<section id="H6AB43F16B17845B396827E13B1BC9FC0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Paterson Great Falls National Historical Park Act</short-title></quote>.</text></section>
<section id="H8F39EAD9E119431585C4CD4522E409ED"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="H2973E3DEB44145AD97984D4BCDD74779"><enum>(1)</enum><header>City</header><text>The term <term>City</term> means the City of Paterson, New Jersey.</text></paragraph>
<paragraph id="H07C2BCC93DDB481EBAFBC5CBD476BA37"><enum>(2)</enum><header>Commission</header><text>The term <term>Commission</term> means the Paterson Great Falls National Historical Park Advisory Commission established by section 6(a).</text></paragraph>
<paragraph id="HEEB175609763454784E826ED19E77DAE"><enum>(3)</enum><header>Historic district</header><text>The term <term>Historic District</term> means the Great Falls Historic District in the State.</text></paragraph>
<paragraph id="H016163300DCB4B2EA66C001BD085A5B4"><enum>(4)</enum><header>Management plan</header><text>The term <term>management plan</term> means the management plan for the Park developed under section 5.</text></paragraph>
<paragraph id="HD6A89952CCDD4ED09DCF34E00D401D6"><enum>(5)</enum><header>Map</header><text>The term <term>Map</term> means the map entitled <quote>Paterson Great Falls National Historical Park-Proposed Boundary</quote>, numbered T03/80,001, and dated May 2008.</text></paragraph>
<paragraph id="H6C278C66AF69430493636344EB7738FD"><enum>(6)</enum><header>Park</header><text>The term <term>Park</term> means the Paterson Great Falls National Historical Park established by section 3(a).</text></paragraph>
<paragraph id="H7D5267EB12A44346B21B707B98BDF7C"><enum>(7)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph>
<paragraph id="H2FFE71CA61CC4D13B9739BB4DDDA3669"><enum>(8)</enum><header>State</header><text>The term <term>State</term> means the State of New Jersey.</text></paragraph></section>
<section id="H7BD8BDD80E224C2BB0AD81ED08C4FB00"><enum>3.</enum><header>Paterson great falls national historical park</header>
<subsection id="H227392C3C9D64CAC843580C1B3160099"><enum>(a)</enum><header>Establishment</header>
<paragraph id="H090C5F95EFDE440BB050A6CF2F94AB94"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), there is established in the State a unit of the National Park System to be known as the <quote>Paterson Great Falls National Historical Park</quote>.</text></paragraph>
<paragraph id="H9E170C0FD4D34A229912092C40D35C4B"><enum>(2)</enum><header>Conditions for establishment</header><text>The Park shall not be established until the date on which the Secretary determines that—</text>
<subparagraph id="H81191E23393344F7A1FB2F92501D73BA"><enum>(A)</enum>
<clause id="H1E576ECB4F1248F7AB33E5EE7700F17F" display-inline="yes-display-inline"><enum>(i)</enum><text>the Secretary has acquired sufficient land or an interest in land within the boundary of the Park to constitute a manageable unit; or</text></clause>
<clause id="HE5F8B2A3E11E47709002E019C6FB9564" indent="up1"><enum>(ii)</enum><text>the State or City, as appropriate, has entered into a written agreement with the Secretary to donate—</text>
<subclause id="H04017B1E2F954A7ABE6383DD2E8DCD38"><enum>(I)</enum><text>the Great Falls State Park, including facilities for Park administration and visitor services; or</text></subclause>
<subclause id="HC9F60591FEE14231AED012811BFD72F2"><enum>(II)</enum><text>any portion of the Great Falls State Park agreed to between the Secretary and the State or City; and</text></subclause></clause></subparagraph>
<subparagraph id="H39C1C8511DEE44E685682D75C3053CC8"><enum>(B)</enum><text>the Secretary has entered into a written agreement with the State, City, or other public entity, as appropriate, providing that—</text>
<clause id="H1FFB4021C2E74D60A52932ED4711EB7E"><enum>(i)</enum><text>land owned by the State, City, or other public entity within the Historic District will be managed consistent with this Act; and</text></clause>
<clause id="HD1F3B044290C426296CC90855F2F49E0"><enum>(ii)</enum><text>future uses of land within the Historic District will be compatible with the designation of the Park.</text></clause></subparagraph></paragraph></subsection>
<subsection id="HE0BF0058003F4FD99756D0276F3E2482"><enum>(b)</enum><header>Purpose</header><text>The purpose of the Park is to preserve and interpret for the benefit of present and future generations certain historical, cultural, and natural resources associated with the Historic District.</text></subsection>
<subsection id="HCE23EAFF9CCF406F8E134EAD00D521B7"><enum>(c)</enum><header>Boundaries</header><text>The Park shall include the following sites, as generally depicted on the Map:</text>
<paragraph id="H9ED1DA04357C4DD48448575EABB782AB"><enum>(1)</enum><text>The upper, middle, and lower raceways.</text></paragraph>
<paragraph id="H4C65F29E7CCC49A09F7E4104546F1573"><enum>(2)</enum><text>Mary Ellen Kramer (Great Falls) Park and adjacent land owned by the City.</text></paragraph>
<paragraph id="HFF9F4E4B96744CF881F6BE627EDA45BF"><enum>(3)</enum><text>A portion of Upper Raceway Park, including the Ivanhoe Wheelhouse and the Society for Establishing Useful Manufactures Gatehouse.</text></paragraph>
<paragraph id="HA15C7A21EA064D8FB9B1A4F5ED44B285"><enum>(4)</enum><text>Overlook Park and adjacent land, including the Society for Establishing Useful Manufactures Hydroelectric Plant and Administration Building.</text></paragraph>
<paragraph id="HA4F1DAAC66624187AC6ECB1FA67F04E"><enum>(5)</enum><text>The Allied Textile Printing site, including the Colt Gun Mill ruins, Mallory Mill ruins, Waverly Mill ruins, and Todd Mill ruins.</text></paragraph>
<paragraph id="HA0E9501421E747658CEE444BA978F388"><enum>(6)</enum><text>The Rogers Locomotive Company Erecting Shop, including the Paterson Museum.</text></paragraph>
<paragraph id="H946F2DFFD04B4588AFDB8657EC07F34E"><enum>(7)</enum><text>The Great Falls Visitor Center.</text></paragraph></subsection>
<subsection id="H00A59B9266624045999C1DDEBBEF2249"><enum>(d)</enum><header>Availability of map</header><text>The Map shall be on file and available for public inspection in the appropriate offices of the National Park Service.</text></subsection>
<subsection id="HC312EC5F37EA426EBF0097B77406AC2D"><enum>(e)</enum><header>Publication of notice</header><text>Not later than 60 days after the date on which the conditions in subparagraphs (A) and (B) of subsection (a)(2) are satisfied, the Secretary shall publish in the Federal Register notice of the establishment of the Park, including an official boundary map for the Park.</text></subsection></section>
<section id="H8FE208EA18D747A3BD29252F66CA60A2"><enum>4.</enum><header>Administration</header>
<subsection id="HB5FE767D050F446400C49228C289F0FE"><enum>(a)</enum><header>In general</header><text>The Secretary shall administer the Park in accordance with—</text>
<paragraph id="H246AD3617B5F4C638552179B70784173"><enum>(1)</enum><text>this Act; and</text></paragraph>
<paragraph id="HD81F824023894FEDB889B2DCE0871CCE"><enum>(2)</enum><text>the laws generally applicable to units of the National Park System, including—</text>
<subparagraph id="H1FA66292F3354392A476583EDBC0CCE8"><enum>(A)</enum><text>the National Park Service Organic Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1">16 U.S.C. 1 et seq.</external-xref>); and</text></subparagraph>
<subparagraph id="H139239946BA349D0BE5CD06ED3C12E1D"><enum>(B)</enum><text>the Act of August 21, 1935 (<external-xref legal-doc="usc" parsable-cite="usc/16/461">16 U.S.C. 461 et seq.</external-xref>).</text></subparagraph></paragraph></subsection>
<subsection id="H548E604F76124DA5AC136C322BFC6DE7"><enum>(b)</enum><header>State and local jurisdiction</header><text>Nothing in this Act enlarges, diminishes, or modifies any authority of the State, or any political subdivision of the State (including the City)—</text>
<paragraph id="H194E16A0D4734179B94C7E38574FE0CE"><enum>(1)</enum><text>to exercise civil and criminal jurisdiction; or</text></paragraph>
<paragraph id="HBCB7CDF9FB31469CAE2EBDD83E622701"><enum>(2)</enum><text>to carry out State laws (including regulations) and rules on non-Federal land located within the boundary of the Park.</text></paragraph></subsection>
<subsection id="HECD5E90CA37F4DE59790D4ECC6A7FEC9"><enum>(c)</enum><header>Cooperative Agreements</header>
<paragraph id="H70A3798C0F104C389EC08CDB841E8902"><enum>(1)</enum><header>In general</header><text>As the Secretary determines to be appropriate to carry out this Act, the Secretary may enter into cooperative agreements with the owner of the Great Falls Visitor Center or any nationally significant properties within the boundary of the Park under which the Secretary may identify, interpret, restore, and provide technical assistance for the preservation of the properties.</text></paragraph>
<paragraph id="H7A24C075E21E45EA94AB31F0C4759674"><enum>(2)</enum><header>Right of access</header><text>A cooperative agreement entered into under paragraph (1) shall provide that the Secretary, acting through the Director of the National Park Service, shall have the right of access at all reasonable times to all public portions of the property covered by the agreement for the purposes of—</text>
<subparagraph id="H2DECDDEC83674DC5A5044D2D00631468"><enum>(A)</enum><text>conducting visitors through the properties; and</text></subparagraph>
<subparagraph id="H8F4EA19438ED4A9A8496DDAF5B6337FB"><enum>(B)</enum><text>interpreting the properties for the public.</text></subparagraph></paragraph>
<paragraph id="HE60655994B6344088C48D5435513E4E"><enum>(3)</enum><header>Changes or alterations</header><text>No changes or alterations shall be made to any properties covered by a cooperative agreement entered into under paragraph (1) unless the Secretary and the other party to the agreement agree to the changes or alterations.</text></paragraph>
<paragraph id="H2086739B58184AA084766B5F8C829E08"><enum>(4)</enum><header>Conversion, use, or disposal</header><text>Any payment made by the Secretary under this subsection shall be subject to an agreement that the conversion, use, or disposal of a project for purposes contrary to the purposes of this Act, as determined by the Secretary, shall entitle the United States to reimbursement in amount equal to the greater of—</text>
<subparagraph id="HAD92204741DF441DAD942BF8B089168"><enum>(A)</enum><text>the amounts made available to the project by the United States; or</text></subparagraph>
<subparagraph id="H88F5BA026CDD4EC0A019232E9B002F51"><enum>(B)</enum><text>the portion of the increased value of the project attributable to the amounts made available under this subsection, as determined at the time of the conversion, use, or, disposal.</text></subparagraph></paragraph>
<paragraph id="HC300AF57C6AB4BC48708343B5F2F5B70"><enum>(5)</enum><header>Matching funds</header>
<subparagraph id="H7599B8EF15B44BD0B4D6248CA2018586"><enum>(A)</enum><header>In general</header><text>As a condition of the receipt of funds under this subsection, the Secretary shall require that any Federal funds made available under a cooperative agreement shall be matched on a 1-to-1 basis by non-Federal funds.</text></subparagraph>
<subparagraph id="H67F03F49EC2C43F08129D0CE14B91258"><enum>(B)</enum><header>Form</header><text>With the approval of the Secretary, the non-Federal share required under subparagraph (A) may be in the form of donated property, goods, or services from a non-Federal source.</text></subparagraph></paragraph></subsection>
<subsection id="H20000B5C4B48494CA31FCFFF68CADE10"><enum>(d)</enum><header>Acquisition of Land</header>
<paragraph id="HE35018FE4CD04CA08FFE00A66105BA4D"><enum>(1)</enum><header>In general</header><text>The Secretary may acquire land or interests in land within the boundary of the Park by donation, purchase from a willing seller with donated or appropriated funds, or exchange.</text></paragraph>
<paragraph id="H28B6825D29F2407A95019802D2C024D4"><enum>(2)</enum><header>Donation of state owned land</header><text>Land or interests in land owned by the State or any political subdivision of the State may only be acquired by donation.</text></paragraph></subsection>
<subsection id="H579094015D4440A9AC23511537B09070"><enum>(e)</enum><header>Technical assistance and public interpretation</header><text>The Secretary may provide technical assistance and public interpretation of related historic and cultural resources within the boundary of the Historic District.</text></subsection></section>
<section id="HD71C6BF1B6614829A090A61600B364F3"><enum>5.</enum><header>Management plan</header>
<subsection id="H2FA01A826A134E9B9EB011E89B422974"><enum>(a)</enum><header>In general</header><text>Not later than 3 fiscal years after the date on which funds are made available to carry out this section, the Secretary, in consultation with the Commission, shall complete a management plan for the Park in accordance with—</text>
<paragraph id="H2E6B00B32BEA4D1BB29F1C01CE9D48FF"><enum>(1)</enum><text>section 12(b) of <external-xref legal-doc="public-law" parsable-cite="pl/91/383">Public Law 91–383</external-xref> (commonly known as the <quote>National Park Service General Authorities Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/16/1a">16 U.S.C. 1a–7(b)</external-xref>); and</text></paragraph>
<paragraph id="H45BEC401DB674B1E9355753BE5C4B75"><enum>(2)</enum><text>other applicable laws.</text></paragraph></subsection>
<subsection id="H828BA5D379C343679FD5531C54D94814"><enum>(b)</enum><header>Cost share</header><text>The management plan shall include provisions that identify costs to be shared by the Federal Government, the State, and the City, and other public or private entities or individuals for necessary capital improvements to, and maintenance and operations of, the Park.</text></subsection>
<subsection id="H630DC15DD0464CD69E2D9669F8EBF2AA"><enum>(c)</enum><header>Submission to congress</header><text>On completion of the management plan, the Secretary shall submit the management plan to—</text>
<paragraph id="H1CC16EA84A6E4C538E6314F875FA0033"><enum>(1)</enum><text>the Committee on Energy and Natural Resources of the Senate; and</text></paragraph>
<paragraph id="H81F9ACC446A54D4600E937FE5012CAA"><enum>(2)</enum><text>the Committee on Natural Resources of the House of Representatives.</text></paragraph></subsection></section>
<section id="HEA6CD9AEAF654ADABD7BE3D37CAFC600"><enum>6.</enum><header>Paterson Great Falls National Historical Park Advisory Commission</header>
<subsection id="HAD9624D4E2A5416084CE004254DCAB7D"><enum>(a)</enum><header>Establishment</header><text>There is established a commission to be known as the <quote>Paterson Great Falls National Historical Park Advisory Commission</quote>.</text></subsection>
<subsection id="H24B71B45DCB246F6A494992E1331A91"><enum>(b)</enum><header>Duties</header><text>The duties of the Commission shall be to advise the Secretary in the development and implementation of the management plan.</text></subsection>
<subsection id="H852DCEDD3A4A4101AD8BB9F4D0DEFC14"><enum>(c)</enum><header>Membership</header>
<paragraph id="H7F5D5C7494FB49EBAAFB8DE675FFC4AE"><enum>(1)</enum><header>Composition</header><text>The Commission shall be composed of 9 members, to be appointed by the Secretary, of whom—</text>
<subparagraph id="HEBF7E3CBCB704B7C9FCF61C62BB78BC8"><enum>(A)</enum><text>4 members shall be appointed after consideration of recommendations submitted by the Governor of the State;</text></subparagraph>
<subparagraph id="H118DE25E99604DD4BD69AF6B1B134C14"><enum>(B)</enum><text>2 members shall be after consideration of recommendations submitted by the City Council of Paterson, New Jersey;</text></subparagraph>
<subparagraph id="H67B94F605F9643A6B8A317D8522562C6"><enum>(C)</enum><text>1 member shall be after consideration of recommendations submitted by the Board of Chosen Freeholders of Passaic County, New Jersey; and</text></subparagraph>
<subparagraph id="HB0ABC5819FF04D8EB1F88E62FE766131"><enum>(D)</enum><text>2 members shall have experience with national parks and historic preservation.</text></subparagraph></paragraph>
<paragraph id="HDD73EC7D365C4EAAA8C9D00F08C2D4"><enum>(2)</enum><header>Initial appointments</header><text>The Secretary shall appoint the initial members of the Commission not later than the earlier of—</text>
<subparagraph id="H03862282EECD49ECB6164C44D35036E9"><enum>(A)</enum><text>the date that is 30 days after the date on which the Secretary has received all of the recommendations for appointments under paragraph (1); or</text></subparagraph>
<subparagraph id="H699428EAE2B247BF0016964759EF63A6"><enum>(B)</enum><text>the date that is 30 days after the Park is established in accordance with section 3.</text></subparagraph></paragraph></subsection>
<subsection id="H6FCD2147113C47FC89A33DD95F612300"><enum>(d)</enum><header>Term; Vacancies</header>
<paragraph id="H8A5840331ADB4CFDA833D882847E621D"><enum>(1)</enum><header>Term</header>
<subparagraph id="HF866733F5AD548FABA6031C88EDAAA39"><enum>(A)</enum><header>In general</header><text>A member shall be appointed for a term of 3 years.</text></subparagraph>
<subparagraph id="HA908F3CD4457452A94C8BAB20091CED5"><enum>(B)</enum><header>Reappointment</header><text>A member may be reappointed for not more than 1 additional term.</text></subparagraph></paragraph>
<paragraph id="H2DEE60F201BF4AF4A319A38FDBA3532"><enum>(2)</enum><header>Vacancies</header><text>A vacancy on the Commission shall be filled in the same manner as the original appointment was made.</text></paragraph></subsection>
<subsection id="H64E2E34B750B4F5497FAF681A122A0F8"><enum>(e)</enum><header>Meetings</header><text>The Commission shall meet at the call of—</text>
<paragraph id="HD1FF4E2EB2344A30A73924AFD8563656"><enum>(1)</enum><text>the Chairperson; or</text></paragraph>
<paragraph id="HA5092F25632B4DD09803F68E43DD8276"><enum>(2)</enum><text>a majority of the members of the Commission.</text></paragraph></subsection>
<subsection id="H89DC47D449A346D8A9FACFDA1490D005"><enum>(f)</enum><header>Quorum</header><text>A majority of the Commission shall constitute a quorum.</text></subsection>
<subsection id="H4CDB475C1F054D0096D595182CEC77C2"><enum>(g)</enum><header>Chairperson and Vice Chairperson</header>
<paragraph id="HE74C991D38474CD59FA2A100BFDCEF2E"><enum>(1)</enum><header>In general</header><text>The Commission shall select a Chairperson and Vice Chairperson from among the members of the Commission.</text></paragraph>
<paragraph id="HAF062B88A50B4CCE97C4071825EE1019"><enum>(2)</enum><header>Vice chairperson</header><text>The Vice Chairperson shall serve as Chairperson in the absence of the Chairperson.</text></paragraph>
<paragraph id="H4D19AF9DBCFB47A383C4C94D022FAD60"><enum>(3)</enum><header>Term</header><text>A member may serve as Chairperson or Vice Chairman for not more than 1 year in each office.</text></paragraph></subsection>
<subsection id="HB360A27B07594C1087FD171297DE02F"><enum>(h)</enum><header>Commission Personnel Matters</header>
<paragraph id="HF5EBD820FAC048109733B872A4A6ACFF"><enum>(1)</enum><header>Compensation of members</header>
<subparagraph id="H145DFD74D38F4F8A8E7E8E32A4C91C69"><enum>(A)</enum><header>In general</header><text>Members of the Commission shall serve without compensation.</text></subparagraph>
<subparagraph id="HA5C3B2585F35416F92A7C9586600003E"><enum>(B)</enum><header>Travel expenses</header><text>Members of the Commission shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for an employee of an agency under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from the home or regular place of business of the member in the performance of the duties of the Commission.</text></subparagraph></paragraph>
<paragraph id="H82E18BEEF8EA47E990F8006B612CACE9"><enum>(2)</enum><header>Staff</header>
<subparagraph id="HA8176DE1BF1A4A63939F3E65A95231CA"><enum>(A)</enum><header>In general</header><text>The Secretary shall provide the Commission with any staff members and technical assistance that the Secretary, after consultation with the Commission, determines to be appropriate to enable the Commission to carry out the duties of the Commission.</text></subparagraph>
<subparagraph id="H1D47E8604EB64CE7A59B7708BEFBED98"><enum>(B)</enum><header>Detail of employees</header><text>The Secretary may accept the services of personnel detailed from—</text>
<clause id="HD004569772CA4AF394B64200F451A11D"><enum>(i)</enum><text>the State;</text></clause>
<clause id="HD423332496034CD1A6C4AB7F12B7E965"><enum>(ii)</enum><text>any political subdivision of the State; or</text></clause>
<clause id="H3F3FB6107CF04BAEBE77B680F4E81177"><enum>(iii)</enum><text>any entity represented on the Commission.</text></clause></subparagraph></paragraph></subsection>
<subsection id="H55EB300F64C349319464F4C48834BA"><enum>(i)</enum><header>FACA nonapplicability</header><text>Section 14(b) of the Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Commission.</text></subsection>
<subsection id="HEE910BDD48F2479599CDFF0019530304"><enum>(j)</enum><header>Termination</header><text>The Commission shall terminate 10 years after the date of enactment of this Act.</text></subsection></section>
<section id="H8E4A1E2B872B41CFA82561B1AF8C135D"><enum>7.</enum><header>Study of Hinchliffe Stadium</header>
<subsection id="H21022F637CD64A2E93634FAFB93C8EAB"><enum>(a)</enum><header>In general</header><text>Not later than 3 fiscal years after the date on which funds are made available to carry out this Act, the Secretary shall complete a study regarding the preservation and interpretation of Hinchliffe Stadium, which is listed on the National Register of Historic Places.</text></subsection>
<subsection id="H256E9FB45E62481695575C7D9C8EF892"><enum>(b)</enum><header>Inclusions</header><text>The study shall include an assessment of—</text>
<paragraph id="HE6210CE566AB4980A76580A5B416563"><enum>(1)</enum><text>the potential for listing the stadium as a National Historic Landmark; and</text></paragraph>
