<section id="HCF9AB79E9CD74F098A237ACCA0A536D6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Helping Expedite and Advance Responsible Tribal Homeownership Act</quote> or the <quote>HEARTH Act</quote> .</text> </section>
<section id="H27DA856520924ECF9CFE441D03319304"><enum>2.</enum><header>Approval of, and regulations related to, tribal leases</header><text display-inline="no-display-inline">The first section of the Act titled <quote>An Act to authorize the leasing of restricted Indian lands for public, religious, educational, recreational, residential, business, and other purposes requiring the grant of long-term leases</quote>, approved August 9, 1955 (25 U.S.C. 415) is amended as follows:</text> 
<paragraph id="H70311048F9214CA785AD4054F34E0EF3"><enum>(1)</enum><text>In subsection (d)—</text> 
<subparagraph id="HDA95CB979BE840CF915EC39175ADDA3B"><enum>(A)</enum><text>by striking paragraph (2) and inserting the following:</text>

<paragraph id="HB56364C9740F409E908806AEF1533278"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>Indian tribe</term> has the meaning given such term in section 4(e) of the Indian Self-Determination and Education Assistance Act (25 U.S.C. 450b(e));</text> </paragraph><after-quoted-block>;</after-quoted-block></quoted-block> </subparagraph>
<subparagraph id="H2E288D4F4CA5476BA2153FCB4B64548D"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (3)—</text> 
<clause id="HA66C3F44766548AEA6F23CD54E4DA541"><enum>(i)</enum><text>in the matter preceding subparagraph (A), by striking <quote>Navajo Indian</quote>;</text> </clause>
<clause id="H078A70C5C5724E70B02B9BF5FCB14F35"><enum>(ii)</enum><text>in subparagraph (A), by striking <quote>the Navajo Nation</quote> and inserting <quote>an Indian tribe</quote>;</text> </clause>

<subparagraph id="HAF0EE3F140F54497BF0CD33E4EC8397D"><enum>(C)</enum><text>in paragraph (4), by striking <quote>the Navajo Nation</quote> and inserting <quote>an applicable Indian tribe</quote>;</text> </subparagraph>
<subparagraph id="H8414FADB01264EE3B6A57C5ED2A3422D"><enum>(D)</enum><text>by striking paragraph (5) and redesignating paragraphs (6), (7), and (8) as paragraphs (5), (6), and (7), respectively;</text> </subparagraph>
<subparagraph id="H6A6352E7D840477E821F7D568B0B7E39"><enum>(E)</enum><text>in paragraph (5) (as redesignated), by striking <quote>the Navajo Nation</quote> and inserting <quote>an Indian tribe</quote>; and</text> </subparagraph>
<subparagraph id="H1128D833671D4A4A98A3728DBEDF9F82"><enum>(F)</enum><text>in paragraph (7) (as redesignated)—</text> 
<clause id="H0A6EE72142724129ACAC606943B4123C"><enum>(i)</enum><text>by striking <quote>the Navajo Nation</quote>; and</text> </clause>

<paragraph id="H9C2C79FBAF044330A5CCDB35C8EC4937"><enum>(2)</enum><text>In subsection (e)—</text> 
<subparagraph id="H1560C35F69FC48AFBCC5E5F7A0210475"><enum>(A)</enum><text>by amending the subsection heading to read as follows: <quote><header-in-text level="subsection" style="OLC">Approval of leases—Tribal discretion.—</header-in-text></quote>;</text> </subparagraph>
<subparagraph id="HD10ACEFFD89644F2835DAAC38AA71C41"><enum>(B)</enum><text>in paragraph (1)—</text> 
<clause id="H14DA14E7A04143B6BC6BB5EBE26B14A9"><enum>(i)</enum><text>in the matter preceding subparagraph (A), by striking <quote>Any leases by the Navajo Nation</quote> and inserting <quote>At the discretion of any Indian tribe, any leases by the applicable Indian tribe</quote>; and</text> </clause>

<clause id="H8A04FEE6D43244AC8965B3CFAEE66806"><enum>(i)</enum><text>by striking <quote>the regulations of the Navajo Nation</quote> and inserting <quote>such regulations</quote>; and</text> </clause>
<clause id="HD3AA945DE9774F2CAFF9759E28AA0AE9"><enum>(ii)</enum><text>by striking <quote>with the Navajo Nation</quote> and inserting <quote>with the applicable Indian tribe</quote>;</text> </clause></subparagraph>
<subparagraph id="H3CF9A7AF812042E28960557330FF2752"><enum>(E)</enum><text display-inline="yes-display-inline">in paragraph (4), by striking <quote>Navajo Nation</quote> each place it appears and inserting <quote>applicable Indian tribe</quote>;</text> </subparagraph>
<subparagraph id="HC6EEE743040E4761B661B5ED09DCD008"><enum>(F)</enum><text>in paragraph (5)—</text>

<section id="H36352CEB6F21405E87393AE51E0245C8"><enum>3.</enum><header>Land Title Reports—Review and Report to Congress</header><text display-inline="no-display-inline">Not later than 180 days after funds are made available for this section, the Bureau of Indian Affairs shall prepare and submit to the Committees on Financial Services and Natural Resources in the House of Representatives and the Committees on Banking, Housing, and Urban Affairs and Indian Affairs in the Senate a report regarding the history and experience of Indian tribes that have chosen to assume responsibility for operating the Indian Land Title and Records Office (hereafter referred to as the “LTRO”) functions from the Bureau of Indian Affairs. In conducting the review, the Bureau of Indian Affairs shall consult with the Department of Housing and Urban Development Office of Native American Programs and those Indian tribes that are managing LTRO functions (hereafter referred to as the “managing Indian tribes”). The review shall include an analysis of the following factors:</text> 
<paragraph id="H9F7861B49A7D44E79FA02EEA5A886957"><enum>(1)</enum><text display-inline="yes-display-inline">Whether and how tribal management of the LTRO functions has expedited the processing and issuance of Indian land title certifications as compared to when the Bureau of Indian Affairs managed these programs.</text> </paragraph>
<paragraph id="H3D6AE1FC33CD4F63AAB2E63545AFC1A3"><enum>(2)</enum><text>Whether and how tribal management of the LTRO functions has increased home ownership among the managing Indian tribe’s population.</text> </paragraph>
<paragraph id="H33B2FBC2B56F4F3DB5C9F13AB16EA8A8"><enum>(3)</enum><text>What internal preparations and processes were required of the managing Indian tribes prior to assuming management of the LTRO functions.</text> </paragraph>
<paragraph id="HB4AA9267B50846C38909517906AD0ECA"><enum>(4)</enum><text display-inline="yes-display-inline">Whether tribal management of the LTRO functions resulting in a transfer of financial resources and manpower from the Bureau of Indian Affairs to the managing Indian tribes and, if so, what transfers were undertaken.</text> </paragraph>
<paragraph id="H7A71900600704D32ABE20D1BF771D43B"><enum>(5)</enum><text>Whether, in appropriate circumstances and with the approval of geographically proximate Indian tribes, the LTRO functions may be performed by a single Indian tribe or a tribal consortium in a cost effective manner.</text> </paragraph></section>
