<legis-type>A BILL</legis-type> 
<official-title>To prohibit the Department of Housing and Urban Development from providing any assistance to any organization that has been indicted for a violation under Federal or State law relating to an election for Federal or State office.</official-title>

<section id="H798D664F9DA94F249D4C1AC490659B9D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Taxpayer Protection and Anti-Fraud Act of 2009</short-title></quote>.</text></section> 
<section id="H3ED8A2156EFE464E97D96EF71C3B79F3"><enum>2.</enum><header>Prohibition of HUD assistance</header><text display-inline="no-display-inline">The Department of Housing and Urban Development Act (42 U.S.C. 3531 et seq.) is amended by adding at the end the following new section:</text>

<section id="HE27E631EBD0441AEA583DFE8C70DA103"><enum>15.</enum><header>Prohibition of assistance for certain indicted organizations</header> 
<subsection id="HB0095202EFE04F2F8F0D482ADD741C50"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">No HUD financial assistance shall be distributed to—</text> 
<paragraph id="HCF1BD9FAE8AD4D70BCB4DD783317949E"><enum>(1)</enum><text>any organization that has been indicted for a violation under Federal or State law relating to an election for Federal or State office; or</text></paragraph> 
<paragraph id="HE10FF58A65464F8FB391EAEBA45A9CE6"><enum>(2)</enum><text>any organization that—</text> 
<subparagraph id="HC30E84686220479BB6D63EC1A00A1CE0"><enum>(A)</enum><text>employs any applicable individual, in a permanent or temporary capacity;</text></subparagraph> 
<subparagraph id="HA4D2E1B5C9214CE1B6772BC8FCD2D1C8"><enum>(B)</enum><text>has under contract or retains any applicable individual; or</text></subparagraph> 
<subparagraph id="HFCBECF39C2DE462FAC39F87E74167EE6"><enum>(C)</enum><text>has any applicable individual acting on the organization’s behalf or with the express or apparent authority of the organization.</text></subparagraph></paragraph></subsection> 
<subsection id="HCF07B3A3F9814E3FA38133DFFDFB146C"><enum>(b)</enum><header>Definitions</header><text>For purposes of this section, the following definitions shall apply:</text> 
<paragraph id="H48E75897B24548808E78D794ADDF0582"><enum>(1)</enum><header>Applicable individual</header><text>The term <term>applicable individual</term> means an individual who has been indicted for a violation under Federal or State law relating to an election for Federal or State office.</text></paragraph> 
<paragraph id="HE679CA5D14C24A458E9B3E450C450D78"><enum>(2)</enum><header>HUD financial assistance</header><text>The term <term>HUD financial assistance</term> means any grant, loan, subsidy, guarantee, insurance, cooperative agreement, or other form of financial assistance, including any insurance or guarantee of a loan, mortgage, or pool of mortgages, under a program administered by the Secretary of Housing and Urban Development.</text> </paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
