		<official-title>To amend the Public Health Service Act to provide for the
		  public disclosure of charges for certain hospital and ambulatory surgical
		  center services and drugs.</official-title>

		<section display-inline="no-display-inline" id="H09D068B8E15F41FF8C5DEA245200958D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Hospital Price Transparency and Disclosure Act of
			 2009</short-title></quote>.</text>
		</section><section id="H19168578942A4B409BDA18843F964B4B"><enum>2.</enum><header>Public disclosure
			 of hospital data</header><text display-inline="no-display-inline">Part B of
			 title II of the Public Health Service Act (42 U.S.C. 238 et seq.) is amended by
			 adding at the end the following new section:</text>
			<quoted-block display-inline="no-display-inline" id="HD5B4D22FEBAD413EBC4FE8786DDCD93" style="traditional">
				<section id="H4F7D58D15089477C8CDE410707597136"><enum>249.</enum><header>Data reporting by hospitals and ambulatory surgical centers
		  and public posting</header><subsection commented="no" display-inline="yes-display-inline" id="HF558791043574805AB8D1D63DCBE7CFE"><enum>(a)</enum><header>Semiannual reporting
				requirement</header><text display-inline="yes-display-inline">Not later than 80
				days after the end of each semiannual period beginning January 1 or July 1
				(beginning more than one year after the date of the enactment of this section),
				a hospital and an ambulatory surgical center shall report to the Secretary the
				following data:</text>
						<paragraph commented="no" id="HFCDC94B28095413CA86D00CE6B4FB8B3"><enum>(1)</enum><text display-inline="yes-display-inline">In the case of a hospital—</text>
							<subparagraph commented="no" id="H50AE66273A5B4B99B9C738200634F0F9"><enum>(A)</enum><text display-inline="yes-display-inline">the frequency with which the hospital
				performed each service selected under subparagraph (A) or (B) of subsection
				(c)(1) in an inpatient or outpatient setting, respectively, during such
				period;</text>
							</subparagraph><subparagraph commented="no" id="H587855D4BE474BDDBDB86618AAB7069E"><enum>(B)</enum><text display-inline="yes-display-inline">the frequency with which the hospital
				administered a drug selected under subparagraph (D) of such subsection in an
				inpatient setting during such period; and</text>
							</subparagraph><subparagraph id="HFB3B5753D7A946EEBC162EC786C20056"><enum>(C)</enum><text>if the service was
				so performed or the drug was so administered during such period—</text>
								<clause id="H55C5E969D7CF47E3A8AE34BC9876287"><enum>(i)</enum><text>the
				total number of times the service was so performed or the drug was so
				administered during such period; and</text>
								</clause><clause id="H246E23931DEF4191AE915313A6C08B9C"><enum>(ii)</enum><text>the average and
				the median charge by the hospital for such service or drug during such period;
				and</text>
								</clause></subparagraph></paragraph><paragraph id="H870E16177F0A4798006F59711C6B9762"><enum>(2)</enum><text>In the case of an
				ambulatory surgical center—</text>
							<subparagraph commented="no" id="HA27B0862871F4878A3EF58638C7C2700"><enum>(A)</enum><text display-inline="yes-display-inline">the frequency with which the center
				performed each service selected under subparagraph (C) of subsection (c)(1)
				during such period; and</text>
							</subparagraph><subparagraph id="HEB267B9BA62B4E33B1B7D374CF6CF0B8"><enum>(B)</enum><text>if the service was
				so performed during such period—</text>
								<clause id="HD01D50794DF841349B080077F2F1DAF5"><enum>(i)</enum><text>the total number
				of times the service was so performed during such period; and</text>
								</clause><clause id="HD7D121628E35465FBA84CC20A5A44648"><enum>(ii)</enum><text>the average and
				the median charge by the center for such service during such period.</text>
								</clause></subparagraph></paragraph></subsection><subsection commented="no" id="HF0046627511346EEB4E79018ADE9C99B"><enum>(b)</enum><header>Public
				availability of data</header>
						<paragraph id="H8A748A93980542AABC60D413CB13331F"><enum>(1)</enum><header>Public posting
				of data</header><text display-inline="yes-display-inline">The Secretary shall
				promptly post, on the official public Internet site of the Department of Health
				and Human Services, the data reported under subsection (a). Such data shall be
				set forth in a manner that promotes charge comparison among hospitals and
				ambulatory surgical centers.</text>
						</paragraph><paragraph id="H3F0721B660CC4629B42BBD77AE3B2B66"><enum>(2)</enum><header>Notice of
				availability</header><text display-inline="yes-display-inline">A hospital and
				an ambulatory surgical center shall prominently post at each admission site of
				the hospital or center a notice of the availability of the data reported under
				subsection (a) on the official public Internet site under paragraph (1).</text>
						</paragraph></subsection><subsection id="H156726752E4B4C3FB341C2DE243182A6"><enum>(c)</enum><header>Selection of
				services and drugs</header><text>For purposes of this section:</text>
						<paragraph id="H59C66501D8524C5BBA48B72576ECFD85"><enum>(1)</enum><header>Initial
				selection</header><text>Based on national data, the Secretary shall select the
				following:</text>
							<subparagraph id="HD3945FBCA1B1446BB600DB712DCCD6BB"><enum>(A)</enum><text>The 25 most
				frequently performed services in a hospital inpatient setting.</text>
							</subparagraph><subparagraph id="HC01CF0537CE749578531221E1F9DC129"><enum>(B)</enum><text>The 25 most
				frequently performed services in a hospital outpatient setting.</text>
							</subparagraph><subparagraph id="H482DB12A55CC4B36A8CA00F3E85B7D"><enum>(C)</enum><text>The 25 most
				frequently performed services in an ambulatory surgical center setting.</text>
							</subparagraph><subparagraph id="H48E1C85536F6448EAA1E003F47CDA7F"><enum>(D)</enum><text>The 50 most
				frequently administered drugs in a hospital inpatient setting.</text>
							</subparagraph></paragraph><paragraph id="H165AA887884B4AC7B4CE4267F965EC77"><enum>(2)</enum><header>Updating
				selection</header><text>The Secretary shall periodically update the services
				and drugs selected under paragraph (1).</text>
						</paragraph></subsection><subsection commented="no" id="HD528CB3CDB484BB9846337516F94FDB5"><enum>(d)</enum><header>Civil money
				penalty</header><text>The Secretary may impose a civil money penalty of not
				more than $10,000 for each knowing violation of subsection (a) or (b)(2) by a
				hospital or an ambulatory surgical center. The provisions of subsection (i)(2)
				of section 351A shall apply with respect to civil money penalties under this
				subsection in the same manner as such provisions apply to civil money penalties
				under subsection (i)(1) of such section.</text>
					</subsection><subsection id="H309251FDED55416982B12757F3A4DB74"><enum>(e)</enum><header>Administrative
				provisions</header>
						<paragraph id="H3D3F640785B8405898DEC757547F3CA"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall prescribe such regulations and issue
				such guidelines as may be required to carry out this section.</text>
						</paragraph><paragraph id="HD97D64B575CB43BC831C6BA6932DAB06"><enum>(2)</enum><header>Classification
				of services</header><text display-inline="yes-display-inline">The regulations
				and guidelines under paragraph (1) shall include rules on the classification of
				different services and the assignment of items and procedures to those
				services.</text>
						</paragraph><paragraph id="HC65432BB1D6B454FBF1387F09FA3E6E"><enum>(3)</enum><header>Rules</header><text>The
				regulations and guidelines under paragraph (1) shall include rules regarding
				reporting of inpatient diagnostic related groups (DRGs), outpatient procedures
				and tests and classification of drugs. Classification of drugs may include
				unit, strength, and dosage information for reporting.</text>
						</paragraph><paragraph id="H681C2F1E97B24314BE59C73C344CD3AB"><enum>(4)</enum><header>Computation of
				average and median charges</header>
							<subparagraph id="H476A9989C41A4516BAEF13D0845750B7"><enum>(A)</enum><header>In
				general</header><text>The regulations and guidelines under paragraph (1) shall
				include a methodology for computing an average and median charge for a service
				or drug, in accordance with subparagraph (B).</text>
							</subparagraph><subparagraph id="H4D76808CDF7047079DB52BA585B53DD7"><enum>(B)</enum><header>Methodology</header><text>The
				methodology prescribed by the Secretary under subparagraph (A) shall ensure
				that an average and median charge for a service reflects the amount charged
				before any adjustment based on a negotiated rate with a third party.</text>
							</subparagraph></paragraph><paragraph id="H1F8DCF23A0D94FF492263C43D0452991"><enum>(5)</enum><header>Form of report
				and notice</header><text display-inline="yes-display-inline">The regulations
				and guidelines under paragraph (1) shall specify the electronic form and manner
				by which a hospital or an ambulatory surgical center shall report data under
				subsection (a) and the form for posting of notices under subsection
				(b)(2).</text>
						</paragraph></subsection><subsection id="HD70F46850AB749638EE91B00EAACF56E"><enum>(f)</enum><header>Rules of
				Construction</header>
						<paragraph commented="no" id="H4A74AF55A5084168B6FDC0D0DF8B0914"><enum>(1)</enum><header>Non-preemption
				of State laws</header><text display-inline="yes-display-inline">Nothing in this
				section shall be construed as preempting or otherwise affecting any provision
				of State law relating to the disclosure of charges or other information for a
				hospital or an ambulatory surgical center.</text>
						</paragraph><paragraph commented="no" id="H117490E1A4374ADD876D38FB03C450AD"><enum>(2)</enum><header>Charges</header><text>Nothing
				in this section shall be construed to regulate or set hospital or ambulatory
				surgical center charges.</text>
						</paragraph></subsection><subsection id="H51D8DF1AD88445C49FB464C61F5F3726"><enum>(g)</enum><header>Definitions</header><text>In
				this section:</text>
						<paragraph id="H72D49811E48D4955B84E6EDDC6BAF08"><enum>(1)</enum><header>Hospital and
				ambulatory surgical center</header><text>The terms <term>hospital</term> and
				<term>ambulatory surgical center</term> have the meaning given such terms by
				the Secretary.</text>
						</paragraph><paragraph id="HCA4B20DF84024B3F83BA9B4FAE2728D8"><enum>(2)</enum><header>Drug</header><text>For
				purposes of this section, the term <term>drug</term> includes a biological and
				a non-prescription drug, such as an
				ointment.</text>
