		<official-title>To amend the Internal Revenue Code of 1986 to allow
		  eligible veterans to use qualified veterans mortgage bonds to refinance home
		  loans, and for other purposes.</official-title>

		<section id="H62F6D737541E4283AD4B029B5CE1B526" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Veterans Home Loan Refinance
			 Opportunity Act of 2009</short-title></quote>.</text>
		</section><section id="HC40FBC989CB5412FBA3B96F200F67037"><enum>2.</enum><header>Modification of
			 qualified veterans’ mortgage bonds program to allow eligible veterans to
			 refinance current home loans</header>
			<subsection id="HDF0D1132765A48209FABDCC50714531"><enum>(a)</enum><header>Elimination of
			 refinance prohibition for veterans’ bonds</header><text display-inline="yes-display-inline">Section 143(b) of the Internal Revenue Code
			 of 1986 (relating to qualified veterans’ mortgage bond defined) is
			 amended—</text>
				<paragraph id="HCAE31B353CC7474D8BA3E1FFA178ACE3"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1) by striking
			 <quote>residences</quote> and inserting <quote>residences or qualified
			 refinancing loans</quote>; and</text>
				</paragraph><paragraph id="HD305DE7CDBF842D2BA6ECC8C746EA806"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (3) by striking
			 <quote>(i)(1),</quote>.</text>
				</paragraph></subsection><subsection id="HF0934E453E774587B25A5F1CB89D4767"><enum>(b)</enum><header>Definition</header><text display-inline="yes-display-inline">Section 143(l) of the Internal Revenue Code
			 of 1986 (relating to additional requirements for qualified veterans’ mortgage
			 bonds) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HB5A7AD23D7264472A27DD380741DA81C" style="OLC">
					<paragraph id="H437613B55C5B4E00A3F286C32D970EA5"><enum>(6)</enum><header>Qualified
				refinancing loan</header><text display-inline="yes-display-inline">For purposes
				of this subsection, the term <term>qualified refinancing loan</term> means a
				loan that is used to refinance acquisition indebtedness (as defined in
				subclauses (I) and (II) of section 163(h)(3)(B)(i)) for a principal residence
				(within the meaning of section 121).</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H74A5B17D704B4818AC63BE34D5339272"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to bonds
			 issued after the date of enactment of this Act.</text>
			</subsection></section><section id="H88543E0774DD4A14B9CBB44D1C4DB21"><enum>3.</enum><header>Inflation
			 adjustment of state veterans limit</header>
			<subsection id="H62DFCD4553CD47B7B7EF003BF0274E87"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Paragraph (3) of
			 section 143(l) of the Internal Revenue Code of 1986 (relating to volume
			 limitation) is amended by adding at the end the following new
			 subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="H024C3A1BDBB64BB00094D45F53860218" style="OLC">
					<subparagraph id="H28716E9AFBBB4D97A861BFC0E8F637ED"><enum>(D)</enum><header>Limitation
				adjustment based on inflation</header>
						<clause id="H1B9DFADDF10B4BD39715A7F21B55E989"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">In the case of any
				calendar year after 2010, the limit determined under subparagraph (B) for a
				State shall be adjusted for such calendar year by multiplying such limit by the
				inflation adjustment factor for the calendar year.</text>
						</clause><clause id="HD492AC73286949FAAB1C34221100044E"><enum>(ii)</enum><header>Computation of
				inflation adjustment factor</header><text display-inline="yes-display-inline">For purposes of clause (i)—</text>
							<subclause id="HA7BD3CABC1CC4AC989ED94AB679054E8"><enum>(I)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary shall,
				not later than each October 1, determine and publish in the Federal Register
				the inflation adjustment factor for the succeeding calendar year in accordance
				with this clause.</text>
							</subclause><subclause id="HDE659BC389294F9ABDE8D871E3ABD0DA"><enum>(II)</enum><header>Inflation
				adjustment factor</header><text>The term <term>inflation adjustment
				factor</term> means, with respect to a calendar year, a fraction the numerator
				of which is the CMHPI for the second quarter of the calendar year preceding the
				calendar year for which the adjustment is being made, and the denominator of
				which is the CMHPI for the second quarter of calendar year 2009.</text>
							</subclause><subclause id="H33923245EA8E42B3B365C2CBC1F9B035"><enum>(III)</enum><header>CMHPI</header><text>The
				term <term>CMHPI</term> means the Conventional Mortgage Home Price Index
				compiled by Federal Home Loan Mortgage Corporation. The CMHPI for any quarter
				shall be the CMHPI first published for such quarter.</text>
							</subclause><subclause commented="no" id="H0470EE4E3D5C4DC896F3F8C4A98F2C8F"><enum>(IV)</enum><header>Limitation</header><text>No
				adjustment shall be made under clause (i) for any year in which the fraction in
				subclause (II) is less than 1.</text>
							</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H028145661A0B47FE9B2DCDF56C13AC4E"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply to bonds issued after the date of the enactment of
			 this Act.</text>
			</subsection></section><section id="HB43F77424C3A441FA0571E79E6A39671"><enum>4.</enum><header>Modification of
			 materially higher yield for mortgages made from qualified veterans’ mortgage
			 bonds</header>
			<subsection id="H11133400B34B4557AD86B0AFB33F23C4"><enum>(a)</enum><header>Mortgage yield
			 limitation measured under general program obligation provisions</header>
				<paragraph id="HA92A6D12C84E4F8D839593E0373DD661"><enum>(1)</enum><header>Amendment</header><text>Paragraph
			 (3) of section 143(b) of the Internal Revenue Code of 1986 (relating to
			 qualified veterans’ mortgage bond defined) is amended by inserting
			 <quote>(other than paragraph (2) thereof)</quote> after
			 <quote>(g)</quote>.</text>
				</paragraph><paragraph id="H54A549A77E7941A2AA8781DC06557640"><enum>(2)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subparagraph (C) of
			 section 143(g)(3) of the Internal Revenue Code of 1986 (relating to
			 requirements related to arbitrage) is amended by striking <quote>1.125
			 percentage points</quote> and inserting <quote>1.50 percentage points</quote>.</text>
				</paragraph><paragraph id="H2705C18BCF724971B7ED02FAA3C670DA"><enum>(3)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">Section 143(g)(3)
			 of such Code (relating to requirements related to arbitrage) is amended in the
			 heading for subparagraph (C) by striking <quote><header-in-text level="subparagraph" style="OLC">where issuer does not use full 1.125
			 percentage points under paragraph (2)</header-in-text></quote> and inserting
			 <quote><header-in-text level="subparagraph" style="OLC">for certain unused
			 amounts</header-in-text></quote>.</text>
				</paragraph></subsection><subsection id="H16FFC890EB3D46B9B0DAF1BFE668B9EC"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply to obligations issued after the date of the enactment
			 of this Act.</text>
