		<official-title>To direct the Secretary of Defense to adopt a program of
		  professional and confidential screenings for members of the armed forces on
		  active duty to detect mental health conditions for the purpose of reducing the
		  incidence of suicide among such members and veterans, and to detect traumatic
		  brain injuries, and for other purposes.</official-title>

		<section id="H8A221453E5D849BF83A300AB00E3B407" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Kyle Barthel Veterans and Service
			 Members Mental Health Screening Act</short-title></quote>.</text>
		</section><section id="HFCFDEF4A1F894E5CAA2BB0F556A21481"><enum>2.</enum><header>Mandatory
			 confidential screenings for suicide and substance abuse prevention</header>
			<subsection id="H1F38EDFE8E47436DB70E36A6EEB9C7DA"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of
			 Defense shall ensure that each member of the armed forces on active duty
			 (referred to in this Act as <quote>member</quote>) is screened for mental
			 health conditions by a licensed mental health professional for the purpose of
			 reducing the prevalence of suicide among such service members, future veterans,
			 and veterans.</text>
			</subsection><subsection id="H0FC65E2C4A3046089955A1D01D901129"><enum>(b)</enum><header>Requirements for
			 screenings</header>
				<paragraph id="H84C77E4DDC664FDDA10F207029D3EA99"><enum>(1)</enum><header>Mandatory</header><text display-inline="yes-display-inline">Each member shall be required to
			 participate in screenings under
			 <internal-xref idref="H1F38EDFE8E47436DB70E36A6EEB9C7DA" legis-path="3.(a)">subsection (a) </internal-xref>shall be mandatory.</text>
				</paragraph><paragraph id="H047B0F48A6F34CCB9F473C23EFA09E00"><enum>(2)</enum><header>Confidential</header><text display-inline="yes-display-inline">With respect to the screenings conducted
			 under this section, the Secretary shall ensure compliance with all applicable
			 laws and regulations relating to the confidentiality of the health care
			 information generated through such screenings.</text>
				</paragraph><paragraph id="H097C12BBEE694493A68ECE0D5FECF1C9"><enum>(3)</enum><header>In person
			 screening required</header><text display-inline="yes-display-inline">The
			 licensed mental health professional conducting the screening under
			 <internal-xref idref="H1F38EDFE8E47436DB70E36A6EEB9C7DA" legis-path="3.(a)">subsection (a)</internal-xref> must be in the physical
			 presence of the member at the time the screening for such member is
			 conducted.</text>
				</paragraph><paragraph id="HC8C8BCFF9E564CAFBAB55CE1C573AD2F"><enum>(4)</enum><header>Standards</header><text>The
			 screenings under
			 <internal-xref idref="H1F38EDFE8E47436DB70E36A6EEB9C7DA" legis-path="2.(a)">subsection (a)</internal-xref> shall conform to a set of
			 standards developed by the Secretary of Defense, in consultation with the
			 National Institute for Mental Health, for the purpose of identifying suicide
			 and substance abuse risk factors.</text>
				</paragraph></subsection><subsection id="H8BCFF234517E48D2AB34382F2F5B288A"><enum>(c)</enum><header>Timing of
			 screenings</header><text display-inline="yes-display-inline">With respect to a
			 member, the screenings under
			 <internal-xref idref="H1F38EDFE8E47436DB70E36A6EEB9C7DA" legis-path="3.(a)">subsection (a)</internal-xref> shall be conducted—</text>
				<paragraph id="HCDF0CCD4A23645FE9CCAD31EE7C79851"><enum>(1)</enum><text>within 30 days of
			 such member’s induction to active duty service;</text>
				</paragraph><paragraph id="H2060CCD51C194ED5903128D1830226B6"><enum>(2)</enum><text>as a component of
			 each required physical exam;</text>
				</paragraph><paragraph id="H99DBF51276AA4F50B7A893A7143677FE"><enum>(3)</enum><text display-inline="yes-display-inline">one time during the 30-day period ending on
			 the date such member is deployed to in support of a contingency operation (as
			 defined in section 101(13) of title 10, United States Code);</text>
				</paragraph><paragraph id="H85BB1003EC804403A06049DE2286B079"><enum>(4)</enum><text>one time during
			 the 30-day period ending on the date that such deployment is scheduled to
			 end;</text>
				</paragraph><paragraph id="HAD792470206F4E6FACB5CA8F4D6A3E09"><enum>(5)</enum><text>one time during
			 the 90-day period following the date under
			 <internal-xref idref="H85BB1003EC804403A06049DE2286B079" legis-path="2.(c)(4)">paragraph (4)</internal-xref>; and</text>
				</paragraph><paragraph id="H8F09C516E60C4B81AF0880F41B976780"><enum>(6)</enum><text>one time during
			 the 90-day period following the period in
			 <internal-xref idref="HAD792470206F4E6FACB5CA8F4D6A3E09" legis-path="3.(c)(5)">paragraph (5)</internal-xref>.</text>
				</paragraph></subsection><subsection id="H8C1B1AC156984456BC9877D417C68C2D"><enum>(d)</enum><header>Protection from
			 adverse treatment</header><text>For the purpose of encouraging members to
			 provide complete information during the screenings under
			 <internal-xref idref="H1F38EDFE8E47436DB70E36A6EEB9C7DA" legis-path="2.(a)">subsection (a)</internal-xref> and to discourage members
			 from stigmatizing participation in treatment for depression and other mental
			 health problems, the Secretary of Defense shall not use the results of a
			 screening under
			 <internal-xref idref="H1F38EDFE8E47436DB70E36A6EEB9C7DA" legis-path="2.(a)">subsection (a)</internal-xref> to—</text>
				<paragraph id="H0F9B95AE18684405A6E54DE4C1E762BD"><enum>(1)</enum><text>prohibit a member
			 from returning to the United States;</text>
				</paragraph><paragraph id="H2E11AFCD33CA41D9BD46DDDD1271D60C"><enum>(2)</enum><text>prohibit a member
			 from being discharged from the armed forces; or</text>
				</paragraph><paragraph commented="no" id="HB496BADF525047688DF8B1A90B323925"><enum>(3)</enum><text>to involuntary
			 discharge a member from the armed forces.</text>
				</paragraph></subsection><subsection commented="no" id="HB480CE4C897A47B190155B25D8269E5"><enum>(e)</enum><header>Defense study and
			 report</header>
				<paragraph commented="no" id="HE820E2F0DF6746669E42AFB56C61AA08"><enum>(1)</enum><header>Study</header><text>The
			 Secretary of Defense shall conduct a study—</text>
					<subparagraph id="H4D176DFE4A3349EB95C66A4D6C996DA4"><enum>(A)</enum><text>to collect data
			 on—</text>
						<clause commented="no" id="HEBC343C693984E4792A98A7C8195BADC"><enum>(i)</enum><text>the number of
			 licensed mental health providers who are employed by the Secretary;</text>
						</clause><clause commented="no" id="H882CB13360AD438C8ED59C400D44C424"><enum>(ii)</enum><text>the number of
			 members that each such provider is expected to screen and treat;</text>
						</clause><clause commented="no" id="H01E65A394A3343339131E54F666C4199"><enum>(iii)</enum><text>the expected
			 retirement dates of such providers;</text>
						</clause><clause commented="no" id="H22F754720E92464DB465FB03D9DD7F9D"><enum>(iv)</enum><text>the geographic
			 location of such providers; and</text>
						</clause><clause id="H995CD34894F240AFA51BECDDB59F4106"><enum>(v)</enum><text>the
			 ability of members to access screening and treatment services offered by such
			 providers; and</text>
						</clause></subparagraph><subparagraph id="H64965ED09C714F9783C297006C02AFE5"><enum>(B)</enum><text>to evaluate
			 whether redistributing such providers geographically, assigning different tasks
			 to such providers, and hiring additional such providers would assist the
			 Secretary in providing adequate mental health screening and treatment to
			 members (including the mental health screenings required by this Act).</text>
					</subparagraph></paragraph><paragraph id="H90C41D0BEAC843D3BF8AB3015E1A6DFC"><enum>(2)</enum><header>Report</header><text>Not
			 later than one year after the date of the enactment of this section, the
			 Secretary of Defense shall submit to the Congress a report on the results of
			 the study conducted under
			 <internal-xref idref="HE820E2F0DF6746669E42AFB56C61AA08" legis-path="5.(a)(1)">paragraph (1)</internal-xref>.</text>
				</paragraph></subsection><subsection commented="no" id="H45CDBD573E784E689312E78CDFBD4C87"><enum>(f)</enum><header>Department of
			 Veterans Affairs</header>
				<paragraph commented="no" id="H22D634B9151A4050A374AFE5C20B8175"><enum>(1)</enum><header>Study</header><text>The
			 Secretary of Veterans Affairs shall conduct a study—</text>
					<subparagraph commented="no" id="H68FA2B7DC09C47F99A93A4C3958A331E"><enum>(A)</enum><text>to collect data
			 on—</text>
						<clause commented="no" id="H37560075A69B493A97C33BBE6EA4EA0B"><enum>(i)</enum><text>the number of
			 licensed mental health providers who are employed by the Secretary;</text>
						</clause><clause commented="no" id="HE242785DA90044A88FA9C93C1BC9A8D9"><enum>(ii)</enum><text>the number of
			 veterans that each provider is expected to screen and treat;</text>
						</clause><clause commented="no" id="HDC1ADA4B74104C13AD46390AA8655C7E"><enum>(iii)</enum><text>the expected
			 retirement dates of such providers;</text>
						</clause><clause commented="no" id="HCDFFD9D0437540AAA4FF43F91866511D"><enum>(iv)</enum><text>the geographic
			 location of such providers; and</text>
						</clause><clause commented="no" id="HE21DEA6A6C6D404D908E1BB83E05F3C6"><enum>(v)</enum><text>the ability of
			 veterans to access screening and treatment services offered by such providers;</text>
						</clause></subparagraph><subparagraph commented="no" id="H9F7F210633534D308B222AF0285DC892"><enum>(B)</enum><text>to evaluate
			 whether redistributing such providers geographically, assigning different tasks
			 to such providers, and hiring additional such providers would assist the
			 Secretary in providing adequate mental health treatment and screening services
			 to veterans; and</text>
					</subparagraph><subparagraph commented="no" id="HAE1A149E860D4088B355ED516622B797"><enum>(C)</enum><text>to determine the
			 projected cost of hiring and retaining licensed mental health providers to be
			 placed in each veteran hospital, community-based outpatient clinic, and
			 facility operates under a contract to provide clinical services on behalf of
			 the Department of Veterans Affairs.</text>
					</subparagraph></paragraph><paragraph commented="no" id="HBDF7D5540FE949C2B280A5BA89A7E33A"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than one year after the date of
			 the enactment of this section, the Secretary of Veterans Affairs shall submit
			 to the Congress a report on the results of the study conducted under
			 <internal-xref idref="H22D634B9151A4050A374AFE5C20B8175" legis-path="5.(a)(1)">paragraph (1)</internal-xref>.</text>
				</paragraph></subsection></section><section id="HAF1BE2A2F6CF40FCAEAFB577AFFF4714"><enum>3.</enum><header>Mandatory TBI
			 Screenings</header>
			<subsection id="H84F16550DE3D45658DDC044018BB1D53"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of
			 Defense shall require that each member on active duty is screened for a
			 traumatic brain injury by a licensed professional who is qualified to conduct
			 such screening.</text>
			</subsection><subsection display-inline="no-display-inline" id="H23E9E165D6DE4A9987E87F1C5A690D9A"><enum>(b)</enum><header>Timing of
			 screenings</header><text display-inline="yes-display-inline">With respect to a
			 service member, the screenings under
			 <internal-xref idref="H1F38EDFE8E47436DB70E36A6EEB9C7DA" legis-path="3.(a)">subsection (a)</internal-xref> shall be conducted—</text>
				<paragraph id="H56057A15310E4768AD25BD8D0ABF593D"><enum>(1)</enum><text>as a component of
			 each required physical exam;</text>
				</paragraph><paragraph id="H3454494DB67D420CADD014A4EA680425"><enum>(2)</enum><text display-inline="yes-display-inline">one time during the 30-day period beginning
			 on the date such member is deployed such member is deployed to in support of a
			 contingency operation (as defined in section 101(13) of title 10, United States
			 Code);</text>
				</paragraph><paragraph id="H1754D9B9A95D47B197469F4AF3A5CA2A"><enum>(3)</enum><text>one time during
			 the 30-day period ending on the date on which such deployment is scheduled to
			 end for such member; and</text>
				</paragraph><paragraph id="H9258C83567C741779BA6B4AD075597FD"><enum>(4)</enum><text>one time during
			 the 90-day period following the date under
			 <internal-xref idref="H1754D9B9A95D47B197469F4AF3A5CA2A" legis-path="3.(b)(3)">paragraph (3)</internal-xref>.</text>
				</paragraph></subsection></section><section id="HF83ADD64F9C44265BA4FEEB7EC5EF9A8"><enum>4.</enum><header>Department of
			 Defense and Department of Veterans Affairs information sharing</header><text display-inline="no-display-inline">Pursuant to and consistent with requirements
			 of the Wounded Warrior Act (title XVI of Public Law 110–181) (including the
			 requirements of section 1614 of that Act) and section 1720F of title 38, United
			 States Code, the Secretary of Defense and the Secretary of Veterans Affairs
			 shall establish a joint protocol to share existing and future reports
			 concerning screenings conducted under this Act to help aid members and veterans
			 who are transitioning from receiving health care and treatment through
			 Department of Defense to receiving such care and services through the
			 Department of Veterans Affairs.</text>
