		  to assist low-income individuals in obtaining subsidized prescription drug
		  coverage under the Medicare prescription drug program by expediting the
		  application and qualification process and by revising the resource standards
		  used to determine eligibility for such subsidies, and for other

			 of 2009</short-title></quote>.</text>

			</subsection></section><section id="H306AC699C3FC49D9817076A8DE372753"><enum>2.</enum><header>Expediting
			 low-income subsidies under the Medicare prescription drug program</header>
			<subsection id="H80F0CC5F063347959C8243F6D9433150"><enum>(a)</enum><header>Targeted
			 outreach for low-income subsidies</header>
				<paragraph id="H696F71DB782843FBAB24BB6B0E13FFEE"><enum>(1)</enum><header>In
			 general</header><text>Section 1860D–14 of the Social Security Act (42 U.S.C.
			 1395w–114) is amended by adding at the end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H676A6B3E0D6F498FB0EEDA64D1EED7B" style="OLC">
						<subsection id="H9C9B76F32CEB4390B0F6CC6A44926BC0"><enum>(e)</enum><header>Targeted
				outreach for low-income subsidies</header>
							<paragraph id="H284101BB2F0B4487A7BA507E5207470F"><enum>(1)</enum><header>Targeted
				identification of subsidy-eligible individuals</header>
								<subparagraph id="H26D12FB1FB254E8E81640FF7FC8CD029"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Commissioner of
				Social Security shall provide for the identification of individuals who are
				potentially eligible for low-income assistance under this section through
				requests to the Secretary of the Treasury in accordance with the criterion
				established under section 6103(l)(21) of the Internal Revenue Code of 1986 for
				information indicating whether the individual involved is likely eligible for
				such assistance.</text>
								</subparagraph><subparagraph id="HCC875A66AFD3440B8969DAA4A1B4B941"><enum>(B)</enum><header>Initiation of
				identifications</header><text display-inline="yes-display-inline">Not later
				than 90 days after the date of the enactment of this subsection, the
				Commissioner of Social Security shall begin the identification of individuals
				through the process described in subparagraph (A) and shall, by such date and
				through such process, submit to the Secretary of the Treasury requests for part
				D eligible individuals who the Commissioner has identified as potentially
				eligible for low-income subsidies under this section before such date of
				enactment.</text>
								</subparagraph></paragraph><paragraph id="HA22373F496C24CEDB0300F62DC287C46"><enum>(2)</enum><header>Notification of
				potentially eligible individuals</header><text display-inline="yes-display-inline">In the case of each individual identified
				under paragraph (1) who has not otherwise applied for, or been determined
				eligible for, benefits under this section (or who has applied for and been
				determined ineligible for such benefits based on excess income, resources, or
				both), the Commissioner shall transmit by mail to the individual a letter
				including the information and application required to be provided under
				subparagraphs (A), (B), and (D) of section 1144(c)(1).</text>
							</paragraph><paragraph id="H3390A506A9544AE699BDCF4F7991F3C7"><enum>(3)</enum><header>Follow-up
				communications</header><text display-inline="yes-display-inline">If an
				individual to whom a letter is transmitted under paragraph (2) does not
				affirmatively respond to such letter either by making an enrollment, completing
				an application, or declining either or both, the Commissioner shall make
				additional attempts to contact the individual to obtain such an affirmative
				response.</text>
							</paragraph><paragraph id="H4CC6056BB13549B2B33CFE83BE759574"><enum>(4)</enum><header>Use of preferred
				language in subsequent communications</header><text display-inline="yes-display-inline">In the case an application is completed by
				an individual pursuant to this subsection in which a language other than
				English is specified, the Commissioner shall provide that subsequent
				communications under this part to the individual shall be in such language as
				needed.</text>
							</paragraph><paragraph id="HFB813DC1AE9649BC82C922748CF3164A"><enum>(5)</enum><header>Construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall be
				construed as precluding the Commissioner from taking additional outreach
				efforts to enroll eligible individuals under this part and to provide
				low-income subsidies to eligible individuals.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H75C030E88BC64BCE82E6F1153AD5F5E3"><enum>(6)</enum><header>Maintenance of
				effort with respect to outreach</header><text>In no case shall the level of
				effort with respect to outreach to and enrollment of individuals who are
				potentially eligible for low-income assistance under this section after the
				date of the enactment of this subsection be less than such level of effort
				before such date of enactment until at least 90 percent of such potentially
				eligible individuals have affirmatively responded.</text>
							</paragraph><paragraph id="H7C64BA055D7049C084303F2D40B3A9FA"><enum>(7)</enum><header>GAO report to
				Congress</header><text display-inline="yes-display-inline">Not later than 2
				years after the date of the first submission to the Secretary of the Treasury
				described in paragraph (1)(B), the Comptroller General of the United States
				shall submit to Congress a report, with respect to the 18-month period
				following the establishment of the process described in paragraph (1)(A),
				on—</text>
								<subparagraph id="H5F256A581EED4A07BA55333CFB9D15E9"><enum>(A)</enum><text>the extent to
				which the percentage of individuals who are eligible for low-income assistance
				under this section but not enrolled under this part has decreased during such
				period;</text>
								</subparagraph><subparagraph id="H06FC15E61AD344E4A6815DB012AF4754"><enum>(B)</enum><text display-inline="yes-display-inline">how the Commissioner of Social Security has
				used any savings resulting from the implementation of this section and section
				6103(l)(21) of the Internal Revenue Code of 1986 to improve outreach to
				individual described in subparagraph (A) to increase enrollment of such
				individuals under this part;</text>
								</subparagraph><subparagraph id="H2E0D5F4CA6634A8EA2601ABCDB947C39"><enum>(C)</enum><text display-inline="yes-display-inline">the effectiveness of using information from
				the Secretary of the Treasury in accordance with section 6103(l)(21) of the
				Internal Revenue Code of 1986 for purposes of indicating whether individuals
				are eligible for low-income assistance under this section; and</text>
								</subparagraph><subparagraph id="H7A22815B2DF34A569001932F704B2D15"><enum>(D)</enum><text>the effectiveness
				of the outreach conducted by the Commissioner of Social Security based on the
				data described in subparagraph
				(C).</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H3669EFBE2D804EA7BF3BEE432A1AF6BC"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Section 1144(c)(1) of the Social Security Act (42
			 U.S.C. 1320b–14(c)(1)) is amended by inserting <quote>(including through
			 request to the Secretary of the Treasury pursuant to section
			 1860D–14(e))</quote> before <quote>, the Commissioner shall</quote>.</text>
				</paragraph></subsection><subsection id="H4458766CF9C84C9B994EC2BC7E0C25A4"><enum>(b)</enum><header>Improvements to
			 the low-income subsidy applications</header><text>Section 1860D–14(a)(3) of the
			 Social Security Act (42 U.S.C. 1395w–114(a)(3)) is amended—</text>
				<paragraph id="H24377B805C9E47FF8C27D102086146A4"><enum>(1)</enum><text>in subparagraph
			 (E), by striking clauses (ii) and (iii) and redesignating clause (iv) as clause
			 (ii);</text>
				</paragraph><paragraph id="HCD83920FB1F94F46B2DB3E059A8CEE5D"><enum>(2)</enum><text>by redesignating
			 subparagraphs (F) and (G) as subparagraphs (G) and (H), respectively;
			 and</text>
				</paragraph><paragraph id="H3BF18969BEC142FEA9BFCF8664F69764"><enum>(3)</enum><text>by inserting after
			 subparagraph (E) the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="HDBF26BE2BF8B4C9DB7B4FF671ABB620C" style="OLC">
						<subparagraph id="H9940E137E7E34802B75FE7F27CCBFD7D"><enum>(F)</enum><header>Simplified
				low-income subsidy application and process</header>
							<clause id="H5B1CF16C228E4E60947B8671780AD411"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary,
				jointly with the Commissioner of Social Security, shall—</text>
								<subclause id="H34EA5F72BF34431F854369D7BE023B28"><enum>(I)</enum><text display-inline="yes-display-inline">develop a model, simplified application
				form and process consistent with clause (ii) for the determination and
				verification of a part D eligible individual’s assets or resources under this
				paragraph; and</text>
								</subclause><subclause id="H71A59FE2030345BAA6E522294B0C14F4"><enum>(II)</enum><text>provide such form
				to States.</text>
								</subclause></clause><clause id="H5B57BEEE6EFC42F19FE644DE16CFB02F"><enum>(ii)</enum><header>Documentation
				and safeguards</header><text>Under such process—</text>
								<subclause id="HB037128A72654C57A294819CABCAB690"><enum>(I)</enum><text display-inline="yes-display-inline">the application form shall consist of an
				attestation under penalty of perjury regarding the level of assets or resources
				(or combined assets and resources in the case of a married part D eligible
				individual) and valuations of general classes of assets or resources;</text>
								</subclause><subclause id="H4FA5AE8BFBC8406483FE610A6E08D7CA"><enum>(II)</enum><text display-inline="yes-display-inline">such form shall not require the submittal
				of additional documentation regarding income or assets;</text>
								</subclause><subclause id="H9C44F86340C44E13BAAAF4275D624CA3"><enum>(III)</enum><text display-inline="yes-display-inline">matters attested to in the application
				shall be subject to appropriate methods of administrative verification;</text>
								</subclause><subclause id="HE068093DAEAD4B84A8DF1D12418A3B18"><enum>(IV)</enum><text display-inline="yes-display-inline">the applicant shall be permitted to
				authorize another individual to act as the applicant’s personal representative
				with respect to communications under this part and the enrollment of the
				applicant into a prescription drug plan (or MA–PD plan) and for low-income
				subsidies under this section; and</text>
								</subclause><subclause id="HF2D18621D3E44B6A9DDE7AA443738F90"><enum>(V)</enum><text display-inline="yes-display-inline">the application form shall allow for the
				specification of a language (other than English) that is preferred by the
				individual for subsequent communications with respect to the individual under
				this part.</text>
								</subclause></clause><clause id="HFB0F13C91D45485B992B10822F739C4A"><enum>(iii)</enum><header>No recovery
				for certain subsidies improperly paid</header><text display-inline="yes-display-inline">If an individual in good faith and in the
				absence of fraud is provided low-income subsidies under this section, and if
				the individual is subsequently found not eligible for such subsidies, there
				shall be no recovery made against the individual because of such subsidies
				improperly
				paid.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection display-inline="no-display-inline" id="HC5DF407ECB294731A53255C0B949C25D"><enum>(c)</enum><header>Disclosures To
			 facilitate identification of individuals likely To be eligible for the
			 low-income assistance under the Medicare prescription drug program</header>
				<paragraph id="HBDE5968C4EB0441EBD1F5B280494BDDB"><enum>(1)</enum><header>In
			 general</header><text display-inline="no-display-inline">Subsection (l) of
			 section 6103 of the Internal Revenue Code of 1986 is amended by adding at the
			 end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="HB614D0C8CC7A4D42BB84563129E72033" style="OLC">
						<paragraph id="HE226FF526AAF4D0E9789CFFE2705859C"><enum>(21)</enum><header>Disclosure of
				return information to facilitate identification of individuals likely to be
				eligible for low-income subsidies under Medicare prescription drug
				program</header>
							<subparagraph id="HEBDC34C6D48F47F99512A56CD6E78543"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary, upon
				written request from the Commissioner of Social Security, shall disclose to
				officers and employees of the Social Security Administration, with respect to
				any individual identified by the Commissioner—</text>
								<clause id="H8D18DAC2F49D44F3A37018E8EEF64673"><enum>(i)</enum><text>whether, based on
				the criterion determined under subparagraph (B), such individual is likely to
				be eligible for low-income assistance under section 1860D–14 of the Social
				Security Act, or</text>
								</clause><clause id="HE7937DE9DAE44532A5808B086E894E8B"><enum>(ii)</enum><text>that, based on
				such criterion, there is insufficient information available to the Secretary to
				make the determination described in clause (i).</text>
								</clause></subparagraph><subparagraph id="H679906BFCEB249388A904F35D7173236"><enum>(B)</enum><header>Criterion</header><text>Not
				later than 90 days after the date of the enactment of this paragraph, the
				Secretary, in consultation with the Commissioner of Social Security, shall
				develop the criterion by which the determination under subparagraph (A)(i)
				shall be made (and the criterion for determining that insufficient information
				is available to make such determination). Such criterion may include analysis
				of information available on such individual’s return, the return of such
				individual’s spouse, and any information related to such individual or such
				individual’s spouse which is available on any information
				return.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H54A5298CE7A148EDAF1C8F45BD934705"><enum>(2)</enum><header>Procedures and
			 recordkeeping related to disclosures</header><text>Paragraph (4) of section
			 6103(p) of such Code is amended by striking <quote>or (17)</quote> each place
			 it appears and inserting <quote>(17), or (21)</quote>.</text>
				</paragraph><paragraph id="H363B729914BD48DB9F7E21F704E6BD94"><enum>(3)</enum><header>Effective
			 date</header><text>The amendments made by this subsection shall apply to
			 disclosures made after the date of the enactment of this Act.</text>
				</paragraph></subsection></section><section commented="no" id="H4B45DCCE8BBD4CB88CCEE3410655EB23"><enum>3.</enum><header>Enhanced
			 oversight and enforcement relating to reimbursements for retroactive LIS
			 enrollment</header>
			<subsection commented="no" id="HA511315EBEBD478FBB242F84FB1D8B95"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">In the case of a
			 retroactive LIS enrollment beneficiary (as defined in subsection (e)(4)) who is
			 enrolled under a prescription drug plan under part D of title XVIII of the
			 Social Security Act (or an MA–PD plan under part C of such title)—</text>
				<paragraph commented="no" id="H38DFBFA88500408B96617C2EB47034ED"><enum>(1)</enum><text display-inline="yes-display-inline">the beneficiary (or any eligible third
			 party) is entitled to reimbursement by the plan for covered drug costs (as
			 defined in subsection (e)(1)) incurred by the beneficiary during the
			 retroactive coverage period of the beneficiary in accordance with subsection
			 (b) and in the case of such a beneficiary described in subsection (e)(4)(A)(i),
			 such reimbursement shall be made automatically by the plan upon receipt of
			 appropriate notice the beneficiary is eligible for assistance described in such
			 subsection (e)(4)(A)(i) without further information required to be filed with
			 the plan by the beneficiary;</text>
				</paragraph><paragraph commented="no" id="HD0C32070BE5E475A83FED74A6F294C0A"><enum>(2)</enum><text>the Secretary of
			 Health and Human Services (in this section referred to as the
			 <quote>Secretary</quote>) shall not make payment to the plan—</text>
					<subparagraph id="H330C096958F44EAB97CC322950A228E9"><enum>(A)</enum><text display-inline="yes-display-inline">in the case that the beneficiary is
			 described in subsection (e)(4)(A)(i), for premium subsidies and cost sharing
			 subsidies under section 1860D–14 of the Social Security Act (42 U.S.C.
			 1395w–114) with respect to the provision of prescription drug coverage to the
			 beneficiary during such retroactive period; and</text>
					</subparagraph><subparagraph id="H158D16B039D74BD2B4FC3F78066A01C2"><enum>(B)</enum><text display-inline="yes-display-inline">in the case that the beneficiary is
			 described in subsection (e)(4)(A)(ii), for direct subsidies under section
			 1860D–15(a)(1) of such Act and premium subsidies and cost-sharing subsidies
			 under section 1860D–14 of such Act with respect to the provision of
			 prescription drug coverage to the beneficiary during such retroactive
			 period;</text>
					</subparagraph><continuation-text continuation-text-level="paragraph">unless the
			 plan demonstrates to the Secretary that the plan has provided timely and
			 accurate reimbursement to the beneficiary (or eligible third party) in
			 accordance with paragraph (1);</continuation-text></paragraph><paragraph commented="no" id="H5BC2FC1E1BFE4246AAED313B260CA884"><enum>(3)</enum><text>the Secretary
			 shall not make any payment described in paragraph (2) to the plan with respect
			 to such beneficiary for any month of the retroactive enrollment period during
			 which no expenses for covered part D drugs (as defined in section 1860D–2(e) of
			 the Social Security Act (42 U.S.C. 1395w–102(e)) were incurred by such
			 beneficiary (or eligible third party on behalf of such beneficiary); and</text>
				</paragraph><paragraph id="HEB7E4E75486C43A9A15EBBAB98A17A70"><enum>(4)</enum><text>any payment owed
			 the plan pursuant to this section, taking into account paragraphs (2) and (3),
			 shall be made at the time the Centers for Medicare &amp; Medicaid Services
			 reconciles payments for the entire plan year following the end of the plan
			 year, and not before such time.</text>
				</paragraph></subsection><subsection id="H409DD1A4DD0F49A082668A90335EA5AB"><enum>(b)</enum><header>Administrative
			 requirements relating to reimbursements</header>
				<paragraph id="H18744E8407BE4987A6FF24884468C7CF"><enum>(1)</enum><header>Line-item
			 description</header><text display-inline="yes-display-inline">Each
			 reimbursement made by a prescription drug plan or MA–PD plan under subsection
			 (a)(1) shall include a line-item description of the items for which the
			 reimbursement is made.</text>
				</paragraph><paragraph commented="no" id="HEFDE953BCA484F8997795CAF20898CF2"><enum>(2)</enum><header>Timing of
			 reimbursements</header><text>A prescription drug plan or MA–PD plan must make a
			 reimbursement under subsection (a)(1) to a retroactive LIS enrollment
			 beneficiary, with respect to a claim, not later than 30 days after—</text>
					<subparagraph commented="no" id="H16BC31372A234E8C8C63D3919F5F6AB6"><enum>(A)</enum><text>in the case of a
			 beneficiary described in subsection (e)(4)(A)(i), the date on which the plan
			 receives notice from the Secretary that the beneficiary is eligible for
			 assistance described in such subsection; or</text>
					</subparagraph><subparagraph commented="no" id="H4E3FB488A1C847C99AF3F7BB9B9D357A"><enum>(B)</enum><text>in the case of a
			 beneficiary described in subsection (e)(4)(A)(ii), the date on which the
			 beneficiary files the claim with the plan.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" id="H133BBF4C2B76469EAB31A786538C7BE0"><enum>(c)</enum><header>Notice
			 requirements</header>
				<paragraph id="H1E10CD3167DC449E9B7A19F1C556273E"><enum>(1)</enum><header>By Secretary of
			 HHS and Commission of the Social Security Administration</header><text>The
			 Secretary, jointly with the Commissioner of the Social Security Administration,
			 shall ensure that each retroactive LIS enrollment beneficiary receives, with
			 any letter or notification of eligibility for a low-income subsidy under
			 section 1860D–14 of the Social Security Act, a notice of their right to
			 reimbursement described in subsection (a)(1) for covered drug costs incurred
			 during the retroactive coverage period of the beneficiary. Such notice
			 shall—</text>
					<subparagraph id="HD36C15AE76014D1A8A5DF65E72983C17"><enum>(A)</enum><text>with respect to a
			 beneficiary described in subsection (e)(4)(A)(i), inform the beneficiary of the
			 beneficiary’s right to automatic reimbursement as described in subsection
			 (a)(1); and</text>
					</subparagraph><subparagraph id="HDCC02D97485F4C0D808F99157AAA0AEB"><enum>(B)</enum><text>with respect to a
			 beneficiary described in subsection (e)(4)(A)(ii), include a description of a
			 clear process that the beneficiary should follow to seek such
			 reimbursement.</text>
					</subparagraph></paragraph><paragraph id="HDE5803A9C0FC40EF908A59A9237B0EAE"><enum>(2)</enum><header>By prescription
			 drug plans</header>
					<subparagraph id="H7534B1E2BD244EE2A882C44C8E01B84C"><enum>(A)</enum><header>In
			 general</header><text>Each prescription drug plan under part D of title XVIII
			 of the Social Security Act (and MA–PD plan under part C of such title) shall
			 include in a notice from the plan to a retroactive LIS enrollment beneficiary
			 described in subsection (e)(4)(A)(ii) a model notice developed under
			 subparagraph (B) describing the process the beneficiary must follow to seek
			 retroactive reimbursement. Such notice shall include any form required by the
			 plan to complete such reimbursement and shall indicate the period of
			 retroactive coverage for which the beneficiary is eligible for such
			 reimbursement.</text>
					</subparagraph><subparagraph id="H02D2DD77EDA0415A8351A03BA42F8664"><enum>(B)</enum><header>Model
			 notice</header><text>The Secretary, jointly with the Commissioner of Social
			 Security, shall develop a model notice for purposes of subparagraph (A) and
			 shall make such model notice available to all prescription drug plans under
			 part D of title XVIII of the Social Security Act (and MA–PD plans under part C
			 of such title).</text>
					</subparagraph></paragraph></subsection><subsection commented="no" id="H69A162C04D9A463B92FFD7DC6D0C40CD"><enum>(d)</enum><header>Public posting
			 To track payments</header>
				<paragraph id="HE7E352EC8DBB4DD5B2A5C98F98B6140D"><enum>(1)</enum><header>In
			 general</header><text>Not later than one year after the date of the enactment
			 of this Act, the Secretary shall post (and annually update) on the public
			 Internet website of the Department of Health and Human Services information on
			 the total amount of payments made by the Secretary under subsection (a)(2) to
			 prescription drug plans during the most recent plan year for which plan data is
			 available.</text>
				</paragraph><paragraph id="HC496C947D89C4426A587F924FD76C35B"><enum>(2)</enum><header>Specific
			 information</header><text>Such information posted—</text>
					<subparagraph id="H17E0394D741A4A47BCB98D98CE5DCD8F"><enum>(A)</enum><text>in 2010 or in a
			 subsequent year before 2016, shall include information on payments made for
			 years beginning with 2006 and ending with the year for which the most current
			 information is available; and</text>
					</subparagraph><subparagraph id="H6FB10EEBC9ED41F1AC7C5C98A753A1DF"><enum>(B)</enum><text>in 2016 or a
			 subsequent year, shall include information on payments made for at least the 10
			 previous years.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" id="H90421BB92F90468B98CEDEF12EEB0A2C"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
				<paragraph commented="no" id="HE10A887D0BC34507A3A2ED4FADEF40DD"><enum>(1)</enum><header>Covered drug
			 costs</header><text display-inline="yes-display-inline">The term <term>covered
			 drug costs</term> means, with respect to a retroactive LIS enrollment
			 beneficiary enrolled under a prescription drug plan under part D of title XVIII
			 of the Social Security Act (or an MA–PD plan under part C of such title), the
			 amount by which—</text>
					<subparagraph commented="no" id="H67E3C9870EE94DD0B9CB4C980C73781D"><enum>(A)</enum><text>the costs incurred
			 by such beneficiary during the retroactive coverage period of the beneficiary
			 for covered part D drugs, premiums, and cost-sharing under such title;
			 exceeds</text>
					</subparagraph><subparagraph commented="no" id="H5968270C22CE4C60A4E61F24EE3C592F"><enum>(B)</enum><text>such costs that
			 would have been incurred by such beneficiary during such period if the
			 beneficiary had been both enrolled in the plan and recognized by such plan as
			 qualified during such period for the low income subsidy under section 1860D–14
			 of the Social Security Act to which the individual is entitled.</text>
					</subparagraph></paragraph><paragraph commented="no" id="H6059ECB16FD64EE580695963CCC82BFC"><enum>(2)</enum><header>Eligible third
			 party</header><text>The term <term>eligible third party</term> means, with
			 respect to a retroactive LIS enrollment beneficiary, an organization or other
			 third party that paid on behalf of such beneficiary for covered drug costs
			 incurred by such beneficiary during the retroactive coverage period of such
			 beneficiary.</text>
				</paragraph><paragraph commented="no" id="H64919012E4FB4153BAB427531402F0DE"><enum>(3)</enum><header>Retroactive
			 coverage period</header><text display-inline="yes-display-inline">The term
			 <term>retroactive coverage period</term> means—</text>
					<subparagraph commented="no" id="HD55B925173AD4A88A2566850BF182881"><enum>(A)</enum><text>with respect to a
			 retroactive LIS enrollment beneficiary described in paragraph (4)(A)(i), the
			 period—</text>
						<clause commented="no" id="HE4B5EE44DB5B44CAB77278F46EA5B797"><enum>(i)</enum><text>beginning on the
			 effective date of the assistance described in such paragraph for which the
			 individual is eligible; and</text>
						</clause><clause commented="no" id="HB1E61E003E2641CEA6FD76F0F0EDDDE1"><enum>(ii)</enum><text>ending on the
			 date the plan effectuates the status of such individual as so eligible;
			 and</text>
						</clause></subparagraph><subparagraph commented="no" id="HDCA2CCA876D4485CBFB9A3594713E51F"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to a retroactive LIS
			 enrollment beneficiary described in paragraph (4)(A)(ii), the period—</text>
						<clause commented="no" id="H211224B3B2F947FCB176C9C45A122009"><enum>(i)</enum><text>beginning on the
			 date the individual is both entitled to benefits under part A, or enrolled
			 under part B, of title XVIII of the Social Security Act and eligible for
			 medical assistance under a State plan under title XIX of such Act; and</text>
						</clause><clause commented="no" id="H516FCF8568144875A50A8FD6E46DCD9E"><enum>(ii)</enum><text>ending on the
			 date the plan effectuates the status of such individual as a full-benefit dual
			 eligible individual (as defined in section 1935(c)(6) of such Act).</text>
						</clause></subparagraph></paragraph><paragraph commented="no" id="H210BFF2D43ED44E8A411ABCCDAC77C6E"><enum>(4)</enum><header>Retroactive LIS
			 enrollment beneficiary</header>
					<subparagraph commented="no" id="H9519B3A5ADEA4AEAA346AE3803CA03F9"><enum>(A)</enum><header>In
			 general</header><text>The term <term>retroactive LIS enrollment
			 beneficiary</term> means an individual who—</text>
						<clause commented="no" id="H65C19EAD2F9E434CA6BCFB63708EB3D0"><enum>(i)</enum><text>is enrolled in a
			 prescription drug plan under part D of title XVIII of the Social Security Act
			 (or an MA–PD plan under part C of such title) and subsequently becomes eligible
			 as a full-benefit dual eligible individual (as defined in section 1935(c)(6) of
			 such Act), an individual receiving a low-income subsidy under section 1860D–14
			 of such Act, an individual receiving assistance under the Medicare Savings
			 Program implemented under clauses (i), (ii), (iii), and (iv) of section
			 1902(a)(10)(E) of such Act, or an individual receiving assistance under the
			 supplemental security income program under section 1611 of such Act; or</text>
						</clause><clause commented="no" id="H7FBA3BACE1044D83A36AF1124498B8B7"><enum>(ii)</enum><text display-inline="yes-display-inline">subject to subparagraph (B)(i), is a
			 full-benefit dual eligible individual (as defined in section 1935(c)(6) of such
			 Act) who is automatically enrolled in such a plan under section
			 1860D–1(b)(1)(C) of such Act.</text>
						</clause></subparagraph><subparagraph commented="no" id="HE9402E5EE338468C962BF590539A53A8"><enum>(B)</enum><header>Exception for
			 beneficiaries enrolled in RFP plan</header>
						<clause commented="no" id="HFE0729F8A67B45EBA5257E11BA2BC721"><enum>(i)</enum><header>In
			 general</header><text>In no case shall an individual described in subparagraph
			 (A)(ii) include an individual who is enrolled, pursuant to a RFP contract
			 described in clause (ii), in a prescription drug plan offered by the sponsor of
			 such plan awarded such contract.</text>
						</clause><clause commented="no" id="H9A1C9B064F62468EBC909EDF00942407"><enum>(ii)</enum><header>RFP contract
			 described</header><text>The RFP contract described in this section is a
			 contract entered into between the Secretary and a sponsor of a prescription
			 drug plan pursuant to the Centers for Medicare &amp; Medicaid Services’ request
			 for proposals issued on February 17, 2009, relating to Medicare part D
			 retroactive coverage for certain low income beneficiaries, or a similar
			 subsequent request for proposals.</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" id="H42ABABB9FC87439287C6EA679A50358C"><enum>(f)</enum><header>GAO
			 report</header><text display-inline="yes-display-inline">Not later than 24
			 months after the date of the enactment of this Act, the Comptroller General of
			 the United States shall submit to Congress a report on the extent to which the
			 provisions of this section improve reimbursement for covered drug costs to
			 retroactive LIS enrollment beneficiaries and lower the amounts of payments made
			 by the Secretary, with respect to such beneficiaries, to prescription drug
			 plans under part D of title XVIII of the Social Security Act (and MA–PD plans
			 under part C of such title).</text>
			</subsection><subsection commented="no" id="H6A1CA0AEA0054697B09DBAC079E2C82B"><enum>(g)</enum><header>Report to
			 Congress</header><text display-inline="yes-display-inline">In the case that an
			 RFP contract described in subsection (e)(4)(B)(ii) is awarded, not later than
			 two years after the effective date of such contract, the Secretary of Health
			 and Human Services shall submit to Congress a report evaluating the program
			 carried out through such contract.</text>
			</subsection><subsection id="H857367F0BBDB47F58FEA7A267C0CEA2B"><enum>(h)</enum><header>Effective
			 date</header><text>Paragraphs (2) and (3) of subsection (a) and subsections (b)
			 and (c) shall apply to subsidy determinations made on or after the date that is
			 3 months after the date of the enactment of this Act.</text>
			</subsection></section><section id="HB277838845FF439995E2C04CB9347EE5"><enum>4.</enum><header>Modification of
			 resource standards for determination of eligibility for low-income subsidy;
			 simplification of income and asset rules</header>
			<subsection commented="no" id="H27BDBFA356D44B2D8B088C3526FA0D69"><enum>(a)</enum><header>Single and
			 increased resource standard for low-income subsidies</header><text display-inline="yes-display-inline">Section 1860D–14(a) of the Social Security
			 Act (42 U.S.C. 1395w–114(a)) is amended—</text>
				<paragraph commented="no" id="HB168E73A98A143CB95675FBB16C8BEF2"><enum>(1)</enum><text>in paragraph (1),
			 by inserting <quote>(or, for years after 2010, paragraph (3)(E))</quote> after
			 <quote>paragraph (3)(D)</quote>;</text>
				</paragraph><paragraph commented="no" id="H0BD76E5BCA8F4F44BF14E585738AB800"><enum>(2)</enum><text>in paragraph
			 (3)—</text>
					<subparagraph commented="no" id="HA4856E49845342328CC164AA3FF32100"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A)(iii), by inserting
			 <quote>(or for a year after 2010, subparagraph (E))</quote> before the
			 period;</text>
					</subparagraph><subparagraph commented="no" id="H158471CA39684E9EAE0F42C19D3D7DA2"><enum>(B)</enum><text>in subparagraph
			 (D)(ii), by inserting <quote>before 2011</quote> after <quote>subsequent
			 year</quote>; and</text>
					</subparagraph><subparagraph commented="no" id="HED94B737324F4A1781328A7F78F41009"><enum>(C)</enum><text>in subparagraph
			 (E)(i)—</text>
						<clause commented="no" id="HB2DF59BD1C6441E78A874001FC37B882"><enum>(i)</enum><text>by striking
			 <quote>and</quote> at the end of subclause (I);</text>
						</clause><clause commented="no" id="HA4D482BDC14545698E5D8C3B2B3F06D0"><enum>(ii)</enum><text>in subclause
			 (II)—</text>
							<subclause commented="no" id="H262285C2B7AF4FE88EEA2237D11A1318"><enum>(I)</enum><text>by striking
			 <quote>a subsequent year</quote> and inserting <quote>each of 2007 through
			 2010</quote>;</text>
							</subclause><subclause commented="no" id="H37C30F7BCEE742918ED542A67CE6ECA6"><enum>(II)</enum><text>by striking the
			 period at the end and inserting a semicolon;</text>
							</subclause></clause><clause commented="no" id="HE1A8DE6FB8A54525A9D86743EB461998"><enum>(iii)</enum><text display-inline="yes-display-inline">by inserting after subclause (II) the
			 following new subclauses:</text>
							<quoted-block display-inline="no-display-inline" id="HFD7A8E3DB94F43699185655C414C67E1" style="OLC">
								<subclause commented="no" id="HEB9B1F69EE61428CBC49FF192E6A8674"><enum>(III)</enum><text>for 2011,
				$27,500 (or $55,000 in the case of the combined value of the individual’s
				assets or resources and the assets or resources of the individual’s spouse);
				and</text>
								</subclause><subclause commented="no" id="HCE99210499ED466AAB14BFF44AE03A26"><enum>(IV)</enum><text>for a subsequent
				year the dollar amounts specified in this clause for the previous year
				increased by the annual percentage increase in the consumer price index (all
				items; U.S. city average) as of September of such previous year.</text>
								</subclause><after-quoted-block>; and</after-quoted-block></quoted-block>
						</clause><clause commented="no" id="H00D8B7EE3EC44E5E8B92BA194AC7D1F4"><enum>(iv)</enum><text>in the last
			 sentence, by inserting <quote>or (IV)</quote> after <quote>subclause
			 (II)</quote>.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="H2C898437F1674370A695566174D308BA"><enum>(b)</enum><header>Exemptions from
			 resources</header>
				<paragraph id="HD93CADB6AF4A4682B92F1180988D7EDF"><enum>(1)</enum><header>In
			 general</header><text>Section 1860D–14(a)(3) of the Social Security Act (42
			 U.S.C. 1395w–114(a)(3) is further amended—</text>
					<subparagraph id="H3EAE7486D4A34D2D99786E88EDA8E832"><enum>(A)</enum><text>in subparagraphs
			 (D) and (E), by inserting <quote>and the retirement plan exclusion under
			 subparagraph (H)</quote> after <quote>subparagraph (G)</quote> each place it
			 appears; and</text>
					</subparagraph><subparagraph id="HC9437D3FB89A4605AFFD50EFF6DCD8D5"><enum>(B)</enum><text>by adding at the
			 end the following new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="HB95F49C59F794871B8D91C93CE4C9009" style="OLC">
							<subparagraph id="H0744183B7A2245BFB8470036F849F4E4"><enum>(H)</enum><header>Retirement
				benefit exclusion</header><text display-inline="yes-display-inline">In
				determining the resources of an individual (and their eligible spouse, if any)
				under section 1613 for purposes of subparagraphs (D) and (E), no retirement
				benefit, such as an individual retirement account or plan under section 401(k)
				of the Internal Revenue Code of 1986, shall be taken into account.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" id="H6402AA92AE5D416A8D2C21AB2F4C6400"><enum>(2)</enum><header>Effective
			 date</header><text>The amendments made by paragraph (1) shall apply for months
			 beginning after 2011.</text>
				</paragraph></subsection><subsection commented="no" id="HB38762AC652241D5BB952EF981E8E765"><enum>(c)</enum><header>Clarification
			 relating to including retirement benefits as income</header><text display-inline="yes-display-inline">Nothing in subparagraph (H) of section
			 1860D–14(a)(3) of the Social Security Act (42 U.S.C. 1395w–114(a)(3)), as added
			 by subsection (b), shall be construed as affecting the inclusion of retirement
			 benefits as income under section 1612(a)(2)(B) of such Act (42 U.S.C.
			 1382a(a)(2)(B)).</text>
			</subsection><subsection id="H9DC9A04344374970A6367B6943486522"><enum>(d)</enum><header>Clarification
			 relating to MIPPA effective date for in kind exclusions from
			 income</header><text>Section 116(b) of the Medicare Improvements for Patients
			 and Providers Act of 2008 is amended—</text>
				<paragraph id="HE29E4E152D2D44B8AE1652E3A782A1D5"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>(other than subsection
			 (a)(1))</quote> after <quote>this section</quote>; and</text>
				</paragraph><paragraph id="H94C9CC9E3B1A4B62A7C3C6EF1968471A"><enum>(2)</enum><text>by adding at the
			 end the following new sentence: <quote>The amendment made by subsection (a)(1)
			 shall take effect with respect to benefits provided after such date.</quote>.</text>
				</paragraph></subsection><subsection id="HF228CADE8B2E4C09811A493E27199BBF"><enum>(e)</enum><header>Increasing
			 income limits for partial LIS eligibility to 200 percent FPL and for full LIS
			 to 150 percent FPL</header>
				<paragraph id="H825A82E386DF4FB594FAA7CCD2831CB9"><enum>(1)</enum><header>In
			 general</header><text>Section 1860D–14(a) of the Social Security Act (42 U.S.C.
			 1395w–114(a)) is amended—</text>
					<subparagraph id="HDD90689FE0A0481CA0695D46C0DDA235"><enum>(A)</enum><text>in the heading, by
			 striking <quote><header-in-text level="subsection" style="OLC">150</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">200</header-in-text></quote>;</text>
					</subparagraph><subparagraph id="H3DD0F81142964D2C803726E0A0B792ED"><enum>(B)</enum><text>in paragraph

				copayment amount specified under section 1860D–2(b)(4)(A)(i)(I) for the drug
				and year involved; and</text>

				amount determined under this subparagraph for the previous year increased by

			 eligibility for benefits under other programs</header>
			<subsection id="H1EB0160D55B84021BA33D6AEAE8010"><enum>(a)</enum><header>In
			 general</header><text>Section 1860D–14(a)(3) of the Social Security Act (42
			 U.S.C. 1395w–114(a)(3)), as amended by section 4(b)(1)(B), is further
			 amended—</text>
				<paragraph id="H18B7EC46375849009170195724ADBF32"><enum>(1)</enum><text>in subparagraph
			 (A), in the matter preceding clause (i), by striking <quote>subparagraph
			 (F)</quote> and inserting <quote>subparagraphs (F) and (I)</quote>; and</text>
				</paragraph><paragraph id="H4F4181EC26EC42C0AC9F3264D6DE48D5"><enum>(2)</enum><text>by adding at the
			 end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="H0BF6F90994744ACF83916BCC7E2468FA" style="OLC">
						<subparagraph commented="no" id="H607374F8C5D64959B4FA6CFE7F70F090"><enum>(I)</enum><header>No impact on
				eligibility for benefits under other programs</header><text>The availability of
				premium and cost-sharing subsidies under this section shall not be treated as
				benefits or otherwise taken into account in determining an individual’s
				eligibility for, or the amount of benefits under, any other Federal
				program.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H1AA0062A44614DF596B39E0400E51BF"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 subsection (a) shall apply to premium and cost-sharing subsidies for months
			 beginning after the date of the enactment of this Act.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H0B79EA6BA44B461091361E6B365C0464" section-type="subsequent-section"><enum>7.</enum><header>Requiring individuals
			 eligible for Medicare savings programs to be deemed to be subsidy eligible
			 individuals</header>
			<subsection id="H48CBF9AB56594FDB9F13660C6DDC7962"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section
			 1860D–14(a)(3)(B)(v) of the Social Security Act (42 U.S.C.
			 1395w–114(a)(3)(B)(v)) is amended—</text>
				<paragraph id="HEFC7B29AF8F944A2B8DA85F90CCD3C64"><enum>(1)</enum><text>in subclause
			 (II)—</text>
					<subparagraph id="H130FA82E97084A14957CE7A4E0759D11"><enum>(A)</enum><text>by striking
			 <quote>may</quote> and inserting <quote>shall</quote>; and</text>
					</subparagraph><subparagraph id="HDB662D5D8CF844A5ABD9AC9853F771AA"><enum>(B)</enum><text>by inserting
			 <quote>(ii),</quote> after <quote>clause (i),</quote>; and</text>
					</subparagraph></paragraph><paragraph id="HFD868AC1863B4F8C933051CD2A4F8765"><enum>(2)</enum><text>by striking the
			 second sentence.</text>
				</paragraph></subsection><subsection commented="no" id="H156FA1EAADFF4517BE6041FA73B15AC7"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) shall take effect as of
			 the date of the enactment of this Act and apply to determinations made for
			 purposes of title XIX on or after the first date of the first plan year
			 beginning after the date of the enactment of this Act.</text>
			</subsection></section><section display-inline="no-display-inline" id="H9249BF12A3F94F2C0014A672C62CCE2" section-type="subsequent-section"><enum>8.</enum><header>Special enrollment
			 period for subsidy eligible individuals</header>
			<subsection id="H07451CCB15124CCCA8774D1FF7C6093C"><enum>(a)</enum><header>In
			 general</header><text>Section 1860D–1(b)(3) of the Social Security Act (42
			 U.S.C. 1395w–101(b)(3)) is amended by adding at the end the following new
			 subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="H3C6C298B87A54F1497423560AE93FAFA" style="OLC">
					<subparagraph commented="no" id="H4A4D1371BA964A4EA708EDE5438BB000"><enum>(F)</enum><header>Eligibility for
				low-income subsidy</header>
						<clause commented="no" id="HFB355FFE56FC41F3BCFC29004E43F758"><enum>(i)</enum><header>In
				general</header><text>In the case of an applicable subsidy eligible individual
				(as defined in clause (ii)), the special enrollment period described in clause
				(iii).</text>
						</clause><clause commented="no" id="H4CBDF43C5D614DFFB3809998E3EF9E00"><enum>(ii)</enum><header>Applicable
				subsidy eligible individual defined</header><text>For purposes of this
				subparagraph, the term <term>applicable subsidy eligible individual</term>
				means a part D eligible individual who is not described in subparagraph (D) and
				who is determined under subparagraph (B) of section 1860D–14(a)(3) to be a
				subsidy eligible individual (as defined in subparagraph (A) of such section),
				including such an individual who was enrolled in a prescription drug plan or an
				MA–PD plan on the date of such determination.</text>
						</clause><clause commented="no" id="H14F29B79EACA48EB9D39BB2BB9368D2F"><enum>(iii)</enum><header>Special
				enrollment period described</header><text>The special enrollment period
				described in this clause, with respect to an applicable subsidy eligible
				individual, is the period beginning on the date the individual receives
				notification that such individual has been determined under section
				1860D–14(a)(3)(B) to be a subsidy eligible individual (as so defined) and
				ending on the date the individual is no longer so
				eligible.</text>
						</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H5F06EFF3F0874FDEA73C506582F446EF"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to subsidy
			 determinations made for months beginning with January 2010.</text>
