		<section id="H384FAF5D7B174BE095B7A9DCEF5623F8" section-type="section-one"><enum>1.</enum><header>Short title;
			 findings</header>
			<subsection id="H9D3985DF59A24490B1122E246C1715C2"><enum>(a)</enum><header>Short
			 title</header><text>This Act may be cited as the <quote><short-title>Chinook Nation Restoration
			 Act</short-title></quote>.</text>
			</subsection><subsection id="H185455833BC24F0CB41B69CF1CD6A516"><enum>(b)</enum><header>Findings</header><text>Congress
			 finds the following:</text>
				<paragraph id="H87E8C32B957645229D35582AD5FADB15"><enum>(1)</enum><text display-inline="yes-display-inline">The Chinook Nation made a significant
			 contribution to the historic journey of Meriwether Lewis and William Clark to
			 the Pacific Ocean by greeting the expedition and their company as well as
			 trading with them throughout the winter of 1805–1806.</text>
				</paragraph><paragraph id="H64120861751444758F373DE653D543A2"><enum>(2)</enum><text>The United States
			 subsequently recognized the Chinook Nation as an Indian tribe in the Anson Dart
			 (Tansy Point) Treaty of 1851, and the Isaac Stevens (Chehalis River) Treaty of
			 1855, but neither treaty was ratified, resulting in serious harm to the Chinook
			 people.</text>
				</paragraph><paragraph id="HFA6B4D09B5A543708CF489FC9157E344"><enum>(3)</enum><text>As a result of the
			 failure of the United States to protect the Chinook Nation and people, the
			 Chinooks lost their historic lands on the Columbia River, and a great number of
			 them succumbed to poverty and disease in the 19th century.</text>
				</paragraph><paragraph id="H8A82E2C6E6894C2C8092978A50952B8E"><enum>(4)</enum><text>It was the intent
			 of Congress in the Act of March 4, 1911 (36 Stat. 1345), to provide restitution
			 to the Chinook people in the form of allotments of land on existing Indian
			 reservations, which the Supreme Court of the United States upheld in Halbert v.
			 United States (283 U.S. 753 (1931)).</text>
				</paragraph><paragraph id="H9B7D7DA93533486F8E05C1B6EAA59342"><enum>(5)</enum><text>Congress named
			 four of the five tribes of the Chinook Nation, the Lower Chinook, Wahkiakum,
			 Cathlamet, and Clatsop, in the Western Oregon Termination Act of 1954, and this
			 Act is the only basis for termination of the Federal relationship with the
			 Tribe.</text>
				</paragraph><paragraph id="H2F354305D7EB4C6BAC7D862C530EAA14"><enum>(6)</enum><text>The Chinook Nation
			 has remained active on the Lower Columbia River and Willapa Bay in the vicinity
			 of the reservation area of the Tansy Point Treaty and is well-known to
			 neighboring tribes and other communities.</text>
				</paragraph><paragraph id="HAA62824CE2E346BFAA7C932B99847802"><enum>(7)</enum><text>The Chinook people
			 have survived and maintained their language, Chinookwawa, and culture despite
			 decades of neglect by the United States.</text>
				</paragraph><paragraph id="H5503C2620D174EEDAFA62271DA79CFAF"><enum>(8)</enum><text>With different
			 Administrations disagreeing about the legal status of the Chinook Nation, it is
			 time for Congress to restore the Chinook Nation to Federal tribal
			 status.</text>
				</paragraph></subsection></section><section id="H32CA312B819549938DF60C8672291F2F"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">For the purposes of this Act, the following
			 definitions apply:</text>
			<paragraph id="H2446D98F0842432287AD8BAB97B8C1F3"><enum>(1)</enum><header>Member</header><text>The
			 term <term>member</term> means an enrolled member of the Chinook Nation as of
			 the date of enactment of this Act, or an individual who has been placed on the
			 membership role in accordance with this Act.</text>
			</paragraph><paragraph id="HFE61BDF62FE649D9B8029DD781831D3F"><enum>(2)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph><paragraph id="HF7728F0AF5F640A4844A4005A33E36BC"><enum>(3)</enum><header>Tribe</header><text>The
			 term <term>Tribe</term> means the Chinook Indian Nation, composed of the Lower
			 Chinook, Wahkiakum, Cathlamet, Clatsop, and Willapa Tribes.</text>
			</paragraph><paragraph id="HCC45C575C2634CBF81CED95A53158575"><enum>(4)</enum><header>State</header><text>The
			 term <term>State</term> means the State of Washington.</text>
			</paragraph><paragraph id="H52299FFF0BEA4236B8183610A7FC7286"><enum>(5)</enum><header>State
			 territorial waters</header><text>The term <term>State territorial waters</term>
			 means all waters within the territorial limits of the State of
			 Washington.</text>
			</paragraph></section><section id="HBE098DEDE4624E84836A1E2361AD8A6F"><enum>3.</enum><header>Federal
			 recognition</header><text display-inline="no-display-inline">Federal
			 recognition is hereby extended to the Chinook Indian Nation. Except as
			 otherwise provided in this Act, all laws and regulations of the United States
			 of general application to Indians, and nations, tribes, or bands of Indians,
			 including the Act of June 18, 1934 (25 U.S.C. 461 et seq.), that are not
			 inconsistent with any specific provision of this Act shall be applicable to the
			 Tribe and its members.</text>
		</section><section id="H2870B95BC7E743D98AB25B7DE2074BFC"><enum>4.</enum><header>Federal services
			 and benefits</header>
			<subsection id="H5A300D20E99945929975FFE7B6DD3D83"><enum>(a)</enum><header>In
			 general</header><text>The Tribe and its members shall be eligible, on and after
			 the date of the enactment of this Act, for all services and benefits provided
			 by the Federal Government to federally recognized tribes without regard to the
			 existence of a reservation for the Tribe or the location of the residence of
			 any member on or near any Indian reservation.</text>
			</subsection><subsection id="H8A2AF5B7BEEC47B692D415AEB55B8BCF"><enum>(b)</enum><header>Service
			 area</header><text>For purposes of the delivery of Federal services to enrolled
			 members of the Tribe, the Tribe’s service area shall consist of Pacific,
			 Wahkiakum, Cowlitz, and Clark Counties, Washington, and Clatsop and Columbia
			 Counties, Oregon.</text>
			</subsection><subsection id="HAFC3BD588F384981A0D86BD8B21B623D"><enum>(c)</enum><header>Civil
			 jurisdiction</header><text>Upon approval of the constitution and bylaws
			 pursuant to section 6 of this Act, the Nation shall exercise jurisdiction over
			 all its members who reside within the service area located in the State in
			 matters pursuant to the Indian Child Welfare Act of 1978 (25 U.S.C. 1901 et
			 seq.) as if the members were residing upon a reservation as defined in that
			 Act.</text>
			</subsection></section><section id="H128A5750E7014EDEB351B952983FA9EA"><enum>5.</enum><header>Membership</header><text display-inline="no-display-inline">Not later than 9 months after the date of
			 the enactment of this Act, the Tribe shall submit to the Secretary a membership
			 roll consisting of all individuals enrolled in the Tribe.</text>
		</section><section id="H5ECFADE62EC14CBC8876C37B70F43246"><enum>6.</enum><header>Constitution and
			 governing body</header>
			<subsection id="H6D0F4CAFCB114A73AFBDA4740ACC577A"><enum>(a)</enum><header>Constitution</header>
				<paragraph id="HD63CDC3B75734EE6B1A29F403F62E65F"><enum>(1)</enum><header>Adoption</header><text>Not
			 later than 1 year after the date of the enactment of this Act, the Tribe shall
			 conduct, by secret ballot, an election to adopt a constitution and bylaws for
			 the Tribe.</text>
				</paragraph><paragraph id="HC6421255C36F4A428189AEAE71F7F0E2"><enum>(2)</enum><header>Interim
			 governing documents</header><text>Until such time as a new constitution is
			 adopted under this section, the governing documents in effect on the date of
			 the enactment of the Act shall be the interim governing documents for the Tribe
			 most recently submitted to the Department of the Interior.</text>
				</paragraph></subsection><subsection id="H49232258F2814AA98DA1208AE4A37AF9"><enum>(b)</enum><header>Officials</header><text>Not
			 later than 6 months after the Tribe adopts a constitution and bylaws pursuant
			 to this section, the Tribe shall elect a governing body in accordance with the
			 procedures set forth in its constitution and bylaws. Until such time as a new
			 governing body is elected, the governing body of the Tribe shall be the
			 governing body selected under the election procedures specified in the interim
			 governing documents of the Tribe.</text>
			</subsection></section><section id="H26D3355CE42E406CA6129DFB0B5D1F9C"><enum>7.</enum><header>Land in
			 trust</header>
			<subsection id="H631BFFAD23DC4FE1AC4B398DAFE3D056"><enum>(a)</enum><header>Requirement To
			 take land in trust</header><text>If the Tribe transfers all right, title, and
			 interest in and to any land to the Secretary, the Secretary shall take such
			 land in trust for the benefit of the Tribe, subject to subsection (c). This
			 subsection does not limit the authority of the Secretary to take land in trust
			 under the Indian Reorganization Act.</text>
			</subsection><subsection id="H066FCCB0899A4DFA9833EC1F8821601C"><enum>(b)</enum><header>Plan for
			 establishment of reservation</header>
				<paragraph id="H7AF8DC07926642D5BD249D4FFA7FD28D"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall—</text>
					<subparagraph id="H5670A7DE7318457DB878D092FB8DA15B"><enum>(A)</enum><text>negotiate with the
			 tribal governing body with respect to establishing a reservation for the Tribe;
			 and</text>
					</subparagraph><subparagraph id="H3B6718289EEB44D4B5E290DAC19E806E"><enum>(B)</enum><text>not later than two
			 years after the date of enactment of this Act, develop a plan for establishment
			 of a reservation.</text>
					</subparagraph></paragraph><paragraph id="H74E3B65E8AD9404ABFBE460F1CA58129"><enum>(2)</enum><header>Consultation
			 with state and local officials required</header><text>To assure that legitimate
			 State and local interests are not prejudiced by the proposed establishment of
			 the reservation, the Secretary shall notify and consult with all appropriate
			 officials of the State and all owners of land adjacent to lands considered for
			 the proposed reservation in developing any plan under this subsection. The
			 Secretary shall provide complete information on the proposed plan to such
			 officials, including the restrictions imposed by subsection (c). During any
			 consultation by the Secretary under this subsection, the Secretary shall
			 provide such information as the Secretary possesses and request comments and
			 additional information on the following subjects:</text>
					<subparagraph id="HB72E5ADBF846458EA50F2A74A0B3DE2C"><enum>(A)</enum><text>The size and
			 location of the proposed reservation.</text>
					</subparagraph><subparagraph id="H5D061829D47A44BCBCFB1C34806F03C7"><enum>(B)</enum><text>The anticipated
			 effect of the establishment of the proposed reservation on State and local
			 expenditures and tax revenues.</text>
					</subparagraph><subparagraph id="HC56D6B0A2CB24804B6D1694A87BEBA0E"><enum>(C)</enum><text>The extent of any
			 State or local service to the Tribe, the reservation, or members after the
			 establishment of the proposed reservation.</text>
					</subparagraph><subparagraph id="HFFFAE840FF284AB1B1F85F6EC05BE7B8"><enum>(D)</enum><text>The extent of
			 Federal services to be provided in the future to the Tribe, the reservation, or
			 members.</text>
					</subparagraph><subparagraph id="HDED25E1C6172414FB24F206E81F8B409"><enum>(E)</enum><text>The extent of
			 service to be provided in the future by the Tribe to members resident on or off
			 the reservation.</text>
					</subparagraph></paragraph><paragraph id="H1489B2E3E0824BA9BDB9280E3B6AB2BE"><enum>(3)</enum><header>Restrictions on
			 plan</header><text display-inline="yes-display-inline">A plan developed
			 pursuant to this subsection shall be in accordance with subsection (c).</text>
				</paragraph><paragraph id="H6FAD8099AE9C42AA9C264B14F97501F1"><enum>(4)</enum><header>Submission of
			 plan</header>
					<subparagraph id="HDD4286FBAF914F319BDE09B49E85C554"><enum>(A)</enum><header>Submission to
			 congress</header><text>Upon the approval by the tribal governing body of the
			 plan developed pursuant to this subsection (and after consultation with
			 interested parties pursuant to paragraph (2)), the Secretary shall submit the
			 plan to the Clerk of the House of Representatives and the Secretary of the
			 Senate for distribution to the committees of the respective Houses of Congress
			 with jurisdiction over the subject matter.</text>
					</subparagraph><subparagraph id="H07E2AE75F70641EE9DFFA5B469628757"><enum>(B)</enum><header>Appendix to
			 plan</header><text>The Secretary shall append to the plan submitted to Congress
			 under this subsection a detailed statement—</text>
						<clause id="H45AB8463030646C3952713034871286D"><enum>(i)</enum><text>describing the
			 manner in which the Secretary notified all interested parties in accordance
			 with this subsection;</text>
						</clause><clause id="H276185C4C5AD42B1B8FDB21A51FF68D9"><enum>(ii)</enum><text>naming each
			 individual and official consulted in accordance with this subsection;</text>
						</clause><clause id="H47A70D35B25A473980B67780F55DDA5E"><enum>(iii)</enum><text>summarizing the
			 testimony received by the Secretary pursuant to any such consultation;
			 and</text>
						</clause><clause id="H08541A26E4C54EA29261D3E9140884FC"><enum>(iv)</enum><text>including any
			 written comments or reports submitted to the Secretary by any party named
			 pursuant to clause (ii).</text>
						</clause></subparagraph></paragraph></subsection><subsection id="H5F316FF6DF594AE4812BC586C2E71460"><enum>(c)</enum><header>Restrictions on
			 land taken in trust</header>
				<paragraph id="H36ED326A6B2C4E3B86D309B722B6CC0E"><enum>(1)</enum><text>Any real property
			 transferred by the Tribe or any member to the Secretary shall be taken and held
			 in the name of the United States for the benefit of the Tribe.</text>
				</paragraph><paragraph id="HBC122242601345899446B18F3706F634"><enum>(2)</enum><text>The Secretary
			 shall not accept any real property in trust for the benefit of the Tribe that
			 is not located within the political boundaries of Pacific, Wahkiakum, or
			 Cowlitz County, Washington.</text>
				</paragraph><paragraph id="H179689C0A3884AB1BF9E0776B20FD56D"><enum>(3)</enum><text>Any real property
			 taken in trust by the Secretary for the benefit of the Tribe shall be—</text>
					<subparagraph id="HCD9D7356829447E8B1AC0DFFA9F8DA8E"><enum>(A)</enum><text>subject to—</text>
						<clause id="H9DEE72D6E343464D8EB311A278BCB057"><enum>(i)</enum><text>all
			 legal rights and interests in such land existing at the time of acquisition of
			 such land by the Secretary, including any lien, mortgage, or previously levied
			 and outstanding State or local tax; and</text>
						</clause><clause id="H2A5C3385B3CE48CD877E5B4071B40C82"><enum>(ii)</enum><text>foreclosure or
			 sale in accordance with the laws of the State pursuant to the terms of any
			 valid obligations in existence at the time of the acquisition of such land by
			 the Secretary; and</text>
						</clause></subparagraph><subparagraph id="H88BF5EBB348443F99A3E0AD3F30832BA"><enum>(B)</enum><text>exempt from
			 Federal, State, and local taxation of any kind.</text>
					</subparagraph></paragraph><paragraph id="HA1251C93F5AD4D98B7BC6594C107A48D"><enum>(4)</enum><text>Any privately
			 owned lands acquired by the Tribe or its members to be taken in trust by the
			 Secretary for the benefit of the Tribe shall be acquired on a willing-seller,
			 willing-buyer basis.</text>
				</paragraph><paragraph id="HFE5F8B2E4CB64DE6916336D024DA8C54"><enum>(5)</enum><text>No eminent domain
			 authority may be exercised for the purposes of acquiring lands for the benefit
			 of the Tribe.</text>
				</paragraph></subsection></section><section id="HB3B0FC87C7794ABCA6A147FDCE7D70EE"><enum>8.</enum><header>
			 Fishing, hunting, and trapping rights not restored</header>
			<subsection id="H4F79B4A2311F4739ADAD038479AF72F8"><enum>(a)</enum><header>In
			 general</header><text>No nonceremonial fishing, hunting, or trapping rights of
			 any nature of the Tribe or of any member of the Tribe, including any indirect
			 or procedural right or advantage over individuals who are not members, are
			 granted or restored under this Act. Ceremonial hunting and fishing rights (not
			 to include whaling) shall be allowed in the area in which the Tribe has
			 historically hunted or fished, in Pacific and Wahkiakum Counties,
			 Washington.</text>
			</subsection><subsection id="HC4A38E182A00425DB8894F454308CC82"><enum>(b)</enum><header>Ceremonial
			 hunting and fishing</header>
				<paragraph id="H2DE49103EE6F40729A8CDB7D606FF91F"><enum>(1)</enum><header>Defined</header><text>Ceremonial
			 hunting and fishing includes traditional occasions on which the tribe has
			 traditionally fished, including—</text>
					<subparagraph id="HBB89A674F8284FF8A0099F88D52612EF"><enum>(A)</enum><text>the First Salmon
			 ceremony, which takes place annually on the third Friday of June;</text>
					</subparagraph><subparagraph id="H02818C4632634EAB87D9CE23668055ED"><enum>(B)</enum><text>the Winter
			 Gathering, which takes place annually on the third Saturday of January;
			 and</text>
					</subparagraph><subparagraph id="H22601CCBEC3F47AFA419E8A6A4B60502"><enum>(C)</enum><text>the funerals of
			 certain tribal members, to be determined in the tribe’s constitution.</text>
					</subparagraph></paragraph><paragraph id="H782D6EAF502C44D3AA85525B0830324B"><enum>(2)</enum><header>Time
			 period</header><text>Ceremonial hunting and fishing may take place for up to 3
			 calendar days during the week preceding the ceremonies referred to in paragraph
			 (1).</text>
				</paragraph></subsection><subsection id="HDBE56FDFB4B94662B666814BD4B74EB3"><enum>(c)</enum><header>Permits</header><text display-inline="yes-display-inline">The director of the Washington Department
			 of Fish and Wildlife—</text>
				<paragraph id="H8A9A05A5BABF4ADD8800CB2CE1166803"><enum>(1)</enum><text>may issue permits
			 to members of the Chinook Nation to take fish for ceremonial purposes;</text>
				</paragraph><paragraph id="H43A9407DB6D748D4BDB1B266F4859977"><enum>(2)</enum><text>shall establish
			 the areas in which the permits are valid; and</text>
				</paragraph><paragraph id="HA2EC19E98491402BA1DC5DA04ED40341"><enum>(3)</enum><text>shall regulate the
			 times for and manner of taking the fish, and the allocations from which they
			 will be taken.</text>
				</paragraph></subsection><subsection id="HF1B9AC6250E746C885F62DB8D6454ABA"><enum>(d)</enum><header>Rules and
			 regulations</header><text>To assure that ceremonial fishing is consistent with
			 the Tribe’s historic customs and traditions, any member of the Tribe who wishes
			 to take part in ceremonial fishing, must do so pursuant to—</text>
				<paragraph id="H8F3E30BBB57A4EC599DFB2CE2849A34B"><enum>(1)</enum><text>any rules or
			 regulations put forth by the Washington Department of Fish and Wildlife with
			 respect to Indian ceremonial fishing; and</text>
				</paragraph><paragraph id="HFB1417B1CCA645F7B634F6B1987D279C"><enum>(2)</enum><text display-inline="yes-display-inline">any rules or regulations put forth by the
			 Washington Department of Fish and Wildlife, or by the Washington Administrative
			 Code, with regard to the commercial and recreational allocations.</text>
				</paragraph></subsection><subsection id="H19A234F1B1AF478A976707BDD7EDFEF2"><enum>(e)</enum><header>Allocation</header><text display-inline="yes-display-inline">Fish taken for ceremonial purposes will be
			 drawn from the commercial and recreational allocations as designated by the
			 Washington Department of Fish and Wildlife.</text>
			</subsection><subsection id="H59428D2FBE6D4B05BEC5E11539E1CB13"><enum>(f)</enum><header>No commercial
			 rights</header><text>Nothing in this section shall be construed to create a
			 right to fish commercially.</text>
			</subsection></section><section id="H160616968FCB436DA989A6EE704846FA"><enum>9.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated to carry out this Act, $2,000,000 for fiscal year
			 2010, $3,000,000 for fiscal year 2011, and $4,000,000 for fiscal year
			 2012.</text>
