		<official-title display="yes">To ensure that the right of an individual
		  to display the Service Flag on residential property not be
		  abridged.</official-title>

		<section id="H56E56C63664B444784AE6959750B9FD5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Blue Star/Gold Star Flag Act of
			 2010</short-title></quote>.</text>
		</section><section id="id61BBB80B31F04D909081D700A201E843"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act—</text>
			<paragraph id="id90F35750ED8A44C88F84B971F08B8D43"><enum>(1)</enum><text>the term
			 <term>Service Flag</term> has the meaning given such term under section 901 of
			 <external-xref legal-doc="public-law" parsable-cite="pl/105/225">Public Law
			 105–225</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/36/901">36 U.S.C. 901</external-xref>);</text>
			</paragraph><paragraph id="idA39705FF06C94C0387E7FA86A970BE2B"><enum>(2)</enum><text>the terms
			 <term>condominium association</term> and <term>cooperative association</term>
			 have the meanings given such terms under section 604 of
			 <external-xref legal-doc="public-law" parsable-cite="pl/96/399">Public Law
			 96–399</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/15/3603">15 U.S.C. 3603</external-xref>);</text>
			</paragraph><paragraph id="idA4F6734E83FF48618A44B31A74FC803E"><enum>(3)</enum><text>the term
			 <term>residential real estate management association</term> has the meaning
			 given such term under <external-xref legal-doc="usc" parsable-cite="usc/26/528">section 528</external-xref> of the Internal Revenue
			 Code of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/26/528">26
			 U.S.C. 528</external-xref>); and</text>
			</paragraph><paragraph id="id572BDCE4FF7E44FA87C19B63DEB7D5CA"><enum>(4)</enum><text>the term
			 <term>member</term>—</text>
				<subparagraph id="idE90E7F8CA7B2412AB94AB925F9D7AEEE"><enum>(A)</enum><text>as used with
			 respect to a condominium association, means an owner of a condominium unit (as
			 defined under section 604 of
			 <external-xref legal-doc="public-law" parsable-cite="pl/96/399">Public Law
			 96–399</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/15/3603">15 U.S.C. 3603</external-xref>)) within such
			 association;</text>
				</subparagraph><subparagraph id="id065024C2028943899FE0614C2D757D1B"><enum>(B)</enum><text>as used with
			 respect to a cooperative association, means a cooperative unit owner (as
			 defined under section 604 of
			 <external-xref legal-doc="public-law" parsable-cite="pl/96/399">Public Law
			 96–399</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/15/3603">15 U.S.C. 3603</external-xref>)) within such
			 association; and</text>
				</subparagraph><subparagraph id="idC3419C15FF2B4BFCA30FC0D16437E437"><enum>(C)</enum><text>as used with
			 respect to a residential real estate management association, means an owner of
			 a residential property within a subdivision, development, or similar area
			 subject to any policy or restriction adopted by such association.</text>
				</subparagraph></paragraph></section><section id="idA4DA19961E6D4C0499135A6BFA0EE493"><enum>3.</enum><header>Right To display
			 the service flag</header><text display-inline="no-display-inline">A condominium
			 association, cooperative association, or residential real estate management
			 association may not adopt or enforce any policy, or enter into any agreement,
			 that would restrict or prevent a member of the association from displaying the
			 Service Flag on residential property within the association with respect to
			 which such member has a separate ownership interest or a right to exclusive
			 possession or use.</text>
		</section><section id="id0176A26E1E6A43019FEFBAB27875D793"><enum>4.</enum><header>Limitations</header><text display-inline="no-display-inline">Nothing in this Act shall be considered to
			 permit any display or use that is inconsistent with—</text>
			<paragraph id="id6CEF00BB22404D288E3944D92E1576AA"><enum>(1)</enum><text>any regulations
			 prescribed by the United States Secretary of Defense regarding rules or customs
			 pertaining to the proper display or use of the Service Flag; or</text>
			</paragraph><paragraph id="id5D936A73BCE64FE098F6CC80678EDB4F"><enum>(2)</enum><text>any reasonable
			 restriction pertaining to the time, place, or manner of displaying the Service
			 Flag necessary to protect a substantial interest of the condominium
			 association, cooperative association, or residential real estate management
			 association.</text>
