3.In this Act—
(1)the terms Administration and
Administrator mean the Small Business Administration and the
Administrator thereof, respectively;
(2)the terms extramural budget,
Federal agency, Small Business Innovation Research
Program, SBIR, Small Business Technology Transfer
Program, and STTR have the meanings given such terms in
section 9 of the Small Business Act (15 U.S.C. 638); and
(3)the term small business
concern has the same meaning as under section 3 of the Small Business
Act (15 U.S.C. 632).

U.S.C. 638(m)) is amended by striking <quote>2008</quote> and inserting
<quote>2017</quote>.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="id098e0e53-2cc9-451e-b97b-bdf2a1381053"><enum>(b)</enum><header display-inline="yes-display-inline">STTR</header><text display-inline="yes-display-inline">Section 9(n)(1)(A) of the Small Business
Act (15 U.S.C. 638(n)(1)(A)) is amended by striking <quote>2009</quote> and
inserting <quote>2017</quote>.</text>

Technology</header><text display-inline="no-display-inline">Section 9(b) of the
Small Business Act (15 U.S.C. 638(b)) is amended—</text>
<paragraph commented="no" display-inline="no-display-inline" id="id078016de-018f-43ab-875b-66276b839d61"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (7), by striking
<quote>and</quote> at the end;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id209787f8-9f9d-4d8e-a1a8-5c0c8f17dd46"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (8), by striking the period at
the end and inserting <quote>; and</quote>;</text>

Energy</header><text display-inline="yes-display-inline">For the Department of
Defense and the Department of Energy, to the greatest extent practicable, the
percentage of the extramural budget in excess of 2.5 percent required to be
expended with small business concerns under subparagraphs (D) through (M) of
paragraph (1)—</text>
<clause commented="no" display-inline="no-display-inline" id="idd3b400f8-a591-4500-bb87-02bafc538360"><enum>(i)</enum><text display-inline="yes-display-inline">may not be used for new Phase I or Phase II
awards; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="id9eef5ea3-a2ae-410e-82a8-f5a20ea3b044"><enum>(ii)</enum><text display-inline="yes-display-inline">shall be used for activities that further
the readiness levels of technologies developed under Phase II awards, including
conducting testing and evaluation to promote the transition of such
technologies into commercial or defense products, or systems furthering the
mission needs of the Department of Defense or the Department of Energy, as the
case may
be.</text>

</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="idb2d0f5ed-86fa-4e23-bf6e-9feffb9169dc" section-type="subsequent-section"><enum>104.</enum><header display-inline="yes-display-inline">STTR allocation increase</header><text display-inline="no-display-inline">Section 9(n)(1)(B) of the Small Business Act
(15 U.S.C. 638(n)(1)(B)) is amended—</text>
<paragraph commented="no" display-inline="no-display-inline" id="id0298ca00-73bb-4c76-b21c-0f3a11156c7b"><enum>(1)</enum><text display-inline="yes-display-inline">in clause (i), by striking
<quote>and</quote> at the end;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id31969a13-c846-4522-8064-6305f2f196a7"><enum>(2)</enum><text display-inline="yes-display-inline">in clause (ii), by striking
<quote>thereafter.</quote> and inserting <quote>through fiscal year

<subsection commented="no" display-inline="no-display-inline" id="idd88dafa9-6031-4251-926a-e472e6292b8a"><enum>(a)</enum><header display-inline="yes-display-inline">SBIR adjustments</header><text display-inline="yes-display-inline">Section 9(j)(2)(D) of the Small Business
Act (15 U.S.C. 638(j)(2)(D)) is amended—</text>

inserting <quote>3 years</quote>; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id63909ac5-ae73-44de-a029-60e5814aa65a"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>and programmatic

</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9a8a45aa-b7a8-4e55-8bb5-bfe5d8f21526"><enum>(d)</enum><header display-inline="yes-display-inline">Limitation on certain awards</header><text display-inline="yes-display-inline">Section 9 of the Small Business Act (15
U.S.C. 638) is amended by adding at the end the following:</text>

<subsection commented="no" display-inline="no-display-inline" id="id98ab335c-97b2-4dc1-9d43-d458ca806e07"><enum>(aa)</enum><header display-inline="yes-display-inline">Limitation on certain awards</header>
<paragraph commented="no" display-inline="no-display-inline" id="id3e9b62c8-62df-4cf8-8470-24503d4140e3"><enum>(1)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">No Federal agency may issue an award under
the SBIR program or the STTR program if the size of the award exceeds the award
guidelines established under this section by more than 50 percent.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id08281da7-f302-46f0-968e-6c7c32fb7a44"><enum>(2)</enum><header display-inline="yes-display-inline">Maintenance of information</header><text display-inline="yes-display-inline">Participating agencies shall maintain
information on awards exceeding the guidelines established under this section,
including—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="ida63c5944-94a2-41f4-b5b8-ccd428dbf11b"><enum>(A)</enum><text display-inline="yes-display-inline">the amount of each award;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id829874ed-9d80-4788-b470-7294d732aecb"><enum>(B)</enum><text display-inline="yes-display-inline">a justification for exceeding the award
amount;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id06a983b3-975e-4d48-8255-76e96755f1f4"><enum>(C)</enum><text display-inline="yes-display-inline">the identity and location of each award
recipient; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idce8ea87d-deb4-416d-aebb-287ec9ec7d08"><enum>(D)</enum><text display-inline="yes-display-inline">whether a recipient has received any
venture capital investment and, if so, whether the recipient is majority-owned
and controlled by multiple venture capital companies.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbb7ed9bb-77a6-4530-80fb-112445268f2f"><enum>(3)</enum><header display-inline="yes-display-inline">Reports</header><text display-inline="yes-display-inline">The Administrator shall include the
information described in paragraph (2) in the annual report of the
Administrator to Congress.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id728AEE0DFB324E67A6ACAD12F17250F4"><enum>(4)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall be
construed to prevent a Federal agency from supplementing an award under the
SBIR program or the STTR program using funds of the Federal agency that are not
part of the SBIR program or the STTR program of the Federal
agency.</text>
</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</subsection></section><section commented="no" display-inline="no-display-inline" id="id72fc368b-bc6c-41c5-ad33-34fdd2df9a76" section-type="subsequent-section"><enum>106.</enum><header display-inline="yes-display-inline">Agency and program
collaboration</header><text display-inline="no-display-inline">Section 9 of the
Small Business Act (15 U.S.C. 638), as amended by this Act, is amended by
adding at the end the following:</text>

award from a Federal agency under this section shall be eligible to receive an
award for a subsequent phase from another Federal agency, if the head of each
relevant Federal agency or the relevant component of the Federal agency makes a
written determination that the topics of the relevant awards are the same and
both agencies report the awards to the Administrator for inclusion in the
public database under subsection (k).</text>

U.S.C. 638), as amended by this Act, is amended by adding at the end the
following:</text>

<paragraph commented="no" display-inline="no-display-inline" id="id3d313066-bb1a-41bf-abaa-0c9b292064bf"><enum>(1)</enum><header display-inline="yes-display-inline">Authority and determination</header>
<subparagraph commented="no" display-inline="no-display-inline" id="id5be62488-4124-4c54-adc2-ae2fec5dadad"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Upon a written determination provided not
later than 30 days in advance to the Administrator and to the Committee on
Small Business and Entrepreneurship of the Senate and the Committee on Small
Business of the House of Representatives—</text>
<clause commented="no" display-inline="no-display-inline" id="id7dc928dc-f4c6-4e28-acec-e662e8145d23"><enum>(i)</enum><text display-inline="yes-display-inline">the Director of the National Institutes of
Health may award not more than 18 percent of the SBIR funds of the National
Institutes of Health allocated in accordance with this Act, in the first full
fiscal year beginning after the date of enactment of this subsection, and each
fiscal year thereafter, to small business concerns that are owned in majority
part by venture capital companies and that satisfy the qualification
requirements under paragraph (2) through competitive, merit-based procedures
that are open to all eligible small business concerns; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="id083cef74-3c60-4c41-a8ad-917db1bc30d4"><enum>(ii)</enum><text display-inline="yes-display-inline">the head of any other Federal agency
participating in the SBIR program may award not more than 8 percent of the SBIR
funds of the Federal agency allocated in accordance with this Act, in the first
full fiscal year beginning after the date of enactment of this subsection, and
each fiscal year thereafter, to small business concerns that are majority owned
by venture capital companies and that satisfy the qualification requirements
under paragraph (2) through competitive, merit-based procedures that are open
to all eligible small business concerns.</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ided21d216-4dd4-4018-9170-4fcef4cacec4"><enum>(B)</enum><header display-inline="yes-display-inline">Determination</header><text display-inline="yes-display-inline">A written determination made under
subparagraph (A) shall explain how the use of the authority under that
subparagraph will induce additional venture capital funding of small business
innovations, substantially contribute to the mission of the funding Federal
agency, demonstrate a need for public research, and otherwise fulfill the
capital needs of small business concerns for additional financing for the SBIR
project.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id050f8993-32e9-4397-a710-c9c218c4651b"><enum>(2)</enum><header display-inline="yes-display-inline">Qualification requirements</header><text display-inline="yes-display-inline">The Administrator shall establish
requirements relating to the affiliation by small business concerns with
venture capital companies, which may not exclude a United States small business
concern from participation in the program under paragraph (1) on the basis that
the small business concern is owned in majority part by, or controlled by, more
than 1 United States venture capital company, so long as no single venture
capital company owns more than 49 percent of the small business concern.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id746b1a82-9f3a-42dd-81e7-d7174fa90e8a"><enum>(3)</enum><header display-inline="yes-display-inline">Registration</header><text display-inline="yes-display-inline">A small business concern that is majority
owned and controlled by multiple venture capital companies and qualified for
participation in the program authorized under paragraph (1) shall—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id825208cd-98cb-4bbc-960d-4c13e36e3d03"><enum>(A)</enum><text display-inline="yes-display-inline">register with the Administrator on the date
that the small business concern submits an application for an award under the
SBIR program; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9608ef8e-e897-4ba4-a7a3-d35dff53f0cd"><enum>(B)</enum><text display-inline="yes-display-inline">indicate whether the small business concern
is registered under subparagraph (A) in any SBIR proposal.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0e23fbe4-6f09-4859-af93-22e0fa5e9ac4"><enum>(4)</enum><header display-inline="yes-display-inline">Compliance</header><text display-inline="yes-display-inline">A Federal agency described in paragraph (1)
shall collect data regarding the number and dollar amounts of phase I, phase
II, and all other categories of awards under the SBIR program, and the
Administrator shall report on the data and the compliance of each such Federal
agency with the maximum amounts under paragraph (1) as part of the annual
report by the Administration under subsection (b)(7).</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9b576a02-5b36-4d0b-a02e-2a78e0a34f6b"><enum>(5)</enum><header display-inline="yes-display-inline">Enforcement</header><text display-inline="yes-display-inline">If a Federal agency awards more than the
amount authorized under paragraph (1) for a purpose described in paragraph (1),
the amount awarded in excess of the amount authorized under paragraph (1) shall
be transferred to the funds for general SBIR programs from the non-SBIR
research and development funds of the Federal agency within 60 days of the date
on which the Federal agency awarded more than the amount authorized under
paragraph (1) for a purpose described in paragraph
(1).</text>
</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</subsection><subsection commented="no" display-inline="no-display-inline" id="id2f24b3e2-ffa1-4959-8927-510ff4cbb579"><enum>(b)</enum><header display-inline="yes-display-inline">Technical and conforming
amendment</header><text display-inline="yes-display-inline">Section 3 of the
Small Business Act (15 U.S.C. 632) is amended by adding at the end the
following:</text>

</subsection><subsection commented="no" display-inline="no-display-inline" id="id9c9f2d26-5a25-4285-9556-9fcc8dca058c"><enum>(c)</enum><header display-inline="yes-display-inline">Assistance for determining
affiliates</header><text display-inline="yes-display-inline">Not later than 30
days after the date of enactment of this Act, the Administrator shall post on
the website of the Administration (with a direct link displayed on the homepage
of the website of the Administration or the SBIR website of the
Administration)—</text>
<paragraph commented="no" display-inline="no-display-inline" id="idfbb28ce6-d7c5-438c-8aee-b256abead440"><enum>(1)</enum><text display-inline="yes-display-inline">a clear explanation of the SBIR affiliation
rules under part 121 of title 13, Code of Federal Regulations; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbb2593da-484a-408a-89a8-ad0ba872a679"><enum>(2)</enum><text display-inline="yes-display-inline">contact information for officers or
employees of the Administration who—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id876134e1-d126-492b-b244-2a8175451f50"><enum>(A)</enum><text display-inline="yes-display-inline">upon request, shall review an issue
relating to the rules described in paragraph (1); and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id280b2591-16ab-4bb0-a80f-604de4e2213e"><enum>(B)</enum><text display-inline="yes-display-inline">shall respond to a request under
subparagraph (A) not later than 20 business days after the date on which the
request is received.</text>
</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id3712b37e-e5e5-4ff0-92aa-11dddbb4934e" section-type="subsequent-section"><enum>109.</enum><header display-inline="yes-display-inline">SBIR and STTR special acquisition
preference</header><text display-inline="no-display-inline">Section 9(r) of the
Small Business Act (15 U.S.C. 638(r)) is amended by adding at the end the
following:</text>

<paragraph commented="no" display-inline="no-display-inline" id="idca936e6f-9670-4309-97a3-35fa4a38a567"><enum>(4)</enum><header display-inline="yes-display-inline">Phase III awards</header><text display-inline="yes-display-inline">To the greatest extent practicable, Federal
agencies and Federal prime contractors shall issue Phase III awards relating to
technology, including sole source awards, to the SBIR and STTR award recipients
that developed the
technology.</text>
</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
</section><section commented="no" display-inline="no-display-inline" id="id8d154098-1568-4073-82a3-4411b47bec04" section-type="subsequent-section"><enum>110.</enum><header display-inline="yes-display-inline">Collaborating with Federal laboratories and
research and development centers</header><text display-inline="no-display-inline">Section 9 of the Small Business Act (15
U.S.C. 638), as amended by this Act, is amended by adding at the end the
following:</text>
<quoted-block changed="added" display-inline="no-display-inline" id="idf7bbfcd7-f535-47b3-bb78-a016ab0d9418" reported-display-style="italic" style="OLC">
<subsection commented="no" display-inline="no-display-inline" id="id5feb1f79-12f8-411b-b9b7-508454146341"><enum>(dd)</enum><header display-inline="yes-display-inline">Collaborating with Federal laboratories and
research and development centers</header>
<paragraph commented="no" display-inline="no-display-inline" id="idb107fbf8-83ee-43f2-9adf-1a55df412f23"><enum>(1)</enum><header display-inline="yes-display-inline">Authorization</header><text display-inline="yes-display-inline">Subject to the limitations under this
section, the head of each participating Federal agency may make SBIR and STTR
awards to any eligible small business concern that—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="ida59b442f-e62f-4990-b106-cf6f0170ad62"><enum>(A)</enum><text display-inline="yes-display-inline">intends to enter into an agreement with a
Federal laboratory or federally funded research and development center for
portions of the activities to be performed under that award; or</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf071f1b5-3e36-449d-8f89-53e310fcc033"><enum>(B)</enum><text display-inline="yes-display-inline">has entered into a cooperative research and
development agreement (as defined in section 12(d) of the Stevenson-Wydler
Technology Innovation Act of 1980 (15 U.S.C. 3710a(d))) with a Federal
laboratory.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id76f3d6b1-f214-4bd9-bccf-9d0cbe446432"><enum>(2)</enum><header display-inline="yes-display-inline">Prohibition</header><text display-inline="yes-display-inline">No Federal agency shall—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="idecf7bcb5-57ae-45e2-95d1-6b165c809ad8"><enum>(A)</enum><text display-inline="yes-display-inline">condition an SBIR or STTR award upon
entering into agreement with any Federal laboratory or any federally funded
laboratory or research and development center for any portion of the activities
to be performed under that award;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8c67142e-90b3-40e6-a007-d1febe5dd9b9"><enum>(B)</enum><text display-inline="yes-display-inline">approve an agreement between a small
business concern receiving a SBIR or STTR award and a Federal laboratory or
federally funded laboratory or research and development center, if the small
business concern performs a lesser portion of the activities to be performed
under that award than required by this section and by the SBIR Policy Directive
and the STTR Policy Directive of the Administrator; or</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfbf46a5a-fd4a-4fc8-a26b-6e56161af4a6"><enum>(C)</enum><text display-inline="yes-display-inline">approve an agreement that violates any
provision, including any data rights protections provision, of this section or
the SBIR and the STTR Policy Directives.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2cb2c5d9-7873-4307-956a-afe61b1651d5"><enum>(3)</enum><header display-inline="yes-display-inline">Implementation</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
enactment of this subsection, the Administrator shall modify the SBIR Policy
Directive and the STTR Policy Directive issued under this section to ensure
that small business concerns—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="idf450f82e-f754-4690-bec9-e9119706d64d"><enum>(A)</enum><text display-inline="yes-display-inline">have the flexibility to use the resources
of the Federal laboratories and federally funded research and development
centers; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id97d52e4c-6588-4fea-baf2-e809e23b3cf8"><enum>(B)</enum><text display-inline="yes-display-inline">are not mandated to enter into agreement
with any Federal laboratory or any federally funded laboratory or research and
development center as a condition of an
award.</text>
</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</section><section commented="no" display-inline="no-display-inline" id="id5a8c679e-0509-4702-8393-fae2fd2ef2b4" section-type="subsequent-section"><enum>111.</enum><header display-inline="yes-display-inline">Notice requirement</header><text display-inline="no-display-inline">The head of any Federal agency involved in a
case or controversy before any Federal judicial or administrative tribunal
concerning the SBIR program or the STTR program shall provide timely notice, as
determined by the Administrator, of the case or controversy to the
Administrator.</text>
</section><enum>II</enum><header display-inline="yes-display-inline">Outreach and commercialization
initiatives</header>
<section commented="no" display-inline="no-display-inline" id="id2f8afa65-df64-4226-b3ba-a4ac99817bdf" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">Rural and State outreach</header>
<subsection commented="no" display-inline="no-display-inline" id="idaaa25469-2896-49d2-9839-3007bce85ceb"><enum>(a)</enum><header display-inline="yes-display-inline">Outreach</header><text display-inline="yes-display-inline">Section 9 of the Small Business Act (15
U.S.C. 638) is amended by inserting after subsection (r) the following:</text>

<paragraph commented="no" display-inline="no-display-inline" id="id7a83deb9-18ea-42cb-ba01-78798f4a84f5"><enum>(1)</enum><header display-inline="yes-display-inline">Definition of eligible State</header><text display-inline="yes-display-inline">In this subsection, the term <term>eligible
State</term> means a State—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id4a0fa919-ee11-4b39-b628-f9864767b6c0"><enum>(A)</enum><text display-inline="yes-display-inline">for which the total value of contracts
awarded to the State under this section during the most recent fiscal year for
which data is available was less than $5,000,000; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd59565da-d449-4d2a-a457-14364388486c"><enum>(B)</enum><text display-inline="yes-display-inline">that certifies to the Administrator that
the State will, upon receipt of assistance under this subsection, provide
matching funds from non-Federal sources in an amount that is not less than 50
percent of the amount provided under this subsection.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0d1f96b6-b8b0-40ec-b05b-09a762134e79"><enum>(2)</enum><header display-inline="yes-display-inline">Program authority</header><text display-inline="yes-display-inline">Of amounts made available to carry out this
section for each of fiscal years 2010 through 2014, the Administrator may
expend with eligible States not more than $5,000,000 in each such fiscal year
in order to increase the participation of small business concerns located in
those States in the programs under this section.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb1e6cf0a-0e44-413f-b0fa-ab511044e413"><enum>(3)</enum><header display-inline="yes-display-inline">Amount of assistance</header><text display-inline="yes-display-inline">The amount of assistance provided to an
eligible State under this subsection in any fiscal year—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="idd6bb4259-1c01-4c7f-835f-fd67f5c8cf67"><enum>(A)</enum><text display-inline="yes-display-inline">shall be equal to not more than 50 percent
of the total amount of matching funds from non-Federal sources provided by the
State; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb019c874-70bb-4c28-a739-4c751145d582"><enum>(B)</enum><text display-inline="yes-display-inline">shall not exceed $100,000.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5f0dd34c-978e-4316-9b98-bdd6998608a2"><enum>(4)</enum><header display-inline="yes-display-inline">Use of assistance</header><text display-inline="yes-display-inline">Assistance provided to an eligible State
under this subsection shall be used by the State, in consultation with State
and local departments and agencies, for programs and activities to increase the
participation of small business concerns located in the State in the programs
under this section, including—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="idd1485182-cd95-4596-89c3-680aad1c5e8d"><enum>(A)</enum><text display-inline="yes-display-inline">the establishment of quantifiable
performance goals, including goals relating to—</text>
<clause commented="no" display-inline="no-display-inline" id="id6922574a-864b-4679-83b0-07315e3b99f5"><enum>(i)</enum><text display-inline="yes-display-inline">the number of program awards under this
section made to small business concerns in the State; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="idb48eeb41-d4a4-450b-8303-41248b83faf3"><enum>(ii)</enum><text display-inline="yes-display-inline">the total amount of Federal research and
development contracts awarded to small business concerns in the State;</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0e15a055-1b51-48bf-9f4c-84bb2e557ef4"><enum>(B)</enum><text display-inline="yes-display-inline">the provision of competition outreach
support to small business concerns in the State that are involved in research
and development; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id445a3d05-ad79-45dd-ab0f-7afb297c5b34"><enum>(C)</enum><text display-inline="yes-display-inline">the development and dissemination of
educational and promotional information relating to the programs under this
section to small business concerns in the
State.</text>
</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</subsection><subsection commented="no" display-inline="no-display-inline" id="idd0a7ef4f-e833-4732-ba66-2e858cc7b317"><enum>(b)</enum><header display-inline="yes-display-inline">Federal and State Program
Extension</header><text display-inline="yes-display-inline">Section 34 of the
Small Business Act (15 U.S.C. 657d) is amended—</text>

non-Federal share of the cost of the activity carried out using an award or
under a cooperative agreement under this section shall be 35 cents for each
Federal dollar that will be directly allocated by a recipient described in
paragraph (A) to serve small business concerns located in a rural area.</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ida47eea12-3bb2-4a78-a89a-af77446e1d94"><enum>(ii)</enum><header display-inline="yes-display-inline">Enhanced rural awards</header><text display-inline="yes-display-inline">For a recipient located in a rural area
that is located in a State described in subparagraph (A)(i), the non-Federal
share of the cost of the activity carried out using an award or under a
cooperative agreement under this section shall be 15 cents for each Federal
dollar that will be directly allocated by a recipient described in paragraph
(A) to serve small business concerns located in the rural area.</text>
</clause><clause commented="no" display-inline="no-display-inline" id="idc8fc5461-a617-4d0c-8de1-d1cf62651f28"><enum>(iii)</enum><header display-inline="yes-display-inline">Definition of rural area</header><text display-inline="yes-display-inline">In this subparagraph, the term <term>rural
area</term> has the meaning given that term in section 1393(a)(2)) of the
Internal Revenue Code of
1986.</text>

</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id48a75501-8ce8-42b7-8327-7b816ba9e9db" section-type="subsequent-section"><enum>202.</enum><header display-inline="yes-display-inline">SBIR–STEM Workforce Development Grant Pilot
Program</header>
<subsection commented="no" display-inline="no-display-inline" id="idf25f97a0-d129-4cfd-a352-2ef71dfb929b"><enum>(a)</enum><header display-inline="yes-display-inline">Pilot program established</header><text display-inline="yes-display-inline">From amounts made available to carry out
this section, the Administrator shall establish a SBIR–STEM Workforce
Development Grant Pilot Program to encourage the business community to provide
workforce development opportunities for college students, in the fields of
science, technology, engineering, and math (in this section referred to as
<quote>STEM college students</quote>), by providing a SBIR bonus grant.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="id250f141e-c2b9-4fb9-b4b7-961bdbf04f8d"><enum>(b)</enum><header display-inline="yes-display-inline">Eligible entities defined</header><text display-inline="yes-display-inline">In this section the term <quote>eligible
entity</quote> means a grantee receiving a grant under the SBIR Program on the
date of the bonus grant under subsection (a) that provides an internship
program for STEM college students.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="id56234e3a-c66a-4924-8df6-68909a15e7a5"><enum>(c)</enum><header display-inline="yes-display-inline">Awards</header><text display-inline="yes-display-inline">An eligible entity shall receive a bonus
grant equal to 10 percent of either a Phase I or Phase II grant, as applicable,
with a total award maximum of not more than $10,000 per year.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="ide0e784a9-c387-40af-aff5-c145e3a4a066"><enum>(d)</enum><header display-inline="yes-display-inline">Evaluation</header><text display-inline="yes-display-inline">Following the fourth year of funding under
this section, the Administrator shall submit a report to Congress on the
results of the SBIR–STEM Workforce Development Grant Pilot Program.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="idb5809035-c931-4c61-b3da-b372aeaf05ce"><enum>(e)</enum><header display-inline="yes-display-inline">Authorization of
appropriations</header><text display-inline="yes-display-inline">There are
authorized to be appropriated to carry out this section—</text>

awardees</header><text display-inline="no-display-inline">Section 9(q)(3) of
the Small Business Act (15 U.S.C. 638(q)(3)) is amended—</text>
<paragraph commented="no" display-inline="no-display-inline" id="idbe5a4513-0b00-4272-aec4-44f37f78afe0"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking
<quote>$4,000</quote> and inserting <quote>$5,000</quote>;</text>

</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbff14f27-aa18-434b-bea1-d96cd33d0bb8"><enum>(D)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">A Federal agency may not—</text>
<clause commented="no" display-inline="no-display-inline" id="id8bbea3d3-33c9-44d0-9539-38fea73015b1"><enum>(i)</enum><text display-inline="yes-display-inline">use the amounts authorized under
subparagraph (A) or (B) unless the vendor selected under paragraph (2) provides
the technical assistance to the recipient; or</text>

paragraph (2) under which the amount provided for technical assistance is based

III technologies in subcontracting plans; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1dbbc38f-e648-4cc0-a444-fd133f7288de"><enum>(B)</enum><text display-inline="yes-display-inline">require a prime contractor on such a
contract to report the number and dollar amount of contracts entered into by
that prime contractor for Phase III SBIR or STTR projects.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id16979eb5-cafd-4c8a-b9f5-0c1c26af09e7"><enum>(6)</enum><header display-inline="yes-display-inline">Goal for SBIR and STTR technology
insertion</header><text display-inline="yes-display-inline">The Secretary of
Defense shall—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id55d20fcb-675f-4344-9eda-aa0699def906"><enum>(A)</enum><text display-inline="yes-display-inline">set a goal to increase the number of Phase
II SBIR contracts and the number of Phase II STTR contracts awarded by that
Secretary that lead to technology transition into programs of record or fielded
systems;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id71f10c76-131c-4d35-9249-55c911de458d"><enum>(B)</enum><text display-inline="yes-display-inline">use incentives in effect on the date of
enactment of the <short-title>SBIR/STTR Reauthorization Act of
2009</short-title>, or create new incentives, to encourage agency program
managers and prime contractors to meet the goal under subparagraph (A);
and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6955b529-e14c-4385-8015-2d628d48ddcb"><enum>(C)</enum><text display-inline="yes-display-inline">include in the annual report to Congress
the percentage of contracts described in subparagraph (A) awarded by that
Secretary, and information on the ongoing status of projects funded through the
Commercialization Program and efforts to transition these technologies into
programs of record or fielded
systems.</text>
</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
</paragraph></section><section commented="no" display-inline="no-display-inline" id="idbeeadf6c-8b21-4256-bbd0-2a0e9c964c1c" section-type="subsequent-section"><enum>205.</enum><header display-inline="yes-display-inline">Commercialization Pilot Program for
civilian agencies</header><text display-inline="no-display-inline">Section 9 of
the Small Business Act (15 U.S.C. 638), as amended by this Act, is amended by
adding at the end the following:</text>

set aside not more than 10 percent of the SBIR and STTR funds of such agency
for further technology development, testing, and evaluation of SBIR and STTR
Phase II technologies.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1b5083f1-f218-4f4a-8214-cd0b9c90c66b"><enum>(2)</enum><header display-inline="yes-display-inline">Application by Federal agency</header>
<subparagraph commented="no" display-inline="no-display-inline" id="idfa48ac69-98a5-4057-b34a-084a4b01cc63"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A covered Federal agency may not establish
a pilot program unless such agency makes a written application to the
Administrator, not later than 90 days before to the first day of the fiscal
year in which the pilot program is to be established, that describes a
compelling reason that additional investment in SBIR or STTR technologies is
necessary, including unusually high regulatory, systems integration, or other
costs relating to development or manufacturing of identifiable, highly
promising small business technologies or a class of such technologies expected
to substantially advance the mission of the agency.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida5caf196-f880-4610-96ca-51803fbb1a89"><enum>(B)</enum><header display-inline="yes-display-inline">Determination</header><text display-inline="yes-display-inline">The Administrator shall—</text>
<clause commented="no" display-inline="no-display-inline" id="id5f9f4a9c-c974-41f9-8e04-61b8a87ef2ac"><enum>(i)</enum><text display-inline="yes-display-inline">make a determination regarding an
application submitted under subparagraph (A) not later than 30 days before the
first day of the fiscal year for which the application is submitted;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="idc68d431b-417b-46b8-8da2-6e6ab6114649"><enum>(ii)</enum><text display-inline="yes-display-inline">publish the determination in the Federal
Register; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="id7fe116cc-0da8-4be2-9443-e5416703a5a6"><enum>(iii)</enum><text display-inline="yes-display-inline">make a copy of the determination and any
related materials available to the Committee on Small Business and
Entrepreneurship of the Senate and the Committee on Small Business of the House
of Representatives.</text>
</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id46711b79-86dc-4acc-9573-c407b0054b2e"><enum>(3)</enum><header display-inline="yes-display-inline">Maximum amount of award</header><text display-inline="yes-display-inline">The head of a Federal agency may not make
an award under a pilot program in excess of 3 times the dollar amounts
generally established for Phase II awards under subsection (j)(2)(D) or
(p)(2)(B)(ix).</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2673f1a4-1e2c-492b-85ee-2c138978d401"><enum>(4)</enum><header display-inline="yes-display-inline">Matching</header><text display-inline="yes-display-inline">The head of a Federal agency may not make
an award under a pilot program for SBIR or STTR Phase II technology that will
be acquired by the Federal Government unless new private, Federal non-SBIR, or
Federal non-STTR funding that at least matches the award from the Federal
agency is provided for the SBIR or STTR Phase II technology.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id34d88784-976d-489a-8442-cb86b459d141"><enum>(5)</enum><header display-inline="yes-display-inline">Eligibility for award</header><text display-inline="yes-display-inline">The head of a Federal agency may make an
award under a pilot program to any applicant that is eligible to receive a
Phase III award related to technology developed in Phase II of an SBIR or STTR
project.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida9a3e638-29b3-427a-906a-d85cfe96e8fb"><enum>(6)</enum><header display-inline="yes-display-inline">Registration</header><text display-inline="yes-display-inline">Any applicant that receives an award under
a pilot program shall register with the Administrator in a registry that is
available to the public.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6fd1bef6-f613-425b-b653-6f2ea7732781"><enum>(7)</enum><header display-inline="yes-display-inline">Termination</header><text display-inline="yes-display-inline">The authority to establish a pilot program
under this section expires at the end of fiscal year 2014.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9bee1b10-8734-4faa-9943-42111f943054"><enum>(8)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id9903c076-3f79-43f7-9e2a-d808e5c9c389"><enum>(A)</enum><text display-inline="yes-display-inline">the term <term>covered Federal

</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbe7cb294-f562-408a-a36a-ef7bf56c7122"><enum>(B)</enum><text display-inline="yes-display-inline">the term <term>pilot program</term> means
the program established under paragraph
(1).</text>
</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

<subsection commented="no" display-inline="no-display-inline" id="ida94b69ea-19c2-44fb-a064-ba6003859a1e"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 9 of the Small Business Act (15
U.S.C. 638), as amended by this Act, is amended by adding at the end the
following:</text>

</subsection><subsection commented="no" display-inline="no-display-inline" id="id889b2772-e687-479c-b4df-2026210fa631"><enum>(b)</enum><header display-inline="yes-display-inline">Sunset</header><text display-inline="yes-display-inline">Effective October 1, 2014, subsection (ff)
of the Small Business Act, as added by subsection (a) of this section, is
repealed.</text>
</subsection></section><section commented="no" display-inline="no-display-inline" id="idfdca4da8-283b-4256-b683-92a8ade45dae" section-type="subsequent-section"><enum>207.</enum><header display-inline="yes-display-inline">Accelerating cures</header><text display-inline="no-display-inline">The Small Business Act (15 U.S.C. 631 et
seq.) is amended—</text>
<paragraph commented="no" display-inline="no-display-inline" id="id5d2a8b6c-43af-4408-826c-6f6128c6e9ea"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating section 44 as section 45;
and</text>

<paragraph commented="no" display-inline="no-display-inline" id="id9022052a-48cb-4173-b7c2-990193d5ad92"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">An independent advisory board shall be
established at the National Academy of Sciences (in this section referred to as
the <quote>advisory board</quote>) to conduct periodic evaluations of the SBIR
program (as that term is defined in section 9) of each of the National
Institutes of Health (referred to in this section as the <quote>NIH</quote>)
institutes and centers for the purpose of improving the management of the SBIR
program through data-driven assessment.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcbdb862c-6099-4400-ae93-d4e136d2443e"><enum>(2)</enum><header display-inline="yes-display-inline">Membership</header>
<subparagraph commented="no" display-inline="no-display-inline" id="id114e5d89-b160-4311-8fa2-543861f09c2e"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The advisory board shall consist of—</text>
<clause commented="no" display-inline="no-display-inline" id="ida7bef066-0512-46cb-aa39-a1a350917b6e"><enum>(i)</enum><text display-inline="yes-display-inline">the Director of the NIH;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="idde401212-86de-435a-9ccc-aa9e4120900d"><enum>(ii)</enum><text display-inline="yes-display-inline">the Director of the SBIR program of the
NIH;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="id10260693-bdc0-4daf-9d15-c8e56b70e027"><enum>(iii)</enum><text display-inline="yes-display-inline">senior NIH agency managers, selected by the
Director of NIH;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="id030b330d-8aa0-462d-b020-e7d8a4bc22ff"><enum>(iv)</enum><text display-inline="yes-display-inline">industry experts, selected by the Council
of the National Academy of Sciences in consultation with the Associate
Administrator for Technology of the Administration and the Director of the
Office of Science and Technology Policy; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="id7d9aec03-6def-4ae9-b541-615ed73ee960"><enum>(v)</enum><text display-inline="yes-display-inline">owners or operators of small business
concerns that have received an award under the SBIR program of the NIH,
selected by the Associate Administrator for Technology of the
Administration.</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1eae8bff-c33a-4857-827a-a9c4276cc9f9"><enum>(B)</enum><header display-inline="yes-display-inline">Number of members</header><text display-inline="yes-display-inline">The total number of members selected under
clauses (iii), (iv), and (v) of subparagraph (A) shall not exceed 10.</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9491c790-dd78-4d4f-8fda-14b7b307f598"><enum>(C)</enum><header display-inline="yes-display-inline">Equal representation</header><text display-inline="yes-display-inline">The total number of members of the advisory
board selected under clauses (i), (ii), (iii), and (iv) of subparagraph (A)
shall be equal to the number of members of the advisory board selected under
subparagraph (A)(v).</text>
</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id31950dee-a0ed-4db6-8bc2-676bc145a233"><enum>(b)</enum><header display-inline="yes-display-inline">Addressing data gaps</header><text display-inline="yes-display-inline">In order to enhance the evidence-base
guiding SBIR program decisions and changes, the Director of the SBIR program of
the NIH shall address the gaps and deficiencies in the data collection concerns
identified in the 2007 report of the National Academies of Science entitled
<quote>An Assessment of the Small Business Innovation Research Program at the
NIH</quote>.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="id105b50f3-008f-4d82-9c45-cdccf45611a5"><enum>(c)</enum><header display-inline="yes-display-inline">Pilot program</header>
<paragraph commented="no" display-inline="no-display-inline" id="idb0db0295-6bec-4894-9ccc-53f457db58b7"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Director of the SBIR program of the NIH
may initiate a pilot program, under a formal mechanism for designing,
implementing, and evaluating pilot programs, to spur innovation and to test new
strategies that may enhance the development of cures and therapies.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id89ae839b-496c-4e41-a9b3-14bca79440a2"><enum>(2)</enum><header display-inline="yes-display-inline">Considerations</header><text display-inline="yes-display-inline">The Director of the SBIR program of the NIH
may consider conducting a pilot program to include individuals with successful
SBIR program experience in study sections, hiring individuals with small
business development experience for staff positions, separating the commercial
and scientific review processes, and examining the impact of the trend toward
larger awards on the overall program.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4abc2f86-f114-46e2-ade5-62f347588b64"><enum>(d)</enum><header display-inline="yes-display-inline">Report to Congress</header><text display-inline="yes-display-inline">The Director of the NIH shall submit an
annual report to Congress and the advisory board on the activities of the SBIR
program of the NIH under this section.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="id40940112-24e3-43b5-86f1-4e883e4740c2"><enum>(e)</enum><header display-inline="yes-display-inline">SBIR grants and contracts</header>
<paragraph commented="no" display-inline="no-display-inline" id="id1523f651-2462-4000-b861-c1b661a97ec7"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In awarding grants and contracts under the
SBIR program of the NIH each SBIR program manager shall place an emphasis on
applications that identify products and services that may enhance the
development of cures and therapies.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfb5266e0-409a-462e-90a3-dd67f4e97049"><enum>(2)</enum><header display-inline="yes-display-inline">Examination of commercialization and other
metrics</header><text display-inline="yes-display-inline">The advisory board
shall evaluate the implementation of the requirement under paragraph (1) by
examining increased commercialization and other metrics, to be determined and
collected by the SBIR program of the NIH.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id421ee863-5ab6-4491-a90c-c66e6c205c28"><enum>(3)</enum><header display-inline="yes-display-inline">Phase
I and II</header><text display-inline="yes-display-inline">To the greatest
extent practicable, the Director of the SBIR program of the NIH shall reduce
the time period between Phase I and Phase II funding of grants and contracts
under the SBIR program of the NIH to 6 months.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9206a8a1-f7d5-4cba-9b1a-df3347a5eba3"><enum>(f)</enum><header display-inline="yes-display-inline">Limit</header><text display-inline="yes-display-inline">Not more than a total of 1 percent of the
extramural budget (as defined in section 9 of the Small Business Act (15 U.S.C.
638)) of the NIH for research or research and development may be used for the
pilot program under subsection (c) and to carry out subsection (e).</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="id977c4c25-5aff-43b9-9e05-dcd97f932af6"><enum>(g)</enum><header display-inline="yes-display-inline">Sunset</header><text display-inline="yes-display-inline">This section shall cease to be effective on
the date that is 5 years after the date of enactment of the
<short-title>SBIR/STTR Reauthorization Act of
2009</short-title>.</text>

</paragraph></section><enum>III</enum><header display-inline="yes-display-inline">Oversight and evaluation</header>

awardee has received as of the date of the award; and</text>
</subclause><subclause commented="no" display-inline="no-display-inline" id="id6484553b-07be-49c8-b02b-0c62a5c122a5"><enum>(II)</enum><text display-inline="yes-display-inline">the amount of additional capital that the
awardee has invested in the SBIR technology;</text>
</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id73471805-7815-41ed-946a-9c47bb134c44"><enum>(ii)</enum><text display-inline="yes-display-inline">has an investor that—</text>
<subclause commented="no" display-inline="no-display-inline" id="id72d233c1-2065-46c6-9a75-a98e649ba1bf"><enum>(I)</enum><text display-inline="yes-display-inline">is an individual who is not a citizen of
the United States or a lawful permanent resident of the United States, and if
so, the name of any such individual; or</text>
</subclause><subclause commented="no" display-inline="no-display-inline" id="id284e8ced-7643-4cc7-af1f-833ed0875423"><enum>(II)</enum><text display-inline="yes-display-inline">is a person that is not an individual and
is not organized under the laws of a State or the United States, and if so the
name of any such person;</text>
</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id771aab23-c682-4612-b723-8417eea501fe"><enum>(iii)</enum><text display-inline="yes-display-inline">is owned by a woman or has a woman as a

collected on an annual basis;</text>
</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id98b0ad5d-89a1-43b0-98d4-4162561936da"><enum>(iii)</enum><text display-inline="yes-display-inline">the names and locations of any affiliates
of the awardee;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="idb5b8c778-0d28-4595-8162-a54e851e769b"><enum>(iv)</enum><text display-inline="yes-display-inline">the number of employees of the
awardee;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="id4e73c547-d6a8-42f8-bcd9-d42adc39e3df"><enum>(v)</enum><text display-inline="yes-display-inline">the number of employees of the affiliates
of the awardee; and</text>

calculations</header>
<subsection commented="no" display-inline="no-display-inline" id="id2050de40-1536-4517-ac03-9c1a8ed2ff03"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
enactment of this Act, and every 3 years thereafter, the Comptroller General of
the United States shall—</text>
<paragraph commented="no" display-inline="no-display-inline" id="id6710e3b4-3276-4b56-a1f6-693ec0fbc9e4"><enum>(1)</enum><text display-inline="yes-display-inline">conduct a fiscal and management audit of
the SBIR program and the STTR program for the applicable period to—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="idb0c8c8b8-3868-4bec-a769-42e9d2e6c244"><enum>(A)</enum><text display-inline="yes-display-inline">determine whether Federal agencies comply
with the expenditure amount requirements under subsections (f)(1) and (n)(1) of
section 9 of the Small Business Act (15 U.S.C. 638), as amended by this
Act;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2a6c364b-5ec9-4b8f-9b09-0ca6f2ba11ad"><enum>(B)</enum><text display-inline="yes-display-inline">assess the extent of compliance with the
requirements of section 9(i)(2) of the Small Business Act (15 U.S.C. 638(i)(2))
by Federal agencies participating in the SBIR program or the STTR program and
the Administration;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida2c7982f-ac09-4f38-97f4-a2a8f90b4f3d"><enum>(C)</enum><text display-inline="yes-display-inline">assess whether it would be more consistent
and effective to base the amount of the allocations under the SBIR program and
the STTR program on a percentage of the research and development budget of a
Federal agency, rather than the extramural budget of the Federal agency;
and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id800f7cad-1951-4db2-b68f-1de20cbd118b"><enum>(D)</enum><text display-inline="yes-display-inline">determine the portion of the extramural
research or research and development budget of a Federal agency that each
Federal agency spends for administrative purposes relating to the SBIR program
or STTR program, and for what specific purposes, including the portion, if any,
of such budget the Federal agency spends for salaries and expenses, travel to
visit applicants, outreach events, marketing, and technical assistance;
and</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ided95f7c0-7f96-42c2-b30f-2eb23b2f1a0e"><enum>(2)</enum><text display-inline="yes-display-inline">submit a report to the Committee on Small
Business and Entrepreneurship of the Senate and the Committee on Small Business
of the House of Representatives regarding the audit conducted under paragraph
(1), including the assessments required under subparagraphs (B) and (C), and
the determination made under subparagraph (D) of paragraph (1).</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id100c3935-bf42-4840-a469-dd5ff3b8a0eb"><enum>(b)</enum><header display-inline="yes-display-inline">Definition of applicable
period</header><text display-inline="yes-display-inline">In this section, the
term <term>applicable period</term> means—</text>
<paragraph commented="no" display-inline="no-display-inline" id="idcd8873f1-fcbc-4ea6-b31b-b34026f96f38"><enum>(1)</enum><text display-inline="yes-display-inline">for the first report submitted under this
section, the period beginning on October 1, 2000, and ending on September 30 of
the last full fiscal year before the date of enactment of this Act for which
information is available; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf2bd5d86-7189-4786-a16f-60f7eecb08ca"><enum>(2)</enum><text display-inline="yes-display-inline">for the second and each subsequent report
submitted under this section, the period—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id06118b85-08fe-4886-a2a1-967f3c4b7999"><enum>(A)</enum><text display-inline="yes-display-inline">beginning on October 1 of the first fiscal
year after the end of the most recent full fiscal year relating to which a
report under this section was submitted; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id070b174a-7737-4868-b2ea-2365ed2d9e72"><enum>(B)</enum><text display-inline="yes-display-inline">ending on September 30 of the last full
fiscal year before the date of the report.</text>
</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id0c9e8491-71eb-43bc-afe7-a69f43f05abd" section-type="subsequent-section"><enum>307.</enum><header display-inline="yes-display-inline">Continued evaluation by the National
Academy of Sciences</header><text display-inline="no-display-inline">Section
108 of the Small Business Reauthorization Act of 2000 (15 U.S.C. 638 note) is
amended by adding at the end the following:</text>

<paragraph commented="no" display-inline="no-display-inline" id="ida306be22-a378-4c53-bc61-528d7e05eda1"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 6 months after the date of
enactment of the <short-title>SBIR/STTR Reauthorization Act of
2009</short-title>, the head of each agency described in subsection (a), in
consultation with the Small Business Administration, shall cooperatively enter
into an agreement with the National Academy of Sciences for the National
Research Council to conduct a study described in subsection (a)(1) and make
recommendations described in subsection (a)(2) not later than 4 years after the
date of enactment of the <short-title>SBIR/STTR Reauthorization Act of
2009</short-title>, and every 4 years thereafter.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7f6ab919-7edf-463b-b965-a58876cef510"><enum>(2)</enum><header display-inline="yes-display-inline">Reporting</header><text display-inline="yes-display-inline">An agreement under paragraph (1) shall
require that not later than 4 years after the date of enactment of the
<short-title>SBIR/STTR Reauthorization Act of 2009</short-title>, and every 4
years thereafter, the National Research Council shall submit to the head of the
agency entering into the agreement, the Committee on Small Business and
Entrepreneurship of the Senate, and the Committee on Small Business of the
House of Representatives a report regarding the study conducted under paragraph
(1) and containing the recommendations described in paragraph
(1).</text>
</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</section><section commented="no" display-inline="no-display-inline" id="id77481463-24f2-437f-b7df-ee51b59e7a55" section-type="subsequent-section"><enum>308.</enum><header display-inline="yes-display-inline">Technology insertion reporting
requirements</header><text display-inline="no-display-inline">Section 9 of the
Small Business Act (15 U.S.C. 638), as amended by this Act, is amended by
adding at the end the following:</text>
<quoted-block changed="added" display-inline="no-display-inline" id="id3a049e04-e3df-4f51-9d3a-1d6b0747193e" reported-display-style="italic" style="OLC">

by the Administration under subsection (b)(7) shall include, for each Phase III

<paragraph commented="no" display-inline="no-display-inline" id="ide644eca0-5d0f-4afc-87e8-863b3975d44c"><enum>(1)</enum><text display-inline="yes-display-inline">the name of the agency or component of the
agency or the non-Federal source of capital making the Phase III award;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0a3a9316-089b-43bc-84e5-7632e1b9309b"><enum>(2)</enum><text display-inline="yes-display-inline">the name of the small business concern or
individual receiving the Phase III award; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5a0a182c-6128-4302-b27f-9a5254167452"><enum>(3)</enum><text display-inline="yes-display-inline">the dollar amount of the Phase III
award.</text>
</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</section><section commented="no" display-inline="no-display-inline" id="id087bb8f8-8ce0-4fce-a909-47ad8912b07c" section-type="subsequent-section"><enum>309.</enum><header display-inline="yes-display-inline">Intellectual property protections</header>
<subsection commented="no" display-inline="no-display-inline" id="id33987e0b-9976-437b-be7d-9739b16c5dbd"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Comptroller General of the United
States shall conduct a study of the SBIR program to assess whether—</text>
<paragraph commented="no" display-inline="no-display-inline" id="id7e1fb080-eeea-4c0c-a261-3f521722f804"><enum>(1)</enum><text display-inline="yes-display-inline">Federal agencies comply with the data
rights protections for SBIR awardees and the technologies of SBIR awardees
under section 9 of the Small Business Act (15 U.S.C. 638);</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id59c84b1d-3441-4bd5-ad02-0957c3d5ea8d"><enum>(2)</enum><text display-inline="yes-display-inline">the laws and policy directives intended to
clarify the scope of data rights, including in prototypes and mentor-protégé
relationships and agreements with Federal laboratories, are sufficient to
protect SBIR awardees; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id57597d40-a40e-42f8-8b15-9c7c4a78612f"><enum>(3)</enum><text display-inline="yes-display-inline">there is an effective grievance tracking
process for SBIR awardees who have grievances against a Federal agency
regarding data rights and a process for resolving those grievances.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2f230920-f819-491c-a43f-189c5ddafa13"><enum>(b)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 18 months after the date of
enactment of this Act, the Comptroller General shall submit to the Committee on
Small Business and Entrepreneurship of the Senate and the Committee on Small
Business of the House of Representatives a report regarding the study conducted
under subsection (a).</text>
</subsection></section><enum>IV</enum><header display-inline="yes-display-inline">Policy directives</header>
<section commented="no" display-inline="no-display-inline" id="idda98e1cb-ea17-486b-ac3b-72c4e584f7ac" section-type="subsequent-section"><enum>401.</enum><header display-inline="yes-display-inline">Conforming amendments to the SBIR and the
STTR Policy Directives</header>
<subsection commented="no" display-inline="no-display-inline" id="id9475faaa-3cd7-4ae1-9407-0e9ca6342cf6"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
enactment of this Act, the Administrator shall promulgate amendments to the
SBIR Policy Directive and the STTR Policy Directive to conform such directives
to this Act and the amendments made by this Act.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="id99734e08-264c-4092-a041-f383846c73a9"><enum>(b)</enum><header display-inline="yes-display-inline">Publishing SBIR Policy Directive and the
STTR Policy Directive in the Federal Register</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
enactment of this Act, the Administrator shall publish the amended SBIR Policy
Directive and the amended STTR Policy Directive in the Federal Register.</text>
</subsection></section><section id="idA42602D1E72B44BCA0FE369ABBC99039"><enum>402.</enum><header>Priorities for certain
research initiatives</header>
<subsection id="idEBB66466A65E4598AB7B12C31A3CF3BD"><enum>(a)</enum><header>In
general</header><text>Section 9 of the Small Business Act (15 U.S.C. 638), as
amended by this Act, is amended by adding at the end the following:</text>
<quoted-block changed="added" display-inline="no-display-inline" id="id7BD7BEAA35A24558AA472BB8196AB987" reported-display-style="italic" style="OLC">
<subsection id="id0BACACCE451A4B6BBCA34B1073BA0FBC"><enum>(hh)</enum><header>Research
initiatives</header><text>To the extent that such projects relate to the
mission of the Federal agency, each Federal agency participating in the SBIR
program or STTR program shall encourage the submission of applications for
support of projects relating to security, energy, transportation, or improving
the security and quality of the water supply of the United States to such
program.</text>
</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
</subsection><subsection id="id2D3F5B04F16C4B049D0B2BC13F4F92F9"><enum>(b)</enum><header>Sunset</header><text>Effective
October 1, 2014, section 9(hh) of the Small Business Act, as added by
subsection (a) of this section, is repealed.</text>
</subsection></section><section id="idCD0F4CCB0F314628B435A09301DB4163"><enum>403.</enum><header>Report on SBIR and
STTR program goals</header><text display-inline="no-display-inline">Section 9
of the Small Business Act (15 U.S.C. 638), as amended by this Act, is amended
by adding at the end the following:</text>

metrics</header><text display-inline="yes-display-inline">The head of each
Federal agency required to participate in the SBIR program or the STTR program
shall develop metrics to evaluate the effectiveness, and the benefit to the
people of the United States, of the SBIR program and the STTR program of the
Federal agency that—</text>
<subparagraph id="idAACA1C4DE423450CB3144F1353C2AB19"><enum>(A)</enum><text display-inline="yes-display-inline">are science-based and statistically
driven;</text>
</subparagraph><subparagraph id="idB65D9EE8E57E48728B1DB2479725CF0D"><enum>(B)</enum><text>reflect the mission of
the Federal agency; and</text>
</subparagraph><subparagraph id="id0DEF3756EACC4A0DB270D559053C1768"><enum>(C)</enum><text>include factors relating
to the economic impact of the programs.</text>
</subparagraph></paragraph><paragraph id="idB226A228189E489EA824705F6E9E5CC9"><enum>(2)</enum><header>Evaluation</header><text>The
head of each Federal agency described in paragraph (1) shall conduct an annual
evaluation using the metrics developed under paragraph (1) of—</text>
<subparagraph id="id110E307F1FB14AB39744594043462B9B"><enum>(A)</enum><text>the SBIR program and the

Federal agency.</text>
</subparagraph></paragraph><paragraph id="id4928913C31D248A8BFC5F39594CDFA97"><enum>(3)</enum><header>Report</header>
<subparagraph id="idC74465467C034BFA9384F116682F481E"><enum>(A)</enum><header>In
general</header><text>The head of each Federal agency described in paragraph
(1) shall submit to the appropriate committees of Congress and the
Administrator an annual report describing in detail the results of an
evaluation conducted under paragraph (2).</text>
</subparagraph><subparagraph id="idD185056D60B84A0EA8C73EF0022EF20A"><enum>(B)</enum><header>Public availability of
report</header><text>The head of each Federal agency described in paragraph (1)
shall make each report submitted under subparagraph (A) available to the public
online.</text>
</subparagraph><subparagraph id="idBA790303D5FD406AAA776204AD6D90DC"><enum>(C)</enum><header>Definition</header><text>In
this paragraph, the term <term>appropriate committees of Congress</term>
means—</text>

Business and Entrepreneurship of the Senate; and</text>

procedures for SBIR and STTR programs</header><text display-inline="no-display-inline">Section 9 of the Small Business Act (15
U.S.C. 638), as amended by this Act, is amended by adding at the end the
following:</text>
