<official-title display="yes">To amend the Small Business Act with respect to the Small Business Innovation Research Program and the Small Business Technology Transfer Program, and for other purposes.</official-title>

<section id="H28E05361A5C841E29A4A01433D23ECC0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Don’t Ask, Don’t Tell Repeal Act of 2010</short-title></quote>.</text></section>
<section id="H18586937AE864D64864598D6E0A380AB"><enum>2.</enum><header>Department of Defense policy concerning homosexuality in the Armed Forces</header>
<subsection id="H1779E33EB56346219190DB09D800F8AF"><enum>(a)</enum><header>Comprehensive Review on the Implementation of a Repeal of 10 U.S.C. 654</header>
<paragraph id="HC293345F7CC2496E9127BA371FB6AF8F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">On March 2, 2010, the Secretary of Defense issued a memorandum directing the Comprehensive Review on the Implementation of a Repeal of 10 U.S.C. 654 (section 654 of title 10, United States Code).</text></paragraph>
<paragraph display-inline="no-display-inline" id="H28C5CC0C66FC439191BA1CE906E648C7"><enum>(2)</enum><header>Objectives and scope of review</header><text display-inline="yes-display-inline">The Terms of Reference accompanying the Secretary’s memorandum established the following objectives and scope of the ordered review:</text>
<subparagraph id="HB6A84BBDCFFB4609A2F22568D2D21643"><enum>(A)</enum><text>Determine any impacts to military readiness, military effectiveness and unit cohesion, recruiting/retention, and family readiness that may result from repeal of the law and recommend any actions that should be taken in light of such impacts.</text></subparagraph>
<subparagraph id="H4DF3629E1A3B477FA2D86B0D94C023CE"><enum>(B)</enum><text>Determine leadership, guidance, and training on standards of conduct and new policies.</text></subparagraph>
<subparagraph id="H01058D590A8F4C9EB79F44767570CE52"><enum>(C)</enum><text>Determine appropriate changes to existing policies and regulations, including but not limited to issues regarding personnel management, leadership and training, facilities, investigations, and benefits.</text></subparagraph>
<subparagraph id="HCE06A7C53351475681D3A532E5FDA221"><enum>(D)</enum><text>Recommend appropriate changes (if any) to the Uniform Code of Military Justice.</text></subparagraph>
<subparagraph id="H79116EAB8D614F38AD16A432AF4784C9"><enum>(E)</enum><text>Monitor and evaluate existing legislative proposals to repeal 10 U.S.C. 654 and proposals that may be introduced in the Congress during the period of the review.</text></subparagraph>
<subparagraph id="HBBAAEA1EAA80410F8879981CB06B2969"><enum>(F)</enum><text>Assure appropriate ways to monitor the workforce climate and military effectiveness that support successful follow-through on implementation.</text></subparagraph>
<subparagraph id="H43068E5AA62C4AAEB02A4C0CFE08BDFC"><enum>(G)</enum><text>Evaluate the issues raised in ongoing litigation involving 10 U.S.C. 654.</text></subparagraph></paragraph></subsection>
<subsection id="HC972B65C3A23467ABE365B86DD75C3E1"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by subsection (f) shall take effect 60 days after the date on which the last of the following occurs:</text>
<paragraph id="HD522815A44924ACCA08E24D2483B89E3"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary of Defense has received the report required by the memorandum of the Secretary referred to in subsection (a).</text></paragraph>
<paragraph id="H9B7E8822E55B40CBB11B6C008A684BF4"><enum>(2)</enum><text>The President transmits to the congressional defense committees a written certification, signed by the President, the Secretary of Defense, and the Chairman of the Joint Chiefs of Staff, stating each of the following:</text>
<subparagraph id="HF15F70D2ABDA4FD6B1252F1C97BC387B"><enum>(A)</enum><text display-inline="yes-display-inline">That the President, the Secretary of Defense, and the Chairman of the Joint Chiefs of Staff have considered the recommendations contained in the report and the report’s proposed plan of action.</text></subparagraph>
<subparagraph id="H4FB1BBAF1F42467791237B22303EC8E3"><enum>(B)</enum><text>That the Department of Defense has prepared the necessary policies and regulations to exercise the discretion provided by the amendments made by subsection (f).</text></subparagraph>
<subparagraph display-inline="no-display-inline" id="H91B0514A8E9B4FF3B259E93F0DA0B166"><enum>(C)</enum><text display-inline="yes-display-inline">That the implementation of necessary policies and regulations pursuant to the discretion provided by the amendments made by subsection (f) is consistent with the standards of military readiness, military effectiveness, unit cohesion, and recruiting and retention of the Armed Forces.</text></subparagraph></paragraph></subsection>
<subsection display-inline="no-display-inline" id="H1E1730C05720444CAD2BE1952CD10C10"><enum>(c)</enum><header>No immediate effect on current policy</header><text display-inline="yes-display-inline">Section 654 of title 10, United States Code, shall remain in effect until such time that all of the requirements and certifications required by subsection (b) are met. If these requirements and certifications are not met, section 654 of title 10, United States Code, shall remain in effect.</text></subsection>
<subsection display-inline="no-display-inline" id="H464410271A13494FB825E2779F3A17DE"><enum>(d)</enum><header>Benefits</header><text display-inline="yes-display-inline">Nothing in this section, or the amendments made by this section, shall be construed to require the furnishing of benefits in violation of section 7 of title 1, United States Code (relating to the definitions of <quote>marriage</quote> and <quote>spouse</quote> and referred to as the <quote>Defense of Marriage Act</quote>).</text></subsection>
<subsection display-inline="no-display-inline" id="H99A812FA29434550A3B4676A03F41767"><enum>(e)</enum><header>No private cause of action</header><text>Nothing in this section, or the amendments made by this section, shall be construed to create a private cause of action.</text></subsection>
<subsection id="HCA1A75EE2DDF483FAC7D688B3039810B"><enum>(f)</enum><header>Treatment of 1993 policy</header>
<paragraph id="H8329684F9FC642D1B8E250A8E9C1445B"><enum>(1)</enum><header>Title 10</header><text display-inline="yes-display-inline">Upon the effective date established by subsection (b), chapter 37 of title 10, United States Code, is amended—</text>
<subparagraph id="H5E9AF7ADBEF047AABCE73C475F5F8928"><enum>(A)</enum><text>by striking section 654; and</text></subparagraph>
<subparagraph id="HAAC761AE491F4F54BB374081104053E7"><enum>(B)</enum><text display-inline="yes-display-inline">in the table of sections at the beginning of such chapter, by striking the item relating to section 654.</text></subparagraph></paragraph>
<paragraph id="H2823A0752674431380D13F69959646D6"><enum>(2)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Upon the effective date established by subsection (b), section 571 of the National Defense Authorization Act for Fiscal Year 1994 (10 U.S.C. 654 note) is amended by striking subsections (b), (c), and (d).</text></paragraph></subsection></section>
