		<official-title>To require the Director of National Intelligence to
		  submit a report to Congress on retirement benefits for former employees of Air
		  America, and for other purposes.</official-title>

		<section id="H3E107145B59F4F4E8EA58343DB37A6C8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Air America Veterans Act of
			 2009</short-title></quote>.</text>
		</section><section id="H33ADB3FA0F2D46E2A9F805F98C3019D1"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H092268F33133472E855C3F1C1F22F765"><enum>(1)</enum><header>Air
			 America</header><text>The term <term>Air America</term> means Air America,
			 Incorporated.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H87E546B465D54A62A5BD4A7CF8D212E1"><enum>(2)</enum><header>Associated
			 company</header><text>The term <term>associated company</term> means any entity
			 associated with, predecessor to, or subsidiary to Air America, including Air
			 Asia Company Limited, CAT Incorporated, Civil Air Transport Company Limited,
			 and the Pacific Division of Southern Air Transport during the period when such
			 an entity was owned and controlled by the United States Government.</text>
			</paragraph></section><section id="H7CEDF882F19D4D3694984DC2A92FA5A0"><enum>3.</enum><header>Report on
			 retirement benefits for former employees of Air America</header>
			<subsection id="H941462EF78714000B2B6BA3B589575B4"><enum>(a)</enum><header>In
			 general</header><text>Not later than 180 days after the date of the enactment
			 of this Act, the Director of National Intelligence shall submit to Congress a
			 report on the advisability of providing Federal retirement benefits to United
			 States citizens for the service of such citizens prior to 1977 as employees of
			 Air America or an associated company during a period when Air America or the
			 associated company was owned or controlled by the United States Government and
			 operated or managed by the Central Intelligence Agency.</text>
			</subsection><subsection id="HF373045F231140F8A8AF5D5C016AEAA0"><enum>(b)</enum><header>Report
			 Elements</header><text>The report required by subsection (a) shall include the
			 following:</text>
				<paragraph id="H669F1DD8556640EDAFFE565B7630237A"><enum>(1)</enum><text>The history of Air
			 America and the associated companies prior to 1977, including a description
			 of—</text>
					<subparagraph id="H0F922DAE6D8F477193B1401684B48610"><enum>(A)</enum><text>the relationship
			 between Air America and the associated companies and the Central Intelligence
			 Agency or any other element of the United States Government;</text>
					</subparagraph><subparagraph id="H18C36CE97D8B4F5F84EC87876D160651"><enum>(B)</enum><text>the workforce of
			 Air America and the associated companies;</text>
					</subparagraph><subparagraph id="H36F1B023EE05487F93E8706FD04A1303"><enum>(C)</enum><text>the missions
			 performed by Air America, the associated companies, and their employees for the
			 United States; and</text>
					</subparagraph><subparagraph id="HF0B5765256BF4A23A505C7D56F9D84DC"><enum>(D)</enum><text>the casualties
			 suffered by employees of Air America and the associated companies in the course
			 of their employment.</text>
					</subparagraph></paragraph><paragraph id="H6245B4B9039C4FE48097C32BEFA790B5"><enum>(2)</enum><text>A
			 description of—</text>
					<subparagraph id="HE7B6477AF6C34C3DBDE9640E211FEE7F"><enum>(A)</enum><text>the retirement
			 benefits contracted for or promised to the employees of Air America and the
			 associated companies prior to 1977;</text>
					</subparagraph><subparagraph id="H9DD46CBF4DF34221B240C7D9CB468024"><enum>(B)</enum><text>the contributions
			 made by such employees for such benefits;</text>
					</subparagraph><subparagraph id="H7C1AAB54C9C94AADB5FE2CE0DD0A18A0"><enum>(C)</enum><text>the retirement
			 benefits actually paid such employees;</text>
					</subparagraph><subparagraph id="H95FC942D18B34EB2A91CD7A62E51BBB0"><enum>(D)</enum><text>the entitlement of
			 such employees to the payment of future retirement benefits; and</text>
					</subparagraph><subparagraph id="H9D2BFF6CBA114A13B434E514C2ADBBAF"><enum>(E)</enum><text>the likelihood
			 that such employees will receive any future retirement benefits.</text>
					</subparagraph></paragraph><paragraph id="H0731F960EBFE424BB53029E71FF044EB"><enum>(3)</enum><text>An assessment of
			 the difference between—</text>
					<subparagraph id="H1F36110137BB4DEE9740A93B80D5CCDB"><enum>(A)</enum><text>the retirement
			 benefits that former employees of Air America and the associated companies have
			 received or will receive by virtue of their employment with Air America and the
			 associated companies; and</text>
					</subparagraph><subparagraph id="HA30D57142F7F42DDB43CA61084F0A7AD"><enum>(B)</enum><text>the retirement
			 benefits that such employees would have received or be eligible to receive if
			 such employment was deemed to be employment by the United States Government and
			 their service during such employment was credited as Federal service for the
			 purpose of Federal retirement benefits.</text>
					</subparagraph></paragraph><paragraph id="HBCA7DFA4D1D847A083389615E346C01E"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H1AAD3ED71D4542E6B0C120CF2D08A827"><enum>(A)</enum><text>Any recommendations
			 regarding the advisability of legislative action to treat such employment as
			 Federal service for the purpose of Federal retirement benefits in light of the
			 relationship between Air America and the associated companies and the United
			 States Government and the services and sacrifices of such employees to and for
			 the United States.</text>
					</subparagraph><subparagraph id="H5EC1BC6E7DEC48BC9B59C9C701D06DFD" indent="up1"><enum>(B)</enum><text>If legislative action is considered
			 advisable under subparagraph (A), a proposal for such action and an assessment
			 of its costs.</text>
					</subparagraph></paragraph><paragraph id="H7269C19A8A2C49F8B144A6CB88F87CD4"><enum>(5)</enum><text>The opinions of
			 the Director of the Central Intelligence Agency, if any, on any matters covered
			 by the report that the Director of the Central Intelligence Agency considers
			 appropriate.</text>
				</paragraph></subsection><subsection id="H2B6D74A35F3B44F1AE150BA113AC22AE"><enum>(c)</enum><header>Assistance of
			 Comptroller General</header><text>The Comptroller General of the United States
			 shall, upon the request of the Director of National Intelligence and in a
			 manner consistent with the protection of classified information, assist the
			 Director in the preparation of the report required by subsection (a).</text>
			</subsection><subsection id="HD7026818CB6B4DED8487678E95A8296C"><enum>(d)</enum><header>Form</header><text>The
			 report required by subsection (a) shall be submitted in unclassified form, but
			 may include a classified annex.</text>
