		  1965 to establish a discretionary grant program for school construction for
		  local educational agencies affected by base closures and realignments, and for

		<section commented="no" id="H9FF29E8B9F2B432BA997EEFEA01720C0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Military Children’s School Investment
			 Act</short-title></quote>.</text>
		</section><section id="HD76CBE7BD0B14016AF1E4264037DD09C"><enum>2.</enum><header>School
			 construction grants</header>
			<subsection id="HD2DF9ECBC11C44B8895F7B7DB9943988"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 8007 of the
			 Elementary and Secondary Education Act of 1965 (20 U.S.C. 7707) is amended by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HF4082859E8E9419295DCAB2289611522" style="OLC">
					<subsection id="H1037798F874A40E2AD6D99DD84FA50AA"><enum>(c)</enum><header>School
				construction grants</header>
						<paragraph id="H68608F5E78C241DFBC77325B004690B6"><enum>(1)</enum><header>Authority and
				conditions for grants</header><text>From the amount appropriated for each
				fiscal year under section 8014(f), the Secretary is authorized to make grants
				to eligible local educational agencies to carry out eligible projects for the
				construction of public kindergarten, elementary, and secondary school
				facilities.</text>
						</paragraph><paragraph id="H295033AC28CA4761B4FA50F6DF7ED87E"><enum>(2)</enum><header>Eligibility</header><text>To
				be eligible to receive a grant under paragraph (1), the local educational
				agency shall—</text>
							<subparagraph id="HD2EB5186693543198200C9F2D8C5AE62"><enum>(A)</enum><text>have been eligible
				to receive a payment under section 8003 for the fiscal year prior to the year
				for which the application is made; and</text>
							</subparagraph><subparagraph id="H0D8E3D4A89A24783894F055362703038"><enum>(B)</enum><text>have had an
				overall increase in enrollment—</text>
								<clause id="H1BCDA6F15E8D4BCDA1414C589300C00"><enum>(i)</enum><text>during the period
				between the end of the school year preceding the fiscal year for which the
				application is made and the beginning of the school year immediately preceding
				that school year;</text>
								</clause><clause id="H2F79E24F49894C55BEA26E15511F37D5"><enum>(ii)</enum><text>of not less than
				250, or not less than 10 percent (whichever is lower), of students who are
				children described in—</text>
									<subclause id="HA6F61DA2F9C146F786EC5DA790C8E6AA"><enum>(I)</enum><text>subparagraph (A),
				(B), or (D) of section 8003(a)(1); or</text>
									</subclause><subclause id="H4468107A0BB14CF3BEA7E1002484AC72"><enum>(II)</enum><text>subparagraph (F)
				or (G) of section 8003(a)(1), but only to the extent such children are civilian
				dependents of employees of the Department of Defense; and</text>
									</subclause></clause><clause id="H9EE914D965B249078656819856001BB"><enum>(iii)</enum><text>that is the
				direct result of one or more of the following:</text>
									<subclause id="H30A4153C70164C32975F2ED032D2EFFE"><enum>(I)</enum><text>Base realignment
				and closure or global rebasing, as determined by the Secretary of
				Defense.</text>
									</subclause><subclause id="H9F05DEE3C5624A559646EF7ADAFE8C"><enum>(II)</enum><text>Force structure
				changes or force reductions.</text>
									</subclause><subclause id="HA317A99813E94AD29042874E535586B3"><enum>(III)</enum><text>An action
				initiated by the Secretary of Defense.</text>
									</subclause></clause></subparagraph></paragraph><paragraph id="HA315530EC43B40FABCC8BFFFFB00517E"><enum>(3)</enum><header>Criteria for
				grants</header><text>In considering an application for a grant the Secretary
				shall consider—</text>
							<subparagraph id="H1A9156B103F648CAAAA7FD6658161703"><enum>(A)</enum><text>the extent to
				which the local educational agency involved needs the grant because it lacks
				the fiscal capacity to undertake the project for which the grant would be used
				without the grant; and</text>
							</subparagraph><subparagraph id="HE8B92BEFEFC6494C93FA3B2480322DF7"><enum>(B)</enum><text>the demonstrated
				need for the construction, reconstruction, or renovation based on the condition
				of the facility in the project.</text>
							</subparagraph></paragraph><paragraph id="H2D707A484087438DA963F56F3F4458A4"><enum>(4)</enum><header>Eligible
				projects</header><text display-inline="yes-display-inline">To be an eligible
				project for a grant under paragraph (1), the project must consist of—</text>
							<subparagraph id="H0A122C1B3A034433B299AC2CA007F718"><enum>(A)</enum><text>the construction
				of new elementary or secondary schools to meet the needs imposed by enrollment
				growth;</text>
							</subparagraph><subparagraph id="H17BB2305B8754E8488DE4B447F403500"><enum>(B)</enum><text display-inline="yes-display-inline">the construction of additional academic
				learning space at existing schools;</text>
							</subparagraph><subparagraph id="H34DAA5D0474746159DD6A005180654FB"><enum>(C)</enum><text>the repair or
				upgrading of classrooms or structures related to academic learning, including
				but not limited to roofs, walls, plumbing, ventilation equipment, and
				inadequate heating or lighting equipment; or</text>
							</subparagraph><subparagraph id="HB9AD9CD6904144F4B818AD54C75BFA68"><enum>(D)</enum><text display-inline="yes-display-inline">the leasing of buildings or portions of
				buildings from a private entity for the purpose of providing school space, with
				the Secretary's approval.</text>
							</subparagraph></paragraph><paragraph id="HBA02B58E63AB447B9864FF25C6652622"><enum>(5)</enum><header>Amount and
				conditions of grants</header><text display-inline="yes-display-inline">In
				making grants under this subsection, the Secretary shall ensure that the amount
				of a grant does not exceed the total construction, modernization, or repair
				costs involved, as determined by the Secretary.</text>
						</paragraph><paragraph id="HA250660AFBD6437BB3A5CC733E313E28"><enum>(6)</enum><header>Impermissible
				uses of funds</header><text>No funds received under this subsection may be used
				for—</text>
							<subparagraph id="H8351B1979A2344D68300B60992A875D3"><enum>(A)</enum><text>payment of
				maintenance costs; or</text>
							</subparagraph><subparagraph id="H0FAB3FDC87B84EE888BC00DE43766182"><enum>(B)</enum><text>stadiums or other
				facilities primarily used for athletic contests or exhibitions or other events
				for which admission is charged to the general public.</text>
							</subparagraph></paragraph><paragraph id="H4D516F0508AD4E6084499FE4F13B7294"><enum>(7)</enum><header>Supplement, not
				supplant</header><text>A local educational agency receiving a grant under this
				subsection shall use such Federal funds only to supplement and not supplant the
				amount of funds that would, in the absence of such Federal funds, be available
				for construction, modernization, and repair of public kindergarten, elementary,
				and secondary school facilities.</text>
						</paragraph><paragraph id="HFAAAFA8BF66B4E949F699508F2DF6639"><enum>(8)</enum><header>Reporting</header>
							<subparagraph id="H19D6B7D2D92B4AE9BA390092ACB13BE2"><enum>(A)</enum><header>Reports by
				secretary</header><text>Not later than December 31 of each fiscal year, the
				Secretary, and the Secretary of Defense, shall each submit to the Committee on
				Education and Labor and the Committee on Armed Services of the House of
				Representatives and the Committee on Health, Education, Labor, and Pensions and
				the Committee on Armed Services of the Senate a report on grants made under
				this subsection, including the types of construction, modernization, and repair
				funded, and the number of students impacted.</text>
							</subparagraph><subparagraph id="H782FDB969D4B4374B5C73B005377B81E"><enum>(B)</enum><header>Reports by local
				educational agencies</header><text>Not later than September 30 of each fiscal
				year, each local educational agency receiving a grant under this subsection
				shall submit to the Secretary, and to the Secretary of Defense, a report on the
				agency’s use of such grant
				funds.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H2252ACC74E0346CF9380DFCEF803778F"><enum>(b)</enum><header>Authorization of
			 appropriations</header><text>Section 8014 of that Act (20 U.S.C. 7714) is
			 amended—</text>
				<paragraph id="H97CE486550A2481FA53DD556A4DA5D"><enum>(1)</enum><text>in
			 subsection (e), by inserting after <quote>8007</quote> the following:
			 <quote>other than section 8007(c)</quote>; and</text>
				</paragraph><paragraph id="HFB9D58EFBA5340A3BC11E46E7B47B670"><enum>(2)</enum><text>by inserting after
			 subsection (f) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H0D4A52AED08F447D00FC5C602CDC1EFC" style="OLC">
						<subsection id="H52A074C76EC04D46BD892B569C4D1BEB"><enum>(g)</enum><header>School
				construction grants</header><text>For the purposes of carrying out section
				8007(c), there are authorized to be appropriated $500,000,000 for fiscal year
				2009 and such sums as may be necessary for each of the seven succeeding fiscal
				years.</text>
