		<official-title>To amend part B of title XVIII of the Social Security Act
		  to provide Medicare physician incentive payments for efficient
		  areas.</official-title>

		<section id="H4D52F3E90C0B40CBAB77CA8958861932" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Medicare Efficiency Incentive Act of
			 2009</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="H2B0C4E9257C04399A5468DFF16BC21E" section-type="subsequent-section"><enum>2.</enum><header>Payments for efficient
			 physicians</header><text display-inline="no-display-inline">Section 1833 of the
			 Social Security Act (42 U.S.C. 1395l) is amended by adding at the end the
			 following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="H23D77AA6784748B099DB6CA6C6DEE64" style="OLC">
				<subsection id="HC2EC280DF44345FDB3CF5537A55792E"><enum>(x)</enum><header>Incentive
				payments for efficient physicians</header>
					<paragraph id="HECF3FB339F8D4D2ABA275C78849DB09C"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">In the case of
				physicians’ services furnished on or after January 1, 2010, and before January
				1, 2014, by a participating physician in an efficient area (as identified under
				paragraph (2)), in addition to the amount of payment that would otherwise be
				made for such services under this part, there also shall be paid an amount
				equal to 5 percent of the payment amount for the services under this
				part.</text>
					</paragraph><paragraph id="H219D8218B1864C4DBCA19E077C1BCAEB"><enum>(2)</enum><header>Identification
				of efficient areas</header>
						<subparagraph id="H1DE7B3EE26424BCBB227FB30CB4D895"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Based upon available
				data, the Secretary shall identify those counties or equivalent areas in the
				United States in the lowest fifth percentile of utilization based on per capita
				spending for services provided in 2007 under this part and part A.</text>
						</subparagraph><subparagraph id="H70C89922FE7941C99ED1A64558205855"><enum>(B)</enum><header>Identification
				of counties where service is furnished</header><text display-inline="yes-display-inline">For purposes of paying the additional
				amount specified in paragraph (1), if the Secretary uses the 5-digit postal ZIP
				Code where the service is furnished, the dominant county of the postal ZIP Code
				(as determined by the United States Postal Service, or otherwise) shall be used
				to determine whether the postal ZIP Code is in a county described in
				subparagraph (A).</text>
						</subparagraph><subparagraph id="HE9F6B911EC774BCB931E6C96287E0739"><enum>(C)</enum><header>Judicial
				review</header><text display-inline="yes-display-inline">There shall be no
				administrative or judicial review under section 1869, 1878, or otherwise,
				respecting—</text>
							<clause id="H171EDCA6B91242FF8C6D8F51882970F7"><enum>(i)</enum><text>the identification
				of a county or other area under subparagraph (A); or</text>
							</clause><clause id="HE2F2556B19D84517B334BAE14D6C4BE"><enum>(ii)</enum><text>the assignment of
				a postal ZIP Code to a county or other area under subparagraph (B).</text>
							</clause></subparagraph><subparagraph id="H1BFD3F09966443658D0602C6673D743D"><enum>(D)</enum><header>Publication of
				list of counties; posting on website</header><text>With respect to a year for
				which a county or area is identified under this paragraph, the Secretary shall
				identify such counties or areas as part of the proposed and final rule to
				implement the physician fee schedule under section 1848 for the applicable
				year. The Secretary shall post the list of counties identified under this
				paragraph on the Internet website of the Centers for Medicare &amp; Medicaid
				Services.</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
