		  made to Congress, and for other purposes.</official-title>

		<section id="HF461A422098F400B92C188935FFE7530" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Classified Information Accountability
			 Act of 2009</short-title></quote> or <quote><short-title>CIA
			 Act</short-title></quote>.</text>
		</section><section id="H0D9C75A455934056BF1FAA281A690549"><enum>2.</enum><header>Civil penalty for
			 certain misrepresentation made to Congress</header>
			<subsection id="HAAA798096EE7403EA56589DCCD430C41"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Whoever, being a
			 member of the intelligence community, knowingly and willfully—</text>
				<paragraph id="H630A7A30A63E4DF5ABDAEF46A8A9056C"><enum>(1)</enum><text>falsifies,
			 conceals, or covers up by any trick, scheme, or device a material fact;</text>
				</paragraph><paragraph id="H97E3B28800884D7FBEF474C91828318F"><enum>(2)</enum><text>makes any
			 materially false, fictitious, or fraudulent statement or representation;
			 or</text>
				</paragraph><paragraph id="HAD79003D340343F89B52FC21EA40F085"><enum>(3)</enum><text>makes or uses any
			 false writing or document knowing the same to contain any materially false,
			 fictitious, or fraudulent statement or entry;</text>
				</paragraph><continuation-text continuation-text-level="subsection">in any
			 communication to a United States Senator or Representative that involves
			 classified material shall be liable for a civil penalty of not more than
			 $10,000.</continuation-text></subsection><subsection id="HE79306C159484D23844A59502A9FB7D7"><enum>(b)</enum><header>Employee not To
			 be indemnified</header><text display-inline="yes-display-inline">No United
			 States agency or department may directly or indirectly indemnify a person for
			 that person’s liability under this section.</text>
			</subsection><subsection id="HEB4B366243454FECB35E6640A0C154B2"><enum>(c)</enum><header>Congressional
			 standing To sue</header><text display-inline="yes-display-inline">A Senator or
			 Representative who was a party to the communication with respect to which a
			 violation of subsection (a) took place may in a civil action, recover the civil
			 penalty provided by this section on behalf of the United States, to be
			 deposited in the United States Treasury for public use.</text>
			</subsection><subsection id="H9B7C73B44F0347308410FB1C4AE5CE26"><enum>(d)</enum><header>In camera review
			 of classified information</header><text>In a civil action under this section,
			 the court shall conduct any review of classified information in camera.</text>
			</subsection><subsection id="HF25DE812443D46D595BCF1727A3849D2"><enum>(e)</enum><header>Statute of
			 limitations not applicable</header><text>A civil action under this section may
			 be brought at any time without limitation.</text>
			</subsection><subsection id="HE847933BBF184933A9C1D78BA5B52803"><enum>(f)</enum><header>Definitions</header><text>In
			 this section—</text>
				<paragraph id="H72BDCC5D23BF4587A24061BD6EBEB06C"><enum>(1)</enum><text>the term
			 <quote>member of the intelligence community</quote> means a person employed by
			 the intelligence community (as defined in section 3(4) of the National Security
			 Act of 1947 (50 U.S.C. 404a(4)); and</text>
				</paragraph><paragraph id="H017F0581181E4FD093E40938A1346FFF"><enum>(2)</enum><text display-inline="yes-display-inline">the term <quote>classified
			 information</quote> means any information or material that has been determined
			 by the United States Government pursuant to an Executive order, statute, or
			 regulation, to require protection against unauthorized disclosure for reasons
			 of national security.</text>
