<official-title>To require the Secretary of Agriculture to establish a carbon incentives program to achieve supplemental greenhouse gas emissions reductions on private agricultural and forestland of the United States, and for other purposes.</official-title>

<section id="HECF1D5FEEF7C49CDBC9B52C5E2B451AD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Buy American Carbon Incentives Program Act of 2009</short-title></quote>.</text> </section> 
<section id="HA64BC889C4E84CC38147F22FEBB7F191"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H5482EDBD8B8A45F6A616E89D7D4C6F54"><enum>(1)</enum><header>Avoided conversion agreement</header><text>The term <quote>avoided conversion agreement</quote> means a permanent conservation easement covering eligible land enrolled under a climate mitigation contract providing that the eligible land covered will not be converted for development. Avoided conversion agreements shall be consistent with the guidelines of the Farm and Ranchland Protection Program, Forest Legacy Program, or any other program approved by the Secretary for use under this section to provide consistency with Federal legal requirements for permanent conservation easements.</text></paragraph> 
<paragraph id="H13C014547606463E8C3E2EC40995B97F"><enum>(2)</enum><header>Climate mitigation contract</header><text>The term <quote>climate mitigation contract</quote> or <quote>contract</quote> means a contract of not less than 15 years specifying the eligible practices that will be undertaken, the acreage of eligible land upon which the practices will be undertaken, the agreed rate of compensation per acre, and a schedule to verify that the terms of the contract have been fulfilled.</text></paragraph> 
<paragraph id="H67BD8D4BDBFD47B8BA57CDBD42AB9D82"><enum>(3)</enum><header>Eligible lands</header><text>The term <quote>eligible lands</quote> means agricultural and forestland in the United States that is privately owned at the time of initiation of a climate mitigation contract.</text></paragraph> 
<paragraph id="HB1F01C58A1464EAAAA03A752DC82DD82"><enum>(4)</enum><header>Eligible practice</header><text>The term <quote>eligible practice</quote> means an agricultural practice or forestry practice determined by the Secretary to provide measurable increases in carbon sequestration and storage on eligible lands beyond customary practices on comparable lands.</text></paragraph> 
<paragraph id="H93040550D441498ABFD9CD4DC81BC3D"><enum>(5)</enum><header>Program</header><text>The term <quote>program</quote> means the carbon incentives program required by this Act.</text></paragraph> 
<paragraph id="H0AD55F733C7D4FDDB7A9ABCD52408C4C"><enum>(6)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Agriculture.</text></paragraph></section> 
<section id="H817694E1F7014EA3B9EE41206030DC81"><enum>3.</enum><header>Supplemental greenhouse gas emissions reductions in the united states</header> 
<subsection id="H7692835489DF444A861B5953F392836C"><enum>(a)</enum><header>Establishment and purpose</header><text>The Secretary of Agriculture shall establish a carbon incentives program to achieve supplemental greenhouse gas emissions reductions on private agricultural and forestland of the United States.</text></subsection> 
<subsection id="H654BBB992BEB43728BF2EA0B6C2584"><enum>(b)</enum><header>Financial incentive payments</header><text>The Secretary shall provide financial incentive payments under the program for activities that—</text> 
<paragraph id="HC58FD7DAA8AD4F3389433E00C766DFC6"><enum>(1)</enum><text>measurably increase carbon sequestration and storage over a designated contract period through management activities on eligible lands; and</text></paragraph> 
<paragraph id="H4E6206C995FE4371A342E4F09BCCFA59"><enum>(2)</enum><text>maintain carbon sequestration and storage and avoid future emissions through permanent avoided conversion agreements on eligible lands.</text></paragraph></subsection></section> 
<section id="HE51637CD6FF64561ABC8A326D4E6A928"><enum>4.</enum><header>Program requirements</header> 
<subsection id="H3112D091DF2846058F59957112F7EFE3"><enum>(a)</enum><header>Contract required</header><text>To participate in the program, owners of eligible lands shall enter into a climate mitigation contract with the Secretary.</text></subsection> 
<subsection id="HA6F80EBAF02A40A99DC8938106D031E"><enum>(b)</enum><header>Program components</header><text>In establishing the program, the Secretary shall further provide that—</text> 
<paragraph id="H6C53F87AC5314C47A1B232BFC2B0493B"><enum>(1)</enum><text>funds distributed under this section shall not be substituted for, or otherwise used as a basis for reducing, funding authorized or appropriated under other programs to compensate owners of eligible lands for activities that are not covered under a climate mitigation contract;</text></paragraph> 
<paragraph id="H2C74C2C4F4B1414F9FB6E1A6639C99BA"><enum>(2)</enum><text>emissions reductions achieved through a climate mitigation contract shall not be eligible for crediting under any federally established offset program; and</text></paragraph> 
<paragraph id="H296B1981ED584904A7B0FB008DAB2567"><enum>(3)</enum><text display-inline="yes-display-inline">compensation for activities under this program shall be set at such a rate so as not to exceed the net estimated benefit an owner of eligible land would receive for the same practices through crediting under any federally established carbon offset program.</text></paragraph></subsection></section> 
<section id="H3DCE811AFCC74A15B16BBA6F90756128"><enum>5.</enum><header>Incentive payments</header> 
<subsection id="H5955880D1904430280B4BD54575D6D12"><enum>(a)</enum><header>Regulations</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary shall establish regulations specifying eligible practices and related compensation rates, standards, and guidelines as the basis for developing climate mitigation contracts with owners of eligible lands.</text></subsection> 
<subsection id="HB344FE27274A4902BA7B6F52C922F7BE"><enum>(b)</enum><header>Set-aside of funds for certain purposes</header><text>Not less than 35 percent of program funds shall be used to provide further incentives for owners of eligible lands willing to undertake activities and enter into agreements that protect carbon reductions and otherwise enhance environmental benefits achieved under a climate mitigation contract, which shall include—</text> 
<paragraph id="H80B13C238BF945DB89FBB7EB00D09F13"><enum>(1)</enum><text>10 percent to provide incentive payments for additional management activities that increase the adaptive capacity of lands under a climate mitigation contract, including but not limited to activities that increase forest resilience to reversal of stored carbon; and</text></paragraph> 
<paragraph id="H3037E0BFEC61412F93633FE97BF98248"><enum>(2)</enum><text>25 percent to make funds available on a competitive basis to compensate owners for entering avoided conversion agreements on lands subject to a climate mitigation contract.</text></paragraph></subsection></section> 
<section id="H152C738658E94088ACC36C226900D28B"><enum>6.</enum><header>Performance of supplemental reductions</header><text display-inline="no-display-inline">In carrying out the program, the Secretary shall strive to achieve and report on progress toward reaching the following levels of carbon sequestration and storage through climate mitigation contracts:</text> 
<paragraph id="H49A3A9763C3D4762989F6D6BFC8E4F53"><enum>(1)</enum><text>100,000,000 tons of cumulative reductions by 2020.</text></paragraph> 
<paragraph id="H97BFB0C36BB244C1B505FAFD5E1E16E2"><enum>(2)</enum><text>200,000,000 tons of additional cumulative reductions by 2030.</text></paragraph></section> 
<section id="H8B14FD998E074A87AD31B25D89EB1AE"><enum>7.</enum><header>Program measurement, monitoring, verification, and reporting</header> 
<subsection id="H24A74FF7E9704363A977662171E7F855"><enum>(a)</enum><header>Measurement, monitoring, and verification</header><text display-inline="yes-display-inline">The Secretary shall establish and implement protocols that provide reasonable monitoring and verification of compliance with climate mitigation contracts, to include field sampling of actual performance to develop annual estimates of emissions reductions achieved under the program. Eligible practices and compensation rates may be adjusted for future climate mitigation contracts based on results of these measures.</text></subsection> 
<subsection id="H93CD739A6D594D008AB8EA69C406CE45"><enum>(b)</enum><header>Reporting requirement</header><text display-inline="yes-display-inline">At least once every 18 months, the Secretary shall submit to Congress a report containing—</text>
<paragraph id="H11094390770E4A9AA965B3404346EDDE"><enum>(1)</enum><text>an estimate of annual and cumulative reductions generated through the program, determined using standardized measures including economic efficiency; and</text></paragraph>
<paragraph id="HE038A6FFE05E4307963202B8312BA3B6"><enum>(2)</enum><text>a summary of any changes to the program that will be made as a result of program measurement, monitoring, and verification.</text></paragraph></subsection>
<subsection id="HBD86233DC18D487E8395B157C8BFB031"><enum>(c)</enum><header>Availability of report</header><text display-inline="yes-display-inline">Each report required by subsection (b) shall be available to the public through the official website of the Department of Agriculture.</text></subsection></section> 
<section id="H18609D7E6F1A47BE92FFAE43478AF04C"><enum>8.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated such sums as shall be necessary to carry out the purposes of this section.</text></section>
