			 title</header><text>This Act may be cited as the <quote><short-title>California Catastrophic Wildfire Prevention and Community
			 Protection Act</short-title></quote>.</text>

			</subsection></section><section id="H5B0FCBD7A84440EB9900CCD5A3D4223D"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following
			 findings:</text>
			<paragraph id="H8D9515B7DFC248C7AD318EB15F143E06"><enum>(1)</enum><text>Forested lands
			 under the jurisdiction of the Forest Service and Bureau of Land Management in
			 California have grown into a state of unnatural density and structure.</text>
			</paragraph><paragraph id="H492311163E224AF28DB8857F56827E9E"><enum>(2)</enum><text>Overgrown forest
			 conditions, in combination with continued drought and other climatic
			 circumstances, have left these forests at extreme risk to insects, disease, and
			 catastrophic wildfire.</text>
			</paragraph><paragraph id="HF9B12A7AE1AA49169DFB8C3E3FD67943"><enum>(3)</enum><text>The risk of
			 catastrophic wildfire presents a very real threat to the health and safety of
			 individuals and communities in the wildland-urban interface as well as to the
			 property of adjacent private landowners.</text>
			</paragraph><paragraph id="H262DC2DC7CA94312A7967E9C29833922"><enum>(4)</enum><text>The catastrophic,
			 stand-replacing fires that are occurring with increasing frequency as a result
			 of the forest conditions described in paragraph (2), pose a threat to the
			 health of lands, watersheds, wildlife, air quality and the environment.</text>
			</paragraph><paragraph id="H245D6CA7145B4B6C9D22F099269C3C12"><enum>(5)</enum><text>Local communities
			 and interests are willing to work collaboratively to assure seamless protection
			 from catastrophic wildfire and to improve forest health across public and
			 private lands.</text>
			</paragraph><paragraph id="HA844C36ECD83449DA168BFC7B2ABBB38"><enum>(6)</enum><text>The Federal
			 Government, particularly the Forest Service and Bureau of Land Management, must
			 address these conditions at the appropriate annual pace and scale needed across
			 the landscape to have a substantial impact in reducing natural
			 disturbances.</text>
			</paragraph></section><section id="HD5086335B6A94654A06619265EAFB255"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H727EA75AEBB44360854219C497662B8B"><enum>(1)</enum><header>At-risk
			 community</header><text>The term <quote>at-risk community</quote> has the
			 meaning given that term in Section 101 of the Healthy Forests Restoration Act
			 of 2003 (16 U.S.C. 6511).</text>
			</paragraph><paragraph id="H0E88EC5476F14083B3E0C62839A1932F"><enum>(2)</enum><header>At-risk
			 watershed</header><text>The term <quote>at-risk watershed</quote> means a
			 watershed—</text>
				<subparagraph id="H1AC6187DC6C34725B1A5EF942343E705"><enum>(A)</enum><text>where there exists
			 a high risk of losing key ecosystem, wildlife, and watershed components to
			 severe fire, including post-fire disturbances, as documented by the Secretary
			 concerned; and</text>
				</subparagraph><subparagraph id="H996DD928AD2B4F7FB23C19D56FBB1C08"><enum>(B)</enum><text>where there
			 are—</text>
					<clause id="H6472B0BB4F4249C896BCA84C457E9E67"><enum>(i)</enum><text>Federal lands in
			 condition class II or III, as developed by the Forest Service Rocky Mountain
			 Research Station in the general technical report titled <quote>Development of
			 Coarse-Scale Spatial Data for Wildland Fire and Fuel Management</quote>
			 (RMRS–87) and dated April 2000 (including any subsequent revision to the
			 report); or</text>
					</clause><clause id="H5D105350A95E448F9FC780E989FE1F21"><enum>(ii)</enum><text>private lands
			 that are located in a <quote>Very High Fire Hazard Severity Zone</quote>, as
			 determined by the California State Fire Marshal.</text>
					</clause></subparagraph></paragraph><paragraph id="H830BDD1A72164A78A05BC5EA000039A8"><enum>(3)</enum><header>Community
			 wildfire protection plan</header><text>The term <quote>community wildfire
			 protection plan</quote> has the meaning given that term in Section 101 of the
			 Healthy Forests Restoration Act of 2003 (16 U.S.C. 6511).</text>
			</paragraph><paragraph id="HDA33C1BA98C74C7683A29FAFB885EC89"><enum>(4)</enum><header>County fire
			 plan</header><text>The term <quote>county fire plan</quote> means a plan
			 developed similarly to a community wildfire protection plan with an annual
			 mitigation strategy developed through a collaborative effort and formally
			 adopted by the Board of Supervisors of the county in which the forest lands
			 covered by the plan are located.</text>
			</paragraph><paragraph id="H992EF3798CC84ED6B64FA399F9C67297"><enum>(5)</enum><header>Covered forest
			 lands</header>
				<subparagraph id="H3990B0A4704F4236A8DA373E592094FF"><enum>(A)</enum><header>Included
			 lands</header><text>The term <quote>covered forest lands</quote> means—</text>
					<clause id="HD313EE4441894DB39DE2D240B0B56F1F"><enum>(i)</enum><text>National Forest
			 System lands in California; and</text>
					</clause><clause id="H9581A5297CFA410588F30037AABA04A6"><enum>(ii)</enum><text>Public land in
			 California administered by the Secretary of the Interior through the Bureau of
			 Land Management.</text>
					</clause></subparagraph><subparagraph id="HEB03EF7713B7495580DE7B24002C1649"><enum>(B)</enum><header>Excluded
			 land</header><text>The term does not include land that is a component of the
			 National Wilderness Preservation System or other Federal land (other than
			 inventoried roadless areas and wilderness study areas) in which the removal of
			 vegetation is specifically prohibited by Federal law.</text>
				</subparagraph></paragraph><paragraph id="HBFAD46E9349041CE8E47B4D4B9A4725B"><enum>(6)</enum><header>Eligible
			 project</header><text>The term <quote>eligible project</quote> means the
			 measures and methods included in a project carried out on covered forest lands
			 by the Secretary concerned for hazardous fuels reduction, forest health, and
			 forest restoration.</text>
			</paragraph><paragraph id="HB3435333A4CA421A8CC8C7E68222BB0"><enum>(7)</enum><header>Secretary
			 concerned</header><text>The term <quote>Secretary concerned</quote>
			 means—</text>
				<subparagraph id="H425EBCC38AA547DC0028671181451432"><enum>(A)</enum><text>The Secretary of
			 Agriculture, in the case of National Forest System lands; and</text>
				</subparagraph><subparagraph id="HBA343A4C4CDA4B75B58D8B5D00E09D00"><enum>(B)</enum><text>The Secretary of
			 the Interior, in the case of public land administered by the Secretary of the
			 Interior through the Bureau of Land Management.</text>
				</subparagraph></paragraph></section><section id="H02DA383FE9D8445189BF6CDE9DA1C767"><enum>4.</enum><header>Project authority
			 consistent with community wildfire protection plan</header><text display-inline="no-display-inline">The
			 Secretary concerned shall carry out eligible projects on covered forest lands
			 that are within or adjacent to an at-risk community or an at-risk watershed if
			 the eligible project is consistent with the applicable community wildfire
			 protection plan or county fire plan.</text>
		</section><section id="HFE75194F7249442DBF6083C7C79C37B8"><enum>5.</enum><header>Elements of
			 eligible projects</header><text display-inline="no-display-inline">Eligible
			 projects on covered forest lands shall be carried out in a cost-effective
			 manner that—</text>
			<paragraph id="H92B7A9BB70E4441FBBB94CD95D88A7B5"><enum>(1)</enum><text>focuses on
			 surface, ladder, and canopy fuels reduction activities; or</text>
			</paragraph><paragraph id="HF764048FAD7B4EE8BB84F0243541B446"><enum>(2)</enum><text>implements forest
			 restoration activities in response to severe fire, insect, or disease
			 infestation, windthrow, or other extreme weather events or natural
			 disasters.</text>
			</paragraph></section><section id="H3D202F105BC24D4CAFF5C83D42E1DAC6"><enum>6.</enum><header>Environmental
			 analysis</header>
			<subsection id="H96F9AA8D3E5842F18E0497E75636E72"><enum>(a)</enum><header>General rule of
			 proposed action and no action alternative</header><text>The Secretary concerned
			 shall prepare an environmental assessment or an environmental impact statement
			 pursuant to section 102(2) of the National Environmental Policy Act of 1969 (42
			 U.S.C. 4332(2)) for each proposed eligible project. The Secretary concerned
			 shall study, develop, and describe the proposed action and the alternative of
			 no action. Except as provided in subsection (b), the Secretary concerned is not
			 required to study, develop, or describe any alternative actions to the proposed
			 agency action.</text>
			</subsection><subsection id="H566722CA1ADE40E7A73BE27DBA85E575"><enum>(b)</enum><header>Consideration of
			 alternative recommendation</header><text>The Secretary concerned shall evaluate
			 and consider an alternative recommendation submitted by the county in which a
			 proposed eligible project is to be carried out if the county determines that
			 the proposed eligible project is or may be inconsistent with its community
			 wildfire protection plan. The Secretary shall publish the evaluation and
			 consideration of the alternative recommendation in the environmental assessment
			 or environmental impact statement prepared pursuant to section 102(2) of the
			 National Environmental Policy Act of 1969 (42 U.S.C. 4332(2)) for the proposed
			 eligible project.</text>
			</subsection><subsection id="HD8A772C86A7E4677923737C95C808E7C"><enum>(c)</enum><header>Effect of county
			 emergency</header>
				<paragraph id="H9C1519A05BBC469E8961AB8292731C45"><enum>(1)</enum><header>Council on
			 environmental quality</header><text>Pursuant to Section 1506.11 of title 40,
			 Code of Federal Regulations, the Secretary concerned shall request the Council
			 on Environmental Quality to develop and approve alternative arrangements for a
			 proposed eligible project if the county in which the proposed eligible project
			 is to be carried out, in consultation with the Director of the California
			 Department of Forestry and Fire Protection, declares—</text>
					<subparagraph id="H8B5C53B05B0C48D18CE0004173251688"><enum>(A)</enum><text>a state of
			 emergency; or</text>
					</subparagraph><subparagraph id="H8EA65196FC11437F9F614B3C009262CB"><enum>(B)</enum><text>the existence of a
			 dangerous nuisance to public safety, welfare, infrastructure, watersheds,
			 wildlife habitat, or other vital assets due to the accumulation of forest fuels
			 and the associated risk of extreme fire on covered forest lands.</text>
					</subparagraph></paragraph><paragraph id="HD1D485D2BEC342EEAA00FE5C285CA391"><enum>(2)</enum><header>Mandatory
			 information</header><text>When requesting alternative arrangements under
			 paragraph (1), the Secretary concerned shall transmit to the Council on
			 Environmental Quality the following information:</text>
					<subparagraph id="H246B0182A83A40E5A9EC89EB018414D4"><enum>(A)</enum><text>A description of
			 the proposed eligible project.</text>
					</subparagraph><subparagraph id="H9CEF1D55CE114B56AFEAA7C72FD1007B"><enum>(B)</enum><text>The condition of
			 forest fuels within or near the proposed eligible project.</text>
					</subparagraph><subparagraph id="H14170CEDAB254EE4B82E001B52694449"><enum>(C)</enum><text>The threat to
			 public safety, welfare, infrastructure, watersheds, wildlife habitat, or other
			 vital assets due to the accumulation of forest fuels and the associated risk of
			 extreme fire that the proposed eligible project is to relieve.</text>
					</subparagraph><subparagraph id="HA60D4A0056C44957919F87D3369961B4"><enum>(D)</enum><text>The degree to
			 which delaying the implementation of the proposed eligible project will
			 increase the risk of serious harm to public safety, welfare, infrastructure,
			 watersheds, wildlife habitat, or other vital assets due to the accumulation of
			 forest fuels and the associated risk of extreme fire.</text>
					</subparagraph><subparagraph id="H2161AD6648E7400084DA7805F09640E"><enum>(E)</enum><text>Any other
			 information the Secretary concerned determines relevant.</text>
					</subparagraph></paragraph><paragraph id="H5FCD82E84DE343750000BDDB28D5AB51"><enum>(3)</enum><header>Further
			 information</header><text>At the request of either the county in which the
			 eligible project is to be carried out or the Director of the California
			 Department of Forestry and Fire Protection, the Secretary concerned shall
			 transmit to the Council on Environmental Quality information provided to the
			 Secretary concerned by the State or county concerning the threat to public
			 safety, welfare, infrastructure, watersheds, wildlife habitat, or other vital
			 assets due to the accumulation of forest fuels and the associated risk of
			 extreme fire that the proposed eligible project is to relieve.</text>
				</paragraph><paragraph id="H9417776ABB4640B60000426300048F40"><enum>(4)</enum><header>Deadline for
			 alternative arrangements</header><text>Not later than 15 days after receipt of
			 a request under paragraph (1) for approval of alternative arrangements for a
			 proposed eligible project, the Council on Environmental Quality shall submit to
			 the Secretary concerned either the alternative arrangements for the eligible
			 project or a statement explaining why the alternative arrangements are denied.
			 If the Council on Environmental Quality fails to comply with such deadline or
			 denies alternative arrangements, the Secretary concerned shall proceed
			 immediately and to completion on the proposed eligible project notwithstanding
			 any other provision of law including, but not limited to, the National
			 Environmental Policy Act and the National Forest Management Act (16 U.S.C. 1601
			 et seq.). Such actions shall also not be subject to the notice, comment, and
			 appeal requirements of the Appeals Reform Act, (16 U.S.C. 1612 (note), Pub. Law
			 No. 102–381 Sec. 322). Any action authorized by this subsection shall not be
			 subject to judicial review by any court of the United States.</text>
				</paragraph></subsection></section><section id="H1538B855584942C0947301DE5CF62214"><enum>7.</enum><header>Administrative
			 and judicial review</header>
			<subsection id="H681058AAD538472A91B2041224443F4F"><enum>(a)</enum><header>Administrative
			 review</header><text>Administrative review of eligible projects shall occur in
			 accordance with the special administrative review process established under
			 section 105 of the Healthy Forests Restoration Act of 2003 (16 U.S.C.
			 6515).</text>
			</subsection><subsection id="H15EFD7D2C4C84AC4A084C0E92CECDD4"><enum>(b)</enum><header>Judicial
			 review</header><text>Judicial review of eligible projects shall occur in
			 accordance with section 106 of the Healthy Forests Restoration Act of 2003 (16
			 U.S.C. 6516).</text>
			</subsection></section><section id="H78B312C381124F4780FFF0D511EEFDE6"><enum>8.</enum><header>Acceptance and
			 use of funds or in-kind services</header><text display-inline="no-display-inline">The Secretary concerned may accept and use
			 funds or in-kind services from any public or private entity to assist carrying
			 out eligible projects under this Act.</text>
		</section><section id="HA978B17008264FAFB417950929CA55DE"><enum>9.</enum><header>Report</header><text display-inline="no-display-inline">The Secretary concerned shall submit to the
			 Committee on Natural Resources of the House of Representatives and the
			 Committee on Energy and Natural Resources of the Senate an annual report
			 describing all eligible projects conducted under this Act.</text>
