		  recognition and enforcement of foreign defamation judgments and certain foreign
		  judgments against the providers of interactive computer

		<section id="H36CAB63B4C31426A85FBAE55CF4FDDA8" section-type="section-one"><enum>1.</enum><header>Recognition of foreign
			 defamation judgments</header>
			<subsection id="HB360E56C560B44B700C75BCB8D1F24C8"><enum>(a)</enum><header>In
			 General</header><text>Part VI of title 28, United States Code, is amended by
			 adding at the end the following:</text>

						<section id="H9E09C330508745C2B982B4A700A800E8"><enum>4101.</enum><header>Definitions</header><text display-inline="no-display-inline">In this chapter:</text>
							<paragraph id="H9813492CC56A42B7A08E191D003F85A9"><enum>(1)</enum><header>Domestic
				court</header><text>The term <quote>domestic court</quote> means a Federal
				court or a court of any State.</text>
							</paragraph><paragraph id="H6B4439DA15C246C8BE19E4C80076AFC5"><enum>(2)</enum><header>Foreign
				court</header><text>The term <quote>foreign court</quote> means a court,
				administrative body, or other tribunal of a foreign country.</text>
							</paragraph><paragraph id="H89A21DF58A4047FAB4C9BB7F52E10056"><enum>(3)</enum><header>Foreign
				judgment</header><text>The term <quote>foreign judgment</quote> means a final
				judgment rendered by a foreign court.</text>
							</paragraph><paragraph id="HC595690C1F374479BDB63C51C870C37A"><enum>(4)</enum><header>State</header><text>The
				term <quote>State</quote> means each of the several States, the District of
				Columbia, and any commonwealth, territory, or possession of the United
				States.</text>
							</paragraph></section><section id="HE1EC941D9223412EA1B6D9E8119D1100"><enum>4102.</enum><header>Recognition of
				foreign defamation judgments</header>
							<subsection id="H190C37C7ECCF491F82133F339CB0A053"><enum>(a)</enum><header>First amendment
				considerations</header><text display-inline="yes-display-inline">Notwithstanding any other provision of
				Federal or State law, a domestic court shall not recognize or enforce a foreign
				judgment for defamation whenever the party opposing recognition or enforcement
				of the judgment claims that the judgment is inconsistent with the first
				amendment to the Constitution of the United States, unless the domestic court
				determines that the judgment is consistent with the first amendment. The burden
				of establishing that the foreign judgment is consistent with the first
				amendment shall lie with the party seeking recognition or enforcement of the
				judgment.</text>
							</subsection><subsection id="H32170A5CE91A4E9BA691B1F5C5F04EBC"><enum>(b)</enum><header>Jurisdictional
				considerations</header><text display-inline="yes-display-inline">Notwithstanding any other provision of
				Federal or State law, a domestic court shall not recognize or enforce a foreign
				judgment for defamation if the party opposing recognition or enforcement
				establishes that the exercise of personal jurisdiction over such party by the
				foreign court that rendered the judgment failed to comport with the due process
				requirements imposed on domestic courts by the Constitution of the United
				States.</text>
							</subsection><subsection id="HEB065B7871DD4B8CB1911E09241674E1"><enum>(c)</enum><header>Judgment against
				provider of interactive computer service</header><text display-inline="yes-display-inline">Notwithstanding any other provision of
				Federal or State law, a domestic court shall not recognize or enforce a foreign
				judgment for defamation against the provider of an interactive computer
				service, as defined in section 230 of the Communications Act of 1934 (47 U.S.C.
				230), whenever the party opposing recognition or enforcement of the judgment
				claims that the judgment is inconsistent with such section 230, unless the
				domestic court determines that the judgment is consistent with such section
				230. The burden of establishing that the foreign judgment is consistent with
				such section 230 shall lie with the party seeking recognition or enforcement of
				the judgment.</text>
							</subsection><subsection id="H2F32E914858F4A1F921924346EE4EAFE"><enum>(d)</enum><header>Appearances not
				a bar</header><text display-inline="yes-display-inline">An appearance by a
				party in a foreign court rendering a foreign judgment to which this section
				applies for the purpose of contesting the foreign court’s exercise of
				jurisdiction in the case, moving the foreign court to abstain from exercising
				jurisdiction in the case, defending on the merits any claims brought before the
				foreign court, or for any other purpose, shall not deprive such party of the
				right to oppose the recognition or enforcement of the judgment under this
				section.</text>
							</subsection></section><section id="HEB364F3A9C424E5DA0C5FF5C25629FA8"><enum>4103.</enum><header>Attorneys’
				fees</header><text display-inline="no-display-inline">In any action brought in
				a domestic court to enforce a foreign judgment for defamation, the court may
				allow the party opposing recognition or enforcement of the judgment a
				reasonable attorney’s fee if such party prevails in the action on a ground
				specified in subsection (a), (b), or
				(c).</text>

			</subsection><subsection id="H17CCE7260EC54A33911F9E7E00A8D1FD"><enum>(b)</enum><header>Clerical
			 Amendment</header><text>The table of chapters for part VI of title 28, United
			 States Code, is amended by adding at the end the following:</text>
