		<official-title display="yes">To authorize the Secretary of the Interior
		  to create a Bureau of Reclamation partnership with the North Bay Water Reuse
		  Authority and other regional partners to achieve objectives relating to water
		  supply, water quality, and environmental restoration.</official-title>

		<section id="H186A97C7FA33476885D93B1C7BE49361" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>North Bay Water Reuse Program Act of
			 2009</short-title></quote>.</text>
		</section><section id="HCF3D860FE6B945928DCD03F7A7670056"><enum>2.</enum><header>Project
			 authorization</header>
			<subsection id="H2AB4D10712104E0995F100ED51FFF0F3"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Reclamation
			 Wastewater and Groundwater Study and Facilities Act (<external-xref legal-doc="public-law" parsable-cite="pl/102/575">Public Law 102–575</external-xref>, title
			 XVI; <external-xref legal-doc="usc" parsable-cite="usc/43/390h">43 U.S.C. 390h et seq.</external-xref>) is amended by adding at the end the
			 following:</text>

					<section id="HA54FA46063024A0498A2F597409ED637"><enum>16__.</enum><header>North Bay
				water reuse program</header>
						<subsection id="H161498BEA9944429B4DD9C0015C7D922"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
							<paragraph id="HB7A91D08C07349118E00AF289C424C31"><enum>(1)</enum><header>Eligible
				entity</header><text>The term <quote>eligible entity</quote> means a member
				agency of the North Bay Water Reuse Authority of the State located in the North
				San Pablo Bay watershed in—</text>
								<subparagraph id="H55885AD48F4A44C48F5C6D1CDCCD02D4"><enum>(A)</enum><text>Marin
				County;</text>
								</subparagraph><subparagraph id="H67E5440F6BDF4A74A59BF2709C1C73CD"><enum>(B)</enum><text>Napa
				County;</text>
								</subparagraph><subparagraph id="HEBF0A293E39A4EC2B5CDD7ADDE07AE26"><enum>(C)</enum><text>Solano County;
				or</text>
								</subparagraph><subparagraph id="H8DC7BB89BC2B404FBB78D67C761571DC"><enum>(D)</enum><text>Sonoma
				County.</text>
								</subparagraph></paragraph><paragraph id="HD12309636DE44C4F8B8D24C386553698"><enum>(2)</enum><header>Water
				reclamation and reuse project</header><text>The term <quote>water reclamation
				and reuse project</quote> means a project carried out by the Secretary and an
				eligible entity in the North San Pablo Bay watershed relating to—</text>
								<subparagraph id="HF6EC17594F1249AD93B042FFA8B7D2B"><enum>(A)</enum><text>water quality
				improvement;</text>
								</subparagraph><subparagraph id="HD0422F8CAFDD418097855D57FAF6B8B"><enum>(B)</enum><text>wastewater
				treatment;</text>
								</subparagraph><subparagraph id="H43B6B58B2780406994C04DA55F799C57"><enum>(C)</enum><text>water reclamation
				and reuse;</text>
								</subparagraph><subparagraph id="HF33C8DF37E1F4ABE8658DAE5B7DDECD2"><enum>(D)</enum><text>groundwater
				recharge and protection;</text>
								</subparagraph><subparagraph id="HD32E3DC41523458AA4C4CF4D26DFAF67"><enum>(E)</enum><text>surface water
				augmentation; or</text>
								</subparagraph><subparagraph id="H4C2FC294AE184756BD00BEAB5EF7B586"><enum>(F)</enum><text>other related
				improvements.</text>
								</subparagraph></paragraph><paragraph id="HE33B5DC3C4564CA288DCF1FF403BB436"><enum>(3)</enum><header>State</header><text>The
				term <quote>State</quote> means the State of California.</text>
							</paragraph></subsection><subsection id="H66B7225EBCA44F0BB06BE2C08EE1BC15"><enum>(b)</enum><header>North bay water
				reuse program</header>
							<paragraph id="H4B1C1A78787D4C08A81864A04556FC38"><enum>(1)</enum><header>In
				general</header><text>Contingent upon a finding of feasibility, the Secretary,
				acting through a cooperative agreement with the State or a subdivision of the
				State, is authorized to enter into cooperative agreements with eligible
				entities for the planning, design, and construction of water reclamation and
				reuse facilities and recycled water conveyance and distribution systems.</text>
							</paragraph><paragraph id="HC8F153AC65EA43DE87C16C8F3B62F935"><enum>(2)</enum><header>Coordination
				with other Federal agencies</header><text>In carrying out this section, the
				Secretary and the eligible entity shall, to the maximum extent practicable, use
				the design work and environmental evaluations initiated by—</text>
								<subparagraph id="H6C8A46EB082940B79DC9E51EA6BB3C22"><enum>(A)</enum><text>non-Federal
				entities; and</text>
								</subparagraph><subparagraph id="H9F7EDEE6DC914A9BB2B3CA17E8D12EC"><enum>(B)</enum><text>the Corps of
				Engineers in the San Pablo Bay Watershed of the State.</text>
								</subparagraph></paragraph><paragraph id="H0E13C8A711964337929242C16B31ED2C"><enum>(3)</enum><header>Phased
				project</header><text>A cooperative agreement described in paragraph (1) shall
				require that the North Bay Water Reuse Program carried out under this section
				shall consist of 2 phases as follows:</text>
								<subparagraph id="H335A542E3A3541D583CCE12179F47579"><enum>(A)</enum><header>First
				phase</header><text>During the first phase, the Secretary and an eligible
				entity shall complete the planning, design, and construction of the main
				treatment and main conveyance systems.</text>
								</subparagraph><subparagraph id="H1FA5D7846A304BF881423747C1727DCF"><enum>(B)</enum><header>Second
				phase</header><text>During the second phase, the Secretary and an eligible
				entity shall complete the planning, design, and construction of the
				sub-regional distribution systems.</text>
								</subparagraph></paragraph><paragraph id="H631E6700A66949D983F90569C8E6BDE6"><enum>(4)</enum><header>Cost
				sharing</header>
								<subparagraph id="H23F6F948C0AB418194BBCC13009C414D"><enum>(A)</enum><header>Federal
				share</header><text>The Federal share of the cost of the first phase of the
				project authorized by this section shall not exceed 25 percent of the total
				cost of the first phase of the project.</text>
								</subparagraph><subparagraph id="H471423AD08DC47138FBAFD2D6414495F"><enum>(B)</enum><header>Form of
				non-Federal share</header><text>The non-Federal share may be in the form of any
				in-kind services that the Secretary determines would contribute substantially
				toward the completion of the water reclamation and reuse project,
				including—</text>
									<clause id="H18E4A4AB3F8E40B98B3BF08B4F3B905F"><enum>(i)</enum><text>reasonable costs
				incurred by the eligible entity relating to the planning, design, and
				construction of the water reclamation and reuse project; and</text>
									</clause><clause id="H53545B8ABEE84A21B133DB21D000AE03"><enum>(ii)</enum><text display-inline="yes-display-inline">the acquisition costs of land acquired for
				the project that is—</text>
										<subclause id="HFEE0BE454680430FAA1EBD0087066667"><enum>(I)</enum><text>used for planning,
				design, and construction of the water reclamation and reuse project facilities;
				and</text>
										</subclause><subclause id="H365E0AEA1A92430BA51E97E6970500C8"><enum>(II)</enum><text>owned by an
				eligible entity and directly related to the project.</text>
										</subclause></clause></subparagraph><subparagraph id="HFF97B65132DB4126A751C42FA11F6F25"><enum>(C)</enum><header>Limitation</header><text>The
				Secretary shall not provide funds for the operation and maintenance of the
				project authorized by this section.</text>
								</subparagraph></paragraph><paragraph id="HBAB5100767BB4DF0960098EF9E89789D"><enum>(5)</enum><header>Effect</header><text>Nothing
				in this section—</text>
								<subparagraph id="HAEE27262896E4AD888CCCAD6599D06F"><enum>(A)</enum><text>affects or
				preempts—</text>
									<clause id="H96F629ACB2B04DB9B7F5845348041BE8"><enum>(i)</enum><text>State water law;
				or</text>
									</clause><clause id="HAF913402C50E42269D16A4E868F95B9B"><enum>(ii)</enum><text>an interstate
				compact relating to the allocation of water; or</text>
									</clause></subparagraph><subparagraph id="H5FF869EE174B4D5998D79325FAD342B"><enum>(B)</enum><text>confers on any
				non-Federal entity the ability to exercise any Federal right to—</text>
									<clause id="H8E3E743194ED4AF790E0C4903900378E"><enum>(i)</enum><text>the water of a
				stream; or</text>
									</clause><clause id="H07F66A5E4C21472D8F2F51D014001331"><enum>(ii)</enum><text>any groundwater
				resource.</text>
									</clause></subparagraph></paragraph><paragraph id="HDED118EFE1334E8D9764EF44B1EA1066"><enum>(6)</enum><header>Authorization of
				appropriations</header><text>There is authorized to be appropriated for the
				Federal share of the total cost of the first phase of the project authorized by
				this section $25,000,000, to remain available until
				expended.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HB999AE81AFE74D8E8B58AB2BD0914DF8"><enum>(b)</enum><header>Conforming
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections in section 2 of <external-xref legal-doc="public-law" parsable-cite="pl/102/575">Public Law 102–575</external-xref> is amended by inserting after the
			 last item relating to title XVI the following:</text>
				<toc container-level="legis-body-container" lowest-bolded-level="division-lowest-bolded" lowest-level="section" quoted-block="yes-quoted-block" regeneration="yes-regeneration"><toc-quoted-entry style="OLC">
						<toc-entry idref="HA54FA46063024A0498A2F597409ED637" level="section">Sec. 16__. North Bay water reuse
				  program.”.</toc-entry></toc-quoted-entry>
