		<official-title display="yes">To amend title 46, United States Code, to
		  direct the Secretary of Transportation to establish a maritime career training
		  loan program, and for other purposes.</official-title>

		<section id="H6377C02E45DF4790857358357AB3C333" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Maritime Workforce Development
			 Act</short-title></quote>.</text>
		</section><section id="HB2B2032116BE49F58A7EFB78A19750AA"><enum>2.</enum><header>Maritime
			 education loan program</header>
			<subsection id="HECF91756099342CB84384C14F7D2D9F1"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 517 of title
			 46, United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HB54E35D03E484D8080840501FD5D35DD" style="USC">
					<section id="HC908684366DC45BB941554BBCA910115"><enum>51705.</enum><header>Maritime
				career training loan program</header>
						<subsection id="HE2D26A304BDD435EB6071ED72B07FD88"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary of Transportation shall
				establish a maritime career training loan program (in this section referred to
				as the <quote>program</quote>) in accordance with the requirements of this
				section.</text>
						</subsection><subsection id="H890D8ED05DE24E6B90E7723ADC18098A"><enum>(b)</enum><header>Purpose</header><text>The
				purpose of the program shall be to make maritime career training loans
				available to eligible students to provide for the training of United States
				mariners.</text>
						</subsection><subsection id="HC82B0B9791F94DE0927817C136526448"><enum>(c)</enum><header>Administration</header><text display-inline="yes-display-inline">The program shall be carried out by the
				Secretary, acting through the Administrator of the Maritime
				Administration.</text>
						</subsection><subsection id="HF1BF079920BE4B65AD9D49A0F610A505"><enum>(d)</enum><header>Duties</header><text>The
				Secretary shall—</text>
							<paragraph id="HD8AAA25600EC404FB21D922B30DAA3CF"><enum>(1)</enum><text>allocate, on an
				annual basis, the award of loans under the program based on the needs of
				students;</text>
							</paragraph><paragraph id="H1AC1680459774D65BB91BCAC45C8C80A"><enum>(2)</enum><text display-inline="yes-display-inline">develop an application process and
				eligibility criteria for the award of loans under the program;</text>
							</paragraph><paragraph id="H80AAA887BEA4453EA0995E5704131283"><enum>(3)</enum><text>approve
				applications for loans under the program based on the eligibility criteria and
				allocations made under paragraph (1); and</text>
							</paragraph><paragraph id="HEEBC2E731922488BA2FEED50284C054C"><enum>(4)</enum><text>designate maritime
				training institutions at which loans made under the program may be used.</text>
							</paragraph></subsection><subsection id="H657B5AF65C7943A5B9CD884768EA073C"><enum>(e)</enum><header>Designation of
				maritime training institutions</header>
							<paragraph id="H33F3E7490C3C4E518F68654DA4826AD0"><enum>(1)</enum><header>In
				general</header><text>In designating maritime training institutions under
				subsection (d)(4), the Secretary—</text>
								<subparagraph id="H2D156692B29E45B5B0CC5C82D7A97F76"><enum>(A)</enum><text>may include
				Federal, State, and commercial training institutions and nonprofit training
				organizations, except that undergraduate students at the United States Merchant
				Marine Academy shall not be eligible for loans under the program;</text>
								</subparagraph><subparagraph id="HE24F49217B4B4C78B6180E160E0D9907"><enum>(B)</enum><text>shall designate
				institutions based on geographic diversity and scope of classes offered;</text>
								</subparagraph><subparagraph id="H2A3CDB7DCC984E5E9DFCD23E92EC4CA6"><enum>(C)</enum><text>shall ensure that
				designated institutions have the ability to administer the program; and</text>
								</subparagraph><subparagraph id="HE2FD5013B04840FAB0632A8FA3FC56F4"><enum>(D)</enum><text>shall ensure that
				designated institutions meet requirements to provide training instruction for
				appropriate Coast Guard-approved training instruction.</text>
								</subparagraph></paragraph><paragraph id="H65A50714C53C48A9ADD8D12EB4E4212D"><enum>(2)</enum><header>Exclusions</header><text>The
				Secretary—</text>
								<subparagraph id="HBFED749A92B64160A194314BAF419225"><enum>(A)</enum><text>may exclude from
				participation in the program a maritime training institution that has had
				severe performance deficiencies, including deficiencies demonstrated by audits
				or program reviews conducted during the 5 calendar years immediately preceding
				the present year;</text>
								</subparagraph><subparagraph id="H40F561CE442D41A7B9956A92DA551E0B"><enum>(B)</enum><text>shall exclude from
				participation in the program a maritime training institution that has
				delinquent or outstanding debts to the United States, unless such debts are
				being repaid under or in accordance with a repayment arrangement satisfactory
				to the United States, or the Secretary in the Secretary’s discretion determines
				that the existence or amount of any such debts has not been finally determined
				by the appropriate Federal agency;</text>
								</subparagraph><subparagraph id="H2544773282724543BD01EE9229C1BB26"><enum>(C)</enum><text>may exclude from
				participation in the program a maritime training institution that has failed to
				comply with quality standards established by the Department of Labor, the Coast
				Guard, or a State; and</text>
								</subparagraph><subparagraph id="H9EE2574CFB394F1DA2FFD8A939E16381"><enum>(D)</enum><text>may establish such
				other criteria as the Secretary determines will protect the financial interest
				of the United States and promote the purposes of this section.</text>
								</subparagraph></paragraph></subsection><subsection id="HFF0B25A60ADE4A638ED247355DCD6DB7"><enum>(f)</enum><header>State maritime
				academies</header>
							<paragraph id="H67B3A9D6C6D84ECA844E35DC9438C693"><enum>(1)</enum><header>Use of funds for
				loans to students attending State maritime academies</header><text>The
				Secretary may obligate not more than 50 percent of the amounts appropriated to
				carry out this section for a fiscal year for loans to undergraduate students
				attending State maritime academies receiving assistance under chapter 515 of
				this title.</text>
							</paragraph><paragraph id="H087A7792372248549A0F726F8382F496"><enum>(2)</enum><header>Academic
				standards for students</header><text>Students at State maritime academies
				receiving loans under the program shall maintain satisfactory progress toward
				the completion of their course of study as evidenced by the maintenance of a
				cumulative C average, or its equivalent, or academic standing consistent with
				the requirements for graduation, as determined by the institution.</text>
							</paragraph></subsection><subsection id="H387CA18286E84B8C8F6FA38109B7D1CD"><enum>(g)</enum><header>Loan amounts and
				use</header>
							<paragraph id="H3FD727D71BD84FE49D10C0F200444CCE"><enum>(1)</enum><header>Maximum
				amounts</header><text>The Secretary may not make loans to a student under the
				program in an amount that exceeds $15,000 in a calendar year or $60,000 in the
				aggregate.</text>
							</paragraph><paragraph id="HD79461C4D18C4C91A60A2C0493FDA6C2"><enum>(2)</enum><header>Use of loan
				proceeds</header><text>A student who receives a loan under the program may use
				the proceeds of the loan only for postsecondary expenses incurred at an
				institution designated by the Secretary under subsection (d)(4) for books,
				tuition, required fees, travel to and from training facilities, and room and
				board.</text>
							</paragraph></subsection><subsection id="H70DC9DDF196C42C5AABA9085CECD2197"><enum>(h)</enum><header>Student
				eligibility</header><text>To be eligible to receive a loan under the program, a
				student shall—</text>
							<paragraph id="HB741D0C6536A458BA193ED253084BDE4"><enum>(1)</enum><text>be eligible to
				hold a license or merchant mariner document issued by the Coast Guard;</text>
							</paragraph><paragraph id="H0EB1BC542DB644F98BF8738AE044B50E"><enum>(2)</enum><text>provide to the
				Secretary such information as the Secretary may require, including all current
				Coast Guard documents, certifications, proof of United States citizenship or
				permanent legal status, and a statement of intent to enter a maritime
				career;</text>
							</paragraph><paragraph id="HFB8740EEBA4F46318B9AD71B1F68A213"><enum>(3)</enum><text>meet the
				enrollment requirements of a maritime training institution designated by the
				Secretary under subsection (d)(4); and</text>
							</paragraph><paragraph id="HD0CC1A7C3F6847B3BCAFB246DAC9392A"><enum>(4)</enum><text>sign an agreement
				to—</text>
								<subparagraph id="HE84D9F6200054333A57C40B95D4AFF41"><enum>(A)</enum><text>complete a course
				of instruction at such a maritime training institution; and</text>
								</subparagraph><subparagraph id="H17B349EBFB774FD78C69C55E245896A0"><enum>(B)</enum><text display-inline="yes-display-inline">maintain a license or document and work
				under the authority of the license or document and any associated endorsements
				for at least 18 months following the date of graduation from the maritime
				program for which the loan proceeds will be used.</text>
								</subparagraph></paragraph></subsection><subsection id="H6BB847EFBAB2481C8579099AFADE1C13"><enum>(i)</enum><header>Administration
				of loans</header>
							<paragraph id="H3EAE4A8782BD4CE4B0A2D6EE363E7642"><enum>(1)</enum><header>Contents of loan
				agreements</header><text display-inline="yes-display-inline">Any agreement
				between the Secretary and a student borrower for a loan under the program
				shall—</text>
								<subparagraph commented="no" id="HD31CF1360C45477C89F666916D25570E"><enum>(A)</enum><text>be evidenced by a
				note or other written instrument that provides for the repayment of the
				principal amount of the loan and any origination fee, together with interest
				thereon, in equal installments (or, if the student borrower so requests, in
				graduated periodic installments determined in accordance with such schedules as
				may be approved by the Secretary) payable quarterly, bimonthly, or monthly, at
				the option of the student borrower, over a period beginning 9 months from the
				date on which the student borrower completes study or discontinues attendance
				at the maritime program for which the loans are used at the institution
				approved by the Secretary and not exceeding 10 years;</text>
								</subparagraph><subparagraph id="H7842B615992B4C918C881D56215ADEE3"><enum>(B)</enum><text>include provision
				for acceleration of repayment of the whole, or any part, of such loan, at the
				option of the student borrower;</text>
								</subparagraph><subparagraph id="H4CD7B34E0D1743D7A6BCD7B6C3EE32FB"><enum>(C)</enum><text>provide the loan
				without security and without endorsement;</text>
								</subparagraph><subparagraph id="HE2008307674D43F9A53563E7AC94E8B4"><enum>(D)</enum><text>provide that the
				liability to repay the loan shall be canceled upon the death of the student
				borrower, or if the student borrower becomes permanently and totally disabled,
				as determined in accordance with regulations to be issued by the
				Secretary;</text>
								</subparagraph><subparagraph id="HA285F1F275D7407C94EBFC31B7E64E88"><enum>(E)</enum><text>contain a notice
				of the system of disclosure of information concerning default on such loan to
				credit bureau organizations; and</text>
								</subparagraph><subparagraph id="H844474B2AC8D4573A98FB0232F5A3D8F"><enum>(F)</enum><text>include provisions
				for deferral of repayment, as determined by the Secretary.</text>
								</subparagraph></paragraph><paragraph id="H427F1BCD86324095A0E0E7551B120633"><enum>(2)</enum><header>Rate of
				interest</header><text>A student borrower who receives a loan under the program
				on or after January 1, 2010, and before October 1, 2015, shall be obligated to
				repay the loan amount to the Secretary, together with interest beginning in the
				period referred to in paragraph (1)(A), at a rate to be determined as
				follows:</text>
								<subparagraph id="H82C254DA2B9F4036BADF912EB7082DA4"><enum>(A)</enum><text>For a loan for
				which the first disbursement is made on or after January 1, 2010, and before
				October 1, 2011, 5.6 percent on the unpaid principal balance of the
				loan.</text>
								</subparagraph><subparagraph id="HC42F78AA23B8476386F6757432AC9CC1"><enum>(B)</enum><text>For a loan for
				which the first disbursement is made on or after October 1, 2011, and before
				October 1, 2012, 4.5 percent on the unpaid principal balance of the
				loan.</text>
								</subparagraph><subparagraph id="H4D46C3971B034A8E93888FDEDBEED7B9"><enum>(C)</enum><text>For a loan for
				which the first disbursement is made on or after October 1, 2012, 3.4 percent
				on the unpaid principal balance of the loan.</text>
								</subparagraph></paragraph><paragraph id="H1865FBF0DF004BC9AF2092C9AEE11A77"><enum>(3)</enum><header>Disclosure
				required prior to disbursement</header>
								<subparagraph id="H9A85E3D2785E4E2EA5B0B0279B8E9960"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall at or prior to the time the Secretary
				makes a loan to a student borrower under the program, provide thorough and
				adequate loan information on such loan to the student borrower. The disclosures
				required by this paragraph may be made as part of the written application
				material provided to the student borrower, as part of the promissory note
				evidencing the loan, or on a separate written form provided to the student
				borrower.</text>
								</subparagraph><subparagraph id="HD49634DCC8AC449A8442D2CE0CD92F57"><enum>(B)</enum><header>Contents</header><text>The
				disclosures shall include—</text>
									<clause id="H4AF8E82B8D444B6C962B38CDCFD0FFDE"><enum>(i)</enum><text>the address to
				which communications and payments should be sent;</text>
									</clause><clause id="HB6DE7FC640F64B11A8423E8AE88D1655"><enum>(ii)</enum><text>the principal
				amount of the loan;</text>
									</clause><clause id="HD91F8498FEDE4ABF9730A92F941FD986"><enum>(iii)</enum><text>the amount of
				any charges collected at or prior to the disbursal of the loan and whether such
				charges are to be deducted from the proceeds of the loan or paid separately by
				the student borrower;</text>
									</clause><clause id="H71F4B066F22C4A14926BF30F29E3BB37"><enum>(iv)</enum><text>the stated
				interest rate on the loan;</text>
									</clause><clause id="H1B42D1EA362B48A9B4811D56F91EC8D1"><enum>(v)</enum><text>the yearly and
				cumulative maximum amounts that may be borrowed;</text>
									</clause><clause id="H7D92C78CE8744D3ABB69FE09E3D94B18"><enum>(vi)</enum><text>an explanation of
				when repayment of the loan will be required and when the student borrower will
				be obligated to pay interest that accrues on the loan;</text>
									</clause><clause id="HD2E7A41DDC2147E9AEBAD4278C622A45"><enum>(vii)</enum><text>a statement as
				to the minimum and maximum repayment term that the Secretary may impose, and
				the minimum monthly payment required by law and a description of any penalty
				imposed as a consequence of default, such as liability for expenses reasonably
				incurred in attempts by the Secretary to collect on a loan;</text>
									</clause><clause id="HB0D0AF085D3349C3A5AA384997A4CA00"><enum>(viii)</enum><text>a statement of
				the total cumulative balance, including the loan applied for, owed by the
				student borrower to the Secretary, and an estimate of the projected monthly
				payment, given such cumulative balance;</text>
									</clause><clause id="H0EEDEA76692046B5805C266ECEF04006"><enum>(ix)</enum><text>an explanation of
				any special options the student borrower may have for loan consolidation or
				other refinancing of the loan;</text>
									</clause><clause id="HFB441BE785434FE4912A08C17062C64E"><enum>(x)</enum><text>a
				statement that the student borrower has the right to prepay all or part of the
				loan, at any time, without penalty;</text>
									</clause><clause id="H45D307F670E44107B11400D1699F2A18"><enum>(xi)</enum><text>a
				statement summarizing circumstances in which repayment of the loan or interest
				that accrues on the loan may be deferred, and a brief notice of the program for
				repayment of loans, on the basis of military service, pursuant to the
				Department of Defense educational loan repayment program (10 U.S.C.
				16302);</text>
									</clause><clause id="H3D28C487475D496782CC077567D5F92D"><enum>(xii)</enum><text>a definition of
				default and the consequences to the student borrower if the student borrower
				defaults, together with a statement that the disbursement of, and the default
				on, a loan under this part shall be reported to a credit bureau or credit
				reporting agency;</text>
									</clause><clause id="H5236E5DD716D4306974209427C609A97"><enum>(xiii)</enum><text>to the extent
				practicable, the effect of accepting the loan on the eligibility of the student
				borrower for other forms of student assistance; and</text>
									</clause><clause id="H4710835492394AE1AAE1D9C38697E0B9"><enum>(xiv)</enum><text>an explanation
				of any cost the student borrower may incur in the making or collection of the
				loan.</text>
									</clause></subparagraph><subparagraph id="HC61701F8B88242379D6EBD5D82FFAD7E"><enum>(C)</enum><header>Information to
				be provided without cost</header><text>The information provided under this
				paragraph shall be available to the Secretary without cost to the student
				borrower.</text>
								</subparagraph></paragraph><paragraph id="H06BCF6B0172E4F508EE13B7494E41C60"><enum>(4)</enum><header>Repayment after
				default</header><text>The Secretary may require any student borrower who has
				defaulted on a loan made under the program to—</text>
								<subparagraph id="H2FBB964056BF444F90864EEF203ADDC9"><enum>(A)</enum><text>pay all reasonable
				collection costs associated with such loan; and</text>
								</subparagraph><subparagraph id="H67FE7CA36A394B5FAEAF46852F140489"><enum>(B)</enum><text>repay the loan
				pursuant to an income contingent repayment plan.</text>
								</subparagraph></paragraph><paragraph id="H9E37999DC58F4177B483DB0BBF6A9A82"><enum>(5)</enum><header>Authorization to
				reduce rates and fees</header><text>Notwithstanding any other provision of this
				section, the Secretary may prescribe by regulation any reductions in the
				interest rate or origination fee paid by a student borrower of a loan made
				under the program as the Secretary determines appropriate to encourage ontime
				repayment of the loan. Such reductions may be offered only if the Secretary
				determines the reductions are cost neutral and in the best financial interest
				of the United States.</text>
							</paragraph><paragraph id="HA3FCA462447B4565A24FED9FEA23D145"><enum>(6)</enum><header>Collection of
				repayments</header><text>The Secretary shall collect repayments made under the
				program and exercise due diligence in such collection, including maintenance of
				all necessary records to ensure that maximum repayments are made. Collection
				and servicing of repayments under the program shall be pursued to the full
				extent of the law, including wage garnishment if necessary. The Secretary of
				the Department in which the Coast Guard is operating shall provide the
				Secretary of Transportation with any information regarding a mariner that may
				aid in the collection of repayments under this section.</text>
							</paragraph><paragraph commented="no" id="HA1053B2540C64045AEAF41834260533D"><enum>(7)</enum><header>Repayment
				schedule</header><text display-inline="yes-display-inline">A student borrower
				who receives a loan under the program shall repay the loan quarterly,
				bimonthly, or monthly, at the option of the student borrower, over a period
				beginning 9 months from the date the student borrower completes study or
				discontinues attendance at the maritime program for which the loan proceeds are
				used and ending not more than 10 years after the date repayment begins.
				Provisions for deferral of repayment shall be determined by the
				Secretary.</text>
							</paragraph><paragraph id="H5592D2D1B7824366BCFF844B66986CB8"><enum>(8)</enum><header>Contracts for
				servicing and collection of loans</header><text display-inline="yes-display-inline">The Secretary may—</text>
								<subparagraph id="H940DDB4B8521484BAC2136B212D09EAA"><enum>(A)</enum><text>enter into a
				contract or other arrangement with State or nonprofit agencies and, on a
				competitive basis, with collection agencies for servicing and collection of
				loans under this section; and</text>
								</subparagraph><subparagraph id="H51735E9574EC464FA3C290D9AE3A5BF9"><enum>(B)</enum><text>conduct litigation
				necessary to carry out this section.</text>
								</subparagraph></paragraph></subsection><subsection id="HC9F5987C72C8479BB98C78C8B4721A81"><enum>(j)</enum><header>Revolving loan
				fund</header>
							<paragraph id="HC5FFA5AB491E4F93AC8556BA416D119F"><enum>(1)</enum><header>Establishment</header><text>The
				Secretary shall establish a revolving loan fund consisting of amounts deposited
				in the fund under paragraph (2).</text>
							</paragraph><paragraph id="HD9472AFB3ACE450989938FEFCA550D51"><enum>(2)</enum><header>Deposits</header><text>The
				Secretary shall deposit in the fund—</text>
								<subparagraph id="H7346E1BB0B0C47D589C5C0968BEB3A42"><enum>(A)</enum><text>receipts from the
				payment of principal and interest on loans made under the program; and</text>
								</subparagraph><subparagraph id="H74D34F0F10024344A1D71BA4A021996E"><enum>(B)</enum><text display-inline="yes-display-inline">any other monies paid to the Secretary by
				or on behalf of individuals under the program.</text>
								</subparagraph></paragraph><paragraph id="H8615BCE2B6C841D9AA57D9C32B52D73A"><enum>(3)</enum><header>Availability of
				amounts</header><text>Amounts in the fund shall be available to the Secretary,
				without further appropriation—</text>
								<subparagraph id="HFDA9FC68D8354079953169C9ECEE70AD"><enum>(A)</enum><text>to cover the
				administrative costs of the program, including the maintenance of records and
				making collections under this section; and</text>
								</subparagraph><subparagraph id="H9A52A371CAF24F519FD6AA3C2E95E17B"><enum>(B)</enum><text>to the extent that
				amounts remain available after paying such administrative costs, to make loans
				under the program.</text>
								</subparagraph></paragraph><paragraph id="HD0EA7D4BFD254D59B6037958D734D5BD"><enum>(4)</enum><header>Maintenance of
				records</header><text>The Secretary shall maintain accurate records of the
				administrative costs referred to in paragraph (3)(A).</text>
							</paragraph></subsection><subsection id="H77A001A49F7B46738FAD1A738E709C05"><enum>(k)</enum><header>Annual
				report</header><text display-inline="yes-display-inline">The Secretary, on an
				annual basis, shall submit to the Committee on Transportation and
				Infrastructure of the House of Representatives and the Committee on Commerce,
				Science, and Transportation of the Senate a report on the program,
				including—</text>
							<paragraph id="HB7BDD81BA1ED4C5AA9BA723631B04714"><enum>(1)</enum><text>the total amount
				of loans made under the program in the preceding year;</text>
							</paragraph><paragraph id="HC4EBB352544D45439CDF2CCB801D3562"><enum>(2)</enum><text>the number of
				students receiving loans under the program in the preceding year; and</text>
							</paragraph><paragraph id="HAAC0FAF21AA24BFABB3CE7876CFF5BCE"><enum>(3)</enum><text>the total amount
				of loans made under program that are in default as of the date of the
				report.</text>
							</paragraph></subsection><subsection id="H5C1B2BDC7E634EB4B90E83CA438CB68B"><enum>(l)</enum><header>Authorization of
				appropriations</header><text>There are authorized to be appropriated for each
				of fiscal years 2010 through 2015—</text>
							<paragraph id="H79B4674842BC4231B89334343DDC3199"><enum>(1)</enum><text>$10,000,000 for
				making loans under the program; and</text>
							</paragraph><paragraph id="HB1B6CE0A4D94496684D7825674C797CB"><enum>(2)</enum><text>$1,000,000 for
				administrative expenses of the Secretary in carrying out the program.</text>
							</paragraph></subsection></section><section id="H4BB92C10AD34494EBDA955102C050FC2"><enum>51706.</enum><header>Maritime
				recruitment, training, and retention grant program</header>
						<subsection id="H73C7A0BEBCD24CCBA4B7B369136A5D4E"><enum>(a)</enum><header>Strategic
				plan</header>
							<paragraph id="H5025DAD5FA76445B82BBF31B9CA4B8FD"><enum>(1)</enum><header>In
				general</header><text>Not later than one year after the date of enactment of
				this section, and at least once every 3 years thereafter, the Secretary of
				Transportation, acting through the Administrator of the Maritime
				Administration, shall publish in the Federal Register a plan that describes the
				demonstration, research, and multistate project priorities of the Department of
				Transportation concerning merchant mariner recruitment, training, and retention
				for the 3-year period following the date of publication of the plan.</text>
							</paragraph><paragraph id="HD352682F84AE4323BBBF0777D6A4D369"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">A plan published under paragraph (1) shall
				contain strategies and identify potential projects to address merchant mariner
				recruitment, training, and retention issues in the United States.</text>
							</paragraph><paragraph id="H1D0133C9B516451E85A2274980D5BD15"><enum>(3)</enum><header>Factors</header><text>In
				developing a plan under paragraph (1), the Secretary shall take into account,
				at a minimum—</text>
								<subparagraph id="H47713D135338491783E1C9EDD58805EE"><enum>(A)</enum><text>the availability
				of existing research (as of the date of publication of the plan);</text>
								</subparagraph><subparagraph id="H04315E29572C40058E6A178D2CC89FC7"><enum>(B)</enum><text>the need to ensure
				results that have broad applicability;</text>
								</subparagraph><subparagraph id="HF7A9BF22A97C430D951E4FE78FE09D44"><enum>(C)</enum><text>the benefits of
				economies of scale and the efficiency of potential projects; and</text>
								</subparagraph><subparagraph id="H4F5313DA95EE43EC9496DAEF7B66D1A3"><enum>(D)</enum><text>the likelihood
				that the results of potential projects will be useful to policymakers and
				stakeholders in addressing merchant mariner recruitment, training, and
				retention issues.</text>
								</subparagraph></paragraph><paragraph id="H0DFE39BFC93D4509B91A75BD0DC48818"><enum>(4)</enum><header>Consultation</header><text>In
				developing a plan under paragraph (1), the Secretary shall consult with
				representatives of the maritime industry, labor organizations, and other
				governmental entities and parties with an interest in the maritime
				industry.</text>
							</paragraph><paragraph id="H674E90C06BD844A2B6E38BE9BC395E1B"><enum>(5)</enum><header>Transmittal to
				Congress</header><text>The Secretary shall transmit copies of a plan published
				under paragraph (1) to the Committee on Transportation and Infrastructure of
				the House of Representatives and the Committee on Commerce, Science, and
				Transportation of the Senate.</text>
							</paragraph></subsection><subsection id="H20E0C5402CB944119836232F447572D5"><enum>(b)</enum><header>Demonstration
				projects</header>
							<paragraph id="H6FFD736E884341239502710D2E0BC938"><enum>(1)</enum><header>In
				general</header><text>The Secretary may award grants to a maritime training
				institution to carry out demonstration projects that implement the priorities
				identified in the plan prepared under subsection (a)(1), for the purpose of
				developing and implementing methods to address merchant mariner recruitment,
				training, and retention issues.</text>
							</paragraph><paragraph id="HFFB4354349484BF486DF945FF9D38576"><enum>(2)</enum><header>Grant
				awards</header><text>Grants shall be awarded under this subsection on a
				competitive basis under guidelines and requirements to be established by the
				Secretary.</text>
							</paragraph><paragraph id="H4066DE21DDEE410E9FF312464F47DF33"><enum>(3)</enum><header>Applications</header><text>To
				be eligible to receive a grant for a project under this subsection, a maritime
				training institution shall submit to the Secretary a grant proposal that
				includes, at a minimum—</text>
								<subparagraph id="HC7C213DFABCD4358B1198966861C8813"><enum>(A)</enum><text>information
				demonstrating the estimated effectiveness of the project; and</text>
								</subparagraph><subparagraph id="HDDAB989C99254BB8BDE7BE5882262F57"><enum>(B)</enum><text>a method for
				evaluating the effectiveness of the project.</text>
								</subparagraph></paragraph><paragraph id="H38CD72E25BA045CCAB2E6F8AB1EC164F"><enum>(4)</enum><header>Eligible
				projects</header><text>Projects eligible for grants under this subsection may
				include—</text>
								<subparagraph id="H3825837D382745F593F334075BE415FB"><enum>(A)</enum><text>the establishment
				of maritime technology skill centers developed through local partnerships of
				industry, labor, education, community-based organizations, economic development
				organizations, or Federal, State, and local government agencies to meet unmet
				skills needs of the maritime industry;</text>
								</subparagraph><subparagraph id="H13B0B4E409BC466EB995B8AC54ED1B38"><enum>(B)</enum><text>projects that
				provide training to upgrade the skills of workers who are employed in the
				maritime industry;</text>
								</subparagraph><subparagraph id="H2F99063B2C9C46BF9A9B333594E916BF"><enum>(C)</enum><text>projects that
				promote the use of distance learning, enabling students to take courses through
				the use of media technology, such as videos, teleconferencing, and the
				Internet;</text>
								</subparagraph><subparagraph id="HDE8E461C904948A59A09E2A02B1A23F1"><enum>(D)</enum><text>projects that
				assist in providing services to address maritime recruitment and training of
				youth residing in targeted high poverty areas within empowerment zones and
				enterprise communities;</text>
								</subparagraph><subparagraph id="H45DB89060C7A45A5BF33136E760DA4A2"><enum>(E)</enum><text>the establishment
				of partnerships with national and regional organizations with special expertise
				in developing, organizing, and administering merchant mariner recruitment and
				training services; and</text>
								</subparagraph><subparagraph id="H11279F296F7A42D5929A4173F43F9F98"><enum>(F)</enum><text>the establishment
				of maritime training programs that foster technical skills and operational
				productivity in communities in which economies are related to or dependent upon
				the maritime industry.</text>
								</subparagraph></paragraph></subsection><subsection id="H5CD4C8A4B2B249AABA8E47D150472B36"><enum>(c)</enum><header>Projects
				authorized</header>
							<paragraph id="HF3B25C8DE317448CAC7AFB99662FDDC0"><enum>(1)</enum><header>Projects</header><text display-inline="yes-display-inline">The Secretary may award grants to carry out
				projects identified in a plan published under subsection (a)(1) under which the
				project sponsor will—</text>
								<subparagraph id="H9E69F48093324802AE2314B6B50CA94A"><enum>(A)</enum><text>design, develop,
				and test an array of approaches to providing recruitment, training, or
				retention services to one or more targeted populations;</text>
								</subparagraph><subparagraph id="HB97A4F67A8984C13859E142BD1F47AAB"><enum>(B)</enum><text>in conjunction
				with employers, organized labor, other groups (such as community coalitions),
				and Federal, State, or local agencies, design, develop, and test various
				training approaches in order to determine effective practices; or</text>
								</subparagraph><subparagraph id="H98F17966D31C4562AC8DD4D03375DD50"><enum>(C)</enum><text>assist in the
				development and replication of effective service delivery strategies for the
				national maritime industry as a whole.</text>
								</subparagraph></paragraph><paragraph id="H4A694D642B8B412AAB5E2BFEB5238BDB"><enum>(2)</enum><header>Research
				projects</header><text display-inline="yes-display-inline">The Secretary may
				award grants to carry out research projects identified in a plan published
				under subsection (a)(1) that will contribute to the solution of maritime
				industry recruitment, training, and retention issues in the United
				States.</text>
							</paragraph><paragraph id="HFD6B44A2A3F84F19B0E09837C1D4FF09"><enum>(3)</enum><header>Multistate or
				regional projects</header><text>The Secretary may award grants to carry out
				multistate or regional projects identified in a plan published under subsection
				(a)(1) to effectively disseminate best practices and models for implementing
				maritime recruitment, training, and retention services designed to address
				industry-wide skill shortages.</text>
							</paragraph><paragraph id="H8B8AA584281B477BB2F338E7F80C8E99"><enum>(4)</enum><header>Grant
				awards</header><text>Grants shall be awarded under this subsection on a
				competitive basis under guidelines and requirements to be established by the
				Secretary.</text>
							</paragraph></subsection><subsection id="H20BB905E61814D72B25699329449ECBC"><enum>(d)</enum><header>Authorization of
				appropriations</header><text>There are authorized to be appropriated for each
				of fiscal years 2010 through 2015—</text>
							<paragraph id="HCD096CEFDBA74343B0AC4D1D68040832"><enum>(1)</enum><text>$10,000,000 for
				making grants under this section; and</text>
							</paragraph><paragraph id="H370967455EC94DF7A8ED01DF58D2A614"><enum>(2)</enum><text>$1,000,000 for
				administrative expenses of the Secretary in carrying out this
				section.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H696A8EDA0D4145F8A62E0A82DADFA87A"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The analysis for such chapter is amended by adding at
			 the end the following:</text>
