<section id="H48A0650CC2BE4166819BDBA9EAF9EC14" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Michael Jon Newkirk Transportation Safety Enhancement Act of 2009</short-title></quote>.</text></section> 
<section id="HEAF95E866CFF4B46A67020FC9D9C0582"><enum>2.</enum><header>State safety inspections of motor vehicles</header> 
<subsection id="H56B0C4EFE65E4909A73499D89F55E0F6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Chapter I of title 23, United States Code, is amended by adding at the end the following:</text>

<section id="H944224E772944E9789413F30FDBD9C37"><enum>167.</enum><header>State safety inspections of motor vehicles</header> 
<subsection id="HC2C64575DBAA429EA9E12FBBAE19BB84"><enum>(a)</enum><header>Withholding of apportionments for noncompliance</header> 
<paragraph id="HD03C1AFB25164284AF428FF303E9FD6"><enum>(1)</enum><header>Fiscal year 2012</header><text>On October 1, 2011, the Secretary shall withhold 5 percent of the amount required to be apportioned to a State on that date under each of paragraphs (1), (3), and (4) of section 104(b) if the State does not meet the requirements of paragraph (3) on that date.</text></paragraph> 
<paragraph id="H072C9EB70463409C9614CDA1BBC29C8B"><enum>(2)</enum><header>Thereafter</header><text>On October 1, 2012, and on the first day of each fiscal year thereafter, the Secretary shall withhold 10 percent of the amount required to be apportioned to a State on that date under each of paragraphs (1), (3), and (4) of section 104(b) if the State does not meet the requirements of paragraph (3) on that date.</text></paragraph> 
<paragraph id="H3B287127F8F94D2182696D42BF739ED1"><enum>(3)</enum><header>Requirement</header><text display-inline="yes-display-inline">A State meets the requirements of this paragraph if the State has enacted and is enforcing a law that requires the owner of a motor vehicle (as such term is defined in section 154(a)) registered in the State to present the vehicle for inspection on an annual basis to ensure that the vehicle meets or exceeds motor vehicle safety standards to be established by the State. At a minimum, such standards shall ensure that the seatbelts and speedometer installed in the vehicle are operable.</text></paragraph></subsection> 
<subsection id="HC72082A4400249DDB2174088A37EF86E"><enum>(b)</enum><header>Apportionment of withheld funds after compliance</header> 
<paragraph display-inline="no-display-inline" id="H9FAB5FE3981949D2AA2B9B493DDFD607"><enum>(1)</enum><header>Period of availability of withheld funds</header> 
<subparagraph id="H241456061B6E4B4D91EA47A24001CC00"><enum>(A)</enum><header>Funds withheld on or before September 30, 2013</header><text>Any funds withheld under subsection (a) from apportionment to any State on or before September 30, 2013, shall remain available until the end of the third fiscal year following the fiscal year for which the funds are authorized to be appropriated.</text></subparagraph> 
<subparagraph id="HEEC609A1B4BA4880A7DDC181EAB2A5"><enum>(B)</enum><header>Funds withheld after September 30, 2013</header><text>No funds withheld under this section from apportionment to any State after September 30, 2013, shall be available for apportionment to the State.</text></subparagraph></paragraph> 
<paragraph id="HB730208DC6DA4DB5896C3D3D99EDE560"><enum>(2)</enum><header>Apportionment</header><text display-inline="yes-display-inline">If, before the last day of the period for which funds withheld under subsection (a) from apportionment are to remain available for apportionment to a State under paragraph (1), the State meets the requirement of subsection (a)(3), the Secretary shall, on the first day on which the State meets the requirement, apportion to the State the funds withheld under subsection (a) that remain available for apportionment to the State.</text></paragraph> 
<paragraph id="H5D6253854E354C108E5C95BAC73C4F14"><enum>(3)</enum><header>Period of availability of subsequently apportioned funds</header><text display-inline="yes-display-inline">Any funds apportioned pursuant to paragraph (2) shall remain available for expenditure until the end of the third fiscal year following the fiscal year in which the funds are so apportioned. Sums not obligated at the end of that period shall lapse.</text></paragraph> 
<paragraph id="H663E8330F33848118F93F09C5BDAB7B1"><enum>(4)</enum><header>Effect of noncompliance</header><text>If, at the end of the period for which funds withheld under subsection (a) from apportionment are available for apportionment to a State under paragraph (1), the State does not meet the requirement of subsection (a)(3), the funds shall lapse.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H4C180BFB201E43BA81D495391E954FD9"><enum>(b)</enum><header>Conforming amendment</header><text>The analysis for such chapter is amended by adding at the end the following:</text>
