		<official-title>To provide for the implementation of a system under which
		  each financial institution will report on the financial condition of the
		  institution to the public, and for other purposes.</official-title>

		<section id="H85340E68C84D46E2813B08ED6010C617" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Financial Transparency Restoration
			 Act</short-title></quote>.</text>
		</section><section id="HEF6D6BB24B324F3593B286003EEA29AE"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds as follows:</text>
			<paragraph id="HAE3A8741E79A41088CB2F07CA32F47D3"><enum>(1)</enum><text display-inline="yes-display-inline">For approximately 70 years, national banks
			 were required by an Act of Congress to publish statements of condition in
			 newspapers where they <quote>did business</quote>.</text>
			</paragraph><paragraph id="H8E22847296DD446FAC2FAFEC2105B3FA"><enum>(2)</enum><text>In 1994, this
			 requirement was repealed by an Act of Congress with no public hearing or
			 explanation.</text>
			</paragraph><paragraph id="H12FA60C3E929437592ECFD5CCAA5ACB0"><enum>(3)</enum><text>The public ought
			 to have access to the statements of financial condition of all financial
			 institutions.</text>
			</paragraph></section><section id="H3DA3D97F79B54A3100563E2648F800DC"><enum>3.</enum><header>Restoration of
			 financial transparency</header>
			<subsection id="H101B32D5FC50492A87B69C566BABA800"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this Act, the following
			 definitions shall apply:</text>
				<paragraph id="HCBE9937148A847179000E3D1CF6C7301"><enum>(1)</enum><header>Federal
			 functional regulator</header><text display-inline="yes-display-inline">The term
			 <quote>Federal functional regulator</quote> has the same meaning as in section
			 509(2) of the Gramm-Leach-Bliley Act, except that such term includes—</text>
					<subparagraph id="H2D8164B6E91F46D2A8D4BA4BC8B15A7"><enum>(A)</enum><text>the Commodity
			 Futures Trading Commission, with regard to any person or entity described in
			 section 509(3)(B) of such Act; and</text>
					</subparagraph><subparagraph id="HE0A8D2CCAD4E45DCBBB9260032599F17"><enum>(B)</enum><text>the Board of
			 Governors of the Federal Reserve System, with regard to any financial
			 institution which does not otherwise have a Federal functional regulator under
			 section 509(2) of such Act.</text>
					</subparagraph></paragraph><paragraph id="H54842820EA5E4EF3B2E4FFA0E3BBFAE3"><enum>(2)</enum><header>Financial
			 institution</header><text>The term <quote>financial institution</quote> has the
			 same meaning as in section 509(3) of the Gramm-Leach-Bliley Act, without regard
			 to any exclusions under any subparagraph of such section.</text>
				</paragraph></subsection><subsection id="HCCC3B504B6824730A606880363F3CE53"><enum>(b)</enum><header>Publication of a
			 statement of condition required</header><text display-inline="yes-display-inline">Within 30 days after the end of each fiscal
			 quarter of any financial institution, the financial institution shall publish a
			 statement of financial condition of the financial institution in a newspaper of
			 general paid circulation published in a city or county within each market area
			 in which the financial institution is located, or if no newspaper of general
			 paid circulation is published in such city or county, then the newspaper of
			 general paid circulation published nearest such city or county.</text>
			</subsection><subsection id="H16A70B5F3CE14F879D00E3DD39238D61"><enum>(c)</enum><header>Oath or
			 affirmation of president or designated officer</header><text>Each publication
			 by a financial institution of a statement of financial condition in accordance
			 with subsection (b) shall include a written verification of the accuracy of the
			 statement, under oath or by affirmation, by the president of the financial
			 institution or another officer designated by the board of directors of such
			 institution.</text>
			</subsection><subsection id="HD77B6A7915F44F7286E6298285C5D865"><enum>(d)</enum><header>Form</header><text>In
			 accordance with the joint regulations prescribed under subsection (e), the
			 Federal functional regulator for any type of financial institution shall
			 prescribe the form and content of the statement of financial condition for such
			 type of institution.</text>
			</subsection><subsection id="H8659071F7D404C8AB0AEB6005C57855C"><enum>(e)</enum><header>Regulations</header><text>The
			 Federal functional regulators shall jointly prescribe regulations appropriate
			 to carry out the requirements of this section and ensure compliance with such
			 requirements.</text>
			</subsection><subsection id="HD7003F525F564E73B0CEC000042D59E"><enum>(f)</enum><header>Effective
			 date</header><text>This section shall apply so as to require each financial
			 institution to publish a written statement of financial condition after the end
			 of each fiscal quarter of the institution that begins not less than 30 days
			 after the date of the enactment of this Act.</text>
