		  for other purposes.</official-title>

		<section id="HEF0978EADE894ABB8A26EB9F0AF6D486" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Automobile Dealer Economic Rights
			 Restoration Act of 2009</short-title></quote>.</text>
		</section><section id="HEF257EC6D83F45C1A64BAA52158235E1" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text>
			<paragraph id="H70B27617A95F4EAF8BD62D953E9AB9A0"><enum>(1)</enum><text>Automobile dealers
			 are an asset to automobile manufacturers that make it possible to penetrate
			 communities and sell automobiles nationally.</text>
			</paragraph><paragraph id="HB4F3A218EFA84E66A609EA42C79B84FB"><enum>(2)</enum><text>The manufacturers
			 obtain the benefits from having a national dealer network at no material cost
			 to the manufacturers.</text>
			</paragraph><paragraph id="HD347809FB5A7474BB6E4D2BD95A439B5"><enum>(3)</enum><text>Historically,
			 automobile dealers have had franchise agreement protections under State
			 law.</text>
			</paragraph></section><section id="HF987F6806D1A4E46A5F5D18ED9D3352E"><enum>3.</enum><header>Restoration of
			 economic rights</header>
			<subsection id="HC2549C7283A04FE0B36C269BCD1ABB8F"><enum>(a)</enum><header>Preservation of
			 rights</header><text display-inline="yes-display-inline">In order to protect
			 assets of the Federal Government, and better assure the viability of automobile
			 manufacturers in which the Federal Government has an ownership interest, no
			 automobile manufacturer in which the Federal Government has an ownership
			 interest may deprive an automobile dealer of its economic rights as they
			 existed prior to the commencement of a bankruptcy case by the manufacturer,
			 including its rights to recourse under State law.</text>
			</subsection><subsection id="H2269F12841E049D6AD52FBF6CC386474"><enum>(b)</enum><header>Restoration of
			 franchise agreements</header><text display-inline="yes-display-inline">In order
			 to preserve economic rights pursuant to subsection (a), automobile
			 manufacturers covered under this Act shall restore the franchise agreements
			 with automobile dealers that were in effect prior to the commencement of a
			 bankruptcy case by those manufacturers.</text>
