		  new energy efficient home credit and to provide a credit against tax for the

		<section id="HDA88DDA8EB0740870063226C3C9D0026" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Next Generation Homes Act of
			 2009</short-title></quote> .</text>
		</section><section id="H8E84052DD8724FC198158F87A978C00"><enum>2.</enum><header>Modification of
			 new energy efficient home credit</header>
			<subsection id="HF63CE3C010D14A48897111050089DAAD"><enum>(a)</enum><header>In
			 general</header>
				<paragraph id="H679C3EF7E88E45A4A86C3E76E1B2207F"><enum>(1)</enum><header>Modification of
			 credit amount</header><text display-inline="yes-display-inline">Paragraph (2)
			 of section 45L(a) of the Internal Revenue Code of 1986 (relating to applicable
			 amount) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H7D74923EB7424AE6AA417F634579CD69" style="OLC">
						<paragraph id="H2624E5A3DB694BB8A0AB74A4D27C113"><enum>(2)</enum><header>Applicable
				amount</header><text display-inline="yes-display-inline">For purposes of
				paragraph (1), the applicable amount is an amount equal to—</text>
							<subparagraph id="H6253714550E7479191390088AA30016"><enum>(A)</enum><text>in the case of an
				Energy Star Home, $700,</text>
							</subparagraph><subparagraph id="HA41DA3E68A46499BB825EE7900FD3007"><enum>(B)</enum><text>in the case of an
				Energy Plus Home, $2,000,</text>
							</subparagraph><subparagraph id="H1702103BC8014873A4128349C655F772"><enum>(C)</enum><text>in the case of an
				Energy Saver Home, $5,000, and</text>
							</subparagraph><subparagraph id="H34CCC95C8D684FBBB003F723BD468A4"><enum>(D)</enum><text>in the case of Zero
				Energy Home,
				$10,000.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H0C237B2C9A0F444196E5CDAE37F612F3"><enum>(2)</enum><header>Modification of
			 energy saving requirement</header><text>Subsection (c) of section 45L of such
			 Code is amended to read as follows:</text>

						<subsection id="H0B6B190B9BBE4DD381F2F8A7A075CE03"><enum>(c)</enum><header>Energy savings
				requirements</header>
							<paragraph id="HB150C9E97807414F9FD4E48C0067EB10"><enum>(1)</enum><header>In
				general</header><text>A dwelling unit meets the energy savings requirements of
				this subsection if such unit is described in paragraph (2).</text>
							</paragraph><paragraph id="HE63CD445E74A4CC98884223D5769E9C3"><enum>(2)</enum><header>Applicable
				dwelling units</header><text>For purposes of this section—</text>
								<subparagraph id="H362EF7AC1C734D8D001EDDE5D671C4DB"><enum>(A)</enum><header>Energy Star
				home</header><text>The term <term>Energy Star Home</term> means a dwelling unit
				which meets the requirements established by the Administrator of the
				Environmental Agency under the Energy Star Labeled Homes program.</text>
								</subparagraph><subparagraph id="HEC9B3069B4AC40C5BED319CC8816F969"><enum>(B)</enum><header>Energy Plus
				Home</header><text display-inline="yes-display-inline">The term <term>Energy
				Plus Home</term> means a dwelling unit which is certified under the most recent
				Mortgage Industry National Home Energy Rating Systems Standards as having a
				relative energy use index value of more than 50, but not more than 70.</text>
								</subparagraph><subparagraph id="H370FFCB5ECB742E49C147320336FE8E4"><enum>(C)</enum><header>Energy Saver
				Home</header><text display-inline="yes-display-inline">The term <term>Energy
				Saver Home</term> means a dwelling unit which meets the requirements of
				subparagraph (B) applied by substituting <quote>0</quote> for <quote>50</quote>
				and <quote>50</quote> for <quote>70</quote>.</text>
								</subparagraph><subparagraph id="H2F9A95F792554C1380E0BAC000C01BFC"><enum>(D)</enum><header>Zero energy
				home</header><text display-inline="yes-display-inline">The term <term>Zero
				Energy Home</term> means a dwelling unit which meets the requirements of
				subparagraph (B) applied by substituting <quote>0</quote> for <quote>more than
				50, but not more than 70</quote>.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H01201EF5B3F1420DA71C704C477794A3"><enum>(3)</enum><header>Modification of
			 termination</header><text>Subsection (g) of section 45L of such Code (relating
			 to termination) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HC4D66AC3B3024FEDB4DD2E043CCF438" style="OLC">
						<subsection id="H62784906F0544EAFB85F012F79C1BAE"><enum>(g)</enum><header>Termination</header><text display-inline="yes-display-inline">This section shall not apply to any
				qualified new energy efficient home acquired after—</text>

				Energy Star Home, December 31, 2011,</text>
							</paragraph><paragraph id="H94674324F6274CC000D3FA6F55A71998"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of a Energy Star Home, December
				31, 2013,</text>
							</paragraph><paragraph id="H21EA527E0B6149C2A7E403337872DCE"><enum>(3)</enum><text display-inline="yes-display-inline">in the case of a Energy Plus Home, December
				31, 2015, and</text>
							</paragraph><paragraph id="H3F8BF08F93164288B79C001FD9E49814"><enum>(4)</enum><text>in the case of a
				Zero Energy Home, December 31,
				2018.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HDE2DB505CDBE457491975DBC10DE0985"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply to new energy efficient homes acquired after December
			 31, 2008.</text>
			</subsection></section><section id="H655D258FBDC04C0AADFE6228804049AE"><enum>3.</enum><header>Energy efficient
			 residence credit</header>
			<subsection id="H9A712EABF95B4D0F9F87399F241B7518"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subpart A of part IV
			 of subchapter A of chapter 1 of the Internal Revenue Code of 1986 is amended by
			 inserting after section 25D the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="HF303AC356DAE4775B563D26B6CA8A7D9" style="OLC">
					<section id="HDBCD0C42A19348619DB3608F4C568DE3"><enum>25E.</enum><header>Energy
				efficient residence credit</header>
						<subsection id="H74029C3218F9425D9818BA2D5B68EE74"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">In the case of an
				individual who purchases a qualified energy efficient residence in the United
				States during a taxable year, there shall be allowed as a credit against the
				tax imposed by this chapter for such taxable year an amount equal to the
				applicable amount determined under subsection (c).</text>
						</subsection><subsection id="HEB8BA36BE9B14979B8C16943C79FC28F"><enum>(b)</enum><header>Qualified energy
				efficient residence</header><text>For purposes of this section, the term
				<quote>qualified energy efficient residence</quote> means any principal
				residence (within the meaning of section 121) of the taxpayer which is an
				Energy Star Home, Energy Plus Home, Energy Saver Home, or Zero Energy Home (as
				each is defined in section 45L(c)(2)).</text>
						</subsection><subsection id="H1E8DB8D8CC574F1483A310A79B5900D5"><enum>(c)</enum><header>Applicable
				amount</header><text>For purposes of this section—</text>
							<paragraph id="H18276F512B5C4490B36F6FEB7509D8F0"><enum>(1)</enum><header>In
				general</header><text>The applicable amount shall be—</text>
								<subparagraph id="HC54BE905A7C448E38C385F56A5513263"><enum>(A)</enum><text>in the case of an
				Energy Star Home, $700,</text>
								</subparagraph><subparagraph id="H07CA44CF058C4C5AA731DAEF809B8772"><enum>(B)</enum><text>in the case of an
				Energy Plus Home, $2,000,</text>
								</subparagraph><subparagraph id="HFACF35C6A2884D4FB186D4EF06A748FD"><enum>(C)</enum><text>in the case of an
				Energy Saver Home, $5,000, and</text>
								</subparagraph><subparagraph id="H4DCFE090F7E54669B3966C9E2CD4D97"><enum>(D)</enum><text>in the case of Zero
				Energy Home, $10,000.</text>
								</subparagraph></paragraph><paragraph id="H1FB5BF8545A84AE7AB80007E55A9287D"><enum>(2)</enum><header>Married filing
				separately</header><text>In the case of a married individual filing a separate
				return, the applicable amount shall be 50 percent of the amount in effect under
				paragraph (1) applicable to the qualified energy efficient home
				involved.</text>
							</paragraph><paragraph id="H14B2D5CF47714316A036FD79479CE529"><enum>(3)</enum><header>Other
				individuals</header><text display-inline="yes-display-inline">If two or more
				individuals who are not married purchase a principal residence, the amount of
				the credit allowed under subsection (a) shall be allocated among such
				individuals in such manner as the Secretary may prescribe, except that the
				total amount of the credits allowed to all such individuals shall not exceed
				the amount in effect under paragraph (1) applicable to the qualified energy
				efficient home involved.</text>
							</paragraph></subsection><subsection id="HA3407AC1AB984FB7A5C23C8DC2BB35B"><enum>(d)</enum><header>Definition and
				special rules</header><text>For purposes of this section—</text>
							<paragraph id="HF48F1143ACC7412F96CA42173E9CE386"><enum>(1)</enum><header>Purchase</header><text display-inline="yes-display-inline">The term <quote>purchase</quote> shall have
				the meaning given such term by section 36.</text>
							</paragraph><paragraph commented="no" id="H1E96416A931E414000238CE8D4290000"><enum>(2)</enum><header>Rules made
				applicable</header><text>Rules similar to the rules of subsections (d) and (f)
				of section 36 shall apply. For purposes of the preceding sentence, such
				subsection (f) shall be applied without regard to paragraph (4)(D)
				thereof.</text>
							</paragraph></subsection><subsection commented="no" id="H9B37B97C5163480EADB2421ED18D1242"><enum>(e)</enum><header>Termination</header><text display-inline="yes-display-inline">This section shall not apply to any
				qualified energy efficient residence purchased after—</text>
							<paragraph commented="no" id="H75377893663643EBBD2B9D8E7638B1D6"><enum>(1)</enum><text>in the case of an
				Energy Star Home, December 31, 2011,</text>
							</paragraph><paragraph commented="no" id="HDDCB0C080A974372AA06D9944061BF87"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of a Energy Star Home, December
				31, 2013,</text>
							</paragraph><paragraph commented="no" id="H21EC30BC4BD644B58C6BB4B13E57AF25"><enum>(3)</enum><text display-inline="yes-display-inline">in the case of a Energy Plus Home, December
				31, 2015, and</text>
							</paragraph><paragraph commented="no" id="HB97A72580D894547A744A7C2ED8A0D"><enum>(4)</enum><text>in the case of a
				Zero Energy Home, December 31,
				2018.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H91C81975EE034B5EB6719F335FAA6710"><enum>(b)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections for subpart A of part IV of subchapter A of chapter 1 of such Code is
			 amended by inserting after the item relating to section 25D the following new
			 item:</text>

			</subsection><subsection id="H83B9D3AC0E4F4FD2AD3EE3B4CABA453"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to
			 residences purchased after the date of the enactment of this Act.</text>
