		<section id="H81F00434D6FC4CAD8E9C742E1874748D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Wastewater Treatment Works Security
			 Act of 2009</short-title></quote>.</text>
		</section><section id="H6A74B9C0C7E14072BA754E745DADA3F9"><enum>2.</enum><header>Wastewater
			 treatment works security</header><text display-inline="no-display-inline">Title
			 II of the Federal Water Pollution Control Act (33 U.S.C. 1281 et seq.) is
			 amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HAF308A10E0424E8A852F77D4649E90CC" style="OLC">
				<section id="H8D55B5C671F944B79F21D986695DFD8"><enum>222.</enum><header>Wastewater
				treatment works security</header>
					<subsection id="H40BD4014966E48759F00EE6263AB7176"><enum>(a)</enum><header>Assessment of
				treatment works vulnerability</header>
						<paragraph id="H2EBFDDAF4AA5446E9E12A8EE8228D927"><enum>(1)</enum><header>In
				general</header><text>Each owner or operator of a treatment works that stores
				or uses a substance of concern in quantities deemed by the Administrator to
				pose a security risk shall conduct a vulnerability assessment of its treatment
				works.</text>
						</paragraph><paragraph id="H6871AE10DDBF4628901F52E2631E5BD7"><enum>(2)</enum><header>Vulnerability
				assessments</header>
							<subparagraph id="H6EB32E937F294DC4B5BBB4E42D48731C"><enum>(A)</enum><header>Definition</header><text>In
				this section, the term <quote>vulnerability assessment</quote> means an
				assessment of the vulnerability of a treatment works to intentional actions
				that may—</text>
								<clause id="HE62AF7BB3AF94AFC92AB007C6FCEB86"><enum>(i)</enum><text>substantially
				disrupt the ability of the treatment works to safely and reliably operate;
				or</text>
								</clause><clause id="H415F20A00F0D4F00A1F713AEA7E9D5EE"><enum>(ii)</enum><text>have a
				substantial adverse effect on critical infrastructure, public health or safety,
				or the environment.</text>
								</clause></subparagraph><subparagraph id="H59BFFF97EB3E40158096BE00AB1B9B99"><enum>(B)</enum><header>Review</header><text>A
				vulnerability assessment shall include an identification of the vulnerability
				of the treatment works’—</text>
								<clause id="H57FE94B7AD2E4280A29610E9505BD7BF"><enum>(i)</enum><text>facilities,
				systems, and devices used in the storage, treatment, recycling, or reclamation
				of municipal sewage or industrial wastes;</text>
								</clause><clause id="H0F134AB1804541AA8394BAA66CAEBF21"><enum>(ii)</enum><text>intercepting
				sewers, outfall sewers, sewage collection systems, and other constructed
				conveyances under the control of the owner or operator of the treatment
				works;</text>
								</clause><clause id="H087730CDFAC7425ABE644411E0B1CFD7"><enum>(iii)</enum><text>electronic,
				computer, and other automated systems;</text>
								</clause><clause id="H151FD66B9B0449099ED1A2DA5D36A841"><enum>(iv)</enum><text>pumping, power,
				and other equipment;</text>
								</clause><clause id="HA0CA58C36D8F46E0B1CCE4544998231D"><enum>(v)</enum><text>use, storage, and
				handling of various chemicals; and</text>
								</clause><clause id="H0058B3EADAA04A95B26D6EF2C0283460"><enum>(vi)</enum><text>operation and
				maintenance procedures.</text>
								</clause></subparagraph><subparagraph id="HEEDD3F0EBD4448ED9D4F541EAF5693E"><enum>(C)</enum><header>Site security
				plan</header><text display-inline="yes-display-inline">A vulnerability
				assessment shall include a site security plan to identify specific security
				enhancements, including procedures, countermeasures, or equipment that the
				owner or operator of a treatment works will implement or utilize to reduce the
				vulnerabilities identified through the review under subparagraph (B) (including
				the identification of the extent to which implementation or utilization of such
				security enhancements may impact the operations of the treatment works in
				meeting the goals and requirements of this Act).</text>
							</subparagraph><subparagraph id="H4057414F681D429CA0E21FD94FAD1590"><enum>(D)</enum><header>Guidelines</header>
								<clause id="H9DDF0DEDC2AF4EFC8C007B2385AADFF8"><enum>(i)</enum><header>In
				general</header><text>Not later than December 31, 2009, the Administrator, in
				consultation with the Secretary of Homeland Security, shall develop and publish
				guidelines for carrying out a vulnerability assessment, consistent with this
				section and the goals and requirements of this Act, and shall periodically
				revise such guidelines, as appropriate.</text>
								</clause><clause id="H0632EE7FFCC844C9A29DEA60A4763E31"><enum>(ii)</enum><header>Identification
				and evaluation of security enhancements</header><text display-inline="yes-display-inline">In developing the guidelines described in
				clause (i), the Administrator shall—</text>
									<subclause id="H625780A7C128484B861F96A6F3446A9E"><enum>(I)</enum><text>identify an array
				of potential security enhancements, including procedures, countermeasures, or
				equipment, that the owner or operator of a treatment works can implement or
				utilize to reduce the vulnerability of the treatment works; and</text>
									</subclause><subclause id="HFC9F0ED42B034272A44BA6E8DCC1CD0A"><enum>(II)</enum><text>include
				information on the potential effectiveness of such security enhancements in
				reducing the vulnerability of the treatment works.</text>
									</subclause></clause><clause id="HF9539D4534664722A151C3AE25983113"><enum>(iii)</enum><header>Risk-based
				evaluation of treatment works</header>
									<subclause id="H294BCABF5B6E418591D2D776D8877CB8"><enum>(I)</enum><header>In
				general</header><text>In developing the guidelines described in clause (i), the
				Administrator shall develop standards for assigning individual treatment works
				into 4 risk-based classifications.</text>
									</subclause><subclause id="H059B33335F6E4E42BAA472A9B35D1FB"><enum>(II)</enum><header>Standards for
				risk-based classifications</header><text>In developing such standards, the
				Administrator shall consider—</text>
										<item id="H93210428F74F46299392FE89BD47E6FB"><enum>(aa)</enum><text>the
				size of the treatment works;</text>
										</item><item id="HCD34CFAA16F94E18A539EEAA17AC33F6"><enum>(bb)</enum><text>the
				proximity of the treatment works to large population centers;</text>
										</item><item id="H40F4DBA3A0A74A7BAB21173EA85E6100"><enum>(cc)</enum><text>the
				potential adverse impacts of an intentional act on the operation of the
				treatment works or on critical infrastructure, public health or safety, or the
				environment; and</text>
										</item><item id="HC928865306DB4A19BE60444F91490003"><enum>(dd)</enum><text>any
				other factor which the Administrator determines to be appropriate.</text>
										</item></subclause><subclause id="HE0CD1BB293F847A6AEADF5C800AFDFB9"><enum>(III)</enum><header>Criteria for
				approval</header><text>The Administrator may assign differing criteria for the
				approval of a vulnerability assessment under paragraph (4) based on the
				risk-based classification of the treatment works.</text>
									</subclause></clause><clause id="H090DBC33C7E34E6B8D472D215D6821ED"><enum>(iv)</enum><header>Substance of
				concern</header>
									<subclause id="H585D56CB5773440BA70D1025F450956A"><enum>(I)</enum><header>In
				general</header><text>In developing the guidelines described in clause (i), the
				Administrator, in consultation with the Secretary of Homeland Security, may
				designate any chemical substance as a substance of concern.</text>
									</subclause><subclause id="H602AB638C9BE4B4F8E6F2301D01A944D"><enum>(II)</enum><header>Threshold
				quantity</header><text>At the time a substance is designated pursuant to
				subclause (I), the Administrator shall establish by rule a threshold quantity
				for the release or theft of the substance, taking into account the toxicity,
				reactivity, volatility, dispersability, combustibility, and flammability of the
				substance and the amount of the substance which, as a result of the release, is
				known to cause or may be reasonably anticipated to cause death, injury, or a
				substantial adverse effect to critical infrastructure, public health or safety,
				or the environment.</text>
									</subclause><subclause id="HEA1A07EC5B324DE4A0AD3B4C4A42949C"><enum>(III)</enum><header>Consideration
				of existing standards</header><text>In making a determination under subclause
				(I), the Administrator shall take into account appendix A of part 27 of title
				6, Code of Federal Regulations (or any successor regulations).</text>
									</subclause></clause><clause id="H8AD2727309304DDEB450F5DD3D4302BE"><enum>(v)</enum><header>Review and
				revision of vulnerability assessments</header><text>In developing the
				guidelines described in clause (i), the Administrator shall include—</text>
									<subclause id="HA34F1898A5964088ADF4ECE47827C8BE"><enum>(I)</enum><text>a process for the
				revision, if necessary, and resubmission of vulnerability assessments for
				treatment works conducted prior to the date of enactment of this section to
				determine whether they meet the requirements of this section; and</text>
									</subclause><subclause id="HF01EC0F42DFA45ADAE216771CE8D3F1E"><enum>(II)</enum><text>provisions for
				the periodic review of vulnerability assessments and revision of vulnerability
				assessments based on new information provided by the Administrator, in
				consultation with the Secretary of Homeland Security, to the owner or operator
				of the treatment works.</text>
									</subclause></clause></subparagraph></paragraph><paragraph id="HA701672A63104F1497E2CA4296C40052"><enum>(3)</enum><header>Certification
				and deadlines</header>
							<subparagraph id="H53E7DFC697BC4BA29C393C8EB0A7700"><enum>(A)</enum><header>Certification</header><text>Each
				owner or operator of a treatment works referred to in paragraph (1) shall
				certify to the Administrator that a vulnerability assessment has been conducted
				for the treatment works and shall submit to the Administrator a written copy of
				the vulnerability assessment.</text>
							</subparagraph><subparagraph id="HD9629F7DA5DB46E69E571601E37ECCCC"><enum>(B)</enum><header>Deadlines</header><text>Certifications
				and submissions referred to in subparagraph (A) shall be made prior to—</text>
								<clause id="H7E4BC30874944624B04C9C06F6BACF54"><enum>(i)</enum><text>December 31, 2010,
				in the case of a treatment works with a treatment capacity of 15,000,000
				gallons per day or greater or that is assigned to the highest risk-based
				classification under the guidelines developed under paragraph (2)(D);</text>
								</clause><clause id="H1D5353F22BF341238C479BEFE1B7A387"><enum>(ii)</enum><text>June 30, 2011, in
				the case of a treatment works that is assigned to the second highest risk-based
				classification under the guidelines developed under paragraph (2)(D);</text>
								</clause><clause id="H720D3C06ED3549D4BC4C667BDF23E75B"><enum>(iii)</enum><text>December 31,
				2011, in the case of a treatment works that is assigned to the third highest
				risk-based classification under the guidelines developed under paragraph
				(2)(D); and</text>
								</clause><clause id="H9806A155377141CF93DDC93B9C0352FA"><enum>(iv)</enum><text>June 30, 2012, in
				the case of a treatment works that is assigned to the lowest risk-based
				classification under guidelines developed under paragraph (2)(D).</text>
								</clause></subparagraph></paragraph><paragraph id="H4D40F27CD65E4AAB0013E4A705B7F49D"><enum>(4)</enum><header>Review of
				vulnerability assessments</header>
							<subparagraph id="HB96ED433FE6244A38C37D7CEF46FDE46"><enum>(A)</enum><header>In
				general</header><text>Not later than 180 days after the date on which the
				Administrator receives a vulnerability assessment under this section, the
				Administrator shall review and approve or disapprove such assessment.</text>
							</subparagraph><subparagraph id="HB07A63FEC47B46E8B7EA760054736075"><enum>(B)</enum><header>Disapproval</header>
								<clause id="H47807D54D32744D580F458F74427F99B"><enum>(i)</enum><header>In
				general</header><text>The Administrator shall disapprove a vulnerability
				assessment if the Administrator determines that the vulnerability assessment
				does not comply with this section (including guidelines developed under
				paragraph (2)(D)) or implementation of any security enhancement identified
				under paragraph (2)(C) is not consistent with the goals and requirements of
				this Act.</text>
								</clause><clause id="HD72A6B0EE0864415A0968D186D8EB8B0"><enum>(ii)</enum><header>Limitation on
				disapproval</header><text display-inline="yes-display-inline">The Administrator
				may not disapprove a vulnerability assessment submitted under this section
				based on the implementation of a particular security enhancement.</text>
								</clause><clause id="H7D0E1E221AAF49A2A5B00A7E057CFF8"><enum>(iii)</enum><header>Provisions of
				notification of disapproval</header><text>If the Administrator disapproves the
				vulnerability assessment under this section, the Administrator shall provide
				the owner or operator of a treatment works a written notification of the
				disapproval that—</text>
									<subclause id="H90B2322B4BB1423ABBEBD9074CB61838"><enum>(I)</enum><text>includes a clear
				explanation of deficiencies in the vulnerability assessment;</text>
									</subclause><subclause id="HBB0B8E7EE5AA492F8D3B02BF9DE847C5"><enum>(II)</enum><text>provides guidance
				to assist the owner or operator in addressing deficiencies; and</text>
									</subclause><subclause id="H4EF0B4BDB5C149B4A814B0E255C5AD5C"><enum>(III)</enum><text>requires the
				owner or operator to revise the vulnerability assessment to address any
				deficiencies and, by such date as the Administrator determines is appropriate,
				to submit to the Administrator a revised vulnerability assessment.</text>
									</subclause></clause></subparagraph></paragraph><paragraph id="H4CEDC213BEB84CD1A356685CBFF24AF"><enum>(5)</enum><header>Prohibition of
				public disclosure</header>
							<subparagraph commented="no" id="H908006E87F3541138E7E8F55339B3507"><enum>(A)</enum><header>In
				general</header><text>The Administrator shall ensure that vulnerability
				assessments (including site security plans) and other security-related
				information, records, and documents are not disclosed except as provided in
				this section.</text>
							</subparagraph><subparagraph id="H0E7E20B7533C4A70BA881439056604EC"><enum>(B)</enum><header>Specific
				prohibitions</header><text>In carrying out paragraph (1), the Administrator
				shall ensure that any information contained in the vulnerability assessment is
				not disclosed—</text>
								<clause id="H6240C521D02E4252834B7693346E29BD"><enum>(i)</enum><text>by
				any Federal agency under section 552 of title 5, United States Code; or</text>
								</clause><clause id="H53FC2260E0244A80889BEA986062CD14"><enum>(ii)</enum><text>under any State
				or local law.</text>
								</clause></subparagraph><subparagraph id="HB75F4ADDE38C4B27B6D8B36B8C92EC44"><enum>(C)</enum><header>Limitation</header><text>Nothing
				in this paragraph shall prohibit the sharing of information, as the
				Administrator, in consultation with the Secretary of Homeland Security,
				determines to be appropriate, with State and local government officials
				possessing the necessary security clearances, including law enforcement
				officials and first responders, for the purpose of carrying out this
				section.</text>
							</subparagraph></paragraph></subsection><subsection id="H7045337421494580AB28C4DEE829CCA"><enum>(b)</enum><header>Grants for
				vulnerability assessments, security enhancements, and worker training
				programs</header>
						<paragraph id="H0F4E970543F84B0AAF7DA0323797673E"><enum>(1)</enum><header>In
				general</header><text>The Administrator may make grants to a State,
				municipality, or intermunicipal or interstate agency—</text>
							<subparagraph id="HAA874F3E25B34DEFA9C65F72AE44F71F"><enum>(A)</enum><text>to conduct a
				vulnerability assessment of a publicly owned treatment works;</text>
							</subparagraph><subparagraph id="H9C330933AD5D401C8F95FF33A9957F38"><enum>(B)</enum><text>to implement
				security enhancements listed in paragraph (2) to reduce vulnerabilities
				identified in an approved vulnerability assessment;</text>
							</subparagraph><subparagraph id="H351D85A3D98C4A6BB808734BD22BCE6C"><enum>(C)</enum><text>to implement
				additional security enhancements to reduce vulnerabilities identified in an
				approved vulnerability assessment; and</text>
							</subparagraph><subparagraph id="H6DCE3F9DC5CF42409EABA136E47AABCB"><enum>(D)</enum><text>to provide for
				security-related training of employees of the treatment works and training for
				first responders and emergency response providers.</text>
							</subparagraph></paragraph><paragraph id="HD3ED2F47D3614E2E8BF3005063796FE5"><enum>(2)</enum><header>Grants for
				security enhancements</header>
							<subparagraph id="H7B144F9FAA9E415581A3E8F5BF827F4E"><enum>(A)</enum><header>Preapproved
				security enhancements</header><text>The Administrator may make a grant to an
				applicant under paragraph (1)(B) to implement a security enhancement of a
				treatment works (identified in an approved vulnerability assessment) for 1 or
				more of the following:</text>
								<clause id="H4D28F72DED6F46C98D16107DDEEA78A0"><enum>(i)</enum><text>Purchase and
				installation of equipment for access control, intrusion prevention and delay,
				and detection of intruders and hazardous or dangerous substances,
				including—</text>
									<subclause id="H5856581645BF4C9DAE004E0075B69C85"><enum>(I)</enum><text>barriers, fencing,
				and gates;</text>
									</subclause><subclause id="HC89432B9316144AB9963FAC990AE874F"><enum>(II)</enum><text>security lighting
				and cameras;</text>
									</subclause><subclause id="HBADFE627B9F145BAAEEAA87ED086F7C"><enum>(III)</enum><text>metal grates,
				wire mesh, and outfall entry barriers;</text>
									</subclause><subclause id="HF3284F48A2884D528561EDF57FD0025"><enum>(IV)</enum><text>securing of
				manhole covers and fill and vent pipes;</text>
									</subclause><subclause id="HF55DF3DE056840CDB292AD3413FF9F34"><enum>(V)</enum><text>installation and
				re-keying of doors and locks; and</text>
									</subclause><subclause id="HE9A863BE63DA406AB85F8E46B0011278"><enum>(VI)</enum><text>smoke, chemical,
				and explosive mixture detection systems.</text>
									</subclause></clause><clause id="H022249AF95D541BFBE97959980491F8B"><enum>(ii)</enum><text>Security
				improvements to electronic, computer, or other automated systems and remote
				security systems, including controlling access to such systems, intrusion
				detection and prevention, and system backup.</text>
								</clause><clause id="H916801D927E044AFB17382BA64E2D6E3"><enum>(iii)</enum><text>Participation in
				training programs and the purchase of training manuals and guidance materials
				relating to security.</text>
								</clause><clause id="H41EA91B58E7643D1ACC8D9AC0000691B"><enum>(iv)</enum><text>Security
				screening of employees or contractor support services.</text>
								</clause></subparagraph><subparagraph id="HB65338CE849448339B732EA0E668DC16"><enum>(B)</enum><header>Additional
				security enhancements</header>
								<clause id="H7291F9E70EE8496590357335209CB10"><enum>(i)</enum><header>In
				general</header><text>The Administrator may make grants under paragraph (1)(C)
				to an applicant for additional security enhancements not listed in subparagraph
				(A) that are identified in an approved vulnerability assessment.</text>
								</clause><clause id="HADAA9344564F4A99A6FFCF00D15EB118"><enum>(ii)</enum><header>Eligibility</header><text>To
				be eligible for a grant under this subparagraph, an applicant must have an
				approved vulnerability assessment and shall submit an application to the
				Administrator containing such information as the Administrator may
				request.</text>
								</clause></subparagraph><subparagraph id="HF72543BA2FF04A5CA6AB85669685C0D"><enum>(C)</enum><header>Limitation on use
				of funds</header><text>Grants under this paragraph may not be used for
				personnel costs or operation or maintenance of facilities, equipment, or
				systems.</text>
							</subparagraph><subparagraph id="H73EDEB2ACF614216B5595D0064CA9C65"><enum>(D)</enum><header>Federal
				share</header><text>The Federal share of the cost of activities funded by a
				grant under paragraph (1) may not exceed 75 percent.</text>
							</subparagraph></paragraph></subsection><subsection id="H7A6686BDF4204ECC8D41994B27D936F"><enum>(c)</enum><header>Technical
				assistance for small publicly owned treatment works</header>
						<paragraph id="H0595DFC81C474F9AB9CE24987828BE34"><enum>(1)</enum><header>Security
				assessment and planning assistance</header><text>The Administrator, in
				coordination with the States, may provide technical guidance and assistance to
				small publicly owned treatment works on conducting a vulnerability assessment
				and implementation of security enhancements to reduce vulnerabilities
				identified in an approved vulnerability assessment. Such assistance may include
				technical assistance programs, training, and preliminary engineering
				evaluations.</text>
						</paragraph><paragraph id="HD3E72040CE8B43D796625C39C13C124E"><enum>(2)</enum><header>Participation by
				nonprofit organizations</header><text>The Administrator may make grants to
				nonprofit organizations to assist in accomplishing the purposes of this
				subsection.</text>
						</paragraph><paragraph id="H8C3BDAC0ED824A0B991400BBC3AF1FDD"><enum>(3)</enum><header>Small publicly
				owned treatment works defined</header><text>In this subsection, the term
				<quote>small publicly owned treatment works</quote> means a publicly owned
				treatment works that services a population of fewer than 10,000 persons.</text>
						</paragraph></subsection><subsection id="HC9D5C42919A140A79120D4F49E4257CF"><enum>(d)</enum><header>Authorization of
				Appropriations</header><text>There is authorized to be appropriated annually to
				the Administrator for fiscal years 2010 through 2014—</text>
						<paragraph id="H3C9EAF2BE75047CCA9DF6B69A925607C"><enum>(1)</enum><text>$200,000,000 for
				making grants under subsection (b); and</text>
						</paragraph><paragraph id="H1BB4758376114998B065488CE9500055"><enum>(2)</enum><text>$15,000,000 for
				providing technical assistance under subsection (c).</text>
						</paragraph><continuation-text continuation-text-level="subsection">Such sums
				shall remain available until
				expended.</continuation-text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
