<section section-type="section-one" id="H268ED7808E9B449F93C930C0BD341617" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Congressional Lawmaking Authority Protection Act of 2009</short-title></quote>.</text></section> 
<section id="H4B432A42D8AB48928D05DA96A29190D5"><enum>2.</enum><header>Findings and purposes</header> 
<subsection id="H997DA4DCAC2D447585A1EEEA3267D242"><enum>(a)</enum><header>Findings</header><text>The Congress makes the following findings:</text> 
<paragraph id="HD67ADDD1D9CA4EE3B674E2850400561E"><enum>(1)</enum><text>The Framers of the Constitution understood that the power to make laws is such an awesome power that they intended it to be exercised by the most democratic branch of government.</text></paragraph> 
<paragraph id="H06A7A7CA74CB4335A1E6DB0596F3544C"><enum>(2)</enum><text>To ensure that the lawmaking power would be exercised by the branch of government that is the closest and most accountable to the people the Constitution provides that <quote>All legislative power herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives.</quote>.</text></paragraph> 
<paragraph id="H7A4B689DC01E4EB1846838BFAECCA788"><enum>(3)</enum><text>The Constitution limits the role of the President in the lawmaking process to—</text> 
<subparagraph id="H70F6C10CB4864D46BBBC0025F141C433"><enum>(A)</enum><text>giving Congress information on the State of the Union;</text></subparagraph> 
<subparagraph id="H7AE4CDF340494DF49C5C61D7337B8189"><enum>(B)</enum><text>recommending to Congress for consideration such measures as the President deems necessary and expedient; and</text></subparagraph> 
<subparagraph id="HC7E06D7179564F2EBF00E1DF1BD92F6"><enum>(C)</enum><text>approving or vetoing bills and joint resolutions presented to him for signature.</text></subparagraph></paragraph> 
<paragraph id="H2B1AC5DCCC214DD8861899A36FAB83D3"><enum>(4)</enum><text>Statements made by the President contemporaneously with the signing of a bill or joint resolution that express the President’s interpretation of the scope, constitutionality, and intent of Congress in enacting the bill or joint resolution presented for signature encroach upon the power to make laws that the Framers vested solely in the Congress.</text></paragraph> 
<paragraph id="H527C664F850644B1AA9BD1019FC0DD71"><enum>(5)</enum><text>According to a May 5, 2006, editorial in the New York Times, the current President of the United States has issued more than 750 <quote>presidential signing statements</quote> declaring he would not do what the laws required, the most notorious example of which is the signing statement issued by the President asserting he was not bound by the Congressional ban on the torture of prisoners.</text></paragraph> 
<paragraph id="HD4D5B003DA324645AAA9EDE526803145"><enum>(6)</enum><text>On June 5, 2006, the American Bar Association created a 10-member Blue-Ribbon <quote>Task Force on Presidential Signing Statements and the Separation of Powers Doctrine</quote> to take a balanced, scholarly look at the use and implications of signing statements, and to propose appropriate ABA policy consistent with the ABA’s commitment to safeguarding the rule of law and the separation of powers in our system of government.</text></paragraph> 
<paragraph id="HC9E3298BAB7F41F7B32C1C9084536DCC"><enum>(7)</enum><text>On July 24, 2006, the Task Force determined that signing statements that signal the president’s intent to disregard laws adopted by Congress undermine the separation of powers by depriving Congress of the opportunity to override a veto, and by shutting off policy debate between the two branches of government. According to the Task Force, such presidential signing statements operate as a <quote>line item veto,</quote> which the U.S. Supreme Court has ruled unconstitutional. The Task Force strongly recommended the Congress to enact appropriate legislation to ensure that such presidential signing statements do not undermine the rule of law and the constitutional system of separation of powers.</text></paragraph></subsection> 
<subsection id="HEA9E5A002AA34770B4E1E0F737EAC914"><enum>(b)</enum><header>Purposes</header><text>The purposes of this Act are—</text> 
<paragraph id="H606ABCF373FA408EB394D9026CB9CD25"><enum>(1)</enum><text>to preserve the separation of powers intended by the Framers by preventing the President from encroaching upon the Congressional prerogative to make law; and</text></paragraph> 
<paragraph id="H71FB4E97F7B14C598DBFB98001D5B57"><enum>(2)</enum><text>to ensure that no Federal or State executive or independent agency, and no Federal or State judge, can attach legal significance to any presidential signing statement when construing any law enacted by the Congress.</text></paragraph></subsection></section> 
<section id="H4136F0926AFE4436B508C7A96B13B5CA"><enum>3.</enum><header>Limitation on use of funds</header> 
<subsection id="H007055CE7CA24988A400C92BA82C0968"><enum>(a)</enum><header>Limitation on Use of Funds</header><text>None of the funds made available to the Executive Office of the President, or to any Executive agency (as defined in <external-xref legal-doc="usc" parsable-cite="usc/5/105">section 105</external-xref> of title 5 of the United States Code), from any source may be used to produce, publish, or disseminate any statement made by the President contemporaneously with the signing of any bill or joint resolution presented for signing by the President.</text></subsection> 
<subsection id="H35C115DB876A44740042A76C775E8C7E"><enum>(b)</enum><header>Application of Limitation</header><text>Subsection (a) shall apply only to statements made by the President regarding the bill or joint resolution presented for signing that contradict, or are inconsistent with, the intent of Congress in enacting the bill or joint resolution or that otherwise encroach upon the Congressional prerogative to make laws.</text></subsection></section> 
<section id="H8A74A42C3C914374AA30604647DAA767"><enum>4.</enum><header>Construction and application of acts of Congress</header><text display-inline="no-display-inline">For purposes of construing or applying any Act enacted by the Congress, a governmental entity shall not take into consideration any statement made by the President contemporaneously with the President’s signing of the bill or joint resolution that becomes such Act.</text></section>
