		<official-title>To amend the Public Health Service Act to direct the
		  Secretary of Health and Human Services to establish a Frontline Providers Loan
		  Repayment Program.</official-title>

		<section id="H6575882B80514BCE8DB74B035B7999FA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Access to Frontline Health Care Act of
			 2009</short-title></quote>.</text>
		</section><section id="H1DA9937191A242F9900FE962B90EE997"><enum>2.</enum><header>Frontline
			 providers loan repayment program</header><text display-inline="no-display-inline">Part D of title III of the Public Health
			 Service Act (42 U.S.C. 254b et seq.) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="HDE925556BD1642F6A08325999B37D855" style="OLC">
				<subpart id="HB67DC077447D4B2CA84EB61DA3C08D6C"><enum>XI</enum><header>Frontline Health
				Care Services</header>
					<section id="HA99F0C800BB441909BEDE553107B7662"><enum>340H.</enum><header>Frontline
				Providers Loan Repayment Program</header>
						<subsection id="H49C2AC10019A4616A0B23B9A801C2748"><enum>(a)</enum><header>In
				General</header><text>The Secretary shall establish and carry out a Frontline
				Providers Loan Repayment Program (in this section referred to as the <term>Loan
				Repayment Program</term>) under which, pursuant to contracts in accordance with
				this section—</text>
							<paragraph id="H8C020BC86F24446A832DB25CF0AF0E6F"><enum>(1)</enum><text display-inline="yes-display-inline">the Secretary agrees to make student loan
				repayments; and</text>
							</paragraph><paragraph id="HD1EC20DF2DF645188E1CFD37A05515A7"><enum>(2)</enum><text display-inline="yes-display-inline">the individual agrees to serve as a health
				professional for a period of full-time service of not less than 2 years at a
				health care facility serving a frontline care scarcity area.</text>
							</paragraph></subsection><subsection id="H95782DE5BC4D473EBEAC624475B20D38"><enum>(b)</enum><header>Eligibility</header><text>To
				be eligible to participate in the Loan Repayment Program, an individual
				must—</text>
							<paragraph id="H4E85CC4B8DB6487BB4AC0140064E94C1"><enum>(1)</enum><text>submit an
				application to participate in the Loan Repayment Program in such form and
				manner and at such time as specified by the Secretary; and</text>
							</paragraph><paragraph id="HB4E54C7751374F2486E23B7516011C3F"><enum>(2)</enum><text>sign and submit to
				the Secretary, at the time of submittal of such application, a written contract
				(described in subsection (d)).</text>
							</paragraph></subsection><subsection id="HFB9C71FF1DD94DEA8A5F37B4635813D0"><enum>(c)</enum><header>Participation in
				Program</header>
							<paragraph id="HC2B8BCA2894740D5BF224179598652F0"><enum>(1)</enum><header>In
				general</header><text>An individual becomes a participant in the Loan Repayment
				Program only upon the approval of the Secretary of the individual’s application
				submitted under subsection (b)(1) and the Secretary’s acceptance of the
				contract submitted by the individual under subsection (b)(2).</text>
							</paragraph><paragraph display-inline="no-display-inline" id="HFA06F76543354240A5EC4DC89BA99139"><enum>(2)</enum><header>Preference</header><text>In
				awarding contracts under this section, the Secretary shall give preference to
				applicants who have undertaken training or coursework in interdisciplinary
				studies.</text>
							</paragraph><paragraph commented="no" id="HA0CDF4BE574B430AAD5BD12FDC79E561"><enum>(3)</enum><header>Recruitment for
				Interdisciplinary Programs</header><text>The Secretary shall—</text>
								<subparagraph id="H67B5C151EBA84B66B42185F0DD2E08BB"><enum>(A)</enum><text>determine the
				frontline care scarcity areas in which to place contract recipients under this
				section; and</text>
								</subparagraph><subparagraph id="H5BE869429868414DAE234CA3BCC850B3"><enum>(B)</enum><text>in making such
				determination, give preference to areas with a demonstrated program of
				interdisciplinary health care, or with demonstrated plans to initiate
				interdisciplinary approaches to community health care.</text>
								</subparagraph></paragraph><paragraph id="H5CA7A728FD1F49CCB69B7C63AC904FE1"><enum>(4)</enum><header>Notice</header><text>The
				Secretary shall provide written notice to an individual promptly upon the
				Secretary’s approving, under paragraph (1), of the individual’s participation
				in the Loan Repayment Program.</text>
							</paragraph></subsection><subsection id="HEAF93221643D4D34A50E1C9AF0EA3653"><enum>(d)</enum><header>Contract</header><text>The
				contract described in this subsection is a written contract between the
				Secretary and an individual that contains—</text>
							<paragraph id="HEADB3FD4ACC74B28AA035CA6F2CEE9B1"><enum>(1)</enum><text>an agreement
				that—</text>
								<subparagraph id="H9862B56E157A4983BFA0BF0453B8D2E7"><enum>(A)</enum><text>the Secretary
				agrees to provide the individual with student loan repayment (described in
				subsection (e)) for a period of time as determined by the Secretary, to pay off
				debts incurred during the course of the study or program described in
				subsection (g)(2)(B); and</text>
								</subparagraph><subparagraph id="HF0AE2C076D6E4331BF5ABC5DE828E5C3"><enum>(B)</enum><text>the individual
				agrees—</text>
									<clause id="H79DD765A1F3D4C87B358A7BB221EC15D"><enum>(i)</enum><text>to
				accept provision of such a student loan repayment to the individual; and</text>
									</clause><clause id="H15DAE780231B4ECA93663840A551ACF9"><enum>(ii)</enum><text display-inline="yes-display-inline">to provide frontline care services for a
				period of full-time service of not less than 2 years at a health care facility
				serving a frontline care scarcity area;</text>
									</clause></subparagraph></paragraph><paragraph id="H0CCBFED4C4904A4BAA2B7F9BC0B14914"><enum>(2)</enum><text>a provision that
				any financial obligation of the United States arising out of a contract entered
				into under this section and any obligation of the individual which is
				conditioned thereon, is contingent upon funds being appropriated for student
				loan repayment under this section;</text>
							</paragraph><paragraph id="HE6DA17A9C3684B6F985CC8AAC1AF62CA"><enum>(3)</enum><text>a statement of the
				damages to which the United States is entitled, under subsection (f), for the
				individual’s breach of the contract; and</text>
							</paragraph><paragraph id="HD9799EA5E90F4CBDAA86D7766B391BF6"><enum>(4)</enum><text>such other
				statements as the Secretary deems appropriate of the rights and liabilities of
				the Secretary and of the individual, not inconsistent with the provisions of
				this section.</text>
							</paragraph></subsection><subsection id="H4656764B74764AE9B46C1E221E7614B4"><enum>(e)</enum><header>Student Loan
				Repayment</header>
							<paragraph id="H5CA210F9F72745E69104B749840E6BA4"><enum>(1)</enum><header>Amount</header><text>The
				amount of an annual student loan repayment under this section on behalf of an
				individual shall be determined by the Secretary, and shall take into
				consideration the need to pay a sufficient amount to enable recruiting of
				health care providers into the loan repayment program under this
				section.</text>
							</paragraph><paragraph id="HDEEA52D518834D8A861327D4BE334065"><enum>(2)</enum><header>Payments
				Directly to Loan Provider</header><text>The Secretary may contract with an
				individual’s loan provider, for the payment to the loan provider, on behalf of
				the individual, of the amounts of a student loan repayment described in
				paragraph (1).</text>
							</paragraph></subsection><subsection commented="no" id="H9679B088115F48C2BDEA6F054E35F166"><enum>(f)</enum><header>Breach of
				contract</header><text display-inline="yes-display-inline">If an individual
				breaches a written contract under this section by failing to begin such
				individual’s service obligation, or to complete such service obligation, the
				United States shall be entitled to recover from the individual an amount that
				is equal to the sum of—</text>
							<paragraph commented="no" id="H43B971E065DB4F819C2180CC725A5D19"><enum>(1)</enum><text>the total amount
				which has been paid to the individual, or on behalf of the individual, under
				the contract; and</text>
							</paragraph><paragraph commented="no" id="H9B0EAB99ACC54261AB05E463D2EC67FE"><enum>(2)</enum><text>any amount of
				interest, as determined by the Secretary.</text>
							</paragraph></subsection><subsection id="HA89B458C8B68452995BEFD2F33280211"><enum>(g)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="HF3FE9E3AE5CB4E038A25EF78BE535CF5"><enum>(1)</enum><text>The term
				<term>frontline care scarcity area</term> means an area, population group, or
				facility that—</text>
								<subparagraph id="H6A2541CC44BB4C2BB6FC96EAEA5B416D"><enum>(A)</enum><text>is designated as a
				health professional shortage area under section 332; or</text>
								</subparagraph><subparagraph id="H6C91811401A44A588E5DC0C13E53FB74"><enum>(B)</enum><text>is designated by
				the State in which the area is located as having a shortage of frontline care
				services.</text>
								</subparagraph></paragraph><paragraph id="H12ACB0B6F26D4B4885965827F0A00832"><enum>(2)</enum><text>The term
				<term>frontline care services</term> means health care services—</text>
								<subparagraph id="HAB4CDD94E2B3497A84A9C3D9242E7F1F"><enum>(A)</enum><text display-inline="yes-display-inline">in the field of general surgery, optometry,
				ophthalmology, chiropractic, physical therapy, audiology, speech language
				pathology, pharmacies, public health, podiatric medicine, dietetics,
				occupational therapy, general pediatrics, respiratory therapy, medical
				technology, otolaryngology, or radiologic technology; and</text>
								</subparagraph><subparagraph id="H4A43A11B4B724E99A0F6339ABD736DDA"><enum>(B)</enum><text display-inline="yes-display-inline">provided by a general surgeon, optometrist,
				ophthalmologist, chiropractor, physical therapist, audiologist, speech language
				pathologist, pharmacist, public health professional, podiatric physician,
				registered dietician, occupational therapist, pediatrician, respiratory
				therapist, medical technologist, otolaryngologist, or radiologic technologist
				who has completed an appropriate course of study or program, offered by an
				accredited institution of higher education in the United States.</text>
								</subparagraph></paragraph></subsection><subsection id="H29D6732486464421B147A4FFCC599D4E"><enum>(h)</enum><header>Authorized of
				appropriations</header><text>For the purpose of carrying out this section,
				there are authorized to be appropriated the following:</text>
							<paragraph id="H32222F7EC59541BAB4DD4946C597B6AC"><enum>(1)</enum><text>For fiscal year
				2010, $78,000,000.</text>
							</paragraph><paragraph id="HA9FEB311F13F4AC3AAA3CE0010D1CE64"><enum>(2)</enum><text>For fiscal year
				2011, $93,000,000.</text>
							</paragraph><paragraph id="HC4936B738E734A29867135BD13AC4789"><enum>(3)</enum><text>For fiscal year
				2012, $108,000,000.</text>
							</paragraph><paragraph id="HE6E1598134F4420C8572655F19E9CC1D"><enum>(4)</enum><text>For fiscal year
				2013, $123,000,000.</text>
							</paragraph><paragraph id="H2E24BDBC96DD4B8BBFE7C02BCE3E3CEA"><enum>(5)</enum><text>For fiscal year
				2014, $138,000,000.</text>
							</paragraph><paragraph id="HF1DC0A62627C48B490E35D94EC734755"><enum>(6)</enum><text>For fiscal year
				2015, $153,000,000.</text>
							</paragraph><paragraph id="HDCDA739824944EF2A8E919F16EF82240"><enum>(7)</enum><text>For fiscal year
				2016, and each subsequent fiscal year, the amount appropriated for the
				preceding fiscal year adjusted by one plus the average percentage increase in
				the costs of health professions education during the prior fiscal year.</text>
							</paragraph></subsection><subsection commented="no" id="H4B1D1C86E0F64D2D92250A23B1689C6F"><enum>(i)</enum><header>Implementation</header><text>The
				Secretary shall begin implementation of the loan repayment program under this
				section within 180 days of the date of the enactment of this
				section.</text>
						</subsection></section></subpart><after-quoted-block>.</after-quoted-block></quoted-block>
