		<official-title>To amend title XIX of the Social Security Act to require
		  Medicaid coverage of professional services of optometrists that are otherwise
		  covered when furnished by a physician.</official-title>

		<section id="H9EDF28A7E2664DB7BCD5A6E6DA4704B6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Optometric Equity in Medicaid Act of
			 2009</short-title></quote>.</text>
		</section><section id="H88A01C6B7F974557A1920464D1659CC2"><enum>2.</enum><header>Requiring
			 medicaid coverage of professional services of optometrists that are otherwise
			 covered when furnished by a physician</header>
			<subsection id="H2F7AD627CC4943AE9B0843D9DD7A45AD"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1905(a)(5) of
			 the Social Security Act (42 U.S.C. 1396d(a)(5)) is amended—</text>
				<paragraph id="HEB05ED66874E462FA94993FAE9C4BFD5"><enum>(1)</enum><text>by striking
			 <quote>and</quote> before <quote>(B)</quote>; and</text>
				</paragraph><paragraph id="H9E46D780D17D4B21859F27F069B69810"><enum>(2)</enum><text>by inserting
			 before the semicolon at the end the following: <quote>, and (C) medical and
			 other health services as defined in section 1861(s) and as authorized by State
			 law, furnished by an optometrist (described in section 1861(r)(4)) to the
			 extent such services may be performed under State law either by a doctor of
			 medicine or by a doctor of optometry and would be described in clause (A) if
			 furnished by a physician (as defined in section 1861(r)(1))</quote>.</text>
				</paragraph></subsection><subsection id="HF48B86CC29CD405DB69F6F379EBCB5F9"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by subsection (a) shall take effect on
			 the date of the enactment of this Act.</text>
