		  Institutions and an Office of Ombudsman for Community Financial Institutions,

		<section id="HC782C27575DB402BA79652CC2DF1D64" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Administrative Support and Oversight for Community
			 Financial Institutions Act of 2009</short-title></quote>.</text>
		</section><section id="H6975D93B4CF4469FAB00DF8743513FE6"><enum>2.</enum><header>Assistant
			 Secretary for Community Financial Institutions</header>
			<subsection id="HB4F4D07B11AF4A328662CCAEB47C1FEF"><enum>(a)</enum><header>Established</header><text display-inline="yes-display-inline">The 1st sentence of section 301(e) of title
			 31, United States Code, is amended—</text>
				<paragraph id="H5E7599E03C7C42C400B656D27E74D248"><enum>(1)</enum><text>by striking
			 <quote>10</quote> and inserting <quote>11</quote>; and</text>
				</paragraph><paragraph id="HD966014B6AA14854B9CFECF0BE0153CE"><enum>(2)</enum><text>by inserting
			 <quote>, 1 of whom shall be designated by the President as the Assistant
			 Secretary for Community Financial Institutions</quote> before the period at the
			 end.</text>
				</paragraph></subsection><subsection id="HA6C70F3BB7914021BB1DE42311337635"><enum>(b)</enum><header>Additional
			 duties</header><text>Subchapter I of chapter 3 of title 31, United States Code,
			 is amended by inserting after section 301 the following new section:</text>

					<section id="H0D5BE68F23E749A4905BFBC292E12638"><enum>301A.</enum><header>Assistant
				Secretary for Community Financial Institutions</header>
						<subsection id="H3B1ECA25080B4E9D9FED18686A7C6F5F"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">In addition to other
				duties and powers prescribed the Secretary, the Assistant Secretary for
				Community Financial Institutions designated under section 301(e) shall—</text>
							<paragraph id="HA332319A55BD4C2B00784F62D8B20083"><enum>(1)</enum><text>advise the
				Secretary on the impact of policies and regulations of the Department on
				community financial institutions; and</text>
							</paragraph><paragraph id="HD7A72BC8A9974D9CAFC51C445110084"><enum>(2)</enum><text>provide guidance to
				the Secretary to ensure that the policies and regulations of the Department
				strengthen community financial
				institutions.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H1385E12026024635AACB336D6E80A2A1"><enum>(c)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections for subchapter I of chapter 3 of title 31, United States Code, is
			 amended by inserting after the item relating to section 301 the following new
			 item:</text>

			</subsection></section><section id="HDD911CF186554693BBCA11B2FD9B2025"><enum>3.</enum><header>Office of
			 Ombudsman for Community Financial Institutions</header><text display-inline="no-display-inline">Section 301A of title 31, United States Code
			 (as added by section 2), is amended by adding at the end the following new
			 subsections:</text>
			<quoted-block display-inline="no-display-inline" id="HD77C4CDA35734FBE86428161A0B31C6E" style="OLC">
				<subsection id="HC71C0F62C24445A6B7D7577322928B1F"><enum>(b)</enum><header>Office of
				Ombudsman for Community Financial Institutions</header>
					<paragraph id="H9474CBBFAF2C40E3BC6FBED76DD780CE"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary of Treasury shall establish
				an Office of Ombudsman for Community Financial Institutions (hereafter in this
				subsection referred to as the <quote>Ombudsman Office</quote>), the head of
				which shall be the Assistant Secretary for Community Financial
				Institutions.</text>
					</paragraph><paragraph id="H67CC9E64A2BC44CB93BA3108DFFC6C9E"><enum>(2)</enum><header>Functions</header><text display-inline="yes-display-inline">The functions of the Assistant Secretary
				for Community Financial Institutions as the head of the Ombudsman Office shall
				be to provide assistance to and answer questions from community financial
				institutions regarding policies of the Secretary and their effects on community
				financial institutions.</text>
					</paragraph><paragraph id="H390D13F965804471B6A04C24F7B1951A"><enum>(3)</enum><header>Additional
				functions relating to TARP and P–PIP</header><text display-inline="yes-display-inline">The Assistant Secretary for Community
				Financial Institutions as the head of the Ombudsman Office shall also provide
				assistance to community financial institutions regarding—</text>
						<subparagraph id="H5E20B218A20A4B1593267521AF5AE99E"><enum>(A)</enum><text>applications and
				the application process for Troubled Asset Relief Program funds;</text>
						</subparagraph><subparagraph id="HA721CCA86DA94AA8BB6C294E4C237521"><enum>(B)</enum><text display-inline="yes-display-inline">sales of assets to or purchase of assets
				from the Public-Private Investment Program for Legacy Assets established by the
				Secretary of the Treasury, in conjunction with the Board of Governors of the
				Federal Reserve System and the Federal Deposit Insurance Corporation;</text>
						</subparagraph><subparagraph id="H9212A1DB56F2471DAF2201A61183C2CE"><enum>(C)</enum><text display-inline="yes-display-inline">status of pending applications for Troubled
				Asset Relief Program funds or sales to or purchases from the Public-Private
				Investment Program for Legacy Assets; and</text>
						</subparagraph><subparagraph id="HEE0E5C54BAF9442AA74AE5A5D2C15E55"><enum>(D)</enum><text display-inline="yes-display-inline">compliance with regulations associated with
				acceptance of Troubled Asset Relief Program funds or sales to or purchases from
				the Public-Private Investment Program for Legacy Assets.</text>
						</subparagraph><subparagraph id="H59001DFF92AC491D933C2D578B2C59B9"><enum>(E)</enum><header>Toll-free
				telephone numbers</header><text>The Assistant Secretary shall establish and
				maintain toll-free telephone assistance phone numbers as follows:</text>
							<clause id="H2A0D09F630EA43B5BBEDD4174EDA60FB"><enum>(i)</enum><text>A
				telephone number shall be made available for community financial institution
				general inquiries 8 hours a day and 7 days a week.</text>
							</clause><clause id="H106C979BE9974FB998536D5BF5D77327"><enum>(ii)</enum><text>A
				telephone number shall be made available for community financial institution
				inquiries about the Troubled Asset Relief Program 8 hours a day and 7 days a
				week.</text>
