			 activities</header>
			<subsection id="H9C437005A957475BBA2BA741C25EEA37"><enum>(a)</enum><header>Inclusion of
			 quality improvement functions</header>
				<paragraph id="H16AC57EC4883436C804C8E28FFA49987"><enum>(1)</enum><header>In
			 general</header><text>Section 1154(a) of the Social Security Act (42 U.S.C.
			 1320c–3(a)) is amended by adding at the end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HA1925EB3ADE7488282600B811117AB4B" style="OLC">
						<paragraph id="H6AA1D5CFF8794D21A40F5CED8B3881BA"><enum>(18)</enum><text>The organization
				shall offer quality improvement assistance to providers, practitioners,
				Medicare Advantage organizations offering Medicare Advantage plans under part C
				of title XVIII, and prescription drug sponsors offering prescription drug plans
				under part D of such title, including the following:</text>
							<subparagraph id="H80F0EF1E222D41BAA472CFA001B0AFC8"><enum>(A)</enum><text>Education on
				quality improvement initiatives, strategies, and techniques.</text>
							</subparagraph><subparagraph id="HBCC1DFE2B5F341F5B66D0AB4EEF7DF8B"><enum>(B)</enum><text>Instruction on how
				to collect, submit, aggregate, and interpret data on measures that may be used
				for quality improvement, public reporting, and payment.</text>
							</subparagraph><subparagraph id="HF921B0C67CAB4FA599411A93F3A92DF4"><enum>(C)</enum><text>Instruction on how
				to conduct root-cause analyses.</text>
							</subparagraph><subparagraph id="HAA83E308FC134434AC0A7E0B28F88440"><enum>(D)</enum><text>Technical
				assistance for providers and practitioners in beneficiary education to
				facilitate patient self-management.</text>
							</subparagraph><subparagraph id="H52652B5DEC3A40CFA8F01E468B4EED48"><enum>(E)</enum><text>Facilitating
				cooperation among local stakeholders in quality improvement.</text>
							</subparagraph><subparagraph id="H61237DCFB9454B57B18348BD9470F960"><enum>(F)</enum><text>Facilitating
				adoption of procedures that encourage timely candid feedback from patients and
				their families concerning perceived problems.</text>
							</subparagraph><subparagraph id="H0A88040A5D7B4E97B1430AC5AA232869"><enum>(G)</enum><text>Guidance on
				redesigning clinical processes, including the adoption and effective use of
				health information technology, to improve the coordination, effectiveness,
				efficiency, and safety of care.</text>
							</subparagraph><subparagraph id="H6441A77CB81D4C58A941DD4DF06DC32D"><enum>(H)</enum><text display-inline="yes-display-inline">Assistance in improving the quality of care
				delivered in rural and frontier areas and reducing health care disparities
				among racial and ethnic minorities, as well as gender disparities, including
				efforts to prevent or address any inconsistencies or delays in the rate of
				adoption of health information technology and in the effective use of such
				technology among such entities that treat racial and ethnic minorities or
				individuals dually eligible for benefits under this title and title XVIII or
				that furnish such services in rural areas.</text>
							</subparagraph><subparagraph id="H35D7949F3B7047FF8F56892ED6F8C760"><enum>(I)</enum><text>Assistance in
				improving coordination of care as patients transition between providers and
				practitioners, including developing the capacity to securely exchange
				electronic health information and helping providers and practitioners to
				effectively use secure electronic health information to improve quality.</text>
							</subparagraph><subparagraph id="H3FA7C33A83F443FB988AD12E318075CD"><enum>(J)</enum><text display-inline="yes-display-inline">Preparation of confidential reports
				comparing the performance of primary care physician practices using
				standardized performance measures and distribution of such reports to primary
				care practices, subject to the following requirements:</text>
								<clause id="H6F176CED862A430D9229AEEBDA001029"><enum>(i)</enum><text>The organization
				shall consult with stakeholders in the State to select clinical topic areas to
				address in such reports.</text>
								</clause><clause id="HB6C68E1D878A4E52920604C169798A75"><enum>(ii)</enum><text>Performance
				measures must have been endorsed by a consensus-based national entity.</text>
								</clause><clause id="HC65164757B7047E8BA3D6D962505CE20"><enum>(iii)</enum><text>The report given
				to each primary care practice shall identify that practice, but shall not
				identify the other practices in the comparison.</text>
								</clause><clause id="H0FDB550BE4F94898AF794C8FF54A9C31"><enum>(iv)</enum><text>The organization
				shall offer assistance to primary care practices in improving performance on
				the
				measures.</text>
								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H96096402C1F9410F8FF50EA09EA3E2E9"><enum>(2)</enum><header>Permitting
			 disclosure of deidentified information</header>
					<subparagraph id="H2BF107B4046A413989F38FB34E540A67"><enum>(A)</enum><header>In
			 general</header><text>Section 1160 of such Act (42 U.S.C. 1320c–9) is
			 amended—</text>
						<clause id="HF448B1D8D04F46D09E11CDCFA37D6A96"><enum>(i)</enum><text>in
			 subsection (a)(2), by inserting <quote>(including the case described in
			 subsection (f))</quote> after <quote>in such cases</quote>; and</text>
						</clause><clause id="HFB62F2F8F254480BA123C4D9D4567DCC"><enum>(ii)</enum><text>by
			 adding at the end the following new subsection:</text>
							<quoted-block display-inline="no-display-inline" id="HB5D1A3FB74AE41149F6E9AA0D17241AE" style="OLC">
								<subsection id="H472682AF6A734E3A95F031194D4D8E3D"><enum>(f)</enum><text display-inline="yes-display-inline">An organization with a contract under this
				part may provide de-identified patient data to providers treating the same
				population of patients for the purpose of measuring and improving the safety,
				quality, and effectiveness of transitions of such patients from one provider of
				services to another. Nothing in this subsection shall be construed to limit,
				alter, or affect the requirements imposed pursuant to the HIAA privacy
				regulations (as defined in section
				1180(b)(3)).</text>
								</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="HF1F8CE4D8A5F4398A014EE693734C449"><enum>(B)</enum><header>Promulgation of
			 regulations</header><text display-inline="yes-display-inline">Not later than
			 180 days after the date of the enactment of this Act, the Secretary of Health
			 and Human Services shall promulgate a regulation that permits the sharing of
			 data under the amendments made by subparagraph (A).</text>
					</subparagraph></paragraph></subsection><subsection id="HC62CFDF368D04BED857E3AF063651D3D"><enum>(b)</enum><header>Medicare quality
			 accountability program</header><text>Paragraph (14) of section 1154(a) of such
			 Act (42 U.S.C. 1320c–3(a)) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HAEBFA31C4B1F4FF9A8CA985EF95B820B" style="OLC">
					<paragraph id="H43E80BED30DD4B6EAFE6B96E8731374C"><enum>(14)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HDCD491BA716F4D7D82DED7A63DC35362"><enum>(A)</enum><text>The organization shall
				conduct a review of all complaints about the quality of services (for which
				payment may otherwise be made under title XVIII) not meeting professionally
				recognized standards of health care, if the complaint is filed with the
				organization by an individual entitled to benefits for such services under such
				title (or a person acting on the individual’s behalf). Before the organization
				concludes that the quality of services does not meet professionally recognized
				standards of health care, the organization must provide the practitioner or
				person concerned with reasonable notice and opportunity for discussion.</text>
						</subparagraph><subparagraph id="H5056D6465F7C498D827C0BDC5975B540" indent="up1"><enum>(B)</enum><text>The organization shall establish and
				operate a Medicare quality accountability program consistent with the
				following:</text>
							<clause id="H9E5D054F3EAC4B14B19D2DF120002FFE"><enum>(i)</enum><text>The organization shall actively
				educate Medicare beneficiaries of their right to bring quality concerns to
				Quality Improvement Organizations.</text>
							</clause><clause id="H169AC0A3E44D4595B7A62E3D546BB046"><enum>(ii)</enum><text>The organization shall report
				findings of its investigations to the beneficiary involved or a representative
				of such beneficiary, regardless of whether such findings involve a provider,
				physician or other practitioner, or plan. Such report shall describe whether
				the organization confirms the allegations in the complaint and any actions
				taken by the provider, practitioner, or plan, respectively, with respect to
				such findings. Such findings may not be used in any form in a medical
				malpractice action.</text>
							</clause><clause id="H7CDD115265274B028D3F207CC52E96A9"><enum>(iii)</enum><text>The organization shall assist
				providers, practitioners, and plans in adopting best practices for soliciting
				and welcoming feedback about patient concerns, and assist providers,
				practitioners, and plans in remedying patient-reported problems that are
				confirmed by the organization and shall report findings of patient reported
				problems to the provider, practitioner, or plan involved before disclosing
				investigation results to the patient or patient’s representative.</text>
							</clause><clause id="H3DA8BD5650DE4ED4B31612F4001C3C1A"><enum>(iv)</enum><text>The organization shall determine
				whether the complaint allegations about clinical quality of care are confirmed
				and assist providers, practitioners, and plans in remedying confirmed
				complaints.</text>
							</clause><clause id="HE3C2402FAE764F5D95B2F89025AB0C98"><enum>(v)</enum><text display-inline="yes-display-inline">The organization shall assist providers,
				practitioners, and plans in preventing recurrence of quality problems caused by
				unsafe systems of care, and refer to an appropriate regulatory body providers,
				practitioners, or plans that are unwilling or unable to improve.</text>
							</clause><clause id="H887DFD1493B74E3BAECF323DA131BE75"><enum>(vi)</enum><text>The organization shall publish
				annual quality reports in each State in which the organization operates,
				including aggregate complaint data and provider performance on standardized
				quality measures.</text>
							</clause><clause id="H6A6E056B33854A0684ABF3801736E774"><enum>(vii)</enum><text display-inline="yes-display-inline">The organization shall promote beneficiary
				awareness and understanding of standardized quality measures that may be used
				for evaluating care and for choosing providers, practitioners and plans.</text>
							</clause></subparagraph><subparagraph id="H8837B196924E433F8A84BEDF2E46FBDA" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">The Secretary shall monitor and report to
				Congress, regarding—</text>
							<clause id="H1473AEE8A45442659B1489169F449A37"><enum>(i)</enum><text>the reliability of complaint
				determinations by Quality Improvement Organizations;</text>
							</clause><clause id="H32B4D7D12379478E9316C142AD7D556B"><enum>(ii)</enum><text>the effect of disclosure of
				complaint findings on the availability of primary- and specialty-care physician
				reviewers;</text>
							</clause><clause id="H51C141B9AC354F61A569BCF612852548"><enum>(iii)</enum><text>changes resulting from the
				systems change process described in subparagraph (B)(v); and</text>
							</clause><clause id="H9C27A583E55643AFA54DD8CCC78B4333"><enum>(iv)</enum><text>trends in civil litigation filed
				by Medicare beneficiaries or their
				representatives.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HAA4A8323AC034520B9A13D17B2FA184E"><enum>3.</enum><header>Improved program
			 administration</header><text display-inline="no-display-inline">Part B of title
			 XI of the Social Security Act is amended by adding at the end the following new
			 section:</text>
			<quoted-block display-inline="no-display-inline" id="HDE1E0660DA144A87885E14C1BF783402" style="traditional">
				<section id="H1556EBAA34BD490F8CD84826ACBE6283"><enum>1164.</enum><header>Program administration</header><subsection commented="no" display-inline="yes-display-inline" id="HBDF7CE27C4054753A45279DBB2791069"><enum>(a)</enum><header>Improved program
				management</header><text display-inline="yes-display-inline">The Secretary
				shall ensure that Quality Improvement Organizations are provided maximum
				freedom in designing and applying intervention strategies for local quality
				improvement.</text>
					</subsection><subsection id="HC998B179A87F460DACB6FF31930DEF4E"><enum>(b)</enum><header>Assuring data
				access</header><text>The Secretary shall ensure that Quality Improvement
				Organizations have timely, top priority access to Medicare data for all parts
				of Medicare pertinent to the contract activities, in a form allowing the data
				to be integrated and analyzed by such organizations according to the needs of
				partners and Medicare beneficiaries in each jurisdiction.</text>
					</subsection><subsection id="HBE312B179F8B4EB7A145ECF624320211"><enum>(c)</enum><header>Setting
				strategic priorities</header>
						<paragraph id="H87E1D1ADDE3C40899A7BB9FD14F7E4F9"><enum>(1)</enum><header>Appointment of
				strategic advisory committee</header><text display-inline="yes-display-inline">The Secretary shall appoint an independent
				strategic advisory committee (in this subsection referred to as the
				<quote>committee</quote>), composed of national quality measurement and
				improvement experts, that includes at least three representatives of
				organizations holding contracts under this part and at least one appropriately
				qualified representative of each of the following:</text>
							<subparagraph id="H75E13C1F697F43A7A8955C21A6D01382"><enum>(A)</enum><text>Medicare
				beneficiaries.</text>
							</subparagraph><subparagraph id="H1F4AFF15684E4CB3B066B74714BA5AA2"><enum>(B)</enum><text>The Agency for
				Healthcare Research and Quality.</text>
							</subparagraph><subparagraph id="H07EC23B44A0D44FE91A031AB83D5B05B"><enum>(C)</enum><text>The Federal
				Employee Health Benefits Program.</text>
							</subparagraph><subparagraph id="H4EE446A599DC43FAA6D25AF88AB51C7E"><enum>(D)</enum><text>The Indian Health
				Service.</text>
							</subparagraph><subparagraph id="H6B2A22C11A1547F1B5272511A34823B3"><enum>(E)</enum><text>The TRACER
				program.</text>
							</subparagraph><subparagraph id="H85FEE2BC6F654EE69A22C1B3D74ED566"><enum>(F)</enum><text>The Veterans
				Health Affairs program.</text>
							</subparagraph><subparagraph id="HA9230EA42F3246329E5A247AE4CDFD5B"><enum>(G)</enum><text>State Medicaid
				programs.</text>
							</subparagraph><subparagraph id="HB6F14A8709AC4BC49845897CA8B27D46"><enum>(H)</enum><text>Private
				purchasers.</text>
							</subparagraph><subparagraph id="H7AECDE72D27A4607AEE4E1E97A5C9187"><enum>(I)</enum><text>Health care
				providers.</text>
							</subparagraph><subparagraph id="H8808CABA7FBF42EBB192A911274D6611"><enum>(J)</enum><text>Physicians.</text>
							</subparagraph><subparagraph id="H38D194634D864CBCA7DB93A4E1F22C8A"><enum>(K)</enum><text>Other health care
				practitioners.</text>
							</subparagraph></paragraph><paragraph id="H6B0D449F700942FDAF14397FF53B9FCB"><enum>(2)</enum><header>Duties of
				committee</header>
							<subparagraph id="HB2A67854879D40DBA004A044B0DBD580"><enum>(A)</enum><header>In
				general</header><text>The committee shall set national strategic priorities for
				improvement in the quality of care, consistent with the Institute of Medicine's
				six aims for health care improvement, including safety, effectiveness, patient
				centeredness, timeliness, efficiency and equity, and update these in time to
				permit preparation of a draft statement of work and funding request for each
				program cycle under this part.</text>
							</subparagraph><subparagraph id="H6E06F600DF034EAEAA5FFD9D74CE7D00"><enum>(B)</enum><header>Secretarial
				consultation with committee</header><text display-inline="yes-display-inline"><inline-comment display="no">Now in we are
				currently in the 9th Statement of Work which runs through August 2011. The 10th
				Statement of Work will begin in August 2011 through 2013. </inline-comment>Two
				years before the start of the contract cycle under this part that begins at
				least 30 months after the date of the enactment of this section, the Secretary
				shall begin consultation with the committee on the design and tasks of the
				statement of work for such contract cycle.</text>
							</subparagraph><subparagraph id="HA5018B85EDD043698C15A41750E2B18B"><enum>(C)</enum><header>Public
				forum</header><text>Eighteen months before the beginning of such contract
				cycle, the committee shall convene a public forum to solicit and receive
				stakeholder and public comment concerning the design and tasks under the next
				contract.</text>
							</subparagraph></paragraph><paragraph id="H15FE6E3D6BE54DDE833CEA4D747A0BB8"><enum>(3)</enum><header>Independent
				evaluation</header><text display-inline="yes-display-inline">The committee
				should ensure that the Quality Improvement Organization program is evaluated by
				an independent entity using a study design, such as a crossover design, to
				allow for an assessment of program performance in a way that does not have an
				adverse impact on providers, practitioners, and plans that may work with the
				Organization.</text>
						</paragraph><paragraph id="H87EBFE66D3FB4EEC8E8D9926EDA7F5C2"><enum>(4)</enum><header>Funding</header><text display-inline="yes-display-inline">The Secretary shall allocate funds for the
				strategic advisory committee from the portion of the funding that does not
				directly fund the contracts with Quality Improvement Organizations, as required
				under section 1159(b).</text>
						</paragraph></subsection><subsection id="H8DB22DBFD19C4764958F21D000258825"><enum>(d)</enum><header>Taking into
				account recommendations from stakeholders in statements of
				work</header><text>Each statement of work under this part for a contract period
				beginning on or after August 1, 2009, shall include a task for the contracting
				Quality Improvement Organization to convene stakeholders to identify high
				priority quality problems for work in the next contract period that are
				relevant to Medicare beneficiaries in the State. Each such organization shall
				propose, as part of such statement, one or more projects to the Secretary
				taking into consideration the recommendations of such stakeholders, along with
				suggested performance measures to evaluate progress on such item.</text>
					</subsection><subsection id="H3DB10BF2BDC447F999889D38349D135F"><enum>(e)</enum><header>Allocation of
				resources to priority areas</header><text>The Secretary shall allocate at least
				20 percent of the funding that directly funds contracts with Quality
				Improvement Organizations under section 1159(b) to promote improvement in one
				or more locally defined priority areas identified under subsection (d).</text>
					</subsection><subsection id="H6215CB7A6F3B4BA0923004EF844E71AF"><enum>(f)</enum><header>Quality
				coordination</header><text display-inline="yes-display-inline">Quality
				Improvement Organizations holding contracts under this part shall be an
				integral part of Federal performance improvement initiatives and each
				organization’s activities shall be coordinated with initiatives developed by
				the Secretary and other Federal agencies.</text>
					</subsection><subsection id="H07B5FC392895430AA9EE0394DFC47C49"><enum>(g)</enum><header>Funding</header><text display-inline="yes-display-inline">The Secretary shall increase contract
				funding for any significant new work required as a result of coordinating the
				activities of contractors with initiatives developed by the Secretary and other
				Federal
				agencies.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HE364E4F72F30485E9EF1CD88A88F79D7"><enum>4.</enum><header>Use of evaluation
			 and competition</header><text display-inline="no-display-inline">Section 1153
			 of the Social Security Act (42 U.S.C. 1320c–2) is amended—</text>
			<paragraph id="H7852B5387F2B48F387CB4C1CB509F427"><enum>(1)</enum><text>by amending
			 paragraph (3) of subsection (c) to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H7676BC2C7838485985E2E050B7037095" style="traditional">
					<paragraph id="HDD6B4BEB4CCD4F2094CF3847BF855EB9"><enum>(3)</enum><text>contract terms are
				consistent with subsection (j);</text>
					</paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H80CA1E3419CF45598E83232A9DFB2DBB"><enum>(2)</enum><text>in subsection
			 (c)(1), by inserting <quote>, at the sole discretion of the
			 organization,</quote> after <quote>or may subcontract</quote>;</text>
			</paragraph><paragraph id="H5754700C16374BBD9999B566685CE2B1"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (e), by striking <quote>(1)
			 Except as provided</quote> and all that follows through <quote>(2)</quote>;
			 and</text>
			</paragraph><paragraph id="HFBF7E06561254DD39F4E8AFD681E340B"><enum>(4)</enum><text>by adding at the
			 end the following new subsection:</text>

					<subsection id="HCE10A3A821084B608DFD8689E00FAB4F"><enum>(j)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H6C9F2A1D363B44848578E0070C924395"><enum>(1)</enum><text display-inline="yes-display-inline">Subject to the succeeding provisions of
				this subsection, each contract with an organization under this section shall be
				for an initial term of five years, beginning and ending on a common date for
				all contractors as required under this subsection and shall be renewable for
				5-year terms thereafter.</text>
						</paragraph><paragraph id="H3C7E2D8D337148D4885D8772384F8F17" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">If an incumbent organization achieves
				excellent performance as described in paragraph (3), then the Secretary may
				renew the contract with that organization without full and open competition,
				but in no case may an organization be permitted to hold a contract for more
				than 10 years without being subject to full and open competition.</text>
						</paragraph><paragraph id="H4ABD440B58504C23AB9737639F412936" indent="up1"><enum>(3)</enum><text>Before publishing a request for
				proposal for a contract period, the Secretary shall, in consultation with the
				strategic advisory committee appointed under section 1164(c)(1), establish
				measurable goals for each task to be included in such proposal. The contract
				shall include performance thresholds by which an organization holding a
				contract under this section may demonstrate excellent performance. The
				Secretary may not establish such performance thresholds in such a way as to
				predetermine or limit either the number or percentage of organizations which
				may demonstrate excellent performance.</text>
						</paragraph><paragraph id="H0DAAAA5CCB474AF5B57B193F625CF54C" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">The Secretary shall publish the request for
				proposals no later than four months prior to the beginning of such contract
				period.</text>
						</paragraph><paragraph id="H4F3A2E5BE6CB45FE97EF994231E413A1" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">The Secretary shall ensure that measures to
				be used in evaluating the performance of organizations holding a contract under
				this section have been demonstrated to be valid, reliable, and feasible for use
				under the terms and circumstances of the contract.</text>
						</paragraph><paragraph id="H4902FE790236429FA3540B91B31BA412" indent="up1"><enum>(6)</enum><text>In the case of an open competition
				for a contract under this section, if the incumbent organization bidding for
				the contract in the State in which it holds the contract demonstrates excellent
				performance in fulfilling the terms of such contract during the previous
				contract period, the Secretary shall award such organization a bonus equivalent
				to ten percent of the total possible score for the proposal.</text>
						</paragraph><paragraph id="H67832A94CDEB4804BAD1439DBC573F5F" indent="up1"><enum>(7)</enum><text>The Secretary may not reduce the
				amount of a contract award below the amount proposed by the bidder prevailing
				in a competitive bidding process.</text>
						</paragraph><paragraph id="H59A6C351747D4866940C90279548005B" indent="up1"><enum>(8)</enum><text>The Secretary shall design the
				process for performance evaluation of contracts under this section—</text>
							<subparagraph id="H5F4F0034C724405EA7335704807489B7"><enum>(A)</enum><text>to avoid interfering with the work of
				contractors with plans, providers, and practitioners;</text>
							</subparagraph><subparagraph id="H57E3652953504677BAAB2B3C522EDB73"><enum>(B)</enum><text>to hold harmless and not penalize
				contractors when performance is impaired or delayed by failures of the
				Secretary, personnel of the Department of Health and Human Services, or
				contractors of the Secretary, to provide timely deliverables by other
				entities;</text>
							</subparagraph><subparagraph id="H948B755C959646F4A18517F620B6718F"><enum>(C)</enum><text>to use a continuous measurement
				strategy with provision for frequent performance updates for evaluating interim
				progress; and</text>
							</subparagraph><subparagraph id="H2CE3CE8FEFB3497DBF2E3EE63B115F99"><enum>(D)</enum><text>to require that evaluation metrics be
				monitored and permit their adjustment based on experience or evolving science
				over the course of a contract
				cycle.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HEDFAE2B6DE554F8F820D451758727D3E"><enum>5.</enum><header>Quality
			 improvement funding</header><text display-inline="no-display-inline">Section
			 1159 of the Social Security Act (42 U.S.C. 1320c–8) is amended—</text>
			<paragraph id="H5520C74938004531A66769A590096ED9"><enum>(1)</enum><text>by inserting
			 <quote>(a)</quote> before <quote>Expenses incurred</quote>; and</text>
			</paragraph><paragraph id="H933C9D69A7FA455A93E58CCB3409B77F"><enum>(2)</enum><text>by adding at the
			 end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HCF17FBD168824057A95A12136C6BF0B0" style="traditional">
					<subsection id="H9AD0AA1108344A51B160BE9D08668051"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H90C5A7791504485D9E0542866896214F"><enum>(1)</enum><text display-inline="yes-display-inline">The aggregate annual funding for contracts
				under this part that begin after August 1, 2009, shall not be less than
				$421,666,000. In addition, there are authorized to be apportioned for contract
				periods in subsequent years such additional amounts as may be necessary to
				adequately fund any resource needs in excess of the amount provided under the
				previous sentence.</text>
						</paragraph><paragraph id="HF63E98668D4E496295C3CA12DBF0E561" indent="up1"><enum>(2)</enum><text>At least 80 percent of the funding
				under this part in a contract period shall be expended to directly fund the
				contracts held by organizations, as required under section 1153(b).</text>
						</paragraph><paragraph id="HF9F28B1825014B6E9085D9DE17237D6F" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">The Secretary shall determine the resources
				needs for a contract period, taking into account any new work added by contract
				modification, during the course of the contract period or added from one
				contract cycle to the next cycle. New work includes—</text>
							<subparagraph id="HBC3AC8D7FC0D4F87BFE6A4149B466CAE"><enum>(A)</enum><text>additional core contract tasks,
				requirements, deliverables, and performance thresholds;</text>
							</subparagraph><subparagraph id="HB5D4EEF0AB8D431497FC336DAF4002D2"><enum>(B)</enum><text>technical assistance for additional
				providers, practitioners, and health plans and additional provider
				settings;</text>
							</subparagraph><subparagraph id="HAFFDB3CFC1EE426C81284C6B8C044AA1"><enum>(C)</enum><text>increased outreach and communications
				to Medicare beneficiaries, providers, practitioners, and plans; and</text>
							</subparagraph><subparagraph id="HC35DBC3CAA3C4333928EF9F4E8EECA00"><enum>(D)</enum><text>increased volume of medical
				reviews.</text>
							</subparagraph></paragraph><paragraph id="H27A1EAEC58834787ABE2AA30AA7ECAB9" indent="up1"><enum>(4)</enum><text>With respect to the apportionment of
				funds under this part for a contract period—</text>
							<subparagraph id="HBC76E277A69B47F2A3239D4EF5CC6F4F"><enum>(A)</enum><text>the Secretary shall submit a proposed
				apportionment to the Director of the Office of Management and Budget no later
				than 1 year before the first date of the contract period;</text>
							</subparagraph><subparagraph id="H753084CD120643339C522405F7EE1DA4"><enum>(B)</enum><text>such Director shall approve an
				proposed apportionment no later than 9 months before the first date of such
				contract period;</text>
							</subparagraph><subparagraph id="H643906896EEA4E659EB0E32C46284559"><enum>(C)</enum><text>for tasks the Secretary proposes to
				continue from the previous contract period, if the apportionment is not
				authorized by the deadline specified in subparagraph (B), funding shall
				continue for the next contract period at a level no less than the level for the
				previous contract period, increased by the percentage increase in the consumer
				price index for all urban consumers during the preceding 12-month
				period.</text>
							</subparagraph></paragraph><paragraph id="HEE04D2FBB38C47098512FF9FB10F2644" indent="up1"><enum>(5)</enum><text>Organizations with a contract under
				this part may enter into contracts with public or private entities including
				providers, practitioners, and payers other than the Secretary, to provide
				quality improvement or other services if there are arrangements made to avoid
				or mitigate potential conflicts of interest.</text>
						</paragraph><paragraph id="H996B16A4E3054B9BBA03DD60DF968222" indent="up1"><enum>(6)</enum><text display-inline="yes-display-inline">Such organizations shall be permitted
				discretion to allocate contract funds as needed to accomplish the tasks to be
				performed for a contract awarded under this title. <inline-comment display="no">The Secretary shall review whether the organization met the
				functions and goals set out for the organization, regardless of allocation of
				funds at the initial acceptance of the contract.</inline-comment></text>
						</paragraph><paragraph id="HE30DF50AB6664143B2C4A614BD6C6679" indent="up1"><enum>(7)</enum><text display-inline="yes-display-inline">Organizations with a contract under this
				part may utilize funding allocated to such contracts to pay for food costs
				directly related to fulfilling contract
				requirements.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H115BE442A6404C7382756A8A44869BA2"><enum>6.</enum><header>Qualifications
			 for QIOs</header>
			<subsection id="H3DE8553A30604D80832C912BF92001AE"><enum>(a)</enum><header>In
			 general</header><text>Subsection (b) of section 1153 of the Social Security Act
			 (42 U.S.C. 1320c–2) is amended by adding at the end the following new
			 paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H91720774685143D4A9B9983495AAADE7" style="traditional">
					<paragraph id="HE502FE417CE8458E80D718E74E6EE375" indent="up1"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HE719CEEA450E4928BBD3DDCBC6FE6812"><enum>(A)</enum><text>The Secretary shall not
				enter into or renew a contract under this section with an entity unless the
				entity has demonstrated success in facilitating clinical and administrative
				system redesign to improve the coordination, effectiveness, and safety of
				health care, and in facilitating cooperation among stakeholders in quality
				improvement.</text>
						</subparagraph><subparagraph id="HCB092BFB95104914853C9EADE83653AE" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The Secretary shall ensure that the entity
				complies with standards to ensure organizational integrity, including—</text>
							<clause id="H1EFE730F9E934436AE56AAF3DB190B47"><enum>(i)</enum><text>appropriate representation of
				consumers and other stakeholders in the composition of the governing
				body;</text>
							</clause><clause id="H932BC2795FF1491FA59BF570069656F0"><enum>(ii)</enum><text>market-based compensation of board
				members and executives;</text>
							</clause><clause id="HB373FDDA08194BE8A48A888EABD141D3"><enum>(iii)</enum><text>avoidance and mitigation of board
				member conflict of interest; and</text>
							</clause><clause id="H6FE4922672F741BABC021F2FF82A80A6"><enum>(iv)</enum><text>safeguards to ensure appropriate
				travel expenses.</text>
							</clause><continuation-text continuation-text-level="subparagraph">To the
				extent practicable, the Secretary shall utilize standards developed in the
				private sector for purposes of carrying out this subparagraph and shall conduct
				audits as necessary to ensure compliance with such
				standards.</continuation-text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HF2D67511A73D45A0BD3FED2EEAB9F738"><enum>(b)</enum><header>Use of States
			 for geographic areas</header><text>Subsection (a) of such section is amended to
			 read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HEF26F8F67A5C4D08894021F60B8CC86C" style="traditional">
					<subsection id="H6A3349AD2F1543FDA501FA85FED14F99"><enum>(a)</enum><text display-inline="yes-display-inline">The Secretary shall designate each State as
				a geographic area with respect to which contracts under this part will be
				made.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HAB14E196ED014D5CA568866E1E58E8F2"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to contract
			 periods beginning after the date of the enactment of this Act.</text>
			</subsection></section><section id="H1EEEC7C400134E47802EA5946B72C50C"><enum>7.</enum><header>Coordination with
			 Medicaid</header>
			<subsection display-inline="no-display-inline" id="H56846574A59B47B1A7C260FD2DA63411"><enum>(a)</enum><header>Permitting
			 alternative quality improvement program</header><text display-inline="yes-display-inline">Section 1902(a)(30) of the Social Security
			 Act (42 U.S.C. 1396a(a)(30)) is amended by striking <quote>and</quote> at the
			 end of subparagraph (A), by adding <quote>and</quote> and the end of
			 subparagraph (B), and by adding at the end the following new
			 subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="HBA476BE941B1497899CE20F0C80A221D" style="OLC">
					<subparagraph id="H9E90A632136648708781B1E805136F69"><enum>(C)</enum><text display-inline="yes-display-inline">provide, at the discretion of the State
				plan, for a quality improvement program in place of the program described in
				subparagraph (A), in whole or in part, that—</text>
						<clause id="H523F474E910C41DFB2A7F9EBF8530F87"><enum>(i)</enum><text>establishes
				priorities for achieving significant measurable improvement in the quality of
				health care services provided to individuals eligible under this title, and
				reviews such priorities at least every five years for the purpose of making
				appropriate revisions;</text>
						</clause><clause id="H38E43DA16D7245EAB1D5E2C102165BB8"><enum>(ii)</enum><text>provides quality
				improvement assistance to providers and practitioners consistent with such
				priorities; and</text>
						</clause><clause id="H0DDB5FC8238243D28BA482A3893BC1F9"><enum>(iii)</enum><text>provides for an
				annual report to the Secretary on quality performance under such plan of
				providers and practitioners using nationally standardized quality
				measures;</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H897EF4A253FC4BF89887B54F4C27D37C"><enum>(b)</enum><header>Role of
			 QIOs</header><text>Section 1902(d) of such Act (42 U.S.C. 1396a(d)) is
			 amended—</text>
				<paragraph id="H730E5DF8C3C445E1A59F69F8C2E5B14C"><enum>(1)</enum><text>by inserting
			 <quote>(1)</quote> after <quote>(d)</quote>; and</text>
				</paragraph><paragraph id="HEDD2A4F2AB9A4AE6B9FFA5AA09AC08C4"><enum>(2)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HAA45BED8F3C14260A056D43C6E0AF888" style="traditional">
						<paragraph id="H5AD5673454EF406E8C039D028C1FE231" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">If a State contracts with a Quality
				Improvement Organization having a contract with the Secretary under part B of
				title XI for the performance of quality improvement program activities required
				by subsection (a)(30)(C), such requirements shall be deemed to be met for those
				activities by delegation to such an Organization if the contract provides for
				the performance of activities not inconsistent with part B of title XI and
				provides for such assurances of satisfactory performance by such an entity or
				organization as the Secretary may
				prescribe.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H0D293A08A73B49F7842ECC2E371DC3BB"><enum>(c)</enum><header>Funding</header><text display-inline="yes-display-inline">Section 1903(a)(3)(C) of such Act (42
			 U.S.C. 1396b(a)(3)(C)) is amended—</text>
				<paragraph id="H2FF9CE859F13400BB02338491EA6E177"><enum>(1)</enum><text>in clause (i), by
			 striking <quote>1902(d)</quote> and inserting <quote>1902(d)(1)</quote>;
			 and</text>
				</paragraph><paragraph id="HA5E315CD5D784E278668807DBA8E487B"><enum>(2)</enum><text>by adding at the
			 end the following new clause:</text>
					<quoted-block display-inline="no-display-inline" id="H84CDCB5FDDA34DBCBD1FE8AD4AEE4FFE" style="traditional">
						<clause id="HCE3248E6F06C45D0AE58B89414B51E4E"><enum>(iii)</enum><text display-inline="yes-display-inline">75 percent of the sums expended with
				respect to costs incurred during such quarter (as found necessary by the
				Secretary for the proper and efficient administration of the State plan) as are
				attributable to the performance of quality improvement program activities under
				a contract entered into under section 1902(d)(2) by an organization holding a
				contract under section 1153;
				and</text>
						</clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H74453A70690B45F1804BDA152DBE6BD3"><enum>(d)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply to contract periods beginning after the date of the
			 enactment of this Act.</text>
			</subsection></section><section id="HB10BB181570144D38F39986E077BCD12"><enum>8.</enum><header>Conforming name
			 to <quote>quality improvement organizations</quote></header><text display-inline="no-display-inline">Part C of title XI of the Social Security
			 Act is amended by striking <quote>utilization and quality control peer
			 review</quote> and <quote>peer review</quote> each place either appears before
			 <quote>organization</quote> or <quote>organizations</quote> and inserting
			 <quote>quality improvement</quote>.</text>
