				receives a sole survivorship discharge, the Secretary concerned—</text>

				member of the unearned portion of any bonus, incentive pay, or similar benefit
				previously paid to the member; and</text>
										</clause><clause id="HFD399397CB8A45C4A6F32BDBA129A79D" indent="up1"><enum>(ii)</enum><text>may grant an exception to the
				requirement to terminate the payment of any unpaid amounts of a bonus,
				incentive pay, or similar benefit if the Secretary concerned determines that
				termination of the payment of the unpaid amounts would be contrary to a
				personnel policy or management objective, would be against equity and good
				conscience, or would be contrary to the best interests of the United
				States.</text>
										</clause></subparagraph><subparagraph id="H96393D77052D49308A79E76F6261B047" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">In
				this paragraph, the term <quote>sole survivorship discharge</quote> means the
				separation of a member from the Armed Forces, at the request of the member,
				pursuant to the Department of Defense policy permitting the early separation of
				a member who is the only surviving child in a family in which—</text>
										<clause id="HBDFD8A293FFF4CA0A73D2F45F3A9334D"><enum>(i)</enum><text>the father or mother or one or more
				siblings—</text>
											<subclause id="H4678748B44534FB38543EF0AF9ABE86A"><enum>(I)</enum><text>served in the Armed Forces; and</text>
											</subclause><subclause id="H43B452328A4447B6BE519C59B51A5919"><enum>(II)</enum><text>was killed, died as a result of wounds,
				accident, or disease, is in a captured or missing in action status, or is
				permanently 100 percent disabled or hospitalized on a continuing basis (and is
				not employed gainfully because of the disability or hospitalization);
				and</text>
											</subclause></clause><clause id="id69E572F68E34484FA0D3DC019D54A8C5"><enum>(ii)</enum><text>the death, status, or disability
				did not result from the intentional misconduct or willful neglect of the parent
				or sibling and was not incurred during a period of unauthorized
				absence.</text>
										</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection></section></subtitle><subtitle id="H3CB5F6BFE6D747899953D20E722E8C28"><enum>B</enum><header>Retired Pay
			 Benefits</header>
				<section id="H1D970EBEDCF0415BB337D83F9733BF0E" section-type="subsequent-section"><enum>111.</enum><header>Recomputation of
			 retired pay and adjustment of retired grade of Reserve retirees to reflect
			 service after retirement</header>
					<subsection id="HC5713189C9714B4D97FA709577AC9B96"><enum>(a)</enum><header>Recomputation of
			 retired pay</header><text display-inline="yes-display-inline">Section 12739 of
			 title 10, United States Code, is amended by adding at the end the following new
			 subsection:</text>
						<quoted-block display-inline="no-display-inline" id="H443C9D2450B746DA868EE272E6617EC7" style="OLC">
							<subsection id="HE31356B945DD45A9B6370D6C667189AB"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H6293115F74174613AF6CABF9381F3C5A"><enum>(1)</enum><text display-inline="yes-display-inline">If a member of the Retired Reserve is
				recalled to an active status in the Selected Reserve of the Ready Reserve under
				section 10145(d) of this title and completes not less than two years of service
				in such active status, the member is entitled to the recomputation under this
				section of the retired pay of the member.</text>
								</paragraph><paragraph id="HBC215B21119B436396E0DD55BC40EDF9" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary concerned may reduce the
				two-year service requirement specified in paragraph (1) in the case of a member
				who—</text>
									<subparagraph id="HD6CDABB77B6848259B809122399A98EC"><enum>(A)</enum><text>is recalled to serve in a position of
				adjutant general required under section 314 of title 32 or in a position of
				assistant adjutant general subordinate to such a position of adjutant
				general;</text>
									</subparagraph><subparagraph id="HC899F31A29764C1EAF545D0E7C0AB695"><enum>(B)</enum><text>completes at least six months of
				service in such position; and</text>
									</subparagraph><subparagraph id="H35EE90AC96904D11B177F94A0F530256"><enum>(C)</enum><text>fails to complete the minimum two
				years of service solely because the appointment of the member to such position
				is terminated or vacated as described in section 324(b) of title
				32.</text>
									</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="H9CE6F67EE61F41F5BD362CD4FC74A7A3"><enum>(b)</enum><header>Adjustment of
			 retired grade</header><text display-inline="yes-display-inline">Section 12771
			 of such title is amended—</text>
						<paragraph id="HB4E3E1EF56FE4A4CA9C35937F2B22002"><enum>(1)</enum><text>by striking
			 <quote>Unless</quote> and inserting <quote>(a)
			 <header-in-text level="subsection" style="OLC">Grade on
			 transfer</header-in-text>.—Unless</quote>; and</text>
						</paragraph><paragraph id="H4398CBFA58424E9F961F38207CF973D6"><enum>(2)</enum><text>by adding at the
			 end the following new subsection:</text>
							<quoted-block display-inline="no-display-inline" id="H5B54198A0C264F72B7D87D815EB5719A" style="OLC">
								<subsection id="HD0FAE5A4D7CF46B295E52C16D1350A04"><enum>(b)</enum><header>Effect of
				subsequent recall to active status</header><paragraph commented="no" display-inline="yes-display-inline" id="H6869849798BE4281B12BCD248115A28D"><enum>(1)</enum><text display-inline="yes-display-inline">If a member of the Retired Reserve who is a
				commissioned officer is recalled to an active status in the Selected Reserve of
				the Ready Reserve under section 10145(d) of this title and completes not less
				than two years of service in such active status, the member is entitled to an
				adjustment in the retired grade of the member in the manner provided in section
				1370(d) of this title.</text>
									</paragraph><paragraph id="HC58E0EE0AD6B4969A228D221047D7CE3" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary concerned may reduce the
				two-year service requirement specified in paragraph (1) in the case of a member
				who—</text>
										<subparagraph id="HD519107E5B90474AADCB974FB881B4E7"><enum>(A)</enum><text>is recalled to serve in a position of
				adjutant general required under section 314 of title 32 or in a position of
				assistant adjutant general subordinate to such a position of adjutant
				general;</text>
										</subparagraph><subparagraph id="HE491C5DE4774474C8BF9121063D5DBA3"><enum>(B)</enum><text>completes at least six months of
				service in such position; and</text>
										</subparagraph><subparagraph id="H6CDF2237C85D4100BC4344F693DF5E5C"><enum>(C)</enum><text>fails to complete the minimum two
				years of service solely because the appointment of the member to such position
				is terminated or vacated as described in section 324(b) of title

			 retired pay for non-regular service upon retirement for service in an active
			 reserve status performed after attaining eligibility for regular
			 retirement</header>
					<subsection id="H3334B0C41023455F8A81DDA37C3A0732"><enum>(a)</enum><header>Election
			 authority; requirements</header><text display-inline="yes-display-inline">Subsection (a) of section 12741 of title
			 10, United States Code, is amended to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="HDD90053F93A74EEB95CDF0C9502F9D9E" style="OLC">
							<subsection id="H5072975D4B2E464D92BC7DC7F5AB9CF5"><enum>(a)</enum><header>Authority To
				elect To receive reserve retired pay</header><paragraph commented="no" display-inline="yes-display-inline" id="H9FE306E79F40462781BD9B2D3C148A64"><enum>(1)</enum><text display-inline="yes-display-inline">Notwithstanding the requirement in
				paragraph (4) of section 12731(a) of this title that a person may not receive
				retired pay under this chapter when the person is entitled, under any other
				provision of law, to retired pay or retainer pay, a person may elect to receive
				retired pay under this chapter, instead of receiving retired or retainer pay
				under chapter 65, 367, 571, or 867 of this title, if the person—</text>
									<subparagraph id="HECF5BD63AA174528AC19E6397B78C297" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">satisfies the requirements specified in
				paragraphs (1) and (2) of such section for entitlement to retired pay under
				this chapter;</text>
									</subparagraph><subparagraph id="H46E9F1961B5C4D04A0AECC71AD75A82A" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">served in an active status in the Selected
				Reserve of the Ready Reserve after becoming eligible for retirement under
				chapter 65, 367, 571, or 867 of this title (without regard to whether the
				person actually retired or received retired or retainer pay under one of those
				chapters); and</text>
									</subparagraph><subparagraph id="H1A17858313E94071AA3A234CB16E3730" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">completed not less than two years of
				satisfactory service (as determined by the Secretary concerned) in such active
				status (excluding any period of active service).</text>
									</subparagraph></paragraph><paragraph id="HC7EBC05AB6544DB8B33CA92FAFBC6AFC" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary concerned may reduce the
				minimum two-year service requirement specified in paragraph (1)(C) in the case
				of a person who—</text>
									<subparagraph id="H3C84F84A94AD4BB8A3E4139925E92FB6"><enum>(A)</enum><text display-inline="yes-display-inline">completed at least six months of service in
				a position of adjutant general required under section 314 of title 32 or in a
				position of assistant adjutant general subordinate to such a position of
				adjutant general; and</text>
									</subparagraph><subparagraph id="H5A5BEDE3CF3D42C6892BC58CC9AAF6BE"><enum>(B)</enum><text>failed to complete the minimum years
				of service solely because the appointment of the person to such position was
				terminated or vacated as described in section 324(b) of title
				32.</text>
									</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="H62DD675B209D4958BF8320E3F9DB7D47"><enum>(b)</enum><header>Actions To
			 effectuate election</header><text>Subsection (b) of such section is amended by
			 striking paragraph (1) and inserting the following new paragraph:</text>

			 amendment To reflect new variable age requirement for

			 concurrent receipt</header><text>Subsection (a) of section 1414 of title 10,
			 United States Code, is amended to read as follows:</text>

									<subparagraph id="H114B8291C1F640ACB6D64A1628790062"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Subject to subsection
				(b), a member or former member of the uniformed services who is entitled for
				any month to retired pay and who is also entitled for that month to veterans’
				disability compensation for a qualifying service-connected disability (in this
				section referred to as a <quote>qualified retiree</quote>) is entitled to be
				paid both for that month without regard to sections 5304 and 5305 of title
				38.</text>
									</subparagraph><subparagraph id="HEEE9E12B7B9E4569B42CAB8E5E4109D7"><enum>(B)</enum><header>Applicability of
				full concurrent receipt phase-in requirement</header><text display-inline="yes-display-inline">During the period beginning on January 1,
				2004, and ending on December 31, 2013, payment of retired pay to a qualified
				retiree is subject to subsection (c).</text>
									</subparagraph><subparagraph id="H358DCB8E7DB945F1A0EED58028751D2A"><enum>(C)</enum><header>Phase-in
				exception for 100 percent disabled retirees</header><text>The payment of
				retired pay is subject to subsection (c) only during the period beginning on
				January 1, 2004, and ending on December 31, 2004, in the case of the following
				qualified retirees:</text>
										<clause id="HF12F82257C2746BC9BB610A654A8509B"><enum>(i)</enum><text>A
				qualified retiree receiving veterans’ disability compensation for a disability
				rated as 100 percent.</text>
										</clause><clause id="HD0DD5E61526346B5B36408309C80BC70"><enum>(ii)</enum><text>A
				qualified retiree receiving veterans’ disability compensation at the rate
				payable for a 100 percent disability by reason of a determination of individual
				unemployability.</text>
										</clause></subparagraph><subparagraph id="HEFD426F4B19E4CC39206DE6BA3E73D0E"><enum>(D)</enum><header>Temporary
				phase-in exception for certain chapter 61 disability retirees;
				termination</header><text display-inline="yes-display-inline">Subject to
				subsection (b), during the period beginning on January 1, 2010, and ending on
				September 30, 2010, subsection (c) shall not apply to a qualified retiree
				described in subparagraph (B) or (C) of paragraph (2).</text>
									</subparagraph></paragraph><paragraph id="HB3E2D23721A4405FB18086EB656699CA"><enum>(2)</enum><header>Qualifying
				service-connected disability defined</header><text>In this section, the term
				<quote>qualifying service-connected disability</quote> means the
				following:</text>
									<subparagraph id="H383D6F2A2AE242039CBC72D391F0A8EA"><enum>(A)</enum><text>In the case of a
				member or former member receiving retired pay under any provision of law other
				than chapter 61 of this title, or under chapter 61 with 20 years or more of
				service otherwise creditable under section 1405 or computed under section 12732
				of this title, a service-connected disability or combination of
				service-connected disabilities that is rated as not less than 50 percent
				disabling by the Secretary of Veterans Affairs.</text>
									</subparagraph><subparagraph id="HF90C6E8F41F94B7EB1000809590C8DDF"><enum>(B)</enum><text display-inline="yes-display-inline">In the case of a member or former member
				receiving retired pay under chapter 61 of this title with less than 20 years of
				service otherwise creditable under section 1405 or computed under section 12732
				of this title, a service-connected disability or combination of
				service-connected disabilities that is rated by the Secretary of Veterans
				Affairs at the disabling level specified in one of the following clauses (and,
				subject to paragraph (3), is effective on or after the date specified in the
				applicable clause):</text>
										<clause id="HD2EC3F459CC24955A7CBAFDF2AC6F23A"><enum>(i)</enum><text>January 1, 2010,
				rated 100 percent, or a rate payable at 100 percent by reason of individual
				unemployability or rated 90 percent.</text>
										</clause><clause id="H5C2DFE426D2B4A4AA0D22CAE9305ADAD"><enum>(ii)</enum><text>January 1, 2011,
				rated 80 percent or 70 percent.</text>
										</clause><clause id="H898B64DE63284FFABB06442FFEB23087"><enum>(iii)</enum><text>January 1, 2012,
				rated 60 percent or 50 percent.</text>
										</clause></subparagraph><subparagraph id="H1F501BB486F044DFBA59320BDD82022E"><enum>(C)</enum><text display-inline="yes-display-inline">In the case of a member or former member
				receiving retired pay under chapter 61 regardless of years of service, a
				service-connected disability or combination of service-connected disabilities
				that is rated by the Secretary of Veterans Affairs at the disabling level
				specified in one of the following clauses (and, subject to paragraph (3), is
				effective on or after the date specified in the applicable clause):</text>
										<clause id="H455E8F52B610463898AF9E32310B1570"><enum>(i)</enum><text>January 1, 2013,
				rated 40 percent or 30 percent.</text>
										</clause><clause id="H4DA9DF03420D4BC5B86EEC8FCB8E3383"><enum>(ii)</enum><text>January 1, 2014,
				any rating.</text>
										</clause></subparagraph></paragraph><paragraph id="H7D2E3D4588464259BF27AEDFAF845B7C"><enum>(3)</enum><header>Limited
				duration</header><text>Notwithstanding the effective date specified in each
				clause of subparagraphs (B) and (C) of paragraph (2), the clause shall apply
				only if the termination date specified in subparagraph (D) of paragraph (1)
				occurs during or after the calendar year specified in the clause, except that,
				eligibility may not extend beyond the termination
				date.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="H7A1E7B3DC0AC42BA9FBD839F02699350"><enum>(b)</enum><header>Conforming
			 amendment to special rules for chapter 61 disability retirees</header><text display-inline="yes-display-inline">Subsection (b) of such section is amended
			 to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="H2C2211B591C34A818B6FBA750F3D9B43" style="OLC">
							<subsection id="H46E9E623AFC84130ABA1255F2537B51B"><enum>(b)</enum><header>Special rules
				for chapter 61 disability retirees when eligibility has been established for
				such retirees</header>
								<paragraph id="HF610C0ACECA7446F8754639AAF5FC79B"><enum>(1)</enum><header>General
				reduction rule</header><text>The retired pay of a member retired under chapter
				61 of this title is subject to reduction under sections 5304 and 5305 of title
				38, but only to the extent that the amount of the members retired pay under
				chapter 61 of this title exceeds the amount of retired pay to which the member
				would have been entitled under any other provision of law based upon the
				member’s service in the uniformed services if the member had not been retired
				under chapter 61 of this title.</text>
								</paragraph><paragraph id="HC06C56B7644D43508239B2E73E7F6EAD"><enum>(2)</enum><header>Retirees with
				fewer than 20 years of service</header>
									<subparagraph id="HFF67C9F616B840CBA1FCC3706BDEB23B"><enum>(A)</enum><header>Before
				termination date</header><text display-inline="yes-display-inline">If a member
				with a qualifying service-connected disability (as defined in subsection
				(a)(2)) is retired under chapter 61 of this title with fewer than 20 years of
				creditable service otherwise creditable under section 1405 or computed under
				section 12732 of this title, and the termination date specified in subsection
				(a)(1)(D) has not occurred, the retired pay of the member is subject to
				reduction under sections 5304 and 5305 of title 38, but only to the extent that
				the amount of the member’s retired pay under chapter 61 of this title exceeds
				the amount equal to 2½ percent of the member’s years of creditable service
				multiplied by the member’s retired pay base under section 1406(b)(1) or 1407 of
				this title, whichever is applicable to the member.</text>
									</subparagraph><subparagraph id="HF27BBFCF6AD84FA6B95254B6FBED3A64"><enum>(B)</enum><header>After
				termination date</header><text>Subsection (a) does not apply to a member
				retired under chapter 61 of this title with less than 20 years of service
				otherwise creditable under section 1405 of this title, or with less than 20
				years of service computed under section 12732 of this title, at the time of the
				retirement of the member if the termination date in paragraph (1)(D) of such
				subsection has
				occurred.</text>

			 Provisions</header>
				<section id="HAE58FF4409934659BB5B0AC9DBB1B66F"><enum>201.</enum><header>Credit for
			 unused sick leave</header>
					<subsection id="HE03A8F4E3D7B48F686FC6432210AC0F6"><enum>(a)</enum><header>In
			 general</header><text>Section 8415 of title 5, United States Code, is
			 amended—</text>
						<paragraph id="H72556F044A80490DAD821E24F57FD204"><enum>(1)</enum><text>by redesignating
			 the second subsection (k) and subsection (l) as subsections (l) and (m),
			 respectively; and</text>
						</paragraph><paragraph id="HFC048147229447C4B18932D663702DD1"><enum>(2)</enum><text>in subsection (l)
			 (as so redesignated by paragraph (1))—</text>
							<subparagraph id="H63C559695E0A4F399876E6C054DD9B60"><enum>(A)</enum><text>by striking
			 <quote>(l) In computing</quote> and inserting <quote>(l)(1) In
			 computing</quote>; and</text>
							</subparagraph><subparagraph id="H4714310E317643FA9A349E63825D55F9"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
								<quoted-block display-inline="no-display-inline" id="H54A3F282149F4AFABD75D8C7CD622D0F" style="OLC">
									<paragraph id="HC4A9E49EB2DD48408740996A4010575F" indent="up1"><enum>(2)</enum><text>Except as provided in paragraph (1),
				in computing an annuity under this subchapter, the total service of an employee
				who retires on an immediate annuity or who dies leaving a survivor or survivors
				entitled to annuity includes the days of unused sick leave to his credit under
				a formal leave system and for which days the employee has not received payment,
				except that these days will not be counted in determining average pay or
				annuity eligibility under this subchapter. For purposes of this subsection, in
				the case of any such employee who is excepted from subchapter I of chapter 63
				under section 6301(2)(x) through (xiii), the days of unused sick leave to his
				credit include any unused sick leave standing to his credit when he was
				excepted from such
				subchapter.</text>
									</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
							</subparagraph></paragraph></subsection><subsection id="H3CF40A40743C4AF7845D905D4D0A1FD2"><enum>(b)</enum><header>Exception from
			 deposit requirement</header><text>Section 8422(d)(2) of title 5, United States
			 Code, is amended by striking <quote>section 8415(k)</quote> and inserting
			 <quote>paragraph (1) or (2) of section 8415(l)</quote>.</text>
					</subsection><subsection id="H9294E523A00E4085A9655C637290FA8D"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply with respect
			 to annuities computed based on separations occurring on or after the date of
			 enactment of this Act.</text>
					</subsection></section><section id="H660109FD0C0547819A3C48DAF2D9251D"><enum>202.</enum><header>Limited
			 expansion of the class of individuals eligible to receive an actuarially
			 reduced annuity under the civil service retirement system</header>
					<subsection id="HF228E5E0FB2A4393882F13122A91B229"><enum>(a)</enum><header>In
			 general</header><text>Section 8334(d)(2)(A)(i) of title 5, United States Code,
			 is amended by striking <quote>October 1, 1990</quote> each place it appears and
			 inserting <quote>March 1, 1991</quote>.</text>
					</subsection><subsection id="HF3AE97B67FF2451CB06943E2F4A621F3"><enum>(b)</enum><header>Applicability</header><text>The
			 amendment made by subsection (a) shall be effective with respect to any
			 annuity, entitlement to which is based on a separation from service occurring
			 on or after the date of enactment of this Act.</text>
					</subsection></section><section display-inline="no-display-inline" id="H46327E60BB2544D5B55C365C875E837A" section-type="subsequent-section"><enum>203.</enum><header>Computation of
			 certain annuities based on part-time service</header>
					<subsection id="H2219F80391464354BD1047724942E4B8"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 8339(p) of
			 title 5, United States Code, is amended by adding at the end the
			 following:</text>
						<quoted-block id="HCF53C617C39642489D712031C4A21672">
							<paragraph id="H04A1DD70310D4FCDB4E9697BA1EB3946" indent="up1"><enum>(3)</enum><text>In the administration of paragraph
				(1)—</text>
								<subparagraph id="HEC5E2356EA964710A04418377F67279A"><enum>(A)</enum><text>subparagraph (A) of such paragraph
				shall apply with respect to service performed before, on, or after April 7,
				1986; and</text>
								</subparagraph><subparagraph id="H64489C4444CC4016B5AA37486E4E42C9"><enum>(B)</enum><text>subparagraph (B) of such
				paragraph—</text>
									<clause id="HD3E1A5CD29A8494D911BEAFF479B090A"><enum>(i)</enum><text>shall apply with respect to that
				portion of any annuity which is attributable to service performed on or after
				April 7, 1986; and</text>
									</clause><clause id="HAD5EF4A2DC11463DBB6E8D2E5889E5AF"><enum>(ii)</enum><text>shall not apply with respect to
				that portion of any annuity which is attributable to service performed before
				April 7,
				1986.</text>
									</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="H68AA99713DEA4773984157A007166FD4"><enum>(b)</enum><header>Applicability</header><text>The
			 amendment made by subsection (a) shall be effective with respect to any
			 annuity, entitlement to which is based on a separation from service occurring
			 on or after the date of enactment of this Act.</text>
					</subsection></section><section id="H152DB85DE86E4CFA90FFB39408F2BA9E"><enum>204.</enum><header>Authority to
			 deposit refunds under FERS</header>
					<subsection id="HA03F52218AA0417FB2D9E660A3BF5950"><enum>(a)</enum><header>Deposit
			 authority</header><text>Section 8422 of title 5, United States Code, is amended
			 by adding at the end the following:</text>
						<quoted-block id="H390C4AC1768D41058A5EC3D195420A47">
							<subsection id="HD0B5220CAC61457DA46DD1737FD02F3D"><enum>(i)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H648B69AFD6CB45459C4E88F00DF098BA"><enum>(1)</enum><text>Each employee or Member
				who has received a refund of retirement deductions under this or any other
				retirement system established for employees of the Government covering service
				for which such employee or Member may be allowed credit under this chapter may
				deposit the amount received, with interest. Credit may not be allowed for the
				service covered by the refund until the deposit is made.</text>
								</paragraph><paragraph id="HFE659A32A79046F59B1DB53D82DAF4EB" indent="up1"><enum>(2)</enum><text>Interest under this subsection shall
				be computed in accordance with paragraphs (2) and (3) of section 8334(e) and
				regulations prescribed by the Office. The option under the third sentence of
				section 8334(e)(2) to make a deposit in one or more installments shall apply to
				deposits under this subsection.</text>
								</paragraph><paragraph id="H53DAE2C0948F4ADC8A8C4ED04994E240" indent="up1"><enum>(3)</enum><text>For the purpose of survivor
				annuities, deposits authorized by this subsection may also be made by a
				survivor of an employee or
				Member.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="H0BB132612340489C91FD3AF99B45A883"><enum>(b)</enum><header>Technical and
			 conforming amendments</header>
						<paragraph id="HC15E19C6D025499C965E4F9B9E087E1C"><enum>(1)</enum><header>Definitional
			 amendment</header><text>Section 8401(19)(C) of title 5, United States Code, is
			 amended by striking <quote>8411(f);</quote> and inserting <quote>8411(f) or
			 8422(i);</quote>.</text>
						</paragraph><paragraph id="H1E964ED98FD545F08C8E83745B278C60"><enum>(2)</enum><header>Crediting of
			 Deposits</header><text>Section 8422(c) of title 5, United States Code, is
			 amended by adding at the end the following: <quote>Deposits made by an
			 employee, Member, or survivor also shall be credited to the
			 Fund.</quote>.</text>

						</paragraph></subsection></section><section id="HDF8355419DB4417EBE4470CE5DB607CC"><enum>205.</enum><header>Retirement
			 credit for service of certain employees transferred from District of Columbia
			 service to Federal service</header>
					<subsection id="H8D86A27B3451456A968C164225D777D4"><enum>(a)</enum><header>Retirement
			 credit</header>
						<paragraph id="HF36B3141801245D394EA6A5E9A4B52B2"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Any individual who is
			 treated as an employee of the Federal Government for purposes of chapter 83 or
			 chapter 84 of title 5, United States Code, on or after the date of enactment of
			 this Act who performed qualifying District of Columbia service shall be
			 entitled to have such service included in calculating the individual’s
			 creditable service under sections 8332 or 8411 of title 5, United States Code,
			 but only for purposes of the following provisions of such title:</text>
							<subparagraph id="HB8E1A89DD4BC4DF7BD695F4A9E97A99E"><enum>(A)</enum><text>Sections 8333 and
			 8410 (relating to eligibility for annuity).</text>
							</subparagraph><subparagraph id="H948B655CAF35478A968AD841FAE4C97D"><enum>(B)</enum><text>Sections 8336
			 (other than subsections (d), (h), and (p) thereof) and 8412 (relating to
			 immediate retirement).</text>
							</subparagraph><subparagraph id="H70B5F61CDCDD471DBC3E7C7D7CA8DE74"><enum>(C)</enum><text>Sections 8338 and
			 8413 (relating to deferred retirement).</text>
							</subparagraph><subparagraph id="H3EB4A20AEC1B4D6EB482DD4206F313D5"><enum>(D)</enum><text>Sections 8336(d),
			 8336(h), 8336(p), and 8414 (relating to early retirement).</text>
							</subparagraph><subparagraph id="H5225031A694E4F0F8190344F63D97C41"><enum>(E)</enum><text>Section 8341 and
			 subchapter IV of chapter 84 (relating to survivor annuities).</text>
							</subparagraph><subparagraph id="HBF537B60117D4913AF1E39C73607F927"><enum>(F)</enum><text>Section 8337 and

							</subparagraph></paragraph><paragraph id="H76C29BA097324A598F78193B359B5F82"><enum>(2)</enum><header>Treatment of
			 Detention Officer Service as Law Enforcement Officer Service</header><text>Any
			 portion of an individual’s qualifying District of Columbia service which
			 consisted of service as a detention officer under section 2604(2) of the
			 District of Columbia Government Comprehensive Merit Personnel Act of 1978 (sec.
			 1–626.04(2), D.C. Official Code) shall be treated as service as a law
			 enforcement officer under sections 8331(20) or 8401(17) of title 5, United
			 States Code, for purposes of applying paragraph (1) with respect to the
			 individual.</text>
						</paragraph><paragraph display-inline="no-display-inline" id="HDAB37F8247814FA5A0C905516A525BF0"><enum>(3)</enum><header>Service Not
			 Included in Computing Amount of Any Annuity</header><text>Qualifying District
			 of Columbia service shall not be taken into account for purposes of computing
			 the amount of any benefit payable out of the Civil Service Retirement and
			 Disability Fund.</text>
						</paragraph></subsection><subsection id="HE75AB1C43DFC49B9967BCF31066991FE"><enum>(b)</enum><header>Qualifying
			 District of Columbia Service Defined</header><text>In this section,
			 <quote>qualifying District of Columbia service</quote> means any of the
			 following:</text>
						<paragraph id="HB625DBCE83F445BAA3436421E4898DFC"><enum>(1)</enum><text>Service performed
			 by an individual as a nonjudicial employee of the District of Columbia
			 courts—</text>
							<subparagraph id="H7DB4EAE98B7F4D77961C0B1F322AD779"><enum>(A)</enum><text>which was
			 performed prior to the effective date of the amendments made by section
			 11246(b) of the Balanced Budget Act of 1997; and</text>
							</subparagraph><subparagraph id="HF73E7AE01D9849E2B5753E4977654415"><enum>(B)</enum><text>for which the
			 individual did not ever receive credit under the provisions of subchapter III
			 of chapter 83 or chapter 84 of title 5, United States Code (other than by
			 virtue of section 8331(1)(iv) of such title).</text>
							</subparagraph></paragraph><paragraph id="H7B5EBA37605442D9AEDB5865EE3D8229"><enum>(2)</enum><text>Service performed
			 by an individual as an employee of an entity of the District of Columbia
			 government whose functions were transferred to the Pretrial Services, Parole,
			 Adult Supervision, and Offender Supervision Trustee under section 11232 of the
			 Balanced Budget Act of 1997—</text>
							<subparagraph id="H572ED54CFCF74BB699A4E6F980AEDF9D"><enum>(A)</enum><text>which was
			 performed prior to the effective date of the individual’s coverage as an
			 employee of the Federal Government under section 11232(f) of such Act;
			 and</text>
							</subparagraph><subparagraph id="H41B1CD6CF4AC44ED93AD904AE9BC2AE3"><enum>(B)</enum><text display-inline="yes-display-inline">for which the individual did not ever
			 receive credit under the provisions of subchapter III of chapter 83 or chapter
			 84 of title 5, United States Code (other than by virtue of section 8331(1)(iv)
			 of such title).</text>
							</subparagraph></paragraph><paragraph id="H3097C60979B646ACBD1E9FAEEF614FA2"><enum>(3)</enum><text>Service performed
			 by an individual as an employee of the District of Columbia Public Defender
			 Service—</text>
							<subparagraph id="HF31AA4F7264F4A6B991DEA5C00CED809"><enum>(A)</enum><text>which was
			 performed prior to the effective date of the amendments made by section 7(e) of
			 the District of Columbia Courts and Justice Technical Corrections Act of 1998;
			 and</text>
							</subparagraph><subparagraph id="HE8BB57D6CA1340788D9590790F677FE6"><enum>(B)</enum><text display-inline="yes-display-inline">for which the individual did not ever
			 receive credit under the provisions of subchapter III of chapter 83 or chapter
			 84 of title 5, United States Code (other than by virtue of section 8331(1)(iv)
			 of such title).</text>
							</subparagraph></paragraph><paragraph id="HC5FF168BCD50461E936CC66A917290BB"><enum>(4)</enum><text display-inline="yes-display-inline">In the case of an individual who was an
			 employee of the District of Columbia Department of Corrections who was
			 separated from service as a result of the closing of the Lorton Correctional
			 Complex and who was appointed to a position with the Bureau of Prisons, the
			 District of Columbia courts, the Pretrial Services, Parole, Adult Supervision,
			 and Offender Supervision Trustee, the United States Parole Commission, or the
			 District of Columbia Public Defender Service, service performed by the
			 individual as an employee of the District of Columbia Department of
			 Corrections—</text>
							<subparagraph id="H8B0EEFEAF25B4FF390F9A33C2CBC9A30"><enum>(A)</enum><text>which was
			 performed prior to the effective date of the individual’s coverage as an
			 employee of the Federal Government; and</text>
							</subparagraph><subparagraph id="H46CC370467AB42AEB0397D8A8B3BB53E"><enum>(B)</enum><text>for which the
			 individual did not ever receive credit under the provisions of subchapter III
			 of chapter 83 or chapter 84 of title 5, United States Code (other than by
			 virtue of section 8331(1)(iv) of such title).</text>
							</subparagraph></paragraph></subsection><subsection id="H09898FBA5C734AB99202EAFCFAEC0F26"><enum>(c)</enum><header>Certification of
			 Service</header><text>The Office of Personnel Management shall accept the
			 certification of the appropriate personnel official of the government of the
			 District of Columbia or other independent employing entity concerning whether
			 an individual performed qualifying District of Columbia service and the length
			 of the period of such service the individual performed.</text>
					</subsection></section></subtitle><subtitle id="H60D1566454B84A25B6CE7FAD62737EA2"><enum>B</enum><header>Non-Foreign Area
			 Retirement Equity Assurance</header>
				<section commented="no" display-inline="no-display-inline" id="H3D46A0029F0F4100A8D424F716E99B0C"><enum>211.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This subtitle may be
			 cited as the <quote><short-title>Non-Foreign Area
			 Retirement Equity Assurance Act of 2009</short-title></quote> or the
			 <quote><short-title>Non-Foreign AREA Act of
			 2009</short-title></quote>.</text>
				</section><section commented="no" display-inline="no-display-inline" id="H89C298DA46C64071871C92BA2221B32F" section-type="subsequent-section"><enum>212.</enum><header display-inline="yes-display-inline">Extension of Locality Pay</header>
					<subsection commented="no" display-inline="no-display-inline" id="H75940934A1784017B3841797233533D9"><enum>(a)</enum><header display-inline="yes-display-inline">Locality-based comparability
			 payments</header><text display-inline="yes-display-inline">Section 5304 of
			 title 5, United States Code, is amended—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="HB864AFD56C5B4B4D89A1290858FE0557"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (f)(1), by striking
			 subparagraph (A) and inserting the following:</text>
							<quoted-block display-inline="no-display-inline" id="HF550F311A9CB4C3587755C1599BED3CA" style="OLC">

				cost-of-living allowance under section 5941;

									</subparagraph><after-quoted-block>; </after-quoted-block></quoted-block>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6BEDE65206574A498877C02AAB32C129"><enum>(D)</enum><text display-inline="yes-display-inline">in clause (iv) in the matter following
			 subparagraph (D), by inserting <quote>, except for members covered by
			 subparagraph (C)</quote> before the semicolon; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H376C0B96D35C406988E829BA775CE603"><enum>(E)</enum><text>in clause (v) in

							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H08DF452CB0BF46C3972B1BBA22AB796B"><enum>(b)</enum><header display-inline="yes-display-inline">Allowances based on living costs and
			 conditions of environment</header><text display-inline="yes-display-inline">Section 5941 of title 5, United States
			 Code, is amended—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="H7B5BB3DADDD04385BD225811C8F0B51E"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by adding after the last
			 sentence <quote>Notwithstanding any preceding provision of this subsection, the
			 cost-of-living allowance rate based on paragraph (1) shall be the
			 cost-of-living allowance rate in effect on the date of enactment of the
			 Non-Foreign Area Retirement Equity Assurance Act of 2009, except as adjusted
			 under subsection (c).</quote>;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3FA0594B99154FE5991370477FDCF64E"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subsection (b) as
			 subsection (d); and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFBD13A27AD3446FDA1738DD45F3321C1"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after subsection (a) the
			 following:</text>
							<quoted-block display-inline="no-display-inline" id="HC027D891B4774D108C74D63F68D09DBE" style="OLC">
								<subsection commented="no" display-inline="no-display-inline" id="H2C6A771CA46A43BF8BE11093F7C0C5F5"><enum>(b)</enum><text display-inline="yes-display-inline">This section shall apply only to areas that
				are designated as cost-of-living allowance areas as in effect on December 31,
				2009.</text>
								</subsection><subsection commented="no" display-inline="no-display-inline" id="H4F838B95D60944BBBD4E0B0A82BB51BA"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HD07A7A3EF1654B3A953FE4B4587DA52F"><enum>(1)</enum><text display-inline="yes-display-inline">The cost-of-living allowance rate payable
				under this section shall be adjusted on the first day of the first applicable
				pay period beginning on or after—</text>
										<subparagraph commented="no" display-inline="no-display-inline" id="H42A81B29B2394FDDB52FF999E29A67F8" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">January 1, 2010; and</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1D9872A1E95144ED8F4A9A348350AAD9" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">January 1 of each calendar year in which a
				locality-based comparability adjustment takes effect under section 214 (2) and
				(3) of the Non-Foreign Area Retirement Equity Assurance Act of 2009.</text>
										</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3CF87E6CB52B401299690277D283439A" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HA380B2E4B9784B9B9EC90CC86B0DA241"><enum>(A)</enum><text display-inline="yes-display-inline">In this paragraph, the term
				<term>applicable locality-based comparability pay percentage</term> means, with
				respect to calendar year 2010 and each calendar year thereafter, the applicable
				percentage under section 214 (1), (2), or (3) of Non-Foreign Area Retirement
				Equity Assurance Act of 2009.</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCAA78272C81D4D63985A2AEB1CDE276C" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Each adjusted cost-of-living allowance rate
				under paragraph (1) shall be computed by—</text>
											<clause commented="no" display-inline="no-display-inline" id="HA8FE81117AD943A1A233F6575356F631"><enum>(i)</enum><text display-inline="yes-display-inline">subtracting 65 percent of the applicable
				locality-based comparability pay percentage from the cost-of-living allowance
				percentage rate in effect on December 31, 2009; and</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="H763D7D139C934B1FAB15705B02D4CA4C"><enum>(ii)</enum><text display-inline="yes-display-inline">dividing the resulting percentage
				determined under clause (i) by the sum of—</text>
												<subclause commented="no" display-inline="no-display-inline" id="H343EBE7D68F342FFA5F970A49100298B"><enum>(I)</enum><text display-inline="yes-display-inline">one; and</text>
												</subclause><subclause commented="no" display-inline="no-display-inline" id="HDF34B20022A44D3590E011A2C5489653"><enum>(II)</enum><text display-inline="yes-display-inline">the applicable locality-based comparability
				payment percentage expressed as a numeral.</text>
												</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAA4516573D7B4E9C937BC6B1647DA07D" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">No allowance rate computed under paragraph
				(2) may be less than zero.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0BF5C51572FD4F1597703B4E59A553F7" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">Each allowance rate computed under
				paragraph (2) shall be paid as a percentage of basic pay (including any
				applicable locality-based comparability payment under section 5304 or similar
				provision of law and any applicable special rate of pay under section 5305 or
				similar provision of
				law).</text>
									</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HB20A1510C15543CA956BAC3EB707769F" section-type="subsequent-section"><enum>213.</enum><header display-inline="yes-display-inline">Adjustment of special rates</header>
					<subsection commented="no" display-inline="no-display-inline" id="H421D8252316C4942ADC7E6D24C98ABE4"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each special rate of pay established under
			 section 5305 of title 5, United States Code, and payable in an area designated
			 as a cost-of-living allowance area under section 5941(a) of that title, shall
			 be adjusted, on the dates prescribed by section 214 of this subtitle, in
			 accordance with regulations prescribed by the Director of the Office of
			 Personnel Management under section 218 of this subtitle.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="HC772DE9CC1B74F0CB5D331DC92289D82"><enum>(b)</enum><header display-inline="yes-display-inline">Agencies with statutory authority</header>
						<paragraph commented="no" display-inline="no-display-inline" id="HB348BE55788144DE936727A707E2CCDA"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Each special rate of
			 pay established under an authority described under paragraph (2) and payable in
			 a location designated as a cost-of-living allowance area under section
			 5941(a)(1) of title 5, United States Code, shall be adjusted in accordance with
			 regulations prescribed by the applicable head of the agency that are consistent
			 with the regulations issued by the Director of the Office of Personnel
			 Management under subsection (a).</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H538CB7EB2411408397AF3A9708FAC6A8"><enum>(2)</enum><header>Statutory
			 authority</header><text>The authority referred to under paragraph (1), is any
			 statutory authority that—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="H1CD8A8E453F1472BAE355D6DD3619E2B"><enum>(A)</enum><text>is similar to the
			 authority exercised under section 5305 of title 5, United States Code;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBF2B15DA17A448E887422234B57B1EE4"><enum>(B)</enum><text>is exercised by
			 the head of an agency when the head of the agency determines it to be necessary
			 in order to obtain or retain the services of persons specified by statute;
			 and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H571212CCEAEF4C09A3824F49BFC55352"><enum>(C)</enum><text>authorizes the
			 head of the agency to increase the minimum, intermediate, or maximum rates of
			 basic pay authorized under applicable statutes and regulations.</text>
							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H63ED450A961E406FB6564CFAF1142086"><enum>(c)</enum><header display-inline="yes-display-inline">Temporary adjustment</header><text display-inline="yes-display-inline">Regulations issued under subsection (a) or
			 (b) may provide that statutory limitations on the amount of such special rates
			 may be temporarily raised to a higher level during the transition period
			 described in section 214 ending on the first day of the first pay period
			 beginning on or after January 1, 2012, at which time any special rate of pay in
			 excess of the applicable limitation shall be converted to a retained rate under
			 section 5363 of title 5, United States Code.</text>
					</subsection></section><section commented="no" display-inline="no-display-inline" id="H3149952BD19543E58A7EE8141621B7AB" section-type="subsequent-section"><enum>214.</enum><header display-inline="yes-display-inline"> Transition schedule for locality-based
			 comparability payments</header><text display-inline="no-display-inline">Notwithstanding any other provision of this
			 subtitle or section 5304 or 5304a of title 5, United States Code, in
			 implementing the amendments made by this subtitle, for each non-foreign area
			 determined under section 5941(b) of that title, the applicable rate for the
			 locality-based comparability adjustment that is used in the computation
			 required under section 5941(c) of that title shall be adjusted effective on the
			 first day of the first pay period beginning on or after January 1—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="H9B545C024BB2424C9059B3AAC950E736"><enum>(1)</enum><text display-inline="yes-display-inline">in calendar year 2010, by using
			 <fraction>1/3</fraction> of the locality pay percentage for the rest of United
			 States locality pay area;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0C8992DC3F0F4EB7AB7E56376A40DFD7"><enum>(2)</enum><text display-inline="yes-display-inline">in calendar year 2011, by using
			 <fraction>2/3</fraction> of the otherwise applicable comparability payment
			 approved by the President for each non-foreign area; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6FED3E9025F6438D9F4316F01F310894"><enum>(3)</enum><text display-inline="yes-display-inline">in calendar year 2012 and each subsequent
			 year, by using the full amount of the applicable comparability payment approved
			 by the President for each non-foreign area.</text>
					</paragraph></section><section commented="no" display-inline="no-display-inline" id="H64F19B091DC248F2948AC28733E92303" section-type="subsequent-section"><enum>215.</enum><header display-inline="yes-display-inline">Savings provision</header>
					<subsection commented="no" display-inline="no-display-inline" id="H3B3C7ADB4B6946B8858AE1340815DA3A"><enum>(a)</enum><header display-inline="yes-display-inline">Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="H8C7F183C66C340B28D34DFD8031352F4"><enum>(1)</enum><text display-inline="yes-display-inline">the application of this subtitle to any
			 employee should not result in a decrease in the take home pay of that
			 employee;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0F2BAB52AE8A456FA9695BCDC7F3709F"><enum>(2)</enum><text display-inline="yes-display-inline">in calendar year 2012 and each subsequent
			 year, no employee shall receive less than the Rest of the U.S. locality pay
			 rate;</text>
						</paragraph><paragraph id="HB6230CAE147442828DE354D832F4FA1B"><enum>(3)</enum><text>concurrent with
			 the surveys next conducted under the provisions of section 5304(d)(1)(A) of
			 title 5, United States Code, beginning after the date of the enactment of this
			 Act, the Bureau of Labor Statistics should conduct separate surveys to
			 determine the extent of any pay disparity (as defined by section 5302 of that
			 title) that may exist with respect to positions located in the State of Alaska,
			 the State of Hawaii, and the United States territories, including American
			 Samoa, Guam, Commonwealth of the Northern Mariana Islands, Commonwealth of
			 Puerto Rico, and the United States Virgin Islands;</text>
						</paragraph><paragraph id="H3F3164D9A87B49BCAF98A1558647E377"><enum>(4)</enum><text>if the surveys
			 under paragraph (3) indicate that the pay disparity determined for the State of
			 Alaska, the State of Hawaii, or any 1 of the United States territories
			 including American Samoa, Guam, Commonwealth of the Northern Mariana Islands,
			 Commonwealth of Puerto Rico, and the United States Virgin Islands exceeds the
			 pay disparity determined for the locality which (for purposes of section 5304
			 of that title) is commonly known as the <quote>Rest of the United
			 States</quote>, the President’s Pay Agent should take appropriate measures to
			 provide that each such surveyed area be treated as a separate pay locality for
			 purposes of that section; and</text>
						</paragraph><paragraph id="HA9BD29CFE2B645AD8FB508A554E5B7CE"><enum>(5)</enum><text>the President’s
			 Pay Agent will establish 1 locality area for the entire State of Hawaii and 1
			 locality area for the entire State of Alaska.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H30A7CD85017F4C1093D10A3E2C6F4DD7"><enum>(b)</enum><header display-inline="yes-display-inline">Savings provisions</header>
						<paragraph commented="no" display-inline="no-display-inline" id="H48F2E770DC5843F2A39FFB9D1DC7C1C0"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">During the period described under section
			 214 of this subtitle, an employee paid a special rate under 5305 of title 5,
			 United States Code, who the day before the date of enactment of this Act was
			 eligible to receive a cost-of-living allowance under section 5941 of title 5,
			 United States Code, and who continues to be officially stationed in an
			 allowance area, shall receive an increase in the employee’s special rate
			 consistent with increases in the applicable special rate schedule. For
			 employees in allowance areas, the minimum step rate for any grade of a special
			 rate schedule shall be increased at the time of an increase in the applicable
			 locality rate percentage for the allowance area by not less than the dollar
			 increase in the locality-based comparability payment for a non-special rate
			 employee at the same minimum step provided under section 214 of this subtitle,
			 and corresponding increases shall be provided for all step rates of the given
			 pay range.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1EA265B0A5E1452982232B0DDE599879"><enum>(2)</enum><header display-inline="yes-display-inline">Continuation of cost of living allowance
			 rate</header><text display-inline="yes-display-inline">If an employee, who the
			 day before the date of enactment of this Act was eligible to receive a
			 cost-of-living allowance under section 5941 of title 5, United States Code,
			 would receive a rate of basic pay and applicable locality-based comparability
			 payment which is in excess of the maximum rate limitation set under section
			 5304(g) of title 5, United States Code, for his position (but for that maximum
			 rate limitation) due to the operation of this subtitle, the employee shall
			 continue to receive the cost-of-living allowance rate in effect on December 31,
			 2009 without adjustment until—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="H1DEBDC9E8CA344A8BB21AFEFCE521AE9"><enum>(A)</enum><text display-inline="yes-display-inline">the employee leaves the allowance area or
			 pay system; or</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H67D06F855D5B4ADA84947CDDB7A3FCDB"><enum>(B)</enum><text display-inline="yes-display-inline">the employee is entitled to receive basic
			 pay (including any applicable locality-based comparability payment or similar
			 supplement) at a higher rate,</text>
							</subparagraph><continuation-text commented="no" continuation-text-level="paragraph">but, when any such position becomes
			 vacant, the pay of any subsequent appointee thereto shall be fixed in the
			 manner provided by applicable law and regulation.</continuation-text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H413FA53E3DE243E9B50F2F63266C4EE0"><enum>(3)</enum><header display-inline="yes-display-inline">Locality-based comparability
			 payments</header><text display-inline="yes-display-inline">Any employee covered
			 under paragraph (2) shall receive any applicable locality-based comparability
			 payment extended under section 214 of this subtitle which is not in excess of
			 the maximum rate set under section 5304(g) of title 5, United States Code, for
			 his position including any future increase to statutory pay limitations under
			 5318 of title 5, United States Code. Notwithstanding paragraph (2), to the
			 extent that an employee covered under that paragraph receives any amount of
			 locality-based comparability payment, the cost-of-living allowance rate under
			 that paragraph shall be reduced accordingly, as provided under section
			 5941(c)(2)(B) of title 5, United States Code.</text>
						</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H0087CB99BFD748138E5BCED2036DF1CE" section-type="subsequent-section"><enum>216.</enum><header display-inline="yes-display-inline">Application to other eligible
			 employees</header>
					<subsection commented="no" display-inline="no-display-inline" id="H04052BDE2F3649FCA15640D444F0635A"><enum>(a)</enum><header display-inline="yes-display-inline">In General</header>
						<paragraph commented="no" display-inline="no-display-inline" id="H15DC468035F74B65B84A7DC365DEAD27"><enum>(1)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this subsection, the term <term>covered
			 employee</term> means—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="H46562EA396354ED9866DC82BF7981A52"><enum>(A)</enum><text display-inline="yes-display-inline">any employee who—</text>
								<clause commented="no" display-inline="no-display-inline" id="H68AD11ECDC57434E8717763377690AFE"><enum>(i)</enum><text display-inline="yes-display-inline">on the day before the date of enactment of
			 this Act—</text>
									<subclause commented="no" display-inline="no-display-inline" id="H8E51B5DCDFA94FB894393D3985AE8900"><enum>(I)</enum><text display-inline="yes-display-inline">was eligible to be paid a cost-of-living
			 allowance under 5941 of title 5, United States Code; and</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="HCA935BF28291436883A9ECC475DD72E7"><enum>(II)</enum><text display-inline="yes-display-inline">was not eligible to be paid locality-based
			 comparability payments under 5304 or 5304a of that title; or</text>
									</subclause></clause><clause commented="no" display-inline="no-display-inline" id="HC4CD0C00834B4DAEBA71EF29D29E3584"><enum>(ii)</enum><text display-inline="yes-display-inline">on or after the date of enactment of this
			 Act becomes eligible to be paid a cost-of-living allowance under 5941 of title
			 5, United States Code; or</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H99E2376A8A2E45F29AF8BC465D695F76"><enum>(B)</enum><text display-inline="yes-display-inline">any employee who—</text>
								<clause commented="no" display-inline="no-display-inline" id="H370F463148BF4EBCA7B93B4EB36E6030"><enum>(i)</enum><text display-inline="yes-display-inline">on the day before the date of enactment of
			 this Act—</text>
									<subclause commented="no" display-inline="no-display-inline" id="H97A1D93079E24748BC3C561C714D3967"><enum>(I)</enum><text display-inline="yes-display-inline">was eligible to be paid an allowance under
			 section 1603(b) of title 10, United States Code;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="H55BB08FA2AC144A9B74AB431CC38773D"><enum>(II)</enum><text display-inline="yes-display-inline">was eligible to be paid an allowance under
			 section 1005(b) of title 39, United States Code;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="H85F89D8C09824CD5B72E4942F8B64501"><enum>(III)</enum><text display-inline="yes-display-inline">was employed by the Transportation Security
			 Administration of the Department of Homeland Security and was eligible to be
			 paid an allowance based on section 5941 of title 5, United States Code;
			 or</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="H8ED15271E52F479FBE81508F2FCB8A3C"><enum>(IV)</enum><text>was eligible to
			 be paid under any other authority a cost-of-living allowance that is equivalent
			 to the cost-of-living allowance under section 5941 of title 5, United States
			 Code; or</text>
									</subclause></clause><clause commented="no" display-inline="no-display-inline" id="H4764D9C14066414590D351F45CABC9B4"><enum>(ii)</enum><text display-inline="yes-display-inline">on or after the date of enactment of this
			 Act—</text>
									<subclause commented="no" display-inline="no-display-inline" id="H7D0ADC9C244D46BCAE760210F0FED6C3"><enum>(I)</enum><text display-inline="yes-display-inline">becomes eligible to be paid an allowance
			 under section 1603(b) of title 10, United States Code;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="H725FCE66C1354524B73800341B03909F"><enum>(II)</enum><text display-inline="yes-display-inline">becomes eligible to be paid an allowance
			 under section 1005(b) of title 39, United States Code;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="HB69E638A6EB44407BE5BFB688C1FB993"><enum>(III)</enum><text display-inline="yes-display-inline">is employed by the Transportation Security
			 Administration of the Department of Homeland Security and becomes eligible to
			 be paid an allowance based on section 5941 of title 5, United States Code;
			 or</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="H9DD101F0C0F9419699E15E3D22102746"><enum>(IV)</enum><text>is eligible to be
			 paid under any other authority a cost-of-living allowance that is equivalent to
			 the cost-of-living allowance under section 5941 of title 5, United States
			 Code.</text>
									</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H86E04D148A7E4549A3AE45026773535F"><enum>(2)</enum><header display-inline="yes-display-inline">Application to covered employees</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="HDA943E2B431142A9B4F44C30392890A8"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 for purposes of this subtitle (including the amendments made by this subtitle)
			 any covered employee shall be treated as an employee to whom section 5941 of
			 title 5, United States Code (as amended by section 212 of this subtitle), and
			 section 214 of this subtitle apply.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H575358D49475457EAEF5E70CB063B958"><enum>(B)</enum><header display-inline="yes-display-inline">Pay fixed by statute</header><text display-inline="yes-display-inline">Pay to covered employees under section 5304
			 or 5304a of title 5, United States Code, as a result of the application of this
			 subtitle shall be considered to be fixed by statute.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H362C451264B941AC84E4078ECBB9FCCC"><enum>(C)</enum><header display-inline="yes-display-inline">Performance appraisal system</header><text display-inline="yes-display-inline">With respect to a covered employee who is
			 subject to a performance appraisal system no part of pay attributable to
			 locality-based comparability payments as a result of the application of this
			 subtitle including section 5941 of title 5, United States Code (as amended by
			 section 212 of this subtitle), may be reduced on the basis of the performance
			 of that employee.</text>
							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H735E605CAF58417BB3F518FC309EB8A3"><enum>(b)</enum><header display-inline="yes-display-inline">Postal employees in non-foreign
			 areas</header>
						<paragraph commented="no" display-inline="no-display-inline" id="HE58E56354CFA4EF9AE69988D1C29CD26"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1005(b) of title 39, United States
			 Code, is amended—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="H63DE9BDE60F542D18D603F68A3CC2033"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>(1)</quote> after
			 <quote>(b)</quote>;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE2546B62073245E5A84149B0DCD8BC98"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>Section 5941,</quote>
			 and inserting <quote>Except as provided under paragraph (2), section
			 5941</quote>;</text>

				Non-Foreign Area Retirement Equity Assurance Act of 2009—</text>
										<subparagraph commented="no" display-inline="no-display-inline" id="H67D08C66955F47B5AD2F13CFA39148BD"><enum>(A)</enum><text display-inline="yes-display-inline">the provisions of that Act and section 5941
				of title 5 shall apply to officers and employees covered by section 1003 (b)
				and (c) whose duty station is in a nonforeign area; and</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE57F7390E8CB4E70AC2825900148844A"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to officers and employees of
				the Postal Service (other than those officers and employees described under
				subparagraph (A)) of section 216(b)(2) of that Act shall
				apply.</text>
										</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H18B0C344A46548C49C97280FBB13F74D"><enum>(2)</enum><header display-inline="yes-display-inline">Continuation of cost of living
			 allowance</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="HFDE71122D16C40D3A158500C929ACEB5"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this
			 subtitle, any employee of the Postal Service (other than an employee covered by
			 section 1003 (b) and (c) of title 39, United States Code, whose duty station is
			 in a nonforeign area) who is paid an allowance under section 1005(b) of that
			 title shall be treated for all purposes as if the provisions of this subtitle
			 (including the amendments made by this subtitle) had not been enacted, except
			 that the cost-of-living allowance rate paid to that employee—</text>
								<clause commented="no" display-inline="no-display-inline" id="HBFC6E7B184184FDCB20A48BE409BABC1"><enum>(i)</enum><text display-inline="yes-display-inline">may result in the allowance exceeding 25
			 percent of the rate of basic pay of that employee; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="H7EDDED3928DE48DD93E8E9F5D2FACFD7"><enum>(ii)</enum><text display-inline="yes-display-inline">shall be the greater of—</text>
									<subclause commented="no" display-inline="no-display-inline" id="HD68756DCB30A4CBE9EA72FAF836FD5A4"><enum>(I)</enum><text display-inline="yes-display-inline">the cost-of-living allowance rate in effect
			 on December 31, 2009, for the applicable area; or</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="H3D1F49FCD11C41ACADAF961058C8E4CA"><enum>(II)</enum><text display-inline="yes-display-inline">the applicable locality-based comparability
			 pay percentage under section 214.</text>
									</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF44C9D353D2044AA80C2ECC12FBFEDB2"><enum>(B)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this subtitle shall be construed
			 to—</text>
								<clause commented="no" display-inline="no-display-inline" id="H69D98C60DE314AD0A197F7693F1F8E29"><enum>(i)</enum><text display-inline="yes-display-inline">provide for an employee described under
			 subparagraph (A) to be a covered employee as defined under subsection (a);
			 or</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="HF5E548D2B4A149389ECA8B9AEF2E7B14"><enum>(ii)</enum><text display-inline="yes-display-inline">authorize an employee described under
			 subparagraph (A) to file an election under section 217 of this subtitle.</text>
								</clause></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H0BC530C592C84B88931323FA8B988A80" section-type="subsequent-section"><enum>217.</enum><header display-inline="yes-display-inline">Election of additional basic pay for
			 annuity computation by employees</header>
					<subsection commented="no" display-inline="no-display-inline" id="H9F2D8D4E219943B1B279C0738216DB3D"><enum>(a)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this section the term <term>covered
			 employee</term> means any employee—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="H90996F4800E64653B29C7F934B15C200"><enum>(1)</enum><text display-inline="yes-display-inline">to whom section 214 applies;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5BE457D283574D729FDA6505F0F3158C"><enum>(2)</enum><text display-inline="yes-display-inline">who is separated from service by reason of
			 retirement under chapter 83 or 84 of title 5, United States Code, during the
			 period of January 1, 2010, through December 31, 2012; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9235443C0561407FB700E1D1256B7A9E"><enum>(3)</enum><text display-inline="yes-display-inline">who files an election with the Office of
			 Personnel Management under subsection (b).</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H74D0678CA6394CEFB9F9A4F3F0E857C2"><enum>(b)</enum><header display-inline="yes-display-inline">Election</header>
						<paragraph commented="no" display-inline="no-display-inline" id="H090BA401825C4CDFB9AB18EDA2B9BC56"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">An employee described under subsection (a)
			 (1) and (2) may file an election with the Office of Personnel Management to be
			 covered under this section.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEE89DE05E0AA468180239B59CDC5B3C5"><enum>(2)</enum><header display-inline="yes-display-inline">Deadline</header><text display-inline="yes-display-inline">An election under this subsection may be
			 filed not later than December 31, 2012.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HC9B37DBB89D04DE8A2048891B1045630"><enum>(c)</enum><header display-inline="yes-display-inline">Computation of annuity</header>
						<paragraph commented="no" display-inline="no-display-inline" id="HA9A6358D84DB4273AB973EA2F98E2A65"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided under paragraph (2), for
			 purposes of the computation of an annuity of a covered employee any
			 cost-of-living allowance under section 5941 of title 5, United States Code,
			 paid to that employee during the first applicable pay period beginning on or
			 after January 1, 2010, through the first applicable pay period ending on or
			 after December 31, 2012, shall be considered basic pay as defined under section
			 8331(3) or 8401(4) of that title.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H53C07E1D5C3E4FEAAF8235651C32A78E"><enum>(2)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">The amount of the cost-of-living allowance
			 which may be considered basic pay under paragraph (1) may not exceed the amount
			 of the locality-based comparability payments the employee would have received
			 during that period for the applicable pay area if the limitation under section
			 214 of this subtitle did not apply.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H437CAA487D0748CA9D209A4645571DEA"><enum>(d)</enum><header display-inline="yes-display-inline">Civil Service Retirement and Disability
			 Retirement Fund</header>
						<paragraph commented="no" display-inline="no-display-inline" id="H8B58988657E940E49CA028CF0B89FE04"><enum>(1)</enum><header display-inline="yes-display-inline">Employee contributions</header><text display-inline="yes-display-inline">A covered employee shall pay into the Civil
			 Service Retirement and Disability Retirement Fund—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="H74D4C357A74E4173B4AFD5095F3285EB"><enum>(A)</enum><text display-inline="yes-display-inline">an amount equal to the difference
			 between—</text>
								<clause commented="no" display-inline="no-display-inline" id="HEB0CBA1726EC4D818214E41442B27508"><enum>(i)</enum><text display-inline="yes-display-inline">employee contributions that would have been
			 deducted and withheld from pay under section 8334 or 8422 of title 5, United
			 States Code, during the period described under subsection (c) of this section
			 if the cost-of-living allowances described under that subsection had been
			 treated as basic pay under section 8331(3) or 8401(4) of title 5, United States
			 Code; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="H831F15ACD8A74F578939E41C5B9A49A4"><enum>(ii)</enum><text display-inline="yes-display-inline">employee contributions that were actually
			 deducted and withheld from pay under section 8334 or 8422 of title 5, United
			 States Code, during that period; and</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB397E357525945A4B0F858A600A9DE49"><enum>(B)</enum><text display-inline="yes-display-inline">interest as prescribed under section
			 8334(e) of title 5, United States Code, based on the amount determined under
			 subparagraph (A).</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE4E6B7D646BB4846A1BBC6F1408516D4"><enum>(2)</enum><header display-inline="yes-display-inline">Agency contributions</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="HF6C1D1B091784497B393C05AECE42E02"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The employing agency of a covered employee
			 shall pay into the Civil Service Retirement and Disability Retirement Fund an
			 amount for applicable agency contributions based on payments made under
			 paragraph (1).</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8A010A46CE664F0EA85DC706D31787A4"><enum>(B)</enum><header display-inline="yes-display-inline">Source</header><text display-inline="yes-display-inline">Amounts paid under this paragraph shall be
			 contributed from the appropriation or fund used to pay the employee.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFB140CA8EC7A4862B2D3B25EEB00F7DE"><enum>(3)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">The Office of Personnel Management may
			 prescribe regulations to carry out this section.</text>
						</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H462A4769F4854432BA60AF3891BC5102" section-type="subsequent-section"><enum>218.</enum><header display-inline="yes-display-inline">Regulations</header>
					<subsection commented="no" display-inline="no-display-inline" id="HEA49CE8B4B9E4CAD8DE2D4B058096EBC"><enum>(a)</enum><header display-inline="yes-display-inline">In General</header><text display-inline="yes-display-inline">The Director of the Office of Personnel
			 Management shall prescribe regulations to carry out this subtitle,
			 including—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="H9DD0635425B743D794BB3443591CE8C6"><enum>(1)</enum><text display-inline="yes-display-inline">rules for special rate employees described
			 under section 213;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0582D97A4055438794C4772AFDFD911B"><enum>(2)</enum><text display-inline="yes-display-inline">rules for adjusting rates of basic pay for
			 employees in pay systems administered by the Office of Personnel Management
			 when such employees are not entitled to locality-based comparability payments
			 under section 5304 of title 5, United States Code, without regard to otherwise
			 applicable statutory pay limitations during the transition period described in
			 section 214 ending on the first day of the first pay period beginning on or
			 after January 1, 2012; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEC92AD9272724935ABFCD33541AFB7FC"><enum>(3)</enum><text display-inline="yes-display-inline">rules governing establishment and
			 adjustment of saved or retained rates for any employee whose rate of pay
			 exceeds applicable pay limitations on the first day of the first pay period
			 beginning on or after January 1, 2012.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H73091108DF704CB387B6819C8053A5E9"><enum>(b)</enum><header display-inline="yes-display-inline">Other Pay Systems</header><text display-inline="yes-display-inline">With the concurrence of the Director of the
			 Office of Personnel Management, the administrator of a pay system not
			 administered by the Office of Personnel Management shall prescribe regulations
			 to carry out this subtitle with respect to employees in such pay system,
			 consistent with the regulations prescribed by the Office under subsection (a).
			 With respect to employees not entitled to locality-based comparability payments
			 under section 5304 of title 5, United States Code, regulations prescribed under
			 this subsection may provide for special payments or adjustments for employees
			 who were eligible to receive a cost-of-living allowance under section 5941 of
			 that title on the date before the date of enactment of this Act.</text>
					</subsection></section><section commented="no" display-inline="no-display-inline" id="HFA81DA5EE6F94AA49D47D5BAF8AFAF46" section-type="subsequent-section"><enum>219.</enum><header display-inline="yes-display-inline">Effective dates</header>
					<subsection commented="no" display-inline="no-display-inline" id="HF52F190BE29644C9907BB32F33363864"><enum>(a)</enum><header display-inline="yes-display-inline">In General</header><text display-inline="yes-display-inline">Except as provided by subsection (b), this
			 subtitle (including the amendments made by this subtitle) shall take effect on
			 the date of enactment of this Act.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="H34B8C53543DE4DD18AA6C4505A369ABF"><enum>(b)</enum><header display-inline="yes-display-inline">Locality pay and schedule</header><text display-inline="yes-display-inline">The amendments made by section 212 and the
			 provisions of section 214 shall take effect on the first day of the first
			 applicable pay period beginning on or after January 1, 2010.</text>
					</subsection></section></subtitle></title><title id="H65D34F237B5047C78BB18F593F645FB7"><enum>III</enum><header>Deepwater Oil
			 and Gas Research and Development Funding Source Repeal</header>
			<section id="HEF033ECDDDA2470E892B2E06F47111BB"><enum>301.</enum><header>Repeal</header><text display-inline="no-display-inline">Effective October 1, 2010, section 999H of
			 the Energy Policy Act of 2005 (42 U.S.C. 16378) is amended—</text>
				<paragraph id="HC1E0C0BDCC64439BB4CF19BED777B759"><enum>(1)</enum><text>by striking
			 subsections (a), (b), (c), and (f);</text>
				</paragraph><paragraph id="H44B1424DCB864CCFB7386E07ED9AB429"><enum>(2)</enum><text>by redesignating
			 subsections (d) and (e) as subsections (a) and (b), respectively;</text>
				</paragraph><paragraph id="H89550807D1EB4724805D90DF8B93E9FD"><enum>(3)</enum><text>in subsection (a),
			 as so redesignated, by striking <quote>obligated from the Fund under subsection
			 (a)(1)</quote> and inserting <quote>available under this section</quote>;
