		<section display-inline="no-display-inline" id="H5FB849025C2746E9A75F545BA34C758D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Intelligence Authorization Act for
			 Fiscal Year 2010</short-title></quote>.</text>
		</section><title id="HEEA9FA9653E64D6FB77DAB087E2BB6C7"><enum>I</enum><header>Intelligence
			 activities</header>
			<section id="HA0A3D409210148B6ACEB1C7201232D68"><enum>101.</enum><header>Authorization
			 of appropriations</header><text display-inline="no-display-inline">Funds are
			 hereby authorized to be appropriated for fiscal year 2010 for the conduct of
			 the intelligence and intelligence-related activities of the following elements
			 of the United States Government:</text>
				<paragraph id="H5F5702B4924D4A1994B30761F654AAFC"><enum>(1)</enum><text>The Office of the
			 Director of National Intelligence.</text>
				</paragraph><paragraph id="H1D2304FA6DA74BF3B1DD5E24D7DF0C4C"><enum>(2)</enum><text>The Central
			 Intelligence Agency.</text>
				</paragraph><paragraph id="H4241C3E7BE414A1EA78F7215D242B985"><enum>(3)</enum><text>The Department of
			 Defense.</text>
				</paragraph><paragraph id="H5970643F05DE49BC99498B0C64DD9D8A"><enum>(4)</enum><text>The Defense
			 Intelligence Agency.</text>
				</paragraph><paragraph id="H67C9915AE05B40D8ADD1A9A61228C42A"><enum>(5)</enum><text>The National
			 Security Agency.</text>
				</paragraph><paragraph id="HD10ECAE3DA8745CFBEA9F70AC6A89126"><enum>(6)</enum><text>The Department of
			 the Army, the Department of the Navy, and the Department of the Air

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H41C7C2540A3D48428DD420D57288037D"><enum>(16)</enum><text>The Department of
			 Homeland Security.</text>
				</paragraph></section><section id="H0621CF6CF9814E16B1B7D86B377CB31B"><enum>102.</enum><header>Classified
			 Schedule of Authorizations</header>
				<subsection id="H46335511F88E452AB65EF77E55514838"><enum>(a)</enum><header>Specifications
			 of amounts and personnel levels</header><text display-inline="yes-display-inline">The amounts authorized to be appropriated
			 under section 101 and, subject to section 103, the authorized personnel
			 ceilings as of September 30, 2010, for the conduct of the intelligence
			 activities of the elements listed in paragraphs (1) through (16) of section
			 101, are those specified in the classified Schedule of Authorizations prepared
			 to accompany the bill H.R. __ of the One Hundred Eleventh Congress.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="HBE0CED30E4934DE88B4207AF5CFF95B2"><enum>(b)</enum><header>Availability of
			 classified Schedule of Authorizations</header><text>The classified Schedule of
			 Authorizations referred to in subsection (a) shall be made available to the
			 Committee on Appropriations of the Senate, the Committee on Appropriations of
			 the House of Representatives, and to the President. The President shall provide
			 for suitable distribution of the Schedule, or of appropriate portions of the
			 Schedule, within the executive branch.</text>
				</subsection></section><section id="H96CE7036C3D94E4CB1D2E80171CE5547"><enum>103.</enum><header>Personnel
			 ceiling adjustments</header>
				<subsection id="H9AA85321B82A4A0184CEFA0555C1AECE"><enum>(a)</enum><header>Authority for
			 increases</header><text display-inline="yes-display-inline">With the approval
			 of the Director of the Office of Management and Budget, the Director of
			 National Intelligence may authorize employment of civilian personnel in excess
			 of the number authorized for fiscal year 2010 by the classified Schedule of
			 Authorizations referred to in section 102(a) if the Director of National
			 Intelligence determines that such action is necessary to the performance of
			 important intelligence functions, except that the number of personnel employed
			 in excess of the number authorized under such section may not, for any element
			 of the intelligence community, exceed 3 percent of the number of civilian
			 personnel authorized under such Schedule for such element.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H06394C0C3ADE4C26BD1796A0A8EE9C64"><enum>(b)</enum><header>Notice to
			 congressional intelligence committees</header><text>The Director of National
			 Intelligence shall notify the congressional intelligence committees in writing
			 at least 15 days prior to each exercise of an authority described in subsection
			 (a).</text>
				</subsection></section><section display-inline="no-display-inline" id="H7B298E1BD8264DAAA3BA7E1FF274AC8D" section-type="subsequent-section"><enum>104.</enum><header>Intelligence
			 Community Management Account</header>
				<subsection id="H9B402677970B4C3CB0D06A42266AA999"><enum>(a)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated for the Intelligence Community Management Account
			 of the Director of National Intelligence for fiscal year 2010 the sum of
			 $672,812,000. Within such amount, funds identified in the classified Schedule
			 of Authorizations referred to in section 102(a) for advanced research and
			 development shall remain available until September 30, 2011.</text>
				</subsection><subsection id="H2A44C0A3314C490386E5BCF98123CEF5"><enum>(b)</enum><header>Authorized
			 personnel levels</header><text display-inline="yes-display-inline">The elements
			 within the Intelligence Community Management Account of the Director of
			 National Intelligence are authorized 853 full-time or full-time equivalent
			 personnel as of September 30, 2010. Personnel serving in such elements may be
			 permanent employees of the Office of the Director of National Intelligence or
			 personnel detailed from other elements of the United States Government.</text>
				</subsection><subsection id="HB3F2F5797EBD45AD8E4A497FD5A3A020"><enum>(c)</enum><header>Construction of
			 Authorities</header><text>The authorities available to the Director of National
			 Intelligence under section 103 are also available to the Director for the
			 adjustment of personnel levels within the Intelligence Community Management
			 Account.</text>
				</subsection><subsection id="H3A72D68FE1704D7F929AE69BE64B1C5E"><enum>(d)</enum><header>Classified
			 authorizations</header>
					<paragraph id="HECA6BE597B61463681E6EFE92B1DD6F4"><enum>(1)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">In addition to
			 amounts authorized to be appropriated for the Intelligence Community Management
			 Account by subsection (a), there are authorized to be appropriated for the
			 Community Management Account for fiscal year 2010 such additional amounts as
			 are specified in the classified Schedule of Authorizations referred to in
			 section 102(a). Such additional amounts for advanced research and development
			 shall remain available until September 30, 2011.</text>
					</paragraph><paragraph id="H65799265F13D42C0B6AD592824D70E2B"><enum>(2)</enum><header>Authorization of
			 personnel</header><text display-inline="yes-display-inline">In addition to the
			 personnel authorized by subsection (b) for elements of the Intelligence
			 Community Management Account as of September 30, 2010, there are authorized
			 such additional personnel for the Community Management Account as of that date
			 as are specified in the classified Schedule of Authorizations referred to in
			 section 102(a).</text>
					</paragraph></subsection><subsection id="HD672E10EF2FB400E9A135EA3C54FD1E8"><enum>(e)</enum><header>Reimbursement</header><text>Except
			 as provided in section 113 of the National Security Act of 1947 (50 U.S.C.
			 404h), during fiscal year 2010 any officer or employee of the United States or
			 a member of the Armed Forces who is detailed to the staff of the Intelligence
			 Community Management Account from another element of the United States
			 Government shall be detailed on a reimbursable basis, except that any such
			 officer, employee, or member may be detailed on a nonreimbursable basis for a
			 period of less than one year for the performance of temporary functions as
			 required by the Director of National Intelligence.</text>
				</subsection></section></title><title id="H59508409B8B74F27870DB94E67AD3F3F"><enum>II</enum><header>Central
			 Intelligence Agency Retirement and Disability System</header>
			<section commented="no" display-inline="no-display-inline" id="H6FA1869B776D4AA183A0939F6BB438C2" section-type="subsequent-section"><enum>201.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There is
			 authorized to be appropriated for the Central Intelligence Agency Retirement
			 and Disability Fund for fiscal year 2010 the sum of $290,900,000.</text>
			</section></title><title id="H9F679CF0C2FF4D48A353DB4F21BEC6B7"><enum>III</enum><header>General
			 provisions</header>
			<section id="H960F45A8D6E7427192A0B18A4ACE16F5"><enum>301.</enum><header>Increase in
			 employee compensation and benefits authorized by law</header><text display-inline="no-display-inline">Appropriations authorized by this Act for
			 salary, pay, retirement, and other benefits for Federal employees may be
			 increased by such additional or supplemental amounts as may be necessary for
			 increases in such compensation or benefits authorized by law.</text>
			</section><section id="H3E3B4308DB434841B8CD190F1D17DA97"><enum>302.</enum><header>Restriction on
			 conduct of intelligence activities</header><text display-inline="no-display-inline">The authorization of appropriations by this
			 Act shall not be deemed to constitute authority for the conduct of any
			 intelligence activity which is not otherwise authorized by the Constitution or
			 the laws of the United States.</text>
