		<official-title>To provide authority for certain debt refinancing with
		  respect to financings approved under title V of the Small Business Investment
		  Act of 1958, and for other purposes.</official-title>

		<section id="H8760CD4431324DCD99690AE2F21DE11E" section-type="section-one"><enum>1.</enum><header>Authority to provide certain
			 debt refinancing</header><text display-inline="no-display-inline">During the 2
			 year period beginning on the date of the enactment of this Act, any financing
			 approved under title V of the Small Business Investment Act of 1958 (15 U.S.C.
			 695 et seq.) may include debt refinancing relating to a conventional loan that
			 is not guaranteed by the Small Business Administration, if—</text>
			<paragraph id="HE4BC6B8251844803AF184143DA501517"><enum>(1)</enum><text>the proceeds of
			 the indebtedness were used to acquire land, including a building situated
			 thereon, to construct a building thereon, or to purchase equipment;</text>
			</paragraph><paragraph id="H357AE8F272F743BC8737B8502ABA0216"><enum>(2)</enum><text>the existing
			 indebtedness is collateralized by fixed assets;</text>
			</paragraph><paragraph id="H39A7E533E9E0492A8F766EF556BEC6FD"><enum>(3)</enum><text>the existing
			 indebtedness was incurred for the benefit of the small business concern;</text>
			</paragraph><paragraph id="HD61E25CF339046D59B42B7A1E40B6C8C"><enum>(4)</enum><text display-inline="yes-display-inline">the financing under title V of the Small
			 Business Investment Act of 1958 will be used only for refinancing existing
			 indebtedness or costs relating to the project financed under such title;</text>
			</paragraph><paragraph id="H753CF2027E174E2F8AC2C0C953B41DDC"><enum>(5)</enum><text>the financing
			 under such title will provide a substantial benefit to the borrower when
			 prepayment penalties, financing fees, and other financing costs are accounted
			 for; and</text>
			</paragraph><paragraph id="H0E8F44F74A1A4C48A37DF5A5D047CEA2"><enum>(6)</enum><text>the financing
			 under section 504 of such title will provide better terms or rate of interest
			 than the existing indebtedness at the time of refinancing.</text>
