		<official-title>To authorize the Secretary of Transportation to make
		  capital grants for certain freight rail economic development
		  projects.</official-title>

		<section id="HECA2E6517A7844779168AD6B066B002D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Freight Rail Economic Development Act
			 of 2009</short-title></quote>.</text>
		</section><section id="H0418974418BE48DA896663E6CD6EBD4F"><enum>2.</enum><header>Capital grants
			 for freight rail economic development projects</header>
			<subsection id="HFB7301E15B494C7C9D93FEEE3E428DC"><enum>(a)</enum><header>Establishment of
			 program</header><text>The Secretary of Transportation shall carry out a program
			 for making capital grants to construct freight rail switches and sidings to
			 encourage economic development.</text>
			</subsection><subsection id="H0081B5B2BC2E4880B5A7227B4B00F1D2"><enum>(b)</enum><header>Provision of
			 grants and grant criteria</header>
				<paragraph id="HA5E28C9BA2CA4894B90D4AAE989B9E3F"><enum>(1)</enum><header>Eligibility</header><text display-inline="yes-display-inline">Grants shall be made under this
			 section—</text>
					<subparagraph id="H7D66805A71E148758F4BDB9E22370242"><enum>(A)</enum><text>directly to a
			 class I, class II or class II railroad; or</text>
					</subparagraph><subparagraph id="HBFA52333DFAE4AFE90E1733E785FFB15"><enum>(B)</enum><text>with the
			 conconcurrence of the railroad to a State or local government.</text>
					</subparagraph></paragraph><paragraph id="H3A4A7F0A7F174F929FEB697B5A0B5431"><enum>(2)</enum><header>Considerations</header><text>The
			 Secretary shall—</text>
					<subparagraph id="H3B965FA263B94BA084AE270B29705F49"><enum>(A)</enum><text>conduct a national
			 solicitation for applications;</text>
					</subparagraph><subparagraph id="HB30F6A34038A462FA758A1AFA68F4563"><enum>(B)</enum><text>award grants on a
			 competitive basis; and</text>
					</subparagraph><subparagraph id="H37B0D14481D445A987ABE05E4BC5F6DC"><enum>(C)</enum><text>establish criteria
			 for selecting among projects that meet the criteria specified in paragraph
			 (3).</text>
					</subparagraph></paragraph><paragraph id="H575D720AC3DF4EEEBD6C7F9806FB159E"><enum>(3)</enum><header>Grant
			 Criteria</header><text>The Secretary, in selecting the recipients of grants to
			 be provided under this subsection, shall select projects that—</text>
					<subparagraph id="H1A5053C9CC604065B3E34B919EB787A9"><enum>(A)</enum><text>construct or
			 rehabilitate freight rail sidings;</text>
					</subparagraph><subparagraph id="HA4845E5BD8224CD9A6B06F9EE6ADFD35"><enum>(B)</enum><text>construct or
			 rehabilitate freight rail switches;</text>
					</subparagraph><subparagraph id="HD63D5D92299148DE99F60A1579BB0E42"><enum>(C)</enum><text>promote economic
			 development; and</text>
					</subparagraph><subparagraph id="HEA510A906378495F90281A328664F2A0"><enum>(D)</enum><text>have a public
			 benefit.</text>
					</subparagraph></paragraph></subsection><subsection id="HC1638CEE64444CEE935DBA8DECE8C1F9"><enum>(c)</enum><header>State
			 cooperation</header><text>Railroad applicants for a grant under this section
			 are encouraged to utilize the expertise and assistance of State transportation
			 agencies in applying for and administering such grants. State transportation
			 agencies are encouraged to provide such expertise and assistance to such
			 railroads.</text>
			</subsection><subsection id="H228B695378B147CE897042AD78DFEB23"><enum>(d)</enum><header>Federal
			 share</header><text>The maximum Federal share for carrying out a project under
			 this section shall be 80 percent of the project cost. The non-Federal share may
			 be provided by any non-Federal source in cash, equipment, or supplies. Other
			 in-kind contributions may be approved by the Secretary on a case-by-case
			 basis.</text>
			</subsection><subsection id="HC6B8BD0C461B413B9DA921D1CD1EFA8F"><enum>(e)</enum><header>Wage rate
			 requirements</header><text display-inline="yes-display-inline">All laborers and
			 mechanics employed by contractors or subcontractors in the construction,
			 alteration, or repair, including painting and decorating of projects,
			 buildings, and works, with respect to any project that receives assistance
			 under this section shall be paid wages at rates not less than those prevailing
			 on similar construction in the locality as determined by the Secretary of Labor
			 in accordance with subchapter IV of chapter 31 of part A of subtitle II of
			 title 40, United States Code (commonly referred to as the <quote>Davis-Bacon
			 Act</quote>). The Secretary of Labor shall have, with respect to such labor
			 standards, the authority and functions set forth in Reorganization Plan Number
			 14 of 1950 (15 F.R. 3176; 64 Stat. 1267) and in section 3145 of title 40,
			 United States Code.</text>
			</subsection><subsection id="H300194465FF143E3B51BA87500CB44F9"><enum>(f)</enum><header>Regulations</header><text>Not
			 later than 180 days after the date of enactment of this Act, the Secretary
			 shall prescribe regulations for carrying out this section.</text>
			</subsection><subsection id="HA5AE0F5275324002A3D2714057A24C5"><enum>(g)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated to the
			 Secretary of Transportation for use in carrying out this section $20,000,000
			 for each of the fiscal years 2010 through 2014.</text>
