		<section id="HCA8856632BC44F2383315E03880FE122" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Fracturing Responsibility and
			 Awareness of Chemicals Act of 2009</short-title></quote> .</text>
		</section><section id="H41179427C11B45D8912B640B1C5138F9" section-type="subsequent-section"><enum>2.</enum><header>Regulation of
			 hydraulic fracturing</header>
			<subsection id="H40769B5095284A5C90951C718C7FD756"><enum>(a)</enum><header>Hydraulic
			 fracturing</header><text display-inline="yes-display-inline">Section 1421(d)(1)
			 of the Safe Drinking Water Act (42 U.S.C. 300h(d)(1)) is amended by striking
			 subparagraph (B) and inserting:</text>
				<quoted-block display-inline="no-display-inline" id="HC580D223A1FF4EE29569152117CEE74B" style="OLC">
					<subparagraph id="H1BD8C2F7337C4976B51E6B26A231F4B7"><enum>(B)</enum><text display-inline="yes-display-inline">includes the underground injection of
				fluids or propping agents pursuant to hydraulic fracturing operations related
				to oil and gas production activities; but</text>
					</subparagraph><subparagraph id="HBE991410D234478A8C90BB6742C4C011"><enum>(C)</enum><text display-inline="yes-display-inline">excludes the underground injection of
				natural gas for purposes of
				storage.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HC7CF80036D2948DF8109F5C4CF4449F7"><enum>(b)</enum><header>Disclosure</header><text display-inline="yes-display-inline">Section 1421(b) of the Safe Drinking Water
			 Act (42 U.S.C. 300h(b)) is amended as follows:</text>
				<paragraph id="H4552E849B61748BE8554F32C94F7B2C1"><enum>(1)</enum><text>In subparagraph
			 (C) of paragraph (1) insert before the semicolon <quote>, including a
			 requirement that any person using hydraulic fracturing disclose to the State
			 (or the Administrator if the Administrator has primary enforcement
			 responsibility in the State) the chemical constituents (but not the proprietary
			 chemical formulas) used in the fracturing process</quote>.</text>
				</paragraph><paragraph id="HAB96B29F78A741009BBC7D87EB743D03"><enum>(2)</enum><text>Add the following
			 new paragraph at the end thereof:</text>
					<quoted-block display-inline="no-display-inline" id="HAA2A1A74C9FC41FF80662B4B2E643EBE" style="traditional">
						<paragraph id="HB767E22E8D6F438AAF97BC73C3936277"><enum>(4)</enum><text display-inline="yes-display-inline">The State (or Administrator) shall make the
				disclosure of chemical constituents referred to in subparagraph (C) of
				paragraph (1) available to the public, including a posting of the information
				on an appropriate Internet website. In addition, whenever the State or the
				Administrator, or a treating physician or nurse, determines that a medical
				emergency exists and the proprietary chemical formulas or specific chemical
				identity of a chemical used in hydraulic fracturing is necessary for emergency
				or first-aid treatment, the person using hydraulic fracturing shall immediately
				disclose the proprietary chemical formulas or the specific chemical identity of
				a trade secret chemical to the State, the Administrator, or that treating
				physician or nurse, regardless of the existence of a written statement of need
				or a confidentiality agreement. The person using hydraulic fracturing may
				require a written statement of need and a confidentiality agreement as soon
				thereafter as circumstances
				permit.</text>
