		<official-title>To help Federal prosecutors and investigators combat
		  public corruption by strengthening and clarifying the law.</official-title>

		<section display-inline="no-display-inline" id="HB413F27EE30F4A6000B41EC9576B899" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Public Corruption Prosecution Improvements
			 Act</short-title></quote>.</text>
		</section><section id="HF4E92838118C4C94BFD65D94D374D361"><enum>2.</enum><header>Extension of
			 statute of limitations for serious public corruption offenses</header>
			<subsection id="HB69585427D424D4C9B5B7014C0FB98CA"><enum>(a)</enum><header>In
			 General</header><text>Chapter 213 of title 18, United States Code, is amended
			 by adding at the end the following:</text>
				<quoted-block id="HCCF7F8AF9B444798B37DDCB2CAC7F010" style="USC">
					<section id="H493BA936F90C4528AB6E1401AE00B008"><enum>3300.</enum><header>Corruption
				offenses</header><text display-inline="no-display-inline">No person shall be
				prosecuted, tried, or punished for a violation of, or a conspiracy or an
				attempt to violate—</text>
						<paragraph id="H24DAEA3D45D3426DAA4F00A6126FB47C"><enum>(1)</enum><text>section 201 or
				666;</text>
						</paragraph><paragraph id="HA9BBDC2A484E4934A9AB21E4A32068C1"><enum>(2)</enum><text>section 1341 or
				1343, when charged in conjunction with section 1346 and where the offense
				involves a scheme or artifice to deprive another of the intangible right of
				honest services of a public official;</text>
						</paragraph><paragraph id="H3A6AE8DB96854174931490C2DB5EDCBA"><enum>(3)</enum><text>section 1951, if
				the offense involves extortion under color of official right;</text>
						</paragraph><paragraph id="HFC2153CEE03F488F98003B003216E9A7"><enum>(4)</enum><text>section 1952, to
				the extent that the unlawful activity involves bribery; or</text>
						</paragraph><paragraph id="H38DB7B9A1A80434B975965FC83C96558"><enum>(5)</enum><text display-inline="yes-display-inline">section 1962 to the extent that the
				racketeering activity involves—</text>
							<subparagraph id="H8081820DD90F4F59A85451F312163484"><enum>(A)</enum><text>bribery chargeable
				under State law; or</text>
							</subparagraph><subparagraph id="HC80B9DD0CCCB41C1A000957B53F4909F"><enum>(B)</enum><text>a violation
				of—</text>
								<clause id="H04CA1E4AA4AC4066B106CCE7C9E2BA80"><enum>(i)</enum><text>section 201 or
				666;</text>
								</clause><clause id="H17E61C8ADCE240748662F404B6E35CC1"><enum>(ii)</enum><text>section 1341 or
				1343, when charged in conjunction with section 1346 and where the offense
				involves a scheme or artifice to deprive another of the intangible right of
				honest services of a public official; or</text>
								</clause><clause id="H44742845DCE2436FAA0589267462439E"><enum>(iii)</enum><text>section 1951, if
				the offense involves extortion under color of official right;</text>
								</clause></subparagraph></paragraph></section><quoted-block-continuation-text quoted-block-continuation-text-level="subsection">unless an
				indictment is returned or the information is filed within 6 years after the
				commission of the offense.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H86C7E3DED6A348E6ACFCF12B8D654F17"><enum>(b)</enum><header>Clerical
			 Amendment</header><text>The table of sections at the beginning of chapter 213
			 of title 18, United States Code, is amended by adding at the end the
			 following:</text>

						<toc-entry level="section">3300. Corruption
				offenses.</toc-entry>
					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H8924BA6212D54DEBA33373CB62FD8EA4"><enum>(c)</enum><header>Application of
			 Amendment</header><text>The amendments made by this section shall not apply to
			 any offense committed before the date of enactment of this Act.</text>
			</subsection></section><section id="HC398659276A24129ADEE74FD2246A93D"><enum>3.</enum><header>Theft or bribery
			 concerning programs receiving Federal financial assistance</header><text display-inline="no-display-inline">Section 666(a) of title 18, United States
			 Code, is amended—</text>
			<paragraph id="HF46A518871DA49F0B9A3EBA48E66473F"><enum>(1)</enum><text>in paragraph
			 (1)(B), by striking <quote>of $5,000</quote> and inserting <quote>of
			 $1,000</quote>; and</text>
			</paragraph><paragraph id="H583185B76F074378A089C1C46D008E72"><enum>(2)</enum><text>in paragraph (2),
			 by striking <quote>$5,000</quote> and inserting <quote>$1,000</quote>.</text>
			</paragraph></section><section id="HA9E740D364DB4B0DAE0507E0D980FAD0"><enum>4.</enum><header>Addition of
			 District of Columbia to theft of public money offense</header><text display-inline="no-display-inline">Section 641 of title 18, United States Code,
			 is amended by inserting <quote>the District of Columbia or</quote> before
			 <quote>the United States</quote> each place that term appears.</text>
		</section><section id="H7580B109FCD94D218DE9CE4300CABCDE"><enum>5.</enum><header>Additional rico
			 and moneylaudering predicates</header>
			<subsection id="H41D08B04D4314AB1B32F002900521C00"><enum>(a)</enum><header>Rico</header><text>Section
			 1961(1) of title 18, United States Code, is amended—</text>
				<paragraph id="H66D332C3D94B499CAED970855DCB903E"><enum>(1)</enum><text>by inserting
			 <quote>section 641 (relating to embezzlement or theft of public money,
			 property, or records),</quote> after <quote>473 (relating to
			 counterfeiting),</quote>; and</text>
				</paragraph><paragraph id="H909449FFC3704F8F005FB537119F1EBC"><enum>(2)</enum><text>by inserting
			 <quote>section 666 (relating to theft or bribery concerning programs receiving
			 Federal funds),</quote> after <quote>section 664 (relating to embezzlement from
			 pension and welfare funds),</quote>.</text>
				</paragraph></subsection><subsection id="H523894EDF6FB4E3E9513275D156E6C86"><enum>(b)</enum><header>Moneylaundering</header><text>Section
			 1956(c)(7)(D) of title 18, United States Code, is amended—</text>
				<paragraph id="H3492A1FBC6FF4193B3009900FA2146D6"><enum>(1)</enum><text>by striking
			 <quote>section 641 (relating to public money, property, or records),</quote>;
			 and</text>
				</paragraph><paragraph id="H8924B0FC390347DF8E7950267618B01"><enum>(2)</enum><text>by
			 striking <quote>section 666 (relating to theft or bribery concerning programs
			 receiving Federal funds),</quote>.</text>
				</paragraph></subsection></section><section id="HAFDE3876BE4F48A69899D54CAA04F1FF"><enum>6.</enum><header>Additional
			 wiretap predicates</header><text display-inline="no-display-inline">Section
			 2516(1)(c) of title 18, United States Code, is amended by inserting
			 <quote>section 641 (relating to embezzlement or theft of public money,
			 property, or records), section 666 (relating to theft or bribery concerning
			 programs receiving Federal funds),</quote> after <quote>section 224 (bribery in
			 sporting contests),</quote>.</text>
		</section><section id="H8CC390D68E8E439980B560E721F8167F"><enum>7.</enum><header>Clarification of
			 crime of illegal gratuities</header>
			<subsection id="HB53FA716333E4E0582533B18B433FD71"><enum>(a)</enum><header>Definition</header><text>Section
			 201(a) of title 18, United states Code, is amended—</text>
				<paragraph id="H2F377FAE433C47A0B086A15D5FC8C28A"><enum>(1)</enum><text>in paragraph (2),
			 by striking <quote>and</quote> after the semicolon;</text>
				</paragraph><paragraph id="H845038FC15BB403BA9D93B2BAFDA2A36"><enum>(2)</enum><text>in paragraph (3),
			 by striking the period and inserting <quote>; and</quote>; and</text>
				</paragraph><paragraph id="H19568401CAC84FE4A828B59D3FA198AC"><enum>(3)</enum><text>by inserting at
			 the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H79FA5A8DBD2847ED938E908A8FA678A5" style="OLC">
						<paragraph id="HD82123F5410244E9BE502DE9A8302B9C"><enum>(4)</enum><text>the term
				<quote>rule or regulation</quote> means a Federal regulation or a rule of the
				House of Representatives or the Senate, including those rules and regulations
				governing the acceptance of campaign
				contributions.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H29B6BF7BFED74916950ACD4D8BCD8406"><enum>(b)</enum><header>Clarification</header><text display-inline="yes-display-inline">Section 201(c)(1) of title 18, United
			 States Code, is amended—</text>
				<paragraph id="HFEAF92A30CCE44FABDC0A8A29821E0E9"><enum>(1)</enum><text>by striking the
			 matter before subparagraph (A) and inserting <quote>otherwise than as provided
			 by law for the proper discharge of official duty, or by rule or
			 regulation—</quote>;</text>
				</paragraph><paragraph id="H79903B49CC3948129B92765A0F57CE98"><enum>(2)</enum><text>in subparagraph
			 (A), by inserting after <quote>, or person selected to be a public
			 official,</quote> the following: <quote>for or because of the official’s or
			 person’s official position,</quote>; and</text>
				</paragraph><paragraph id="HAF972E96B0E94F23A64F3EBC76D5C647"><enum>(3)</enum><text>in subparagraph
			 (B)—</text>
					<subparagraph id="HCE6F1B2F2176433BA433D8F0DA0D2AC6"><enum>(A)</enum><text>by striking
			 <quote>otherwise than as provided by law for the proper discharge of official
			 duty,</quote>; and</text>
					</subparagraph><subparagraph id="H017784AFE0DC4C06B40141A211704222"><enum>(B)</enum><text>by striking all
			 after <quote>anything of value personally</quote> and inserting <quote>for or
			 because of the official’s or person’s official position, or for or because of
			 any official act performed or to be performed by such official or
			 person;</quote>.</text>
					</subparagraph></paragraph></subsection></section><section id="H163DF2E90EE44095944C07FA95BEF637"><enum>8.</enum><header>Clarification of
			 definition of official Act</header><text display-inline="no-display-inline">Section 201(a)(3) of title 18, United States
			 Code, is amended to read as follows:</text>
			<quoted-block id="HB4AD62CE416F419EB4902B4B7008B000" style="OLC">
				<paragraph id="HDD9EFF4DAA58406B8ECA6656B7178310"><enum>(3)</enum><text>the term
				<term>official act</term>—</text>
					<subparagraph id="HA4B4345142EB49B4BD31BF9C2A19324D"><enum>(A)</enum><text>means any action
				within the range of official duty, and any decision or action on any question,
				matter, cause, suit, proceeding or controversy, which may at any time be
				pending, or which may by law be brought before any public official, in such
				public official’s official capacity or in such official’s place of trust or
				profit; and</text>
					</subparagraph><subparagraph id="HA303FBD90D5A47A685C97EE6738D9BF4"><enum>(B)</enum><text>may be a single
				act, more than one act, or a course of conduct;
				and</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HE5D77A4B5EC04497B7AA86393F99DFD4"><enum>9.</enum><header>Authorization for
			 additional personnel to investigate and prosecute public corruption
			 offenses</header><text display-inline="no-display-inline">There are authorized
			 to be appropriated to the Department of Justice, including the United States
			 Attorneys’ Offices, the Federal Bureau of Investigation, and the Public
			 Integrity Section of the Criminal Division, $25,000,000 for each of the fiscal
			 years 2010, 2011, 2012, and 2013, to increase the number of personnel to
			 investigate and prosecute public corruption offenses including sections 201,
			 203 through 209, 641, 654, 666, 1001, 1341, 1343, 1346, and 1951 of title 18,
			 United States Code.</text>
