenance, repair, or rehabilitation of any
	 existing projects; preservation; and rental assistance activities authorized
	 under title V of the Act: <italic>Provided further,</italic> That rental
	 assistance provided under agreements entered into prior to fiscal year 2010 for
	 a farm labor multi-family housing project financed under section 514 or 516 of
	 the Act may not be recaptured for use in another project until such assistance
	 has remained unused for a period of 12 consecutive months, if such project has
	 a waiting list of tenants seeking such assistance or the project has rental
	 assistance eligible tenants who are not receiving such assistance:
	 <italic>Provided further,</italic> That such recaptured rental assistance
	 shall, to the extent practicable, be applied to another farm labor multi-family
	 housing project financed under section 514 or 516 of the
	 Act.</text>
					</appropriations-small><appropriations-small commented="no" id="idE5189AB05347420AA7E40DCD5D6F72C9"><header display-inline="yes-display-inline">Multi-family housing revitalization program
	 account</header><text display-inline="no-display-inline">For the rural housing
	 voucher program as authorized under section 542 of the
	 <act-name parsable-cite="HA49">Housing Act of 1949</act-name>, but
	 notwithstanding subsection (b) of such section, for the cost to conduct a
	 housing demonstration program to provide revolving loans for the preservation
	 of low-income multi-family housing projects, and for additional costs to
	 conduct a demonstration program for the preservation and revitalization of
	 multi-family rental housing properties described in this paragraph,
	 $39,651,000, to remain available until expended: <italic>Provided,</italic>
	 That of the funds made available under this heading, $18,000,000 shall be
	 available for rural housing vouchers to any low-income household (including
	 those not receiving rental assistance) residing in a property financed with a
	 section 515 loan which has been prepaid after September 30, 2005:
	 <italic>Provided further,</italic> That the amount of such voucher shall be the
	 difference between comparable market rent for the section 515 unit and the
	 tenant paid rent for such unit: <italic>Provided further,</italic> That funds
	 made available for such vouchers shall be subject to the availability of annual
	 appropriations: <italic>Provided further,</italic> That the Secretary shall, to
	 the maximum extent practicable, administer such vouchers with current
	 regulations and administrative guidance applicable to section 8 housing
	 vouchers administered by the Secretary of the Department of Housing and Urban
	 Development (including the ability to pay administrative costs related to
	 delivery of the voucher funds): <italic>Provided further,</italic> That if the
	 Secretary determines that the amount made available for vouchers in this or any
	 other Act is not needed for vouchers, the Secretary may use such funds for the
	 demonstration programs for the preservation and revitalization of multi-family
	 rental housing properties described in this paragraph: <italic>Provided
	 further,</italic> That of the funds made available under this heading,
	 $1,791,000 shall be available for the cost of loans to private nonprofit
	 organizations, or such nonprofit organizations' affiliate loan funds and State
	 and local housing finance agencies, to carry out a housing demonstration
	 program to provide revolving loans for the preservation of low-income
	 multi-family housing projects: <italic>Provided further,</italic> That loans
	 under such demonstration program shall have an interest rate of not more than 1
	 percent direct loan to the recipient: <italic>Provided further,</italic> That
	 the Secretary may defer the interest and principal payment to the Rural Housing
	 Service for up to 3 years and the term of such loans shall not exceed 30 years:
	 <italic>Provided further,</italic> That of the funds made available under this
	 heading, $19,860,000 shall be available for a demonstration program for the
	 preservation and revitalization of the section 514, 515, and 516 multi-family
	 rental housing properties to restructure existing USDA multi-family housing
	 loans, as the Secretary deems appropriate, expressly for the purposes of
	 ensuring the project has sufficient resources to preserve the project for the
	 purpose of providing safe and affordable housing for low-income residents and
	 farm laborers including reducing or eliminating interest; deferring loan
	 payments, subordinating, reducing or reamortizing loan debt; and other
	 financial assistance including advances, payments and incentives (including the
	 ability of owners to obtain reasonable returns on investment) required by the
	 Secretary: <italic>Provided further,</italic> That the Secretary shall as part
	 of the preservation and revitalization agreement obtain a restrictive use
	 agreement consistent with the terms of the restructuring: <italic>Provided
	 further,</italic> That if the Secretary determines that additional funds for
	 vouchers described in this paragraph are needed, funds for the preservation and
	 revitalization demonstration program may be used for such vouchers:
	 <italic>Provided further,</italic> That the Secretary may use any unobligated
	 funds appropriated for the rural housing voucher program in a prior fiscal year
	 to support information technology activities of the Rural Housing Service to
	 the extent the Secretary determines that additional funds are not needed for
	 this fiscal year to provide vouchers described in this paragraph:
	 <italic>Provided further,</italic> That if Congress enacts legislation to
	 permanently authorize a multi-family rental housing loan restructuring program
	 similar to the demonstration program described herein, the Secretary may use
	 funds made available for the demonstration program under this heading to carry
	 out such legislation with the prior notification of the Committees on
	 Appropriations of both Houses of Congress.</text>

	 including the Office of the Commissioner; the Office of Scientific and Medical
	 Programs; the Office of Policy, Planning and Preparedness; the Office of
	 International and Special Programs; the Office of Operations; and central
	 services for these offices: <italic>Provided further,</italic> That the
	 Commissioner, through the Center for Food Safety and Applied Nutrition, may
	 conduct a study and, not later than one year after the date of enactment of
	 this Act, submit a report to Congress on the psychological, physiological, and
	 neurological similarities between addiction to certain types of food and
	 addiction to classic drugs of abuse: <italic>Provided further</italic>, That
	 funds may be transferred from one specified activity to another with the prior
	 notification of the Committees on Appropriations of both Houses of
	 Congress.</text><text display-inline="no-display-inline">In addition,
	 mammography user fees authorized by 42 U.S.C. 263b, export certification user
	 fees authorized by 21 U.S.C. 381, and priority review user fees authorized by
	 21 U.S.C. 360n may be credited to this account, to remain available until
	 expended.</text>

					</appropriations-small><section commented="no" display-inline="no-display-inline" id="IDF35BD95F176C495CA00C67164E5E6B2A" section-type="subsequent-section"><enum>701.</enum><text display-inline="yes-display-inline">Within the unit limit of cost fixed by law,
		appropriations and authorizations made for the Department of Agriculture for
		the current fiscal year under this Act shall be available for the purchase, in
		addition to those specifically provided for, of not to exceed 204 passenger
		motor vehicles, of which 170 shall be for replacement only, and for the hire of
		such vehicles.</text>
					</section><section commented="no" display-inline="no-display-inline" id="id23909EE11B924E729F0671F97B41536E" section-type="subsequent-section"><enum>702.</enum><text display-inline="yes-display-inline">Section 10101 of division B of the
		Consolidated Security, Disaster Assistance, and Continuing Appropriations Act,
		2009, (Public Law 110–329) is amended in subsection (b) by inserting at the end
		the following: “In carrying out this section, the Secretary may transfer funds
		into existing or new accounts as determined by the Secretary.”.</text>
					</section><section commented="no" display-inline="no-display-inline" id="ID42CAC9457AFB42E2A8CF05B47429EE58" section-type="subsequent-section"><enum>703.</enum><text display-inline="yes-display-inline">The Secretary of Agriculture may transfer
		unobligated balances of discretionary funds appropriated by this Act or other
		available unobligated discretionary balances of the Department of Agriculture
		to the Working Capital Fund for the acquisition of plant and capital equipment
		necessary for the delivery of financial, administrative, and information
		technology services of primary benefit to the agencies of the Department of
		Agriculture: <italic>Provided</italic>, That none of the funds made available
		by this Act or any other Act shall be transferred to the Working Capital Fund
		without the prior notification of the agency administrator: <italic>Provided
		further</italic>, That none of the funds transferred to the Working Capital
		Fund pursuant to this section shall be available for obligation without the
		prior notification of the Committees on Appropriations of both Houses of
		Congress: <italic>Provided further</italic>, That none of the funds
		appropriated by this Act or made available to the Department's Working Capital
		Fund shall be available for obligation or expenditure to make any changes to
		the Department's National Finance Center without prior approval of the
		Committees on Appropriations of both Houses of Congress as required by section
		712 of this Act: 
		<proviso><italic>Provided further</italic></proviso>, That of annual
		income amounts in the Working Capital Fund of the Department of Agriculture
		allocated for the National Finance Center, the Secretary may reserve not more
		than 4 percent for the replacement or acquisition of capital equipment,
		including equipment for the improvement and implementation of a financial
		management plan, information technology, and other systems of the National
		Finance Center or to pay any unforeseen, extraordinary cost of the National
		Finance Center: 
		<proviso><italic>Provided further</italic></proviso>, That none of the
		amounts reserved shall be available for obligation unless the Secretary submits
		notification of the obligation to the Committees on Appropriations of the House
		of Representatives and the Senate: 
		<proviso><italic>Provided further</italic></proviso>, That the limitation
		on the obligation of funds pending notification to Congressional Committees
		shall not apply to any obligation that, as determined by the Secretary, is
		necessary to respond to a declared state of emergency that significantly
		impacts the operations of the National Finance Center; or to evacuate employees
		of the National Finance Center to a safe haven to continue operations of the
		National Finance Center.</text>
					</section><section commented="no" display-inline="no-display-inline" id="ID9DBBC14583D247E7A28DDDA96993ACA6" section-type="subsequent-section"><enum>704.</enum><text display-inline="yes-display-inline">No part of any appropriation contained in
		this Act shall remain available for obligation beyond the current fiscal year
		unless expressly so provided herein.</text>
					</section><section commented="no" display-inline="no-display-inline" id="ID4DCADE5C10284BD6AC5B909174577738" section-type="subsequent-section"><enum>705.</enum><text display-inline="yes-display-inline">No funds appropriated by this Act may be
		used to pay negotiated indirect cost rates on cooperative agreements or similar
		arrangements between the United States Department of Agriculture and nonprofit
		institutions in excess of 10 percent of the total direct cost of the agreement
		when the purpose of such cooperative arrangements is to carry out programs of
		mutual interest between the two parties: 
		<proviso><italic>Provided</italic></proviso>, That this does not preclude
		appropriate payment of indirect costs on grants and contracts with such
		institutions when such indirect costs are computed on a similar basis for all
		agencies for which appropriations are provided in this Act.</text>
					</section><section commented="no" display-inline="no-display-inline" id="ID3E3B4A73D7EE45C3A1AE8158BDD05AD3" section-type="subsequent-section"><enum>706.</enum><text display-inline="yes-display-inline">Appropriations to the Department of
		Agriculture for the cost of direct and guaranteed loans made available in the
		current fiscal year shall remain available until expended to disburse
		obligations made in the current fiscal year for the following accounts: the
		Rural Development Loan Fund program account, the Rural Electrification and
		Telecommunication Loans program account, and the Rural Housing Insurance Fund
		program account.</text>
					</section><section commented="no" display-inline="no-display-inline" id="ID092CB1FF56EF454A811C663A073EB9CB" section-type="subsequent-section"><enum>707.</enum><text display-inline="yes-display-inline">Of the funds made available by this Act,
		not more than $1,800,000 shall be used to cover necessary expenses of
		activities related to all advisory committees, panels, commissions, and task
		forces of the Department of Agriculture, except for panels used to comply with
		negotiated rule makings and panels used to evaluate competitively awarded
		grants.</text>
					</section><section commented="no" display-inline="no-display-inline" id="IDB25FA78B743948A99EE12CEE58C1514E" section-type="subsequent-section"><enum>708.</enum><text display-inline="yes-display-inline">Hereafter, none of the funds appropriated
		by this Act or any other Act may be used to carry out section 410 of the
		Federal Meat Inspection Act (21 U.S.C. 679a) or section 30 of the Poultry
		Products Inspection Act (21 U.S.C. 471).</text>
					</section><section commented="no" display-inline="no-display-inline" id="ID82C3ADF55329481AA14F801AD46FE612" section-type="subsequent-section"><enum>709.</enum><text display-inline="yes-display-inline">No employee of the Department of
		Agriculture may be detailed or assigned from an agency or office funded by this
		Act or any other Act to any other agency or office of the Department for more
		than 30 days unless the individual's employing agency or office is fully
		reimbursed by the receiving agency or office for the salary and expenses of the
		employee for the period of assignment.</text>
					</section><section commented="no" display-inline="no-display-inline" id="IDECCB0B524F25475F9D097C2BA7C773C3" section-type="subsequent-section"><enum>710.</enum><text display-inline="yes-display-inline">None of the funds appropriated or otherwise
		made available to the Department of Agriculture or the Food and Drug
		Administration shall be used to transmit or otherwise make available to any
		non-Department of Agriculture or non-Department of Health and Human Services
		employee questions or responses to questions that are a result of information
		requested for the appropriations hearing process.</text>
					</section><section commented="no" display-inline="no-display-inline" id="IDCC54C716988E4539BA561B2C745F1B41" section-type="subsequent-section"><enum>711.</enum><text display-inline="yes-display-inline">None of the funds made available to the
		Department of Agriculture by this Act may be used to acquire new information
		technology systems or significant upgrades, as determined by the Office of the
		Chief Information Officer, without the approval of the Chief Information
		Officer and the concurrence of the Executive Information Technology Investment
		Review Board: <italic>Provided</italic>, That notwithstanding any other
		provision of law, none of the funds appropriated or otherwise made available by
		this Act may be transferred to the Office of the Chief Information Officer
		unless prior notification has been transmitted to the Committees on
		Appropriations of both Houses of Congress: <italic>Provided further</italic>,
		That none of the funds available to the Department of Agriculture for
		information technology shall be obligated for projects over $25,000 prior to
		receipt of written approval by the Chief Information Officer.</text>
					</section><section commented="no" display-inline="no-display-inline" id="ID85B8CB8A96E8493A87E206A70226371F" section-type="subsequent-section"><enum>712.</enum><subsection commented="no" display-inline="yes-display-inline" id="IDFB115D9BEA6740CABBB0AD8B12E304C3"><enum>(a)</enum><text display-inline="yes-display-inline">None of the funds provided by this Act, or
		provided by previous Appropriations Acts to the agencies funded by this Act
		that remain available for obligation or expenditure in the current fiscal year,
		or provided from any accounts in the Treasury of the United States derived by
		the collection of fees available to the agencies funded by this Act, shall be
		available for obligation or expenditure through a reprogramming of funds
		which—</text>
							<paragraph changed="added" commented="no" display-inline="no-display-inline" id="IDFDE9C88C51A24CF9A666F37B2E81B67A" reported-display-style="italic"><enum>(1)</enum><text display-inline="yes-display-inline">creates new programs;</text>
							</paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="ID9BE46371F9464F24910F30C0F3640581" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">eliminates a program, project, or
		activity;</text>
							</paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="ID17107199C0F8400294C400F4EEF3A721" reported-display-style="italic"><enum>(3)</enum><text display-inline="yes-display-inline">increases funds or personnel by any means
		for any project or activity for which funds have been denied or
		restricted;</text>
							</paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="ID7BF186E7D89640808BAFCB492745F8A0" reported-display-style="italic"><enum>(4)</enum><text display-inline="yes-display-inline">relocates an office or employees;</text>
							</paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="IDB70FA6DF78D14A20AB48CC381123E76B" reported-display-style="italic"><enum>(5)</enum><text display-inline="yes-display-inline">reorganizes offices, programs, or
		activities; or</text>
							</paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="ID74EE666C02024269899F2CD91163352E" reported-display-style="italic"><enum>(6)</enum><text display-inline="yes-display-inline">contracts out or privatizes any functions
		or activities presently performed by Federal employees; unless the Committees
		on Appropriations of both Houses of Congress are notified 15 days in advance of
		such reprogramming of funds.</text>
							</paragraph></subsection><subsection changed="added" commented="no" display-inline="no-display-inline" id="ID05E3AA4BF2B54754A234EA0B84516820" reported-display-style="italic"><enum>(b)</enum><text display-inline="yes-display-inline">None of the funds provided by this Act, or
		provided by previous Appropriations Acts to the agencies funded by this Act
		that remain available for obligation or expenditure in the current fiscal year,
		or provided from any accounts in the Treasury of the United States derived by
		the collection of fees available to the agencies funded by this Act, shall be
		available for obligation or expenditure for activities, programs, or projects
		through a reprogramming of funds in excess of $500,000 or 10 percent,
		which-ever is less, that: (1) augments existing programs, projects, or
		activities; (2) reduces by 10 percent funding for any existing program,
		project, or activity, or numbers of personnel by 10 percent as approved by
		Congress; or (3) results from any general savings from a reduction in personnel
		which would result in a change in existing programs, activities, or projects as
		approved by Congress; unless the Committees on Appropriations of both Houses of
		Congress are notified 15 days in advance of such reprogramming of funds.</text>
						</subsection><subsection changed="added" commented="no" display-inline="no-display-inline" id="ID28040274B69C426AA49A44EB4A70090C" reported-display-style="italic"><enum>(c)</enum><text display-inline="yes-display-inline">The Secretary of Agriculture or the
		Secretary of Health and Human Services shall notify the Committees on
		Appropriations of both Houses of Congress before implementing a program or
		activity not carried out during the previous fiscal year unless the program or
		activity is funded by this Act or specifically funded by any other Act.</text>
						</subsection></section><section commented="no" display-inline="no-display-inline" id="IDD7BF7CD141694975B4098DC5CE59FB10" section-type="subsequent-section"><enum>713.</enum><text display-inline="yes-display-inline">None of the funds appropriated by this or
		any other Act shall be used to pay the salaries and expenses of personnel who
		prepare or submit appropriations language as part of the President's Budget
		submission to the Congress of the United States for programs under the
		jurisdiction of the Appropriations Subcommittees on Agriculture, Rural
		Development, Food and Drug Administration, and Related Agencies that assumes
		revenues or reflects a reduction from the previous year due to user fees
		proposals that have not been enacted into law prior to the submission of the
		Budget unless such Budget submission identifies which additional spending
		reductions should occur in the event the user fees proposals are not enacted
		prior to the date of the convening of a committee of conference for the fiscal
		year 2011 appropriations Act.</text>
					</section><section commented="no" display-inline="no-display-inline" id="ID5F6B8DE46B214ABAB98CA1207A9E3068" section-type="subsequent-section"><enum>714.</enum><text display-inline="yes-display-inline">None of the funds made available by this or
		any other Act may be used to close or relocate a Rural Development office
		unless or until the Secretary of Agriculture determines the cost effectiveness
		and/or enhancement of program delivery: <italic>Provided,</italic> That not
		later than 120 days before the date of the proposed closure or relocation, the
		Secretary notifies the Committees on Appropriation of the House and Senate, and
		the members of Congress from the State in which the office is located of the
		proposed closure or relocation and provides a report that describes the
		justifications for such closures and relocations.</text>
					</section><section commented="no" display-inline="no-display-inline" id="ID24D7D22B55E746E998D1C723ECEAFB09" section-type="subsequent-section"><enum>715.</enum><text display-inline="yes-display-inline">None of the funds made available to the
		Food and Drug Administration by this Act shall be used to close or relocate, or
		to plan to close or relocate, the Food and Drug Administration Division of
		Pharmaceutical Analysis in St. Louis, Missouri, outside the city or county
		limits of St. Louis, Missouri.</text>
					</section><section commented="no" display-inline="no-display-inline" id="id3DD76015459E4701B801CE1CB398F89A" section-type="subsequent-section"><enum><added-phrase reported-display-style="italic"></added-phrase>716.</enum><text display-inline="yes-display-inline">There is hereby appropriated $499,000 for
		any authorized Rural Development program purpose, in communities suffering from
		extreme outmigration and situated in areas that were designated as part of an
		Empowerment Zone pursuant to section 111 of the Community Renewal Tax Relief
		Act of 2000 (as contained in appendix G of Public Law 106–554).</text>
					</section><section commented="no" display-inline="no-display-inline" id="ID15F3079C04264FFB946CEA59D2D97A91" section-type="subsequent-section"><enum>717.</enum><text display-inline="yes-display-inline">None of the funds made available in fiscal
		year 2010 or preceding fiscal years for programs authorized under the Food for
		Peace Act (7 U.S.C. 1691 et seq.) in excess of $20,000,000 shall be used to
		reimburse the Commodity Credit Corporation for the release of eligible
		commodities under section 302(f)(2)(A) of the Bill Emerson Humanitarian Trust
		Act (7 U.S.C. 1736f–1): <italic>Provided,</italic> That any such funds made
		available to reimburse the Commodity Credit Corporation shall only be used
		pursuant to section 302(b)(2)(B)(i) of the Bill Emerson Humanitarian Trust
		Act.</text>
					</section><section commented="no" display-inline="no-display-inline" id="ID4f22baa05e7d4a678b668d834467438a" section-type="subsequent-section"><enum>718.</enum><text display-inline="yes-display-inline">There is hereby appropriated $3,497,000, to
		remain available until expended, for a grant to the National Center for Natural
		Products Research for construction or renovation to carry out the research
		objectives of the natural products research grant issued by the Food and Drug
		Administration.</text>
					</section><section commented="no" display-inline="no-display-inline" id="ID2e40093682be486589d49ae1aad8770d" section-type="subsequent-section"><enum>719.</enum><text display-inline="yes-display-inline">Funds made available under section 1240I
		and section 1241(a) of the Food Security Act of 1985 and section 524(b) of the
		Federal Crop Insurance Act (7 U.S.C. 1524(b)) in the current fiscal year shall
		remain available until expended to disburse obligations made in the current
		fiscal year.</text>
					</section><section commented="no" display-inline="no-display-inline" id="IDDE2272D448A34913A45A4B03C83956D0" section-type="subsequent-section"><enum>720.</enum><text display-inline="yes-display-inline">None of the funds appropriated or otherwise
		made available by this or any other Act shall be used to pay the salaries and
		expenses of personnel to carry out the following:</text>
						<paragraph commented="no" display-inline="no-display-inline" id="IDDBEAF73F386D4573A6635C70A0C78851"><enum>(1)</enum><text display-inline="yes-display-inline">An Environmental Quality Incentives Program
		as authorized by sections 1241–240H of the Food Security Act of 1985, as
		amended (16 U.S.C. 3839aa–3839aa(8)), in excess of $1,180,000,000.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID76DB0292B3874BE09B4C9547173CA901"><enum>(2)</enum><text display-inline="yes-display-inline">a program authorized by section 14(h)(1) of
		the Watershed Protection and Flood Prevention Act (16 U.S.C. 1012(h)(1).</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC458928931ED4E97956FAC36E6D166AA"><enum>(3)</enum><text display-inline="yes-display-inline">a program under subsection (b)(2)(A)(ii) of
		section 14222 of Public Law 110–246 in excess of $1,123,000,000:
		<italic>Provided,</italic> That none of the funds made available in this Act or
		any other Act shall be used for salaries and expenses to carry out section
		19(i)(1)(C) of the Richard B. Russell <act-name parsable-cite="NSLA">National
		School Lunch Act</act-name> as amended by section 4304 of Public Law 110–246 in
		excess of $25,000,000 until October 1, 2010: 
		<proviso><italic>Provided further</italic></proviso>, That the
		unobligated balances under section 32 of the Act of August 24, 1935,
		$52,000,000 are hereby rescinded.</text>
						</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID09bcdc610941427fa36722b767e359ee" section-type="subsequent-section"><enum>721.</enum><text display-inline="yes-display-inline">Hereafter, notwithstanding any other
		provision of law, any former RUS borrower that has repaid or prepaid an
		insured, direct or guaranteed loan under the Rural Electrification Act, or any
		not-for-profit utility that is eligible to receive an insured or direct loan
		under such Act, shall be eligible for assistance under section 313(b)(2)(B) of
		such Act in the same manner as a borrower under such Act.</text>
					</section><section commented="no" display-inline="no-display-inline" id="ID589b3b52f2b946e2b704c0b62eadf88e" section-type="subsequent-section"><enum>722.</enum><text display-inline="yes-display-inline">There is hereby appropriated $2,600,000, to
		remain available until expended, for the planning and design of construction of
		an agricultural pest facility in the State of Hawaii.</text>
					</section><section commented="no" display-inline="no-display-inline" id="id62FF908BE96F4EF7BEF9D6A6BD637789" section-type="subsequent-section"><enum>723.</enum><text display-inline="yes-display-inline">There is hereby appropriated $4,000,000 to
		the Secretary of Agriculture to award grant(s) to develop and field test new
		food products designed to improve the nutritional delivery of humanitarian food
		assistance provided through the McGovern-Dole (section 3107 of the Farm
		Security and Rural Investment Act of 2002 (7 U.S.C. 1736o–1)) and the Food for
		Peace title II (7 U.S.C. 1691 et seq.) programs: 
		<proviso><italic>Provided,</italic></proviso> That the Secretary shall
		use the authorities provided under the Research, Education, and Economics
		mission area of the Department in awarding such grant(s), with priority given
		to proposals that demonstrate partnering with and in-kind support from the
		private sector.</text>
					</section><section commented="no" display-inline="no-display-inline" id="ID9e4705da9f9e4211b59499f5a5cc21bb" section-type="subsequent-section"><enum><added-phrase reported-display-style="italic"></added-phrase>724.<added-phrase reported-display-style="italic"></added-phrase></enum><text display-inline="yes-display-inline">The Rural Utilities Service, Rural Housing
		Service, and Rural Business and Cooperative Service shall permit an applicant
		to solicit and procure professional services and have prepared all
		environmental reviews, assessments, and impact statements: 
		<proviso><italic>Provided</italic></proviso>, That such professional
		services will be funded by the applicants and selected by the agencies from
		procurement schedules of contractors determined qualified to perform said
		services: 
		<proviso><italic>Provided further</italic></proviso>, That the Agencies
		shall establish the scope of work and procedures for such services as well as
		procedures to assure contractors have no financial or other conflicts of
		interest in the outcome of the action and the documentation meets the needs of
		the Agencies: 
		<proviso><italic>Provided further</italic></proviso>, That nothing herein
		shall affect the responsibility of the Agencies to comply with the National
		Environmental Policy Act.</text>
					</section><section commented="no" display-inline="no-display-inline" id="idD25E2F704A924943B744DD19E89A22C4" section-type="subsequent-section"><enum>725.</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
		and until receipt of the decennial Census for the year 2010, the Secretary of
		Agriculture shall consider—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="ID6d6a0f34e4764507a8542ac67af83dab"><enum>(1)</enum><text display-inline="yes-display-inline">The unincorporated community of Los Osos,
		in the County of San Luis Obispo, California, to be a rural area for the
		purposes of eligibility for Rural Utilities Service water and waste disposal
		loans and grants; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID92193a7e4e5a4531b255408e5574fddb"><enum>(2)</enum><text display-inline="yes-display-inline">The unincorporated community of Thermalito
		in Butte County, California, (including individuals and entities with projects
		within the community) eligible for loans and grants funded under the housing
		programs of the Rural Housing Service.</text>
						</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID1B031B4249374719A9FF571D2C60890E" section-type="subsequent-section"><enum>726.</enum><text display-inline="yes-display-inline">There is hereby appropriated $3,000,000 for
		section 4404 of Public Law 107–171.</text>
					</section><section commented="no" display-inline="no-display-inline" id="ID30F128FFBEEA43FEBE6D8F0860978518" section-type="subsequent-section"><enum>727.</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
		there is hereby appropriated:</text>
						<paragraph commented="no" display-inline="no-display-inline" id="IDDB9CC44596DB471BA148ED84B868F8C2"><enum>(1)</enum><text display-inline="yes-display-inline">$3,000,000 of which $2,000,000 shall be for
		a grant to the Wisconsin Department of Agriculture, Trade, and Consumer
		Protection, and $1,000,000 shall be for a grant to the Vermont Agency of
		Agriculture, Foods, and Markets, as authorized by section 6402 of the Farm
		Security and Rural Investment Act of 2002 (7 U.S.C. 1621 note); and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID68213A0C2E1041F09147CC1F6512E31D"><enum>(2)</enum><text display-inline="yes-display-inline">$350,000 for a grant to the Wisconsin
		Department of Agriculture, Trade and Consumer Protection.</text>
						</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID335341204CAF41A0B31123C2163E7AAB" section-type="subsequent-section"><enum>728.</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
		the Natural Resources Conservation Service shall provide financial and
		technical assistance—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="ID8B9BB2B5C39E4BEA9883EDA96CF889C2"><enum>(1)</enum><text display-inline="yes-display-inline">through the Watershed and Flood Prevention
		Operations program for the Pocasset River Floodplain Management Project in the
		State of Rhode Island;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBED1BC5650A94438B252B2EAB95928BF"><enum>(2)</enum><text display-inline="yes-display-inline">through the Watershed and Flood Prevention
		Operations program to carry out the East Locust Creek Watershed Plan Revision
		in Missouri, including up to 100 percent of the engineering assistance and 75
		percent cost share for construction cost of site RW1;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6C67C54FA4F94C88B22D8F0E1100A617"><enum>(3)</enum><text display-inline="yes-display-inline">through the Watershed and Flood Prevention
		Operations program to carry out the Little Otter Creek Watershed project in

		for the purposes of a grant under section 412 of the Agricultural Research,
		Extension, and Education Reform Act of 1998, none of the funds in this or any
		other Act may be used to prohibit the provision of in-kind support from
		non-Federal sources under section 412(e)(3) in the form of unrecovered indirect
		costs not otherwise charged against the grant, consistent with the indirect
		rate of cost approved for a recipient.</text>
					</section><section commented="no" display-inline="no-display-inline" id="IDe90026d8809a459890676eb3208bbaca" section-type="subsequent-section"><enum>731.</enum><text display-inline="yes-display-inline">Except as otherwise specifically provided
		by law, unobligated balances remaining available at the end of the fiscal year
		from appropriations made available for salaries and expenses in this Act for
		the Farm Service Agency and the Rural Development mission area, shall remain
		available through September 30, 2011, for information technology
		expenses.</text>
					</section><section commented="no" display-inline="no-display-inline" id="id377F36DED741483BBC647747CC71A7E2" section-type="subsequent-section"><enum><added-phrase reported-display-style="italic"></added-phrase>732.</enum><subsection commented="no" display-inline="yes-display-inline" id="idFBC46B084E7745B7A0A5C7913D57BB9F"><enum>(a)</enum><header display-inline="yes-display-inline">Child nutrition programs</header><text display-inline="yes-display-inline">Section 9(b) of the Richard B. Russell
		National School Lunch Act (42 U.S.C. 1758(b)) is amended by adding at the end
		the following:</text>

									<subparagraph commented="no" display-inline="no-display-inline" id="idEF8BBF827C6846F69386CA690E503871"><enum>(A)</enum><header display-inline="yes-display-inline">Definition of combat pay</header><text display-inline="yes-display-inline">In this paragraph, the term <quote>combat
		  pay</quote> means any additional payment under chapter 5 of title 37, United
		  States Code, or otherwise designated by the Secretary to be appropriate for
		  exclusion under this paragraph, that is received by or from a member of the
		  United States Armed Forces deployed to a designated combat zone, if the
		  additional pay—</text>
										<clause commented="no" display-inline="no-display-inline" id="idDAEEFDFE0A6A4BF782C5789EB78BAAA6"><enum>(i)</enum><text display-inline="yes-display-inline">is the result of deployment to or service
		  in a combat zone; and</text>

		  serving in a combat zone.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id86B5160CA5DA49CDAD6229B31B145157"><enum>(B)</enum><header display-inline="yes-display-inline">Exclusion</header><text display-inline="yes-display-inline">Combat pay shall not be considered to be
		  income for the purpose of determining the eligibility for free or reduced price
		  meals of a child who is a member of the household of a member of the United
		  States Armed
		  Forces.</text>
									</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subsection><subsection changed="added" commented="no" display-inline="no-display-inline" id="idC02B10670762456B9493A5B40662880C" reported-display-style="italic"><enum>(b)</enum><header display-inline="yes-display-inline">Special supplemental nutrition program for
		women, infants, and children</header><text display-inline="yes-display-inline">Section 17(d)(2) of the Child Nutrition Act
		of 1966 (42 U.S.C. 1786(d)(2)) is amended—</text>

							</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID7052ee804a624397960703d5b4f754f9" section-type="subsequent-section"><enum><added-phrase reported-display-style="italic"></added-phrase>734.</enum><text display-inline="yes-display-inline">Notwithstanding section 17(g)(5) of the
		Child Nutrition Act of 1966 (42.U.S.C. 1786(g)(5)), not more than $15,000,000
		of funds provided in this Act may be used for the purpose of evaluating program
		performance in the Special Supplemental Nutrition Program for Women, Infants
		and Children.</text>
					</section><section commented="no" display-inline="no-display-inline" id="IDee74593c1934419eae7edbcb4756dbb9" section-type="subsequent-section"><enum><added-phrase reported-display-style="italic"></added-phrase>735.</enum><text display-inline="yes-display-inline">Notwithstanding section 17(h)(10)(A) of the
		Child Nutrition Act of 1966 (42 U.S.C. 1786(h)(10)(A)), $154,000,000 of funds
		provided in this Act shall be used for infrastructure, management information
		systems and breastfeeding peer counseling support: 
		<proviso><italic>Provided</italic></proviso>, That of the $154,000,000,
		not less than $14,000,000 shall be used for infrastructure, not less than
		$60,000,000 shall be used for management information systems, and not less than
		$80,000,000 shall be used for breastfeeding peer counselors and other related
		activities.</text>
					</section><section commented="no" display-inline="no-display-inline" id="IDb8a20e140fca4122af6fa0397cc1b6cc" section-type="subsequent-section"><enum>736.</enum><text display-inline="yes-display-inline">Agencies with jurisdiction for carrying out
		international food assistance programs under the jurisdiction of this Act,
		including title II of the Food for Peace Act and the McGovern-Dole
		International Food for Education Program, shall—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="id8B062D4B94514196A1C4A1BB9DF9D575"><enum>(1)</enum><text display-inline="yes-display-inline">provide to the Committees on Appropriations
		of the House and the Senate no later than March 1, 2010, the following:</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID7f56298be5dc4084810c505092c2ba42"><enum>(A)</enum><text display-inline="yes-display-inline">estimates on cost-savings and programmatic
		efficiencies that would result from increased use of pre-positioning of food
		aid commodities and processes to ensure such cargoes are appropriately
		maintained to prevent spoilage;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID255a57dcd37f42f19399ad1629199cd8"><enum>(B)</enum><text display-inline="yes-display-inline">estimates on cost-savings and programmatic
		efficiencies that would result from the use of longer-term commodity
		procurement contracts, the proportional distribution of commodity purchases
		throughout the fiscal year, longer-term shipping contracts, contracts which
		include shared-risk principles, and adoptions of other commercially acceptable
		contracting practices;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe84e91ca0c9c4b8bbdb107061a770cad"><enum>(C)</enum><text display-inline="yes-display-inline">estimates on costs of domestic procurement
		of commodities, domestic inland transportation of food aid commodities,
		domestic storage (including loading and unloading), foreign storage (including
		loading and unloading), foreign inland transportation, and ocean freight
		(including ocean freight as adjusted by the ocean freight differential
		reimbursement provided by the Secretary of Transportation), and costs relating
		to allocation and distribution of commodities in recipient countries;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe97fb159e19a48cdb7a1a382dde53f18"><enum>(D)</enum><text display-inline="yes-display-inline">information on the frequency of delays in
		transporting food aid commodities, the cause or purpose of any delays
		(including how those delays are tracked, monitored and resolved), missed
		schedules by carriers and non-carriers (and resulting program costs due to such
		delays, including impacts to program beneficiaries);</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDaa5eac7439d84bccb359378d95bcf1b7"><enum>(E)</enum><text display-inline="yes-display-inline">information on the methodologies to improve
		interagency coordination between host governments, the World Food Program, and
		non-governmental organization to develop more consistent estimates of food aid
		needs and the number of intended recipients to appropriately inform the
		purchases of commodities and in order to appropriately plan for commodity
		procurement for food aid programs;</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1affb8ce26144f52a29137125b063b6d"><enum>(2)</enum><text display-inline="yes-display-inline">provide the matter described under
		subsection (1) of this section in the form of a consensus report under the
		signatures of the Secretaries of Agriculture, State, and Transportation;
		and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idED749B9BDCE64EB5A12F7509D936CCF3"><enum>(3)</enum><text display-inline="yes-display-inline">estimates and cost savings analysis for
		this section shall be derived from periods representative of normal program
		operations.</text>
						</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID5c7de762a05f41ed85ff1dd4b6067c43" section-type="subsequent-section"><enum>737.</enum><text display-inline="yes-display-inline">There is hereby appropriated $7,000,000 to
		carry out section 4202 of Public Law 110–246.</text>
					</section><section commented="no" display-inline="no-display-inline" id="ID0393bccf3e6d43e6a774b5e269b42a31" section-type="subsequent-section"><enum>738.</enum><text display-inline="yes-display-inline">There is hereby appropriated $2,600,000 to
		carry out section 1621 of Public Law 110–246.</text>
					</section><section commented="no" display-inline="no-display-inline" id="ID476ccce230ef4392a38650eb575c8ac1" section-type="subsequent-section"><enum>739.</enum><text display-inline="yes-display-inline">There is hereby appropriated $4,000,000 to
		carry out section 1613 of Public Law 110–246.</text>
					</section><section commented="no" display-inline="no-display-inline" id="IDf28d0fdec6dc42c4b5a2b9e5924e52ff" section-type="subsequent-section"><enum>740.</enum><text display-inline="yes-display-inline">There is hereby appropriated $250,000, to
		remain available until expended, for a grant to the Kansas Farm Bureau
		Foundation for work-force development initiatives to address out-migration in
		rural areas.</text>
					</section><section commented="no" display-inline="no-display-inline" id="ID4b5ed9fd78154ad5a601f1cc749f4aec" section-type="subsequent-section"><enum>741.</enum><text display-inline="yes-display-inline">There is hereby appropriated $800,000 to
		the Farm Service Agency to carry out a pilot program to demonstrate the use of
		new technologies that increase the rate of growth of re-forested hardwood trees
		on private non-industrial forests lands, enrolling lands on the coast of the
		Gulf of Mexico that were damaged by Hurricane Katrina in 2005.</text>
					</section><section commented="no" display-inline="no-display-inline" id="IDc953eeb50ef3426d8defcfbd7e7264a0" section-type="subsequent-section"><enum>742.</enum><text display-inline="yes-display-inline">Applicants with very low, low, and moderate
		incomes shall be eligible for the program established in section 791 of Public
		Law 109–97.</text>
					</section><section commented="no" display-inline="no-display-inline" id="ID3f9ca3544274413e922fa707a6a8947d" section-type="subsequent-section"><enum>743.</enum><text display-inline="yes-display-inline">The Secretary of Agriculture may authorize
		a State agency to use funds provided in this Act to exceed the maximum amount
		of reconstituted infant formula specified in 7 C.F.R. 246.10 when issuing
		infant formula to participants. Such authorizations shall not otherwise impact
		the eligibility of manufacturers to remain eligible under the Special
		Supplemental Nutrition Program for Women, Infants and Children authorized by
		section 17 of the Child Nutrition Act of 1966.</text>
					</section><section commented="no" display-inline="no-display-inline" id="idFF6B79DE5E3D4537AF574DEA9A7E154E" section-type="subsequent-section"><enum>744.</enum><text display-inline="yes-display-inline">None of the funds made available by this
		Act may be used to establish or implement a rule allowing poultry products to
		be imported into the United States from the People's Republic of China unless
		the Secretary of Agriculture formally commits in advance to conduct audits of
		inspection systems, on-site reviews of slaughter and processing facilities,
		laboratories and other control operations before any Chinese facilities are
		certified as eligible to ship fully cooked poultry products to the United
		States, and at least once annually in subsequent years: 
		<proviso><italic>Provided</italic></proviso>, That the Secretary commits
		in advance to implement a significantly increased level of port of entry
		re-inspection: 
		<proviso><italic>Provided further</italic></proviso>, That the Secretary
		commits in advance to conduct information sharing with other countries
		importing poultry products from China that have conducted audits and plant
		inspections: <italic>Provided further</italic>, That this section shall be
		applied in a manner consistent with United States obligations under
		international trade agreements.</text>
					</section><section id="id97A269E5D9BA4500A0284DB2F843ACBD"><enum>745.</enum><subsection commented="no" display-inline="yes-display-inline" id="id16037F2B9ED04215896B1C372085CAB8"><enum>(a)</enum><text display-inline="yes-display-inline">The Commissioner of Food and Drugs may
		establish within the Food and Drug Administration a review group which shall
		recommend to the Commissioner of Food and Drugs appropriate preclinical, trial
		design, and regulatory paradigms and optimal solutions for the prevention,
		diagnosis, and treatment of rare diseases: <italic>Provided,</italic> That the
		Commissioner of Food and Drugs shall appoint 8 individuals employed by the Food
		and Drug Administration to serve on the review group: <italic>Provided
		further,</italic> That members of the review group shall have specific
		expertise relating to the development of articles for use in the prevention,
		diagnosis, or treatment of rare diseases, including specific expertise in
		developing or carrying out clinical trials.</text>
						</subsection><subsection changed="added" id="ID8dc995075a7e4fb8a35058bbe32355fa" reported-display-style="italic"><enum>(b)</enum><text>The Commissioner of Food
		and Drugs may establish within the Food and Drug Administration a review group
		which shall recommend to the Commissioner of Food and Drugs appropriate
		preclinical, trial design, and regulatory paradigms and optimal solutions for
		the prevention, diagnosis, and treatment of neglected diseases of the
		developing world: <italic>Provided,</italic> That the Commissioner of Food and
		Drugs shall appoint 8 individuals employed by the Food and Drug Administration
		to serve on the review group: <italic>Provided further,</italic> That members
		of the review group shall have specific expertise relating to the development
		of articles for use in the prevention, diagnosis, or treatment of neglected
		diseases of the developing world, including specific expertise in developing or
		carrying out clinical trials: <italic>Provided further,</italic> That for the
		purposes of this section the term <quote>neglected disease of the developing
		world</quote> means a tropical disease, as defined in section 524(a)(3) of the
		Federal Food, Drug, and Cosmetic Act (21 U.S.C. 360n(a)(3)).</text>
						</subsection><subsection changed="added" id="IDa5958fd0e7954ff6b88be8e54e1b79bb" reported-display-style="italic"><enum>(c)</enum><text>The Commissioner of Food
		and Drugs shall—</text>
							<paragraph id="ID7cb15487d96d43f88b983f7641c5ef19"><enum>(1)</enum><text>submit, not later than 1
		year after the date of the establishment of review groups under subsections (a)
		and (b), a report to Congress that describes both the findings and
		recommendations made by the review groups under subsections (a) and (b);</text>
							</paragraph><paragraph id="IDb8da17b670c84056808b883c7c39ee4b"><enum>(2)</enum><text>issue, not later than 180
		days after submission of the report to Congress under paragraph (1), guidance
		based on such recommendations for articles for use in the prevention,
		diagnosis, and treatment of rare diseases and for such uses in neglected
		diseases of the developing world; and</text>
							</paragraph><paragraph id="ID68a652d55d7c4fe482e1282ead095702"><enum>(3)</enum><text>develop, not later than
		180 days after submission of the report to Congress under paragraph (1),
		internal review standards based on such recommendations for articles for use in
		the prevention, diagnosis, and treatment of rare diseases and for such uses in
		neglected diseases of the developing world.</text>
							</paragraph></subsection></section><section id="id4AE3C773DAD84EA3BF539059E57C7887"><enum>746.</enum><text display-inline="yes-display-inline">Not later than 60 days after the date of
		enactment of this Act, the Administrator of the Foreign Agricultural Service
		shall submit to Congress a report that describes the status of the
		reorganization of the Foreign Agricultural Service and any future plans of the
		Administrator to modify office structures to meet existing, emerging, and new
		priorities.</text>
					</section><section id="id909E634E6EF8485E8B9EFF5F719EF3E6"><enum>747.</enum><text display-inline="yes-display-inline">None of the funds made available by this
		Act may be used to pay the salaries and expenses of any employee of the
		Department of Agriculture to assess any agency any greenbook charge or to use
		any funds acquired through an assessment of greenbook charges made prior to the
		date of enactment of this Act.</text>
					</section><section id="idF34B14F54A1B4D0296F04F49AAC545E4"><enum>748.</enum><text display-inline="yes-display-inline">The Commissioner of Food and Drugs, in
		consultation with the Administrator of the National Oceanic and Atmospheric
		Administration, shall conduct a study and, not later than 240 days after the
		date of enactment of this Act, submit a report to Congress on the technical
		challenges associated with inspecting imported seafood. The study and report
		shall—</text>
						<paragraph id="IDef4ec640065842b48c012cee9def917d"><enum>(1)</enum><text>provide information on
		the status of seafood importation, including—</text>
							<subparagraph id="id241817116E2A441785B9E12BBB257364"><enum>(A)</enum><text>the volume of seafood
		imported into the United States annually, by product and country of
		origin;</text>
							</subparagraph><subparagraph id="id0D8A0CB912B7426FBA960AEDD15F19CC"><enum>(B)</enum><text>the number of physical
		inspections of imported seafood products conducted annually, by product and
		country of origin; and</text>
							</subparagraph><subparagraph id="id8829DC79832A4678B373CCF014FAA90F"><enum>(C)</enum><text>a listing of the United
		States ports of entry for seafood imports by volume;</text>
							</subparagraph></paragraph><paragraph id="ID3aeb011c31a84d9dbddc0f961dca1e3a"><enum>(2)</enum><text>provide information on
		imported seafood products, by product and country of origin, that do not meet
		standards as set forth in the applicable food importation law, including the
		reason for which each such product does not meet such standards;</text>
						</paragraph><paragraph id="ID466534009ebc4bc395064b644be682ad"><enum>(3)</enum><text>identify the fish,
		crayfish, shellfish, and other sea species most susceptible to violations of
		the applicable food importation law;</text>
						</paragraph><paragraph id="IDd6b0c715dc9c462baa7711e78dac4e5c"><enum>(4)</enum><text>identify the aquaculture
		and mariculture practices that are of greatest concern to human health;
		and</text>
						</paragraph><paragraph id="ID1c8121d403674ad085549ab5556ce536"><enum>(5)</enum><text>suggest methods for
		improving import inspection policies and procedures to protect consumers in the
		United States.</text>
						</paragraph></section><section id="id7C3C931E1E624B788C9F8B4E0B680339"><enum>749.</enum><subsection commented="no" display-inline="yes-display-inline" id="id5416C3668961410BAA5E7A4CE741D826"><enum>(a)</enum><header>In
		general</header><text display-inline="yes-display-inline">Not later than 1 year
		after the date of the enactment of this Act, the Comptroller General of the
		United States, shall report to the Committees on Appropriations of the House of
		Representatives and of the Senate on developing the tourism potential of rural
		communities.</text>
						</subsection><subsection changed="added" id="id198CF9B081EE4C36A7690742A855652A" reported-display-style="italic"><enum>(b)</enum><header>Content of the
		report</header><text>The report required by subsection (a) shall—</text>
							<paragraph id="idFA62C2087E514C0BB04923C898D0FC05"><enum>(1)</enum><text>identify existing Federal
		programs that provide assistance to rural small businesses in developing
		tourism marketing and promotion plans relating to tourism in rural
		areas;</text>
							</paragraph><paragraph id="idE9BC169F6A894BD4A664EE70A844E5DE"><enum>(2)</enum><text>identify existing Federal
		programs that assist rural small business concerns in obtaining capital for
		starting or expanding businesses primarily serving tourists; and</text>
							</paragraph><paragraph id="idFBEF1145451841EA8AF1E717AC1D5474"><enum>(3)</enum><text>include recommendations,
		if any, for improving existing programs or creating new Federal programs that
		may benefit tourism in rural communities.</text>
							</paragraph></subsection></section><section id="id501317A10F1A4FCCB68E0BE748111664"><enum>750.</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of law
		and until the receipt of the decennial census in the year 2010, the Secretary
		of Agriculture may fund community facility and water and waste disposal
		projects of communities and municipal districts and areas in Connecticut,
		Massachusetts, and Rhode Island that filed applications for the projects with
		the appropriate rural development field office of the Department of Agriculture
		prior to August 1, 2009, and were determined by the field office to be eligible
		for funding.</text>
					</section><section id="id7FF8AEDAE73F4D28BB172B23A7E831E8"><enum>751.</enum><subsection commented="no" display-inline="yes-display-inline" id="idE6ECF7D80C1141C284B8FB0264C48148"><enum>(a)</enum><text display-inline="yes-display-inline">The Senate finds that—</text>
							<paragraph changed="added" id="id7449FE3B281B4DF08ACA167B33B3411D" reported-display-style="italic"><enum>(1)</enum><text>sudden loss in late 2008
		of export-market based demand equivalent to about 3 percent of domestic milk
		production has thrown the U.S. dairy industry into a critical supply-demand
		imbalance;</text>
							</paragraph><paragraph changed="added" id="id5933B8C3D33740B6AFA596B871B40263" reported-display-style="italic"><enum>(2)</enum><text>an abrupt decline in U.S.
		exports was fueled by the onset of the global economic crisis combined with
		resurgence of milk supplies in Oceania;</text>
							</paragraph><paragraph changed="added" id="id8E5DFEF211664C878068DE667F1A0F07" reported-display-style="italic"><enum>(3)</enum><text>the U.S. average all-milk
		price reported by the National Agriculture Statistics Service from January
		through May of 2009, has averaged $4.80 per hundredweight below the cost of
		production;</text>
							</paragraph><paragraph changed="added" id="id715C714C0E7041D78E22DDA82743B3CE" reported-display-style="italic"><enum>(4)</enum><text>approximately
		$3,900,000,000 in dairy producer equity has been lost since January;</text>
							</paragraph><paragraph changed="added" id="idB647F546B71D499ABF0CD6413E5CCA0C" reported-display-style="italic"><enum>(5)</enum><text>anecdotal evidence
		suggests that U.S. dairy producers are losing upwards of $100 per cow per
		month;</text>
							</paragraph><paragraph changed="added" id="idCB1907A6010A49B39FCAE4A76EA984E7" reported-display-style="italic"><enum>(6)</enum><text>the Food, Conservation,
		and Energy Act of 2008 extended the counter-cyclical Milk Income Loss Contract
		(MILC) support program and instituted a ‘feed cost adjuster’ to augment that
		support;</text>
							</paragraph><paragraph changed="added" id="id1B19EFBEDE124CAE97292289D8829593" reported-display-style="italic"><enum>(7)</enum><text>the Secretary of
		Agriculture in March transferred approximately 200,000,000 pounds of nonfat dry
		milk to USDA’s Food and Nutrition Service in a move designed to remove
		inventory from the market and support low-income families;</text>
							</paragraph><paragraph changed="added" id="idEAFE80582BC94916A3A5F839078335DC" reported-display-style="italic"><enum>(8)</enum><text>the Secretary on March
		22nd reactivated USDA’s Dairy Export Incentive Program (DEIP) to help U.S.
		producers meet prevailing world prices and develop international
		markets;</text>
							</paragraph><paragraph changed="added" id="idA7E8A379C55E4C2D920D2FA9B399CE4E" reported-display-style="italic"><enum>(9)</enum><text>the Secretary announced
		on July 31, 2009 a temporary increase in the amount paid for dairy products
		through the Dairy Product Price Support Program (DPPSP), an adjustment that is
		projected to increase dairy farmers’ revenue by $243,000,000; and</text>
							</paragraph><paragraph changed="added" id="idC61C12CEB4DD421CAFA235C3338CC2E4" reported-display-style="italic"><enum>(10)</enum><text>U.S. dairy producers
		face unprecedented challenges that threaten the stability of the industry, the
		nation’s milk production infrastructure, and thousands of rural
		communities.</text>
							</paragraph></subsection><subsection changed="added" id="id7B345309ED3A472EA19C6F17005B9177" reported-display-style="italic"><enum>(b)</enum><text display-inline="yes-display-inline">The Senate states that the Secretary of
		Agriculture and the President’s Office of Management and Budget should continue
		to closely monitor the U.S. dairy sector and use all available discretionary
		authority to ensure its long-term health and sustainability.</text>
						</subsection></section><section id="id4560125423AA499CBB818A263C3DD673"><enum>752.</enum><subsection commented="no" display-inline="yes-display-inline" id="id5F55DDC2C240475DB1C422323FEA5C96"><enum>(a)</enum><text display-inline="yes-display-inline">The Commissioner of Food and Drugs, in
		consultation with the Secretary of Agriculture, may conduct a study on the
		labeling of personal care products regulated by the Food and Drug
		Administration for which organic content claims are made. Any such study shall
		include—</text>
							<paragraph changed="added" id="IDacebd6f5181d408085776f184504831b" reported-display-style="italic"><enum>(1)</enum><text>a survey of personal care
		products for which the word <quote>organic</quote> appears on the label;
		and</text>
							</paragraph><paragraph changed="added" id="IDeb823e9934ea4e4497c14ef52558c1b3" reported-display-style="italic"><enum>(2)</enum><text>a determination, based on
		statistical sampling of the products identified under paragraph (1), of the
		accuracy of such claims.</text>
							</paragraph></subsection><subsection changed="added" id="ID776c45c874e34550a81a803a1437667e" reported-display-style="italic"><enum>(b)</enum><text>If the Commissioner of
		Food and Drugs conducts a study described in subsection (a), such Commissioner
		shall—</text>
							<paragraph id="idBD8A9055E3634A61B23303FA2998FEFB"><enum>(1)</enum><text>not later than 270 days
		after the date of enactment of this Act, submit to the Committees on
		Agriculture, Nutrition, and Forestry, Appropriations, and Health, Education,
		Labor, and Pensions in the Senate and the Committees on Agriculture,
		Appropriations, and Energy and Commerce in the House of Representatives a
		report on the findings of the study under subsection (a); and</text>
							</paragraph><paragraph id="ID79fdec7ddbdc4eb1b9175a41927c5aa2"><enum>(2)</enum><text>provide such Committees
		with any recommendations on the need to establish labeling standards for
		personal care products for which organic content claims are made, including
		whether the Food and Drug Administration should have pre-market approval
		authority for personal care product labeling.</text>
							</paragraph></subsection></section><section id="id8BCF6F17FFDA4CADB4C53487A8BA12C8"><enum>753.</enum><subsection commented="no" display-inline="yes-display-inline" id="idC863CF3D21E0422AA8BEA7067A5A7E93"><enum>(a)</enum><text display-inline="yes-display-inline">The Senate finds that—</text>
							<paragraph changed="added" id="IDc49952f5fab04e88b0252a9176c9d2db" reported-display-style="italic"><enum>(1)</enum><text>agriculture is a national
		security concern;</text>
							</paragraph><paragraph changed="added" id="id0EDA28D1F0F64A9EB467D3A118305598" reported-display-style="italic"><enum>(2)</enum><text>the United States suffers
		from periodic disasters which affects the food and fiber supply of the United
		States;</text>
							</paragraph><paragraph changed="added" id="ID71bdcc72a78b4eb1964b6d68e2def41c" reported-display-style="italic"><enum>(3)</enum><text>the Food, Conservation,
		and Energy Act of 2008 (7 U.S.C. 8701 et seq.) established 5 permanent disaster
		programs to deliver timely and immediate assistance to agricultural producers
		recovering from losses;</text>
							</paragraph><paragraph changed="added" id="idCAE2C9D2D959454BA1BDD7EAB77E8CA6" reported-display-style="italic"><enum>(4)</enum><text>as of the date of
		enactment of this Act, of those 5 disaster programs—</text>
								<subparagraph id="idA6BDB86E22BF4B79864329DE79D14914"><enum>(A)</enum><text>none are available,
		finalized, and implemented to deliver urgently needed assistance for 2009
		producer losses; and</text>
								</subparagraph><subparagraph id="idDFC80309CCFC401BA8B02220A734C64C"><enum>(B)</enum><text>only 1 is being
		implemented for 2008 losses;</text>
								</subparagraph></paragraph><paragraph changed="added" id="id0012E66C72BD4E039CBCE11D8831074B" reported-display-style="italic"><enum>(5)</enum><text>according to the Drought
		Monitor, the State of Texas is suffering from extreme and exceptional drought
		conditions, the highest level of severity; and</text>
							</paragraph><paragraph changed="added" id="ID7cc69b614dfd4830a9b8607ab0dd04b7" reported-display-style="italic"><enum>(6)</enum><text>the Secretary of
		Agriculture has previously authorized various forms of disaster assistance by
		providing funding under section 32 of the Act of August 24, 1935 (7 U.S.C.
		612c), and through the Commodity Credit Corporation.</text>
							</paragraph></subsection><subsection changed="added" id="id870BF46F21C042AEAD498084E9096F80" reported-display-style="italic"><enum>(b)</enum><text>It is the sense of the
		Senate that the Secretary of Agriculture should use all of the discretionary
		authority available to the Secretary to make available immediate relief and
		assistance for agricultural producers suffering losses as a result of the 2009
		droughts.</text>
						</subsection></section><section id="id1649E50EB1DB42D48CB3A4FC3FA7F28C"><enum>754.</enum><subsection commented="no" display-inline="yes-display-inline" id="id8C2D2272D8B74B409EB1FC3991F790ED"><enum>(a)</enum><text display-inline="yes-display-inline">The Senate finds that—</text>
							<paragraph changed="added" id="ID4a45f15f7caa462eb5725115661670e2" reported-display-style="italic"><enum>(1)</enum><text>with livestock producers
		facing losses from harsh weather in 2008 and continuing to face disasters in
		2009, Congress wanted to assist livestock producers in recovering losses more
		quickly and efficiently than previous ad hoc disaster assistance
		programs;</text>
							</paragraph><paragraph changed="added" id="ID58e139c82ff243e9afb213e7df6e60a4" reported-display-style="italic"><enum>(2)</enum><text>on June 18, 2008,
		Congress established the livestock indemnity program under section 531(c) of
		the Federal Crop Insurance Act (7 U.S.C. 1531(c)) and section 901(c) of the
		Trade Act of 1974 (19 U.S.C. 2497(c)) as a permanent disaster assistance
		program to provide livestock producers with payments of 75 percent of the fair
		market value for livestock losses as a result of adverse weather such as
		floods, blizzards, and extreme heat;</text>
							</paragraph><paragraph changed="added" id="ID5db7e4f307334e92846b2441c422a9e8" reported-display-style="italic"><enum>(3)</enum><text>on July 13, 2009, the
		Secretary of Agriculture promulgated rules for the livestock indemnity program
		that separated non adult beef animals into weight ranges of <quote>less than
		400 pounds</quote> and <quote>400 pounds and more</quote>; and</text>
							</paragraph><paragraph changed="added" id="IDda7538ec6da5405cb40a729e5e793414" reported-display-style="italic"><enum>(4)</enum><text>the <quote>400 pounds and
		more</quote> range would fall well short of covering 75 percent market value
		payment for livestock in these higher ranges that are close to market
		weight.</text>
							</paragraph></subsection><subsection changed="added" id="IDbe145317d25f48b0a1a6fba3a8e97ec6" reported-display-style="italic"><enum>(b)</enum><text>It is the sense of the
		Senate that the Secretary of Agriculture—</text>
							<paragraph id="IDd0515540aa4d456990a21a07676e69d0"><enum>(1)</enum><text>should strive to
		establish a methodology to calculate more specific payments to offset the cost
		of loss for each animal as was intended by Congress for calendar years 2008
		through 2011; and</text>
							</paragraph><paragraph id="ID5cea802d5adb4f22b5da672ca65b60d5"><enum>(2)</enum><text>should work with groups
		representing affected livestock producers to come up with this more precise
		methodology.</text>
							</paragraph></subsection></section><appropriations-intermediate commented="no" id="id466EE3FA5F1445AC813EA30A497E9383"><text display-inline="no-display-inline">This Act may be cited as the
	 <quote><short-title>Agriculture, Rural Development, Food
	 and Drug Administration, and Related Agencies Appropriations Act,
	 2010</short-title></quote>.</text></appropriations-intermediate></title></amendment-block></amendment></engrossed-amendment-body>
